    AN ORDINANCE AMENDING SECTIONS 25-2-4 AND 25-2-491 AND ADDINGSECTION 25-2-816 TO TUE CITY CODE TO CREATE A NEW COMMERCIALUSE, ALTERNATIVE FINANCIAL SERVICES BUSINESSES, AND TO SE TADDITIONAL REQUIREMENTS FOR THIS USE.BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN:PART 1. Subsection 25-2-4(29) (Commercial Uses Described) of the Ci ty Code isamended to read:(29) FINANCIAL SE RVICES use is the use of a site for the provision of financial andbanking services . This use inc lude s banks, savings and loan inst itu tions, stock andbond brokers, loan and lending ac tiv ities, and similar se rvices. This use excludesalternative financial services businesses uses as defined in this section.PART 2. Section 25-2-4 (Commercial Uses Described) of the City Code is amended toadd a new commercial use, Alternative Financ ial Services Businesses, to read as followsand added as Subsection 25-2-4(3) with all subsequent commercial uses renumbe redaccordingly:(3) ALTERNATIVE FINANCIAL SERVICES BUSINESSES use is the use of a sitefor a check cashing bus iness, payday advance or loan bus iness, money trans ferbusiness, motor vehicle title loan business, or a credi t access bu siness as defined inthis section.

    (1) This use exc ludes:(a) a state or federally chartered bank, savings and loan assoc iatio n or

    credit union, or a pawnshop, and(b) a convenience store, supermarket, or other retai l es tablishment whereconsumer retail sale s constitute at least 75% of the total gross rev enuegenerated on site.

    (2) A check cashing business is an establishment tha t provides one or more ofthe fo llow ing:(a) an amount ofmoney that is equal to the face of a check or the amountspecified in a written authorization for an elec tron ic transfer ofmoney, less any fee charged fo r the transac tio n;

    C,(b) an agreement not to cash a check or execute an electronic transfer ofmoney for a specified period of time; or(c) the cashing of checks , warran ts, drafts, money orders, or other

    commercial paper for compensation by any other person or entity fora fee .(3) A payday advance or loan business is an establishment that makes smallconsumer loans, usually backed by postdated check or authorization to makean electronic debit against an existing financial account, where the check ordebi t is held for an agreed-upon term or until a customers next payday andthen cashed un less the customer repays the loan to reclaim the check ordebit. Such establishments may charge a flat fee or other service chargeand/or a fee or interest ra te based on the size of the loan amount.(4) A motor title loan business is an establishment tha t makes small consumerloans that leverage the equity value of a car or other vehicle as collate ralwhere the title to such vehicle is owned fre e and clear by the loan applicantand any ex isting liens on the vehicle cancel the application. Failure to repaythe loan or make interest payments to extend the loan allows the lender totake possession of the vehicle .(5) A credi t access business has the same meaning as defined in Section 393.601of the Texas Finance Code.

    PART 3. Chapter 25-2 (Zoning) of the City Code is amended to add a new Section 25-2-816 to read: 25-2-816 ALTERNATIVE FINANCIAL SERVICES BUSINESSES.

    (A) Th is section applies to an alternative financial se rvices business use.(B) A use may not be located on a site that is:

    (1) within 1,000 feet of a site tha t con tains another alternative financialservices business use;(2) with in 200 fee t of a property in a res identia l zoning district or onwhich a residential use is located;(3) within 500 fee t of the rights-of-way of Interstate Highway 35, U.S.Highway 183, U.S. Highway 290, Texas State Highway Loop 360,Texas State Highway Loop I Texas State Highway 130, or Texas

    (4) with in the East Austin overlay distric t, waterfront ove rlay distric t, orthe university ne ighb orhood overlay district .(C) A use may be located on ly within a freestanding structure and may not be

    co-located in the same structure with other uses.PART 4. Th e table in Subsection (C) of Section 25-2-49 1 (Permitted, Conditional,and Prohibited Uses) of the City Code is amended to add the alternative financialservices businesses use and to indicate that the alternative financial services businessesuse is permitted in the gene ral commercial sen -ic es (CS) zoning distric t, subject toSection 25-2-816 (Alternative Financial Services Businesses) of the City Code, andconditional in the neighborhood commercial (LR) and downtown mixed use (DMU)zoning di stricts, subject to Se ction 25-2-816 (Alternative Financial Services Businesses)of the City Code.PARTS.     1ESOLUTION NO. 20110818-079WHEREAS. the Ci ty Council of the City of Austin, an d the ci tize ns it

    represents, are deeply concerned about the harmful effects of alternativefinancial service business practices, including payday lenders and auto titlelenders, in the City of Austin and elsewhere rn the state of Texas; an d

    WHEREAS, in the state of Texas th ere are over 2,800 of the seunlicensed and unregulated lending storefronts draining over $600 million inlo an fees and los t assets fro m our communities every ye ar; an d

    WHEREAS, these businesses in our loc al community promise e asycredit that in tact hurt consumers with annual interest rates often be tw een300% an d 500%, and loan terms that pu ll people deeper into debt; and

    WHEREAS, 15 states have adopted a 36 % or lower annual percentagerate cap fo r these sm all loans, and the federal government ha s ad op ted asimilar rate cap for payday and auto title loans to mililary personnel ba sed ona Department of Defense finding that these loan s, undermine milita ryreadiness , harm the mora le of troops and their families, and add to the cost offielding an all-volunteer fighting force; and

    WHEREAS, the City of Austin does not have the authority to reg ula teinterest rates, hut does have lan d use authority; and

    WHEREAS. the City Council believes there is a public benefit torestricting locations of payday and auto title lenders to reduce the negativeimpact on consumers in our community; NOW, THEREFORE,

    BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTiNThe City Councii initiates code amendments to City Code Title 25

    Alternative Financial Services Bu sinesses use is the use of a si te for the provision ofcheck cashing, payday advance or loan , money-transfer, or mo tor vehicle tit le loanservices, or a credit access business as defined in this sec tion.

    1. This definition excludes:a. A state or federally ch artered bank, savings and loan association orcred it union , or a pawnshop, and;I,.     C>Add a new section to regulate Alternative FinancialServices Businesses uses:

    Alternative Financial Services Businesses1. Except as provided in Subsection 2, an alternative financial services businessis a permitted use in a CS zoning district and is a conditional use in an LR or

    DMU zoning district.2. An alternative financial service business may not be located on a lot:

    a. That is within one thousand (1,000) fee t of a lot containing anothercredit access business.b. That is within two hundred (200) feet from a lot zoned or used forresidenri& purposes.c. That is within five hundred (500) feet of the rights-of, way of InterstateHighway 35, U.S. Highway 183, U.S. Highway 290. Texas StateHighway Loop 360, Texas state Highway Loop 1, and Texas Sta reHighway 45 .d. That is within the East Austin Overlay District, Waterfront OverlayDistrict, or the University Neighborhood Overlay District.

    3. An alternative financial service business shall be situated only within afreestanding building and shall not be co-located in the same structure asother uses.
