AN ORDINANCE PRESCRIBING A PROVISIONAL FARE MATRIX FOR THEOPERATION OF TRICYCLE-FOR-HIRE AMID OF COVID-19 UNTIL THE SITUATIONRETURNS TO NORMAL AND IMPOSING PENALTY FOR VIOLATION THEREFOR.

WHEREAS, on a Resolution No. 40, Series of 2020 issued by the Inter-Agency Task Force(IATF) on May 27, 2020, Laguna as part of CALABARZON was placed under General CommunityQuarantine (GCQ). Thus, the same was declared by IATF, on June 15, 2020, retaining theentire region under GCQ as per Resolution No. 46-A series of 2020;
WHEREAS, the Inter-Agency Task Force (IATF) and the Department of Transportation (DOTr)provided guidelines and regulations to be observed by cities/municipalities in all regionsparticularly for road transport sector in areas placed (GCQ) where public transportation isallowed under limited number and reduced capacity to ensure social distancing. Tricycle, on theother hand, must not exceed to one passenger in the side-car, while back riding is not allowed,to ensure that physical distancing is followed;
WHEREAS, the implementation of the said guidelines necessitates assistance of enforcementagencies such as Philippine National Police (PNP) and the Local Government Units (LGUs) toensure that social distancing and sanitation is observed in terminals and vehicles in these citiesto safeguard the health of all drivers and commuters in the transport sector ;
WHEREAS, establishments and offices in areas under GCQ is currently operational and allowedto operate with 70% of their workforce, including government offices, hence,allowing tricycle tooperate necessitates the needs on the mode of transportation by commuting public in the city;
WHEREAS, the city officials have studied thoroughly the situation of tricycle operators underthe GCQ pursuant on the provisions of DOTr guidelines to operate with only one passenger, toavoid the possible accumulation of COVID-19 and came up with the comprehensive solution tobenefit both the riding public and the tricycle drivers and operators which is to increase theregular fare of tricycles-for-hire within the city;
WHEREAS, considering the strict limitation of passengers that a tricycle could accommodate aswell as the strict implementation of the social distancing in public transports brought about byGCQ, the city government intended to adopt an equitable and reasonable fare rate for all;
WHEREAS, the new fare matrix for tricycle will go back to the old tariff as provided underKAUTUSANG PANLUNGSOD BLG. 1412-2005 once any of the Community Quarantine status islifted and until the situation returns to normal as officially declared by the authorities;
WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local GovernmentCode of 1991 provides that "every local government unit shall exercise the powers expresslygranted , those necessarily implied therefrom, as well as powers necessary; appropriate orincidental for its efficient and effective governance, and those which are essential to thepromotion of the general welfare >ooc,";
NOW THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF THECITY OF SANTA ROSA, LAGUNA IN SESSION THAT:
SECTION 1. TITLE. - this ordinance shall be known as "AN ORDINANCE PRESCRIBING APROVISIONAL FARE MATRIX FOR THE OPERATION OF TRICYCLE-FOR-HIRE AMID OF COVID-19 UNTIL THE SITUATION RETURNS TO NORMAL AND IMPOSING PENALTY FOR VIOLATIONTHEREFOR'.;
SECTION 2. PURPOSE AND GENERAL COVERAGE - Tricycles in the City of Santa Rosa willbe allowed to operate while under General Community Quarantine (GCQ) period or any otherstrict community quarantine to be imposed by national and local government, subject to thefollowing conditions, restrictions and guidelines being imposed by the DOTr ;
a) Allow and accept Only one (1) passenger per trip who shall be seated in the sidecar atall times and no back rider per tricycle shall be allowed EXCEPT during medicalemergencies when a family member needs to accompany the patient;

b)Drivers/operators shall put a transparent sheet plastic/barrier or any similar materialsbetween the driver and the passenger without compromising tricycle's safety;
c)Drivers/operators shall provide antiseptic or disinfectant alcohol in the tricycle;
d)Refuse passenger without face mask;
e)Public Utility Tricycle Driver shall regularly observe proper hygiene and sanitationpractices at all times. He/She shall wear face mask and protective gloves as a safetymeasure when handling fares.
f) Drivers/operators shall sanitize/disinfect the tricycle at least twice (2x) a day;
g)Private tricycle may be allowed to operate but shall put a "NOT FOR HIRE" sign. Theprovision under (a) to (c) shall likewise apply under this circumstance.
SECTION 3. DEFINITION OF TERMS. - For the purposes of this Ordinance, the followingdefinitions shall be adopted:
a. Fare- the money a passenger on public transportation has to pay.
b. Fare Matrix - is a chart that tells how much the base fare is per passenger and isusually a requirement by the local government. Most of the time, they are postedinside the sidecar of a tricycle so that passengers can easily read them.
c. Tricycle - a public utility vehicle, a motorized tricycles, or simply tricycles (known inthe rest of the world as a motorcycle and sidecar), a common means of public orprivate transportation in the Philippines.
d. Passenger Capacity/Limit - allow and accept only one (1) passenger per trip who shallbe seated in the sidecar at all times to ensure that physical distancing is followed.
SECTION 4. FARE FOR PUBLIC UTILITY TRICYCLE-FOR HIRE — A public utility tricyclemay charge a passenger a minimum fare of TWENTY FIVE PESOS (Php. 25.00) for a distancenot exceeding Two (2) kilometers and an additional FIVE PESOS (Php. 5.00) for everysucceeding kilometers thereafter.

The Federation of Tricycle Operators and Drivers Association (FETODA) must ensurethat each TODA must be provided with corresponding Fare Matrix of every franchise routeswhich shall be posted conspicuously inside the sidecar of its members tricycle, signed by theFETODA President and SangguniangPanlungsod Committee Chairman of Energy andTransportation.
The fare established herein shall be effective only while the Community Quarantine is ineffect or any strict community quarantine to be imposed by the national and local governmentand pursuant to the guidelines to be established by the DOTr.
SECTION 5. PENALTIES — Any violation on the provisions under this ordinance shall bepenalized as follows:

SECTION 6. MONITORING AND APPREHENSION — For the implementation of thisordinance, the following shall be deputized as the enforcing agency or office (a) City TrafficManagement and Enforcement Unit (CTMEU) and (b) the City of Santa Rosa -Philippine NationalPolice (PNP).
SECTION 7. SUNSET PROVISION — This ordinance shall be automatically repealed and/orrevoked once the situation returns to normal as declared by the authorities with finality.Declaration from the Department of Health (DOH) and from the Inter-Agency Task Force(IATF), placing the province of Laguna as free from Covid-19 infection and contamination,thereby lifting the rules and regulations on social-physical distancing. Upon such declaration,the KAUTUSANG PANLUNGSOD BLG. 1412-2005, shall be automatically implemented.
SECTION 8. SEPARABILITY CLAUSE -If for any reason, any section or provision of thisOrdinance is declared unconstitutional or invalid, the other sections or provisions thereof whichare not affected shall continue to be in full force and effect.
SECTION 9. REPEALING CLAUSE — Any ordinance, rules and regulations and/or partsthereof inconsistent with the provisions of this ordinance are hereby repealed and/or modifiedaccordingly.
SECTION 10. EFFECTIVITY CLAUSE — This ordinance shall take effect immediately upon itsapproval and in accordance with the provisions of the Local Government Code.
ENACTED: This 12th day of August, 2020 in the City of Santa Rosa, Laguna.
