Transitioning to a New Administration: How Can We Assist Immigrants and Refugees?
Generally, what should I communicate in my parish and religious community?
The Bishops and the Catholic Church support immigrants and refugees: The U.S. Bishops are committed to working with the new administration to ensure that refugees and immigrants are humanely welcomed to the United States without sacrificing our nation’s security. In a statement supported by the U.S. Conference of Catholic Bishops (USCCB), Bishop Eusebio Elizondo, Auxiliary Bishop of Seattle and then-Chairman of the USCCB’s Committee on Migration, stated: “We will work to promote humane policies that protect refugees and immigrants’ inherent dignity, keep families together, and honor and respect the laws of this nation.” Read the full statement here.i
Our Catholic community provides welcome, understanding, and spiritual guidance: The Catholic community stands with immigrant and refugees. We welcome them and offer them spiritual support and comfort during this period of uncertainty.
What guidance can we provide to undocumented immigrants?
At this time, we do not know what will occur when the new administration assumes office. In the interim, listed below is guidance you and members of your community can provide to undocumented immigrants to help put them in the best situation possible.
Meet with an immigration legal services provider to get screened for forms of relief: Undocumented individuals and their families may be eligible for relief from removal. In fact, a recent study by the Center for Migration Studies found that 14% of individuals screened for the Deferred Action for Childhood Arrivals (DACA) program were potentially eligible for permanent immigration status.2
Undocumented immigrants should make an appointment to get screened by a recognized immigration legal service provider and ensure that their case is reviewed by an immigration attorney in good standing or an accredited representative.
Apply for citizenship if you are eligible: According to the Department of Homeland Security (DHS), over 8 million immigrants in United States are eligible for citizenship3 but have yet to apply. Catholic communities, such as parishes in the Diocese of Orange, Los Angeles, San Bernardino and San Diego, have recently launched a program to provide assistance to 1.5 million lawful permanent residents in southern California who are eligible for citizenship. The program offers legal workshops with immigration attorneys, provides classes to prepare individuals for the citizenship examination, and

raises funds to help pay their naturalization application fee when needed. (Note: the fees for naturalization will be changing, and in some instances increasing, on December 23, 2016).4
Avoid immigration scams and notario fraud: Individuals need to be particularly vigilant about immigration scams at this time. You can share the following information and resources with undocumented individuals in your community:
o Applications: U.S. Citizenship and Immigration Service (USCIS), the government entity that processes immigration applications in the United States, continues to process all applications, petitions, and requests consistent with current statutory laws, regulations, and policies. If individuals need general information about immigration benefits or current policies, they can “Ask Emma” at uscis.gov.
o Legal Assistance: Individuals should be careful to obtain assistance from a qualified immigration attorney or legal services provider. Visit the Catholic Legal Immigration Network, Inc. (CLINIC)5 website to locate a reputable organization near you. Learn more about immigration scams and notario fraud by looking at the USCIS6 and the Executive Office for Immigration Review7 websites. More information on notario fraud and how to file a complaint can also be found here.8
Learn about your rights in an enforcement situation: Undocumented individuals should educate themselves on their rights when interacting with immigration officers.
o If an Immigration and Customs Enforcement (ICE) officer comes to their residence, the individual may refuse to open the door until the officer presents them with a warrant with their name and address on it. The individual can ask the officer to slide the warrant under the door.
o Individuals have the right to remain silent and do not have to answer the officer’s questions.
o Individuals can demand to speak to their legal counsel and can refuse to sign any documents until they have spoken with their attorney.

Organize your family’s documents and points of contact: Undocumented individuals should ensure that they are organized and that they gather identification documents, and documents related to any interactions with immigration officials, law enforcement, or courts of law. They should make copies of these documents and confirm that family members or trusted friends can access to them. They should memorize or carry the phone number of a person they trust and, if applicable, their legal representative. They should make sure their children also carry a trusted contact’s number.

What guidance can we provide to DACA recipients?
We do not definitely know how, or if, the new administration will repeal the program. Despite not knowing what will ultimately happen to the program, individuals can still offer the following guidance:
Meet with an immigration legal services provider if:
o You are considering applying for DACA and are not a current recipient;
o You are considering applying for a renewal of DACA; or
o You are planning travel outside of the United States.
Seek support from the Church and from your community: DACA recipients should reach out to their local parishes and seek support from local community groups and the Church. Please see Catholic Charities USA (CCUSA)11 for counseling services near you. Also be sure to check your local church for counseling sessions as well.
Try to Focus on Engaging in Your Daily Routine: Individuals should continue to go to school, work, and church and continue their daily routines to the extent possible. They should try and not let the future uncertainty interrupt this semester of their studies, their work obligations, or their participation in church and community activities.
What guidance can we provide to refugees?
We do not know how the new administration will revise the current refugee program. In the interim, it is important to tell refugees in your community to:
Continue to work to integrate into your new community: Refugees should continue to study English, engage with their communities, learn new things about the United States, and work to support themselves and their families.
Report Hate Crimes: Not all communities have seen a recent increase in crime targeted at immigrants and refugees, however, we are deeply saddened to see that some in our country are engaging in acts of hate against foreigners. The Church does not condone such behavior. If a refugee in your community is threatened or assaulted, urge them to immediately call the police. Advise them to provide the responding officer with a detailed description of the incident. Victims should also report the offense to their local Federal Bureau of Investigations (FBI) office.12 There are several government agencies that have existing resources that can be helpful, including information on:
o Reporting to the FBI: The FBI’s Civil Rights Division makes investigating hate crimes its highest priority. Read more here.13

o Asking for Help: If you have questions or concerns in your community, contact the Department of Justice’s Community Relations Service (CRS) at (202) 305-2935 or locate your local office here.14
How can we be supportive of immigrants and refugees at this time?
Host a solidarity event or interfaith prayer service: Our communities need to come together to welcome immigrants and refugees. Solidarity events are a great way to make immigrants and refugees in our communities feel supported. They are also an opportunity to further educate parishioners and community members on our government’s immigration- and refugee-related policies. Interfaith prayer services offer meaningful solidarity. Engage in dialogue about Catholic Social Teaching on migration: Start a dialogue with your community around Catholic Social Teaching on migration. Share a copy of and discuss the pastoral letter Strangers No Longer Together on the Journey of Hope.16
Pray together: Now, more than ever, immigrants and refugees in the United States and abroad need our prayers. You can dedicate a mass to immigrants in your community, lead a homily on migration, and distribute prayer cards. See our materials here.
Host a multicultural potluck night: Promote cultural awareness and foster a community
of welcome by hosting a multicultural potluck event.
Participate in Multicultural Celebrations of our Church: Learn about the Church’s immigrant history by attending mass on the Feast Day of Our Lady of Guadalupe on December 12th, the Feast Day of St. Frances Cabrini on November 13th, and the Feast Day of St. Kateri Tekakwitha on July 14th.
Educate members of your community and ask them to take action on the Justice for Immigrants (JFI) website: Share a link to the JFI website17 with members of your community so they can learn more about JFI’s work to support refugees and immigrants. Ask them to keep an eye out for action alerts posted on the JFI website – these are a quick and easy way for parishioners to make their voices heard!
Engage in National Migration Week: Urge your community and parish to review our
National Migration Week toolkit here and learn about ways they can take action.18

Sensitive Locations FAQs
In 2011, U.S. Immigration and Customs Enforcement (ICE) issued a memorandum on “Enforcement Actions at or Focused on Sensitive Locations” (the “ICE memo”).1 The memo describes ICE’s policy on immigration enforcement actions (such as arrests, interviews, searches, and surveillance operations) at “sensitive locations.” U.S. Customs and Border Protection (CBP) released its own memo regarding CBP operations at sensitive locations in 2013.2 The CBP memo is similar but not identical to the ICE policy.
What places qualify as sensitive locations?
According to the ICE memo, sensitive locations include:
• Schools (pre-schools, primary schools, secondary schools, post-secondary schools, colleges and universities, and other learning institutions such as vocational or trade schools);
• Hospitals; • Churches, synagogues, mosques, or other
institutions of worship, such as buildings rented for the purpose of religious services;
• The site of a funeral, wedding, or other public religious ceremony; and
• Public demonstrations, such as a march, rally, or parade.
Have there been any updates to the sensitive locations memos?
Yes. On January 10, 2018, ICE issued a memo titled, “Civil Immigration Enforcement Actions Inside Courthouses,” to clarify ICE’s policy regarding apprehensions at courthouses.3 Additionally, ICE and CBP have published additional information on their sensitive locations policies via their Frequently Asked Questions (FAQ) pages. The ICE FAQ page can be found here,4 and the CBP FAQ page can be found here.5
Are school bus stops and courthouses sensitive locations?
School bus stops are not specifically noted in the ICE memo. The ICE FAQ on this policy, however, does state that school bus stops are considered sensitive locations if they are “marked and/or known to the [ICE] officer, during period when school children are present at the stop.” 6 Unfortunately, reports show that ICE has not always followed this stated interpretation of its policy.7
As clarified by the January 10, 2018 ICE memo, courthouses do not qualify as sensitive locations. The memo, however, states that ICE officers should generally avoid enforcement actions at courthouses or areas in courthouses that are dedicated to non-criminal courts, such as family courts. It further states that enforcement actions at courthouses will typically be limited to the targeted individual and that officers should not apprehend other undocumented individuals encountered, unless special circumstances arise (including when individuals interfere with ICE’s enforcement action).
Does that mean ICE or CBP can never enter sensitive locations?
No. While ICE typically will not carry out enforcement actions in sensitive locations, it may do so if officials have obtained prior approval or if there is immediate need due to exigent circumstances. Exigent circumstance include instances of a national security threat, pursuit of a dangerous felon, imminent risk of harm, or risk of destruction of evidence in a criminal case.
The sensitive locations policy does not apply to certain enforcement operations conducted within 100 miles of the border, such as activities undertaken when there is a reasonable certainty that the immigrant just crossed the border or when DHS has maintained surveillance since the immigrant crossed the border. In addition, the sensitive locations policy does not apply to certain ICE activities, such as obtaining records, serving subpoenas,
or participating in official functions or community meetings.
Is the sensitive locations policy still in effect?
Yes. The sensitive locations policy currently remains in effect. However, as it is not set forth in statute or regulation, it could be withdrawn or modified by DHS at any point.
Are there any visual materials that can be used to help explain this policy?
Yes. In February 2018, CLINIC, the Catholic Legal Immigration Network, updated its infographic, available in English and Spanish, which serves as a helpful tool to explain this policy.
What can I do to make sure this policy is upheld?
You can urge ICE and CBP to maintain the policy and ensure that their officials are properly trained on its requirements.

Nine Ways to Protect Yourself
1. Learn about your rights in an enforcement situation. It is important to understand your
rights when interacting with immigration officers. For instance:
o If an Immigration and Customs Enforcement (ICE) officer comes to your home, you may refuse to open the door until the officer presents a warrant with your actual name and address on it. You can ask the officer to slide the warrant under the door.
o You have the right to remain silent and do not have to answer the officer’s questions.
o You can demand to speak to your legal counsel and can refuse to sign any documents until you have spoken with your attorney.
o Detailed information on immigrants’ rights can be found in English1 and Spanish.2
2. Organize your family’s documents and points of contact. Gather identification documents,
and documents related to any interactions with immigration officials, law enforcement, or
courts of law. Make copies of these documents and confirm that family members or trusted
friends have access to them. Memorize or carry the phone number of a person you trust and, if
applicable, your legal representative. Make sure your children also carry a trusted person’s
contact number.

4. Register and begin to attend your local church, parish, or other religious or community
center. Join a solidarity or support group if possible.
5. Make a family plan. Think through what your family will do in the event a family member is
arrested or detained. Decide in advance who will take care of your children in an emergency.
6. Know your parental rights. Do you have children under the age of 18? Make yourself aware of
your rights as a parent if you are detained. Learn more here.8
7. Set up a family and friends contact chain. Determine who in your circle of family and friends
will be called first in the event that you or a family member is apprehended.
8. Keep yourself informed about the latest immigration policy and advocacy updates. You

Have an emergency plan at your place of work.• If immigration o�cials come to your workplace, ask your coworkers if they are willing to stay
silent; ask to speak with a lawyer.
• If your workplace has a union, speak with the union representative to better learn how to prepare in case of a raid.
Have a plan to protect your family.• Prepare a “Limited Power of Attorney” form to ensure the proper care of your children with a
relative or family friend in case you are detained.
» This is very important, and in an emergency, would allow for a close friend or family member to care for your children rather than them being placed into the foster care system. See APPENDIX B for a list.
• Obtain a valid passport for your children.
» If your child is a citizen of the United States, obtain a passport for them as soon as possible. They will need this to travel outside of the country.
» If your child is not a citizen of the United States, obtain a passport from their birth country. You can get this from your country’s consulate. See APPENDIX C for a list.
• Register your child as a citizen of your home country at that country’s consulate so you do not have problems in that country once you arrive.
» For example, in some countries, children that are not registered cannot attend school. See page 24 for information on how to register your U.S. born children in your home country.

Special Considerations for Non-Citizens:
• You need to prepare yourself in case you are arrested. Make plans with your family. Memorize the phone numbers of important people to contact, including your lawyer.
• Do not discuss your immigration status with anyone but your lawyer.
• Ask your lawyer about the e�ect of a criminal conviction or plea on your immigration status. If you are in jail, an immigration o�cial may visit you. Do not answer questions or sign anything before talking to a lawyer.
• Read all papers carefully. Tell the o�cer or agent if you need an interpreter.
Your Rights:
• You have the right to remain silent. If you wish to exercise this right, say so out loud and then remain silent. Remember that anything you say can be used against you.
• There is one exception in Ohio to your right to remain silent. If the police reasonably suspect that you have committed a crime, or are about to commit a crime, you must disclose your name, address, and date of birth. After you give the police o�cer this information you do not have to answer any other questions.
• You have the right to refuse to consent to a search of yourself, your car, or your home.
• You have the right to be treated respectfully by the police.
• If you are not under arrest, you have the right to calmly leave.
• If you are arrested under a criminal charge, you have the right to a lawyer. Ask for one immediately.
• Regardless of your immigration or citizenship status, you have constitutional rights.
Your Responsibilities:
• Stay calm and be polite.
• Do not interfere with or obstruct police activities. Comply with all physical requests by the o�cer.
• Do not physically resist an o�cer, even if you believe you are being treated unfairly.
• Do not lie or show false documents.
• Do remember the details of the encounter and write them down as soon as possible.

REMEMBER
You have the right to remain silent.Do not say anything about your immigration status or where you were born.
If you have valid immigration documents, show them.
If You Are Stopped While Driving
• Stop the vehicle in a safe place as quickly as possible. Place your hands on the wheel and do not make any movements until the o�cer arrives at your window.
• Do not get out of the car, try to flee, or make any sudden movements.
• Upon request, show the police your driver’s license, registration, and proof of insurance.
• If an o�cer or immigration agent asks to look inside your car, you can refuse to consent to the search. To preserve certain rights, you must indicate clearly that you are not authorizing a search.
• The police can “feel” your clothing if they suspect that you have a hidden weapon. You should not resist physically, but you must indicate clearly that you are not giving them permission to do a full search.
• Both drivers and passengers have the right to remain silent. If you are a passenger, you can ask if you are free to leave. If the o�cer says yes, sit silently or calmly leave. Even if the o�cer says no, you have the right to remain silent.
• Do not resist arrest, even though you believe you are innocent.
• If you receive a ticket, sign it; if you do not, you can be arrested. You can always take the case to the courts afterwards.
If You Are Questioned About Your Immigration Status
• Remember that you have the right to remain silent. You do not have to discuss your immigration or citizenship status with the police, immigration agents, or any other o�cials. You do not have to answer questions about where you were born, whether you are a U.S. citizen, or how you entered the country.
• Federal law requires non-citizens to carry their valid immigration documents at all times. If an immigration agent (Border Patrol or Immigration and Customs Enforcement (“ICE”)) requests to see your immigration papers, it is a violation of federal law not to present them if you have valid immigration papers.
Do not lie about your citizenship status or provide fake documents. Write down everything you remember, including o�cers’ badge and patrol car numbers, what agency the o�cers are from, and any other details.

If the Police or Immigration O�cials Come to Your House
If police o�cers or immigration o�cials come to your home, DO NOT OPEN THE DOOR. You have the right to deny them entrance unless they have certain kinds of warrants. Ask the o�cer or agent to slip the warrant under the door or hold it up to the window so you can inspect it.
• A search warrant gives police the right to enter the address listed on the warrant, even without permission, but o�cers can only search the areas and for the items listed. A search warrant must be signed by a judge. Ask for a receipt of anything the o�cer takes out of your home.
• A criminal arrest warrant allows police to enter the home of the person named in the warrant if they believe the person is inside. A criminal arrest warrant must be signed by a judge.
• A warrant of removal/deportation (“ICE warrant”) does NOT allow o�cers to enter a home without consent.
Even if o�cers have a warrant, you have the right to remain silent. If you choose to speak to the o�cers, step outside and close the door. However, in some emergency situations, the police o�cers can enter your home and search it without a search warrant (for example, when a person yells for help from inside the house or when the police are chasing someone).
If You Are Arrested
• Ask to speak with your attorney or to make a phone call.
• Contact your trusted friend or family member who knows the number to your lawyer and your emergency plan. Memorize the number of your contact.
• Contact your consulate. You have the right to tell the agent to inform the consulate of your arrest. The consulate can help your find an attorney if you do not have one and may o�er to contact your family.

INFORMATION ABOUT IMMIGRATION DETAINERS
BONDSThe 48 hours begins once the individual pays the bond for an underlying criminal charge, or otherwise is released from state custody. It is possible that ICE can still pick up that individual after they have paid the local/state bond, and that the time in immigration custody will not count towards a sentence. If possible, consult with an attorney as soon as possible after being detained to assess whether it is a good strategy to pay the local bond. Don’t take advice from clerks or jail sta� about this matter.
Because an ICE detainer only allows for an individual to be detained for 48 hours beyond what is permitted by state or local law if that detainer is supported by probable cause, the detained individual should be immediately released after the 48-hour period has ended. After this period, you and/or your lawyer should ask that you be released if you are not released automatically.
According to federal regulations, a person detained pursuant to an immigration detainer cannot be held for more than 48 hours, excluding Saturdays, Sundays, and holidays. The 48-hour period begins after the local or state police would have released that person from their custody for any underlying o�ense. The detainer may be challenged if not supported by probable cause.
How long can the local government detain a person with a detention request from ICE?
If the jail does not have independent authority to detain a person based on criminal charges, it is illegal for them to continue to detain that person after the immigration detainer has expired. Contact an attorney if this has occurred.

IF YOU ARE IN IMMIGRATION DETENTION
While in the immigration detention center, you have a right to:
• Be treated with respect
• A detainee handbook
• Access to an attorney at your own expense and legal materials

• Correspondence
• Recreation
• Religious practices
• Funds and personal property

If You Are Placed in Removal (Deportation) Proceedings
• You have the right to hire a lawyer, but the government will not provide one for you in Immigration Court. If you do not have a lawyer, ask for a list of free or low-cost lawyers.
• Remember that you have the right to remain silent. What you say can be used against you later.
• Do NOT sign anything you do not understand without talking to a lawyer first. Tell the agent if you need an interpreter or if you need a document translated.
• Remember your alien number (“A number”) and give it to your family. It will help family members locate you.
• Keep all documents that are issued to you in a safe place.
Rights in Immigration Court
If you are placed in removal proceedings, and you were not previously ordered removed, you have the right to present your case to an immigration judge. You can waive your right to a hearing if you sign papers agreeing to be removed without a hearing. You also have the right to:
• An attorney to represent you at your hearing, but the government is not responsible for providing one for you.
• Ask for a bond.
• Have an interpreter at your hearings if you do not speak English.

APPENDIX B: IMPORTANT FORMS
INSTRUCTIONS The parent or legal guardian (Principal) should fill out the form on pages 11-12 to give a third party (Attorney-in-Fact) general power to make the majority of decisions and to do the majority of things that a parent would do for their child.
1. You should make copies of this form once it is signed. Use the copies whenever possible in order to protect the original.
2. The form should be signed by the parent or parents with legal custody or the legal guardian. Both parents should sign if the child is living with both parents.
3. A di�erent Limited Power of Attorney form should be completed for each child in the family.
4. Due to travel problems of taking a child to another country, the parents may want to sign a Limited Power of Attorney making the other parent the Attorney-in-Fact, along with a Limited Power of Attorney making another trusted family member or friend an Attorney-in-Fact.
5. The parent or parents must sign the form in front of a notary public. If you did not sign the Limited Power of Attorney form prior to being arrested or detained, you can ask jail sta� to help find a notary in the jail. Every bank has a notary public. You should not have to pay a high fee.
6. This form may not be honored or recognized by all persons, governmental organizations, or businesses.
7. If you sign the Limited Power of Attorney form in advance, you will have to re-sign it if you place an expiration date on it.
8. The Limited Power of Attorney form is only a short-term solution to a parent or parents being arrested and detained by the government. The Attorney-in-Fact will need to consult with an attorney regarding child custody if the child’s parent or legal guardian is detained.

General InformationDetainees cannot receive incoming calls. If you need to get in touch with a detainee to leave an urgent message, you must call the number for the facility and leave the detainee’s full name, alien registration number, and your name and telephone number where you can be reached. The detainee will be given your message.
Visitation: To ensure adequate time to process visitors through security, all visitors must arrive 45 minutes prior to the scheduled visit time. Visitors must present a valid verifiable U.S. government-issued identification card to enter the facility. Minors who are visiting the facility must be accompanied by an adult guardian (18 years or older). Minors must not be left unaccompanied in the waiting room, visiting room or any other area.
Sending money: Contact the detention facility for procedures on how to send money. If detainees receive funds in the mail, they will be taken to the processing area for the money to be placed into their account. The processing o�cer will provide a receipt for all funds received. Do not send cash in the mail.
How to Post an Immigration BondThese bonds are posted when a person has been placed into removal proceedings while in the United States. The person supplying the bond money must show proof of identity and lawful immigration status. This person (the obligor) is responsible for ensuring that the alien presents himself before an o�cer or agent of this agency whenever a request is made. For bond information, please call the bond information number for the detention facility and ask to speak to the Deportation O�cer handling the case. You must have the last name of the detainee and alien registration number before calling.
To post an immigration bond for an alien being detained by ICE, you must post the bond at the Cleveland or Columbus ERO/ICE O�ce (depending on the location), Mondays through Fridays (except public holidays) between the hours of 9 a.m. and 3 p.m. Acceptable bond forms of payment are money order, certified check or cashier’s check. These must be made payable to the “U.S. Department of Homeland Security.”

REGISTERING YOUR U.S. BORN CHILDREN IN YOUR HOME COUNTRY:Contact your country’s consulate or embassy to ask about their requirements for registering your U.S. born children. In most cases, registering your U.S. born child in your home country will allow your child to obtain citizenship from that country; this means your children will be able to obtain a passport from your home country.
REQUIREMENTS TO REGISTER U.S. BORN CHILDREN IN MEXICO:Both parents must present themselves at the nearest Mexican Consulate and bring the following:
• Original certified copy of minor child’s long-form birth certificate. The birth certificate should contain the place, date and time of birth for the child, as well as the names and dates of birth of the parents. If there are errors on these documents they will not be accepted. The original certified copies will not be returned.
• U.S. Passport or state ID of minor child.
• Original birth certificate of both parents. If one of the parents is not a Mexican citizen, they should present their birth certificate, with an apostille from their country of origin, and translated into Spanish, unless it is a U.S. birth certificate.
• Marriage certificate (if the parents are married)
• O�cial and unexpired ID for both parents (passport, matricula, voting card); if one is not of Mexican origin, then they should present their valid passport from their country of origin. The name should appear as it does on the birth certificate.
• Two witnesses with o�cial, unexpired IDs (family members, friends, etc).
NOTE: You must bring two double-sided copies of each document.
Important: In the case of a single mother, the registration can only take place with her present and if the child is registered on the birth certificate with only her last names, and only if the father’s name and information does not appear on the birth certificate.
If the registration is for an adult child over the age of 18, the registration can take place without the presence of the parents.

Tenga un plan para proteger a su familia.• Prepare una “Carta Poder Limitada” para asegurarse de un cuidado adecuado para sus hijos
con un familiar o un amigo cercano en caso de ser detenido.
» Esto es muy importante, y en caso de una emergencia, permitirá a un amigo cercano o a un miembro de la familia cuidar de sus hijos en lugar de ser puestos en custodia del sistema de crianza. Vea la lista de Apéndice B.
• Obtenga un pasaporte válido para sus hijos.

Si la policía tiene sospechas razonables de que usted ha cometido un delito, o está a punto de cometer un delito, usted tiene que decir su nombre, dirección y fecha de nacimiento. Después de que le dé a la policía esta información, usted ya no tiene que contestar a otras preguntas.
• Usted tiene el derecho de negar consentimiento a una revisión de usted, su carro, o su casa.
• Usted tiene el derecho de ser tratado con respeto por la policía.
• Si usted no está bajo arresto, usted tiene el derecho a retirarse con calma.

Si usted es detenido mientras maneja:• Detenga el vehículo en un lugar seguro lo más pronto posible. Ponga sus manos en el volante y
no haga ningún movimiento hasta que el oficial llegue hasta su ventana.
• No salga de su vehículo, o trate de escapar, o haga ningún movimiento repentino.
• Cuando se lo pidan, muestre su licencia, su registración y prueba del seguro del auto.
• Si un oficial o un agente de inmigración pide ver dentro de su carro, usted puede negar consentimiento a la revisión, Para preservar ciertos derechos, usted debe indicar claramente que usted no autoriza la revisión.
• La policía puede “tocar” su ropa si sospechan que usted tiene un arma escondida. Usted no debe poner resistencia física, pero debe indicar claramente que usted no les da permiso de hacer una revisión profunda.
• Tanto el chofer como los pasajeros tienen derecho a guardar silencio. Si usted es un pasajero, puede preguntar si se puede retirar. Si el oficial dice que sí, quédese sentado o retírese con calma. Y aunque el oficial diga que no, usted tiene el derecho de guardar silencio.
• No se resista el arresto, aunque usted crea que es inocente.
• Si a usted le dan una infracción de tránsito, fírmelo; si no lo hace, usted podría ser arrestado. Siempre se puede llevar el caso a la corte después.
Si le hacen preguntas acerca de su estatus de inmigración:• Recuerde que usted tiene el derecho a guardar silencio. Usted no tiene que divulgar su estatus
de inmigración o ciudadanía con la policía, agentes de inmigración, o cualquier otro oficial. Usted no tiene que responder a las preguntas sobre dónde nació, si usted es ciudadano de los EE.UU., o cómo entró al país.
• La ley federal exige que las personas no ciudadanas lleven sus documentos consigo en todo momento. Si un agente de inmigración (Patrulla Fronteriza o Inmigración y Control de Aduanas (ICE)) le solicita ver sus papeles de inmigración, es una violación a la ley federal no mostrarlos si es que tiene papeles válidos.
No mienta acerca de su estatus de ciudadanía ni muestre documentos falsos. Escriba todo lo que recuerde incluyendo la placa y número del carro del oficial, de que agencia es el oficial, y cualquier otro detalle.

Si oficiales de inmigración o la policía vienen a su casa:
Si la policía o un oficial de inmigración vienen a su casa, NO ABRA LA PUERTA. Usted tiene el derecho de negarles la entrada a menos que tengan cierta clase de una orden. Pídale al oficial o agente que le pase la orden por debajo de la puerta o que se la muestre por una ventana para que usted la pueda verifica.
• Una orden de registro le da a la policía el derecho de entrar a la dirección mencionada en la orden, aun sin su permiso, pero los oficiales solamente pueden revisar las áreas y cosas mencionados en la orden. Una orden de registro debe estar firmada por un juez. Pida un recibo de cualquier cosa que los oficiales se lleven de su casa.
• Una orden de registro por un delito le permite a la policía entrar a la casa de la persona mencionada en la orden si creen que esa persona se encuentra dentro. Una orden de registro por un delito debe ser firmada por un juez.
• Una orden de deportación (Orden del ICE) no le permite a los oficiales entrar a su casa sin su permiso.
Aunque los oficiales tengan una orden, usted tiene derecho de guardar silencio. Si usted prefiere hablar con los oficiales, salga afuera y cierre la puerta. Sin embargo, en algunos casos de emergencia, los oficiales de la policía pueden entrar a su casa y revisarla sin tener una orden de registro (por ejemplo, cuando una persona pide ayuda desde adentro de la casa o cuando la policía está persiguiendo a alguien).
Si usted es arrestado:• Pida hablar con un abogado o hacer una llamada.
• Llame a una persona de confianza o a un familiar que esté al tanto del número de su abogado y su plan de emergencia. Memorice los números de su contacto.
• Llame a su consulado. Usted tiene el derecho de decirle al agente que le informe al consulado de su arresto. El consulado le puede ayudar a buscar a un abogado si usted no tiene uno y a llamar a su familia.

INFORMACIÓN ACERCA DE LAS ORDENES DE DETENCION
FIANZASLas 48 horas comienzan una vez que la persona pague la fianza por un cargo penal cometido, o de lo contrario es liberado de la custodia estatal. Es posible que ICE pueda detenerlo después de haber pagado la fianza local/estatal, y que el tiempo en custodia de inmigración no cuenta hacia la sentencia. Si es posible, consulte con un abogado lo más pronto posible después de ser detenido para determinar si es buena estrategia pagar la fianza local. No tome los consejos del personal o secretarias de la cárcel en este asunto.
Debido a que la orden de detención de ICE solamente permite que una persona esté detenida por 48 horas más allá de lo que es permitido por la ley local o estatal si la orden se apoya en causa probable, la persona detenida tendrá que ser liberado después que haya terminado el periodo de 48 horas. Después de este periodo, usted y/o su abogado deben pedir ser liberado si es que no es liberado automáticamente.
De acuerdo con las regulaciones federales, una persona detenida conforme a una orden de detención de inmigración no puede ser detenida por más de 48 horas, excluyendo los sábados, domingos y días festivos. El periodo de las 48 horas comienza después de que la policía local o estatal habría sido liberado a esa persona de su custodia por la ofensa cometida. La orden de detención puede ser rechazada si no hay pruebas de causa probable.
¿Por cuánto tiempo puede el gobierno local tener detenido a una persona por una petición de ICE?
Si la cárcel no tiene autoridad independiente para detener a una persona con base en cargos criminales, es ilegal que ellos continúen tendiendo detenida a una persona después de que la orden de inmigración haya expirado. Comuníquese con un abogado si esto ocurre.

• Recibir correspondencia
• Recreación
• Prácticas religiosas
• Fondos y cosas personales
• Cuidado médico
Si usted es puesto en proceso de (expulsión) deportación:• Tiene el derecho de contratar a un abogado, pero el gobierno no le proporcionará a uno en
la Corte de Inmigración. Si usted no tiene un abogado, pida una lista de abogados gratis o abogados de bajo costo.
• Recuerde que tiene el derecho de guardar silencio. Lo que diga puede ser usado en su contra.
• NO firme nada que usted no entienda sin antes hablar primero con un abogado. Dígale al agente si usted necesita de un intérprete o si necesita la traducción de un documento.
• Recuerde su número de extranjero (el número “A”) y déselo a su familia. Eso ayudará a su familia a localizarlo.
• Mantenga todos los documentos que se le dan en un lugar seguro.
Sus derechos en la Corte de Inmigración:Si usted es puesto en procedimientos de deportación, y no se le ordenó previamente ser deportado, usted tiene derecho de presentar su caso ante un juez de inmigración. Usted puede renunciar a sus derechos de una audiencia si usted firma papeles estando de acuerdo a ser deportado sin una audiencia. Usted también tiene derecho a:
• Un abogado que lo represente en una audiencia, pero el gobierno no es responsable de proporcionar uno.
• Pedir una fianza.
• Tener a un intérprete en sus audiencias si usted no habla inglés.

INSTRUCCIONES El padre o guardián legal (principal) deberá llenar este formulario en las paginas 11-12 para darles a terceras personas (Apoderado) poder general para hacer la mayoría de las decisiones y hacer la mayoría de las cosas que un padre haría por su hijo.
1. Usted deberá hacer copias de este formulario una vez que lo haya firmado. Use las copias cuando le sea posible para proteger el original.
2. Este formulario deberá ser firmado por el padre o los padres con la custodia legal o por el guardián legal (tutor). Los dos padres deben firmar si el menor vive con los dos padres.
3. Un formulario de Carta Poder Limitada diferente deberá ser llenado por cada menor en la familia.
4. Debido a problemas para viajar y llevar al menor a otro país, los padres querrán firmar una Carta Poder Limitada haciendo al otro padre el Apoderado, y también una Carta Poder Limitada para hacer a un miembro de la familia de confianza o a un amigo como Apoderado.
5. El padre o los padres tienen que firmar el formulario delante de un notario público. Si usted no firmó la Carta Poder Limitada antes de ser arrestado o detenido, usted puede preguntar al personal de la cárcel que le ayuden a encontrar a un notario en la cárcel. Cada banco tiene un notario. Usted no tendría que pagar un precio alto.
6. Este formulario pudiera no ser reconocido por todas las personas, organizaciones de gobierno o negocios.
7. Si usted firma la Carta Poder Limitada por adelantado, tendrá que volverlo a firmar si usted pone una fecha de expiración en ella.
8. El formulario Carta Poder Limitada es una solución a corto plazo para el padre o padres que son arrestados y detenidos por el gobierno. El Apoderado tendrá que consultar con un abogado acerca de la custodia del menor o los menores si el padre o el guardián legal (tutor) es arrestado o detenido.

Información generalLos detenidos no pueden recibir llamadas. Si usted necesita comunicarse con un detenido y dejarle un mensaje urgente, usted deberá llamar al número del centro y diga el nombre completo del detenido, número de registro de extranjero, el nombre de usted y su número del teléfono donde se le puede localizar. Le darán el mensaje al detenido.
Visitaciones: Para asegurar un tiempo adecuado en el proceso de seguridad de los visitantes, todos los visitantes deberán llegar con 45 minutos antes de la visita programada. Los visitantes deberán presentar una identificación válida que sea verificable y que haya sido emitida por el gobierno de los EE.UU. para entrar al centro. Cómo pagar una fianza de inmigraciónEstas fianzas se hacen cuando una persona es puesta en procedimientos de deportación mientras está en los Estados Unidos. La persona que proporciona el dinero para la fianza deberá mostrar su identificación y su estatus de inmigración legal. Esta persona (el deudor) es responsable de asegurarse que el extranjero se presente con los oficiales o agentes de esta agencia cuando se le haga un requerimiento. Para información sobre las fianzas, favor de llamar al número de información de fianzas del centro de detención y pida hablar con el Oficial de Deportación que lleva el caso. Deber tener el apellido del detenido y su número de registro de extranjero antes de llamar.
Para pagar una fianza con inmigración para un extranjero detenido por ICE, usted deberá de pagar la fianza en la oficina de Cleveland o Columbus ERO/ICE (dependiendo del área), de lunes a viernes (con excepción de días festivos públicos) entre las 9:00am y las 3:00pm. REGISTRE A SU HIJOS NACIDOS EN LOS EE.UU. EN SU PAÍS DE ORIGEN:Comuníquese con el consulado o la embajada de su país y pregunte sobre los requisitos para registrar a sus hijos nacidos en los EE.UU. En la mayoría de los casos, al registrar a sus hijos nacidos en los EE.UU. en su país de origen, les permitirá obtener la ciudadanía de su país; esto significa que sus hijos podrán obtener un pasaporte de su país de origen.
REQUISITOS PARA REGISTRAR A SUS HIJOS NACIDOS EN LOS EE.UU. EN MÉXICO:Los dos padres deberán presentarse juntos al Consulado más cercano y presentar lo siguiente:
• Copia original del certificado de nacimiento del menor, formulario largo. El certificado de nacimiento deberá tener el lugar de nacimiento, fecha y hora del nacimiento del menor, así como los nombres y fechas de nacimiento de los padres. Si hay errores en los documentos estos no serán aceptados. La copia original del certificado no se devolverá.
• Pasaporte de los EE.UU. o identificación del menor.
• Certificado de nacimiento original de ambos padres. Si alguno de los padres no es ciudadano mexicano, deberá presentar su certificado de nacimiento, apostillado en su país de origen, traducido en español, a menos que sea un certificado de nacimiento de los EE.UU.
• Certificado de matrimonio (si los padre están casados).
• Identificación oficial vigente de los dos padres (pasaporte, matrícula, tarjeta de votar); si uno no es mexicano, deberá presentar su pasaporte vigente de su país de origen. El nombre deberá aparecer exactamente como está en el certificado.
• Dos testigos con identificación oficial vigente (miembros de la familia, amigos, etc).
NOTA: Deberá traer copias por los dos lados de ambos documentos.
Importante: En caso de ser madre soltera, la registración solo se puede hacer con la presencia de ella y si el menor está registrado en el certificado con solo su apellido, y solo si el nombre del padre y su información no aparecen en el certificado.
Si la registración es para un hijo adulto mayor de 18 años, la registración se puede hacer sin la presencia de los padres.
