KEY ISSUES

BACKGROUND
The aim of delegated authority is to assist with improving the time taken to make decisions within the constraints allowed by relevant legislation.
Without delegated authority, most decisions of the City would need to be made by Council at its ordinary meetings. Having appropriate delegations in place allow day to day decisions to be made by the Chief Executive Officer, who in turn can sub-delegate these to other staff if appropriate.
DETAILS
Under the Act, a local government may delegate to the CEO any of its powers or the discharge of any of its duties under the Act, other than those prescribed under s5.43.

All delegations made by the Council must be by an absolute majority as prescribed by s5.42 and s5.44 of the Act that legislates Council's ability to delegate functions to the Chief Executive Officer.
In turn, the Act allows the CEO to delegate to any employee the exercise of any of the CEO's powers or discharge of duties, in accordance with s5.44 of the Act.
A review of the delegation register has recently been undertaken by City staff. The following changes are proposed:
• Position titles have been amended to reflect the organisational structure
• Delegations relating to the Building Act 2011 and Building Regulations 2012 that were adopted by Council in March 2012 to reflect changes to the new Act have been included in the Register.
• Previous delegations DA28 relating to Appointment of Authorised Persons under the Caravan Parks and Camping Grounds Act 1995 has been deleted as there is no statutory authority to delegate this function.
• Previous delegation DA30 relating to Environmental Protection (Noise) Regulations 1997 has been deleted as this delegation is from the CEO of the Department of Environment & Conservation (DEC) to the City of Swan and not from Council.
• New delegation DA32 giving authority to issue certificates under the Gaming and Wagering Commission Act 1987 formalises the arrangement as to who can sign these certificates on behalf of the City. These certificates state the premises complies with Health and Planning legislation.
• New delegation DA31 to enable separation of two separate areas of the Liquor Control Act 1988 legislation.
• New delegation DA36 relating to determining applications for compensation following seizure or the issue of a prohibition notice under the Food Act 2008. This delegation clarifies who within the City has authority to consider a claim for compensation from a food business proprietor following a prohibition notice being issued or a food seizure taking place.
• Minor amendments to remaining delegations relating to environmental health to ensure they are consistent with the statutory power to delegate, administrative changes to ensure the delegations operate at an appropriate level for efficiency and to prevent minor administrative functions having to go to Council (eg. appointing individual staff as 'authorised officers').
After further consultation with relevant business units, the following amendments were made:
• Add Manager Health & Building Services as a delegate for DA33 - Food Act 2008 'Appointment of Authorised Officers' .
• Add Manager Health & Building Services as a delegate for DA34 - Food Act 2008 'Designated Officers'.
These further amendments are considered minor in nature and do not require the Delegated Authority Register to go back to the Governance Committee for endorsement.

Purpose of Delegated Authority The aim of delegated authority is to assist with improving the time taken to make decisions within the constraints allowed by relevant legislation. This is consistent with the City's commitment to a strong customer service focus. This Register details the related document(s) where the power to delegate is derived from, including the relevant legislation and policies of the Council. This enables easier cross-referencing. This Register will be reviewed in accordance with the Local Government Act 1995 once every financial year. The co-ordination of the review will be performed through the Office of the CEO.
Legislation The Local Government Act 1995 ('The Act') was introduced in 1 July 1996 and made significant changes to the way local government conducts its business. Its general aim was to enable local governments to provide good, open and accountable government to the community.
Delegation by Council to the Chief Executive Office r One of the changes was the degree of delegated authority available to be passed onto the Chief Executive Officer or a committee in order to manage the day-to-day operations of the City. The Act allows for a delegate to the Chief Executive Officer the exercise of any of its powers or the discharge of any of its duties under the Act. All delegations made by the Council must be by absolute majority. [s5.42(1)] The following are decisions that cannot be delegated by Council to the Chief Executive Officer under the Local Government Act 1995. [s5.43]
• Any power or duty that requires a decision of an absolute majority or special (75%) majority of the local government;
• Accepting a tender which exceeds an amount determined by the local government; • Appointing an auditor; • Acquiring or disposing of any property valued at an amount determined by the local government; • Any of the local government's powers under section 5.98, 5.98A, 5.99A, 5.99 and 5.100 of the Act; • Borrowing money on behalf of the local government; • Hearing or determining an objection of a kind referred to in section 9.5; • Any power or duty that requires the approval of the Minister or Governor; or • Such other duties or powers that may be prescribed by the Act.
Delegation by the Chief Executive Officer to an Emp loyee The Acts allows for the Chief Executive Officer to delegate any of the powers to another employee. [s5.44(1)] This must be in writing. [s5.44(2)] The Act allows for the Chief Executive Officer to place conditions on any delegations if desired. [s5.44(4)] A register of delegations relevant to the Chief Executive Officer and other employees is to be kept and reviewed at least once every financial year. [s5.46(1) and(2)] If a person is exercising a power or duty that they have been delegated, the Act requires that records be kept whenever the delegated authority is used. [s5.46(3)] The record is to contain the following information;
• How the person exercised the power or discharged the duty; • When the person exercised the power or discharged the duty; and • The persons or classes of persons, other than council or committee members or employees of the local
government, directly affected by the exercise of the power or the discharge of the duty. [Local Government (Administration) Regulations 1996 - Cl19]

A person to whom a power is delegated under the Act is considered to be a 'designated employee' under s5.74(b) of the Act and is required to complete a primary and annual return each year.
Acting Through The Act does not specifically define the meaning of the term "acting through", however, s5.45(2) states; "Nothing in this Division is to be read as preventing - (a) a local government from performing any of its functions by acting through a person other than the CEO; or (b) a CEO from performing any of his or her functions by acting through another person." The Department of Local Government & Regional Development Guideline No.17 - Delegations, establishes the principal issue in determining whether a statutory function or duty is suitable for 'acting through' is that, where the statute provides no discretion in carrying out a function or duty, then the function or duty may be undertaken through the "acting through" concept. Conversely, where the statute allows for discretion on the part of the decision maker, then the function must be:
• delegated; or, • where applicable a person authorised; or, • a policy implemented that provides sufficient control,
for another person to have that authority and fulfil the function or duty. Where considered appropriate and effective in operation, discretionary matters will be determined by Council through policy. The policy decision may then be implemented by officers through the 'acting through' concept. In these instances there is no need for a delegated authority as it is responsibility of the CEO to implement the City's policies.

6. Allow an interested person to inspect a building record and provide to the interested person a copy of the building record (s.131(2))
7. Give the Building Commissioner prescribed information for inclusion in the annual report submitted under the Financial Management Act 2006 Part 5 by the accountable authority (s.132(1)) and provide a record or information requested by the Building Commissioner (s.132(3), r.14)

Details of Delegation The Chief Executive Officer is delegated authority to perform the functions of Council in respect of the following matters:
a) Determination of applications for development approval, including applications involving;
i. the variation of scheme provisions, Planning Policy or provisions of the Residential Design Codes; and
ii. the exercise of discretion under the Scheme, Planning Policy or the Residential Design Codes.
b) Refusal of all development applications where the proposed use is not permitted by the Scheme or where the development does not comply with the non-discretionary provisions of the Residential Design Codes or any mandatory statutory requirement of adopted Council policy;
c) Grant an extension of development approval for up to two (2) years; d) Granting variation to relevant Planning Policies and provisions of the
Residential Design Codes on Building Licence applications; e) Making recommendations to the WA Planning Commission in respect of
applications: i. to commence development by a Public Authority on land zoned under
the Metropolitan Region Scheme; and ii. to commence development on land designated as a Regional Reserve

f) Deletion or modification of conditions of approval, whether imposed under delegated authority or not;
g) Making recommendations to the WA Planning Commission on: • applications for subdivision or amalgamation of land; • minor variations to approved subdivisions; • clearance of conditions of subdivision approval.

provided that the modification is: i. of a minor nature; ii. consistent with the intent of the zone and the Scheme; and iii. unlikely to have a detrimental effect on the amenity of the locality or
any owner or occupier of land in the locality. k) Provision of written and verbal responses to State Administrative Tribunal
(SAT) reviews, mediated settlements resulting from SAT reviews and WA Planning Commission requests for reconsideration;
l) Taking all necessary action against owners and occupiers of properties to cease illegal uses or comply with conditions of Development Approval, including pursuing prosecution through Council's solicitors;
m) Formation of any opinion and consideration of any matter in the exercise of these delegated powers that would be required of Council under the Scheme, including, but not limited to, sufficient information required for the processing of applications, referral and advertising of applications, and interpretation of Scheme provision, relevant planning policies and provisions of the Residential Design Codes.
n) Determination of applications for a built strata approvals and the issuing of Certificates of Approval

Conditions/Exemptions of Delegation
With exception of the Delegation listed under Clause (b) above, all applications will be submitted to a meeting of Council for determination in the following circumstances:
a) Where a delegated decision would be contrary to the intent of a previous decision made at a Council meeting, or any law or regulation;
b) Where written objection is received to the proposal from any statutory agency. c) Where the proposal is inconsistent with the intent of the Local Planning
Scheme, relevant policies, Residential Design Codes, or any Structure Plan (as defined by LPS 17) or Local Planning Strategy adopted by Council;
d) Where notification has been given to adjoining and nearby owners or the general public for comment in accordance with the Local Planning Scheme or any policy and written objections have been received within the time specified, unless in the opinion of the Principal Planner:
i. the proposal is for the exercise of discretion under the R-Codes and is consistent with the intent of the Local Planning Scheme, Residential Design Codes and relevant policy; and
ii. the objections can be overcome by imposing a condition(s) on the development approval, or modifying the design of the development; or
iii. the objection does not relate to valid planning and development issues associated with the proposal.
e) Where, in the opinion of the Principal Planner: i. any of the requirements of this delegation are not satisfied; or ii. there is insufficient certainty as to whether the application complies
with the intent of Scheme, Residential Design Codes or any relevant Council policy; or
iii. it would be in the public interest or consistent with the principles of administrative accountability for Council to determine the application; or
iv. the decision involves a matter of principle which, in the opinion of the Principal Planer, should be made by Council; or
v. a condition recommended by a statutory agency is unnecessary or impractical, or unreasonable to be enforced by the City
