And Whereas the acquisition of the said land is urgently necessary.
Whereas by Government Notification No~ RD/LQN/191/77 dated 12-7-1977 published on page 198 to 200 of Series II No. 16 of the Official Gazette dated 21-7-1977, it was notified under section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as "the said Act") that the land specified in the schedule appended to the said Notification (hereinafter referred to as "the said land") was needed for the public purpose viz. for construction of Cumbarjua canal scheme (Addl. Area) in Tiswadi TaIuka.
The Government is also pleased to direct under Sub~Section (1) of Section 17 of the said Act, that the Collector, appointed under paragraph 2 below, shall at any time on expiry of fifteen days from the publication of the notice relating to the said rand under Sub-Section (1) of Section 9 of the said Act, take possession of the waste or arable land.
The Government is also pleased to appoint Under clause (0) of Section 3 of the said Act, the Land Acquisition Officer, Collector's Office, Panaji to perform the functions of the Collector for all proceedings hereafter to be taken in respect of the said land, and to direct him under Section 7 of the said Act to take order for acquisition of the ~aid -land.

By Government Order No. IRM/CON/(135)/77/IT-21/77 dated 16th January, 1978 the Government of Goa, Daman and Diu, referred the dispute between the above parties for adjudication by this Tribunal with the following Schedule:

"Whether the action of the management of Mis. Kane Industries, Navelim, Margao, Goa, in dismissing from service, 'Shri R. V. Kunde, with effect from 12-8-1977 is legal and justified?

The reference was registered. With a covering letter dated 6th March, 1978, both the parties have forwarded to the Tribunal memorandum of settlement, dated 16th January, 1978, of the dispute that has been referred for adjudication.
Under the memorandum of settlement dated 16th January. 1978, the second party employer agreed to pay on or _ before 5th February, 1978, to the first party workman a sum of Rs. 6000/- in full and final settlement of all his legal dues including gratuity for the service rendered bY' him to the employer and also in settlement of the first_ party workman's demand for reinstatement and full back \yages. The second party employer also agreed to pay the first party wOl'kman the bonus for the year 1977-78 as and when it is declared by the second party. The Union also agreed not to press its demand for reinstatement of the first party workman with full baek wages and to treat the said demand as finally settled by virtue of the settlement.
The concerned workman gets under the settlement a substantial sum of money and also such bonus that might be declared by the management for the year 1977-78. Both the

parties are satisfied with the settlement and have accepted it as resolving the dispute existing between- them. Therefo~ the meniorandwn' of ' settlement is accepted, read and recorded and the following a ward is being made in tenus of- it.
AWARD
The award is made in tenus of the settlement dated 16th January, 1978, which is annexed to and which shall form pal·t of' this award.

SHORT RECITAl,. OF THE CASE
On 17-8-77 the Kane Industries Employees' Union Navelim Goa raised a dispute upon the management of Mis Kane Industlies demanding the reinstatement of Shri R. V. KWlde whose services were terminated from 12-8-77. The conciliation proceedings were initiated by the Conciliation Officer but a settlement could not be reached between the parties as a result of which he recorded failure of the conciliation proceedings. The Conciliation Officer submitted his failure report as required Wlder Section 12 (4) of the Industrial Disputes Act, 1947 under a communication No .. IRM/CON/(135)/77 I IIT·31/77/10851 dated 29-11·77. The Under Secretary, Industries and Labour under his letter No. lRM/CON/(135)1 /77!IT-21/77 dated 26th December 1977 intimated to the parties that the failure report has been received by the Government. During the perioct. from. the submission of the failure report again. the parties entered into negotiations directly and during the direct negotiations- the parties have arrived at the following settlement.
TERMS OF THE SETrLEMENT
1. It is hereby agreed between the parties that Shri R. V. Kunde shall be paid a total amount of as. 60001- towards the full and final settlement of all his legal dues including gratuity for the services rendered by him, to the employer and in settlement of his demand of reinstatement with full back wages.
2. The Management agree to pay him his bonus for the year 1977-78 as -and when the same is dec;lared.
3. The Union agrees not be press the demand of reinstatement of Shri R. V. Kunde with fUll back wages and the said demand is finally settled by virtus of this settlement.
4. The parties agree to submit this settlement to the concerned authorities for registl'Gt.tio~ of the same under section 2(p) of read with section 18(1) of the Industrial Disputes Act, 1947. The parties also agree,to send a copy of ilie same to the, secretary, Industries and Labour, with a covering letter to the effect that in view of the settlement, the Govern~ ment need not act upon the failure report submitted by the conciliation offider on 29-11 .. 77. The payment under the settlement shall be effected to Shri R. V. Kunde on or before 5th February 1978.
