    Hi, Richard.  I’ve met you at a few meetings at DMPED. 

    I’m puzzled by a few changes  – deleting the parenthetical in the first sentence would mean that the District would not 

    be allowed to host events inconsistent with museum or art‐related uses.  Maybe we have to be specific about some 

    prohibited uses applying to only certain condo units.  We also may have some problems with the deletion of  the hours in

    the first prohibited use at least as relates to the 2nd and 3rd condos you describe below.  The rules were meant to apply 

    to common areas as well.  As such, I’m not sure we’ll be ok with smoking in those common areas.  I’ll discuss the 

    changes specifically with DGS Portfolio and get back to you.

    I hereby agree to the District's use restrictions, as proposed in the attached PDF, which we received from Katherine 

    Jough.  We revamped our business plan to accommodate the needs of  DHS in this matter.  We underwrote our planned 

    operations, as a result of  this late breaking request, and we are satisfied in our revised revenue projections to allow us 

    to accommodate the DHS request.  It took awhile, but we are now back on track vision‐wise.  This issue took us by 

    surprise, as we were informed that the District had at least initially accepted our proposed use restrictions, in several 

    recent conversations with Bill. No worries.  All good. 

    We 

    remain 

    committed 

    to 

    the 

    family 

    center 

    at 

    700 

    Delaware. 

    I also agree that 700 Delaware LLC can utilize whomever they wish for architect of  record for the PUD approval 

    efforts.  This apparently was an issue that was causing some confusion with certain members of  the Development 

    team.  I have agreed for awhile that this was the case, so this is likely a drafting issue, as my attorney recently remarked 

    to the attorney for 700 Delaware LLC group. 

    There are no more issues to resolve, per a recent summary of  outstanding issues that I received from attorneys 

    representing all parties.  We were down to these last few.

    I feel the need to advise you directly about what is at stake here, so there is no 

    confusion on the part of  the District about its request and the economic impact.  I am 

    not simply being difficult here. 

    If  accepted as proposed, the economic viability of  the event center is 

    threatened.  Further, if  there is no viable event space, it materially harms the viability of  

    the museum effort. 

    The District made statements at the community meeting in Ward 6 that the family 

    center would operate in harmony with Blind Whino and a museum at 700 Delaware 

    Avenue. 

    We need

     to

     work

     together

     to

     reach

     an

     acceptable

     agreement

     which

     allows

     

    this to be the case. 

    The latest redline request harms the viability the event space operation as a going 

    concern.  This is an economic request by the District, which goes beyond the 

    contemplated transaction for the family center condo component of  the planned 

    PUD.  The remaining 3 condo uses in this planned PUD application need to be viable. 

    Lets work together to come to an acceptable outcome. 

    Suggestions: 

    1.  Agree that my proposed use restrictions are acceptable. 

    2.  The District proposes an economic proposal which compensates for the loss of  the 

    event space revenue, and which allows the museum to operate successfully so the PUD 

    can be properly presented as to its proposed uses before the community and zoning 

    commission. 

    3.  Purchase the entire site.  This allows the District to fully control the uses. 

    I look forward to working with the District. 

    I fully support the family life center.

    Hello Ms. Jough, 

    Good morning. 

    Perhaps we should meet to discuss the latest redline use,restriction proposed by the District, which 

    effectively kills the event space platform at 700 Delaware Avenue. 

    I feel the need to advise you directly about what is at stake here, so there is no confusion on the part of  

    the District about its request and the economic impact.  I am not simply being difficult here. 

    If  accepted as proposed, the economic viability of  the event center is threatened.  Further, if  there is no 

    viable event space, it materially harms the viability of  the museum effort. 

    The District made statements at the community meeting in Ward 6 that the family center would operate 

    in harmony with Blind Whino and a museum at 700 Delaware Avenue.  We need to work together to 

    reach an acceptable agreement which allows this to be the case. 

    The latest redline request harms the viability the event space operation as a going concern.  This is an 

    economic request

     by

     the

     District,

     which

     goes

     beyond

     the

     contemplated

     transaction

     for

     the

     family

     center

     

    condo component of  the planned PUD.  The remaining 3 condo uses in this planned PUD application 

    need to be viable. 

    Lets work together to come to an acceptable outcome. 

    Suggestions: 

    1.  Agree that my proposed use restrictions are acceptable. 

    2.  The District proposes an economic proposal which compensates for the loss of  the event space 

    revenue, and which allows the museum to operate successfully so the PUD can be properly presented as 

    to its

     proposed

     uses

     before

     the

     community

     and

     zoning

     commission.

     3.  Purchase the entire site.  This allows the District to fully control the uses. 

    I look forward to working with the District. 

    I fully support the family life center.

    in order to reflect/refine the concepts that were conveyed to me by DGS’s Portfolio group after their discussions with 

    DHS.  Clearly, there is a need for discussion and I have copied others on the District side to make them aware of  your
