RATIONALE The Red Line Fleet comprises 104 cars (52 married-pairs) of which 30 cars are categorized as Base-Buy (DC Propulsion) and 74 cars are categorized as Option Buy (AC Propulsion).These Breda A650 (Option) Heavy Rail Vehicles (HRV) are in their fourteenth year of operation. To ensure a continued level of safety and reliability, we overhaul the friction brake system equipment consistent with the Original Equipment Manufacturer's (OEM) suggested overhaul interval every four years. Wear and tear on these units in normal service requires both ongoing maintenance, which is performed by our personnel, and periodic overhaul, which is beyond the level of in-house maintenance capability. The overhaul process is divided into two major aspects. The first one is the removal, and installation of brake parts and assemblies from and onto the vehicle. This aspect is performed in-house by our union employees. The other aspect is the removed parts and assemblies will be sent to Wabtec where they are cleaned, replaced, and tested at its location because the Red Line facility has never been setup with this capacity. Wabtec will warrant the overhauled parts for one year. The tentative implementation schedule is one married-pair (2 cars) per month. The contract sum only covers the Option Buy vehicle which is 37 married-pairs. The overhaul of brake system of Base-Buy vehicle is not included and they will be overhauled during the Mid-Life Modernization Program.

SUBJECT: FRICTION BRAKE OVERHAUL - RED LINE CARS

ACTION: AWARD A CONTRACT FOR FRICTION BRAKE OVERHAUL

RECOMMENDATION

Authorize the Chief Executive Officer to award a two-year firm fixed-price unit rate contract under Bid No. 10-0029 to Wabtec Passenger Transit, the single lowest responsive and responsible bidder, for the overhaul of Metro Red Line heavy rail vehicle friction brake system equipment for an amount not to exceed $1,500,928.

RATIONALE

The Red Line Fleet comprises 104 cars (52 married-pairs) of which 30 cars are categorized as Base-Buy (DC Propulsion) and 74 cars are categorized as Option Buy (AC Propulsion).These Breda A650 (Option) Heavy Rail Vehicles (HRV) are in their fourteenth year of operation. To ensure a continued level of safety and reliability, we overhaul the friction brake system equipment consistent with the Original Equipment Manufacturer's (OEM) suggested overhaul interval every four years. Compliance with these overhaul specifications helps provide safe and reliable HRV operation, prolongs equipment life, and increases the Mean Time Between Failures (MTBF). The contractor will perform services in accordance with our specifications and the Rail Fleet Services' scheduled requirements.

FINANCIAL IMPACT

The funding of $324,525 for this procurement is included in the FYI I budget in Rail Cost Center 3942, Rail Fleet Services Maintenance Red Line, under project number 300044, Rail Operations - Red Line, Line Item 50441, MIS Parts - Rev Vehicle. Since this is a multi-year contract, the cost center manager and Chief Operations Officer will be accountable for the budget cost in the future fiscal years. In FY10, no funds were expended on this category for overhauls.

Impact to Bus and Rail Operating and Capital Budnet

The funding for this acquisition will come from the rail operating budget comprised primarily of fares, Prop A 35%, Federal 5309, and Prop C 40%. These funds are eligible to be used for rail operations and rail capital projects. No other sources of funds were considered for this project because these are the designated funds available for rail operations. This procurement is part of the on-going maintenance costs of the rail program.

ALTERNATIVES CONSIDERED

An alternative is not to perform the overhaul. This would compromise safety and reliability of the entire rail-car fleet. Unscheduled maintenance repairs for this system on a component per component level per assembly will result in higher expenditures for the agency versus scheduled and planned maintenance.

FRICTION BRAKE OVERHAUL - RED LINE CARS

A. Backnround on Contractor

Wabtec Passenger Transit Corporation (Wabtec) was formed in November 1999 when Westinghouse Air Brake Company merged with Motive Power Industries, Inc. The original Westinghouse Air Brake Co. was founded in 1869. Wabtec is a manufacturer of a vast array of pneumatic, electronic and mechanical devices such as braking equipment, controllers, current collectors and couplers for the transit industry worldwide, and has been providing rail equipment and services in the United States for 130 years.

Wabtec is the Original Equipment Manufacturer (OEM) of the Breda A650's HRV brake equipment and has provided equipment and services for various government and transit agencies, e.g., Caltrans and MetrolinkILos Angeles. In the past, it has also performed satisfactory work for the Metro Red Line High Rail Vehicle brake system equipment overhaul.

B. Procurement Backnround

Invitation for Bid (IFB) No. 10-0029 was released on December 16, 2009 and advertised on December 16,2009. The bid deadline was February 11,2010. 13 firms requested and received the IFB solicitation package and one firm submitted a bid prior to the stated deadline.

Staff inquiries of the other potential firms indicated that the firms could not meet the requirements of the Technical Specifications in a cost effective manner. None of the potential bidders have a local presence, Wabtec, the firm recommended for award, is located in the Los Angeles area and utilizes a certified DBE firm to provide the personnel that will perform various services required in the brake overhaul process.

The Diversity & Economic Opportunity Department (DEOD) did not recommend a DALP goal for this procurement; however, Wabtec is affording subcontracting opportunities to a DBE firm.

C. Evaluation of Proposals

In accordance with our Procurement Policy Manual, staff performed an evaluation of the bid that was received. Wabtec Passenger Transit's bid was found to be in full compliance with the terms and conditions of the solicitation. Wabtec was determined to be a responsible bidder capable of performing the services per MTA's requirements.

D. CostlPrice Analysis Explanation of Variances

The recommended bid amount of $1,500,928 is the result of an open competitive bid process in a competitive environment, and the bidder prepared its bid in the expectation of adequate price competition. Both MTA and the supplier anticipated there would be more than one acceptable bid submitted. Pricing reflects this anticipated competition.

The bid price has been determined to be fair and reasonable based upon a price analysis conducted by staff. The price analysis compared the price offered by Wabtec to the pricing on current contracts for the GreenIGold and Blue Line light rail vehicles' friction brake overhaul which was determined to be reasonable by a price analysis performed by staff.
