GLOSSARY OF ABSTRACT TERMS
Assembly: Meeting of delegates of a political party held to designate candidates for nomination at a primary election.Assemblies are held every two years.
Convention: Meeting of delegates of a political party held to select delegates to other political conventions and to nominatePresidential Electors. Such Conventions are held every four years
OrMeeting of delegates of a political party held for the purpose of nominating a candidate for a congressional vacancy election.Held as needed.
Initiative: The Colorado Constitution provides that registered voters may propose Constitutional Amendments or changesto the Colorado Revised Statutes (CRS) by petition. Title 1, Article 40, CRS, provides specific procedures for submittinginitiative petitions. Petitions require signatures of registered electors in an amount equal to 5% of the votes cast for allcandidates for the office of Secretary of State at the previous General Election.
Referendum: The General Assembly may propose Constitutional Amendments or refer changes in the statutes to thepeople. In addition, the Colorado Constitution provides that a referendum may be ordered against any act of the GeneralAssembly, except laws necessary for the immediate preservation of the public peace, health, or safety and appropriations forthe support and maintenance of departments of state and state institutions. Referenda initiated by the people requiresignatures of registered electors in an amount equal to 5% of the votes cast for all candidates for the office of Secretary ofState at the previous General Election.
Referendum petitions must be filed with the Secretary of State not more than 90 days after the final adjournment of thesession of the General Assembly that passed the bill on which the referendum is demanded.
Governor/Lieutenant Governor: The Governor and Lieutenant Governor for the two major parties run as individualsduring the Primary Elections. During the General Election the members elected or nominated by their respective parties runon the same ticket. In the 1998 General Election the following individuals ran on the same tickets:

Retention of Judges: Article VI, Section 25 of the Colorado Constitution provides that a Justice of the Supreme Court or ajudge of any other court of record, who shall desire to retain his judicial office shall file with the Secretary of State not morethan 6 months nor less than 3 months prior to the General Election next prior to the expiration of his/her then term of office, aDeclaration of Intent to run for another term. The question on the ballot shall be “Shall Justice (Judge) of the_________________ be retained in Office? _____Yes _____No”

Amendment 11Partial-Birth AbortionTitle
An amendment to the Colorado Revised Statutes concerning a prohibition against partial-birth abortions, and, in connectiontherewith, specifying that no one shall knowingly or intentionally perform a partial-birth abortion; allowing a medicalprocedure to prevent the death of the pregnant woman, if every reasonable effort is made to preserve the lives of the womanand the infant; defining partial-birth abortion as an abortion during which the person performing the abortion deliberately andintentionally causes to be delivered into the vagina a living human fetus or any substantive portion thereof for the purpose ofperforming any procedure the person knows will kill the fetus and kills the fetus before completing delivery; specifying that"fetus" and "infant" mean the biological offspring of human parents and may be used interchangeably throughout themeasure; establishing specified civil remedies for certain persons; establishing criminal penalties for violations after February14, 1999; and stating that the amendment cannot be amended except by a vote of the people.
Amendment 12Parental Notification for AbortionTitle
An amendment to the Colorado Revised Statutes concerning parental notification when an unemancipated minor seeks anabortion, and, in connection therewith, specifying that no abortion shall be performed upon an unemancipated minor until atleast 48 hours after written notice of the pending abortion has been delivered to the parent of the minor; identifyingexceptions to the notice requirement; defining abortion as the use of any means to terminate the pregnancy of a minor withknowledge that the termination by those means will, with reasonable likelihood, cause the death of that person's unbornoffspring at any time after fertilization; establishing criminal penalties for performing an abortion in violation of therequirement to provide notice to the parent and for counseling a minor to furnish a physician with false information to inducethe physician to perform an abortion without providing the notice; and establishing a judicial bypass provision, which shallbe effective under certain circumstances, pursuant to which a court may determine that giving the notice will not be in thebest interests of the minor or that the minor is sufficiently mature to decide whether to have the abortion.
Amendment 13Uniform Regulation of Livestock OperationsTitle
An amendment to the Colorado Constitution requiring the uniform application of laws to livestock operations, and, inconnection therewith, mandating that laws and regulations concerning livestock operations be uniform and based upon thesimilarity in the potential impact on the environment of the livestock operation; making unconstitutional any state law orregulation that does not treat livestock operations uniformly based upon the similarity in the potential impact on theenvironment of the livestock operation; allowing the general assembly to make a distinction between livestock feeding on therange and livestock feeding in a concentrated animal feeding operation; permitting the general assembly to make a distinctionbetween concentrated animal feeding operations that are smaller than one thousand animal units and those that are larger thanone thousand animal units; specifying that one animal unit be considered to be a cow and all other livestock to be fractions ofa cow as determined by the general assembly; and defining livestock as cattle, sheep, goats, swine, mules, poultry, horses,and all other animals raised or kept for profit.

Amendment 14Regulation of Commercial Hog FacilitiesTitle
An amendment to the Colorado Revised Statutes concerning regulation of housed commercial swine feeding operationswhich can house 800,000 or more pounds of swine or which aredeemed commercial under local law, and, in connection therewith, conditioning operation, construction, or expansion of ahoused commercial swine feeding operation on receipt of an individual discharge permit from the department of public healthand environment; directing the water quality control commission to adopt rules regarding the construction, operation, andmanagement of and waste disposal by such operations; providing that such rules shall require that land application of wastefrom such operations shall not exceed the nutritional requirements of the plants on that land and shall minimize runoff andseepage of such waste; providing that such rules shall require that such operations not be permitted to degrade the physicalattributes or value of state trust lands, make immediate reports of spills or contamination to state and county healthdepartments, and monitor land-applied waste from such operations and report thereon to the state health department;authorizing fees on such operations to offset direct and indirect costs of the program; authorizing local governments toimpose more restrictive requirements; requiring that such operations employ technology to minimize odor emissions;requiring operations to cover waste impoundments that do not use air or oxygen in their waste treatment method, and torecover, incinerate, or manage odorous gases therefrom; establishing minimum distances between new land waste applicationsites or impoundments and occupied dwellings, schools, and municipal boundaries; and providing for enforcement of theseprovisions by the state or any person who may be adversely affected.
Amendment 15Water Meters in the San Luis ValleyTitle
An amendment to the Colorado Revised Statutes concerning a requirement for the installation of water flow meters on anynonexempt well in the unconfined aquifer in Water Division 3 (which is located in whole or in part in Conejos, Alamosa, RioGrande, Mineral, Saguache, and Costilla counties) on or before April 1, 1999, and, in connection therewith, requiring that thewater flow meters be certified by the state engineer; requiring the state engineer to read the water flow meters monthly at thewell owner's expense; and directing the state engineer to prevent the operation of any well that does not have a functioningwater flow meter.
Amendment 16Payments for Water by theRio Grande Water Conservation DistrictTitle
An amendment to the Colorado Constitution requiring the Rio Grande Water Conservation District, which is located in wholeor in part in Conejos, Alamosa, Rio Grande, Mineral, and Saguache counties, to pay fees for all water that has been, is being,or will in the future be pumped from aquifers underlying state trust lands pursuant to Water Decree W-3038 in WaterDivision 3 (including all or part of Conejos, Alamosa, Rio Grande, Mineral, Saguache, and Costilla counties) for purposes ofthe "Closed Basin Project", and, in connection therewith, setting such fees at thirty dollars per acre-foot, payable to the state'spublic school fund, and ten dollars per acre-foot, payable to the school districts in Water Division 3, based upon the StateDepartment of Education's student count for such districts; directing the State Auditor to determine the amounts of such feespayable each year and requiring payment of such amounts within thirty days after such determination, subject to interest ateighteen percent on late payments; requiring the Rio Grande Water Conservation District to assess those irrigators withwater rights in the Rio Grande River, in proportion to their water right, an amount equal to the amount of water used andattributable to the water pumped from beneath such state trust lands; and providing that monies paid to the school districts inWater Division 3 shall be in addition to monies made available for public school children and shall not be considered by thegeneral assembly when determining such amount.

Amendment 17Income Tax Credit for EducationTitle
An amendment to the constitution of the state of Colorado concerning the establishment of an income tax credit for parents orlegal guardians of children enrolled in public, non-public schools and non-public home-based educational programs, and, inconnection therewith, requiring the general assembly to establish an income tax credit for income tax years beginning in1999; specifying the methods for determining the amount of such credit; establishing priorities for eligibility for such credit;establishing an educational opportunity fund to be used to offset the entire costs of such credit; prohibiting reductions incurrent per-student public school expenditures as a result of the measure or as a result of the transfer of students to non-publicschools; prohibiting the state or any political subdivision thereof from using this section to increase their regulatory role overthe education of children in non-public schools beyond that exercised and existent on January 1, 1998; and eliminatingeligibility for the income tax credit of parents or legal guardians who send children to certain non-public schools, includingthose that illegally discriminate on the basis of race, ethnicity, color or national origin or teach hatred.
Amendment 18Voluntary Congressional Term LimitsTitle
An amendment to the Colorado Constitution concerning term limits declarations that may be voluntarily submitted bycandidates for the U.S. Congress, and, in connection therewith, specifying when such declarations must be submitted to thesecretary of state; providing that a candidate shall not be refused placement on the ballot if the candidate does not submit adeclaration; providing that candidates may voluntarily declare that the candidate will not serve more than three terms as aU.S. Representative or more than two terms as a U.S. Senator or may voluntarily declare that the candidate has chosen not toaccept term limits; allowing candidates who have made such a declaration to voluntarily authorize placement of an applicableballot designation next to the candidate's name on congressional election ballots and government-sponsored voter educationmaterial; specifying how terms are calculated; allowing candidates to change a declaration; requiring that ballots and votereducation material contain the applicable ballot designation following the name of a candidate; specifying that service inoffice for more than one-half of a term is deemed service for a full term; prohibiting a candidate from having more than onedeclaration and ballot designation in effect at the same time; specifying that a candidate may authorize the applicable ballotdesignation only if the candidate has made the voluntary declaration; and authorizing the secretary of state to providedeclarations and implement this amendment by rule.

Una enmienda a los Estatutos Revisados del Estado de Colorado con respecto a una prohibición del aborto de partointerrumpido y, en relación con la misma, para especificar que nadie podrá a sabiendas o intencionalmente realizar un abortode parto interrumpido; para permitir un procedimiento a fin de impedir la muerte de una mujer embarazada, siempre que setomen todas las medidas razonables para salvar las vidas de la mujer y el bebé; para definir el aborto de partointerrumpido como un aborto durante el cual la persona que realiza el aborto ocasiona, a propósito e intencionalmente, elpaso de un feto vivo o una porción sustancial del mismo en la vagina con el propósito de realizar cualquierprocedimiento que dicha persona sabe que matará al feto, y que efectivamente mata al feto antes de completar el parto; paraespecificar que los terminos "feto" y "bebé" significa el hijo/a biológico de padres humanos y podrán usarsede modo intercambiable en toda la medida; para establecer remedios civiles específicos para ciertas personas; para establecersanciones penales para violaciones después del 14 de febrero de 1999; y para establecer que la enmienda no podrá sermodificada excepto mediante el voto del pueblo.

Una enmienda a la constitución del estado de Colorado para exigir la aplicación uniforme de leyes a las operaciones deganado y, en relación con la misma, disponer que las leyes y regulaciones relacionadas con las operaciones de ganadosean uniformes y basadas en la similitud del potencial impacto en el medio ambiente de la operación de ganado; declararanticonstitucional cualquier ley o regulación estatal que no trate las operaciones de ganado de modo uniforme, enbase a la similitud en su potencial impacto en el medio ambiente de la operación de ganado; permitir que la asamblea generaldistinga entre las operaciones de alimentación concentrada de animales inferiores a mil unidades animales y las que seansuperiores a mil unidades animales; especificar que una unidad animal se considera una res, y que todo el ganado restante seconsidera una fracción de una res según determine la asamblea general; y definir el ganado como el ganado vacuno, ganadoovino, ganado cabrío, ganado porcino, los burros, las aves de corral, el ganado caballar y todos los demás animales criados omantenidos con fines de lucro.
Titúlo y Texto De La Propuesta - Enmienda 14 - Regulación de las operaciones comerciales de ganado porcino
Una enmienda a los Estatutos Revisados del Estado de Colorado en relación a la regulación de las operaciones comerciales dealimentación del ganado porcino, que pueden albergar 800,000 ó más libras de cerdos o lo que se haya determinadocomo una operación comercial bajo la legislación local, y, en relación con la misma, para condicionar la operación,construcción o ampliación de una operación de alimentación de ganado porcino albergado en la obtención previa de unpermiso individual de descarga del departamento de salud pública y del medio ambiente; para ordenar a la comisión decontrol de calidad del agua que adopte reglas con respecto a la construcción, operación y administración del desecho deresiduos de dichas operaciones; para estipular que dichas reglas requieran que la aplicación terrestre de residuos de dichasoperaciones no excederá los requisitos nutritivos de las plantas que crecen en esos terrenos y que minimizará la escorrentía yfiltración de dichos residuos; para estipular que esas reglas establezcan que dichas operaciones no deberán mermar losatributos físicos o el valor de las tierras fiduciarias estatales, que se reporten inmediatamente a los departamentos de saludestatal y del condado acerca de derrames o contaminación y que se monitoree la aplicación terrestre de residuos de dichasoperaciones y se le informe al departamento de salud pública estatal; para autorizar las cuotas sobre dichas operaciones paracompensar los costos directos e indirectos del programa; para autorizar a los gobiernos locales a imponer requerimientos másrestrictivos; para exigir que dichas operaciones empleen tecnología que reduzca al mínimo las emisiones de olores; paraexigir que los operadores cubran los depósitos de residuos en cuyo método de tratamiento no se use aire u oxígeno, y querecuperen, incineren o administren los gases olorosos emanados de los mismos; para establecer distancias mínimasentre nuevos sitios de aplicación terrestre o depósitos de residuos y las residencias ocupadas, escuelas y lindes municipales; ypara estipular la ejecución de estas disposiciones por el estado o por cualquier persona que pudiere verse adversamenteafectada.

Una enmienda a los Estatutos Revisados de Colorado en relación con un requisito de instalación de flujómetros de agua encualquier pozo no exento en el acuífero no confinado de la división de agua 3 (situada total o parcialmente en loscondados de Conejos, Alamosa, Río Grande, Mineral, Saguache y Costilla) en o antes del 1º de abril de 1999 y, en relacióncon la misma, para exigir que los flujómetros de agua sean certificados por el ingeniero del estado; para exigirque el ingeniero del estado tome lecturas mensuales de los flujómetros de agua por cuenta del dueño del pozo; y para ordenaral ingeniero del estado que impida la operación de cualquier pozo que no tuviere un flujómetro de agua en funcionamiento.
Titúlo y Texto De La Propuesta - Enmienda 16 - Pagos por agua por el Distrito de Conservación de Agua de RíoGrande
Una enmienda a la Constitución de Colorado para exigir que el Distrito de conservación del agua de Río Grande, situado totalo parcialmente en los condados de Conejos, Alamosa, Río Grande, Mineral y Saguache, pague cuotas por toda el agua quehaya sido, esté siendo o vaya a ser bombeada en el futuro de los mantos acuíferos subterráneos localizados en las tierrasfiduciarias del estado, conforme al Decreto del agua W-3038 en la División del agua 3 (incluyendo a todos o parte de loscondados de Conejos, Alamosa, Río Grande, Mineral, Saguache y Costilla), para cumplir con los fines del "Proyecto decuenca cerrada" y, en relación con el mismo, para establecer las cuotas que ascienden a treinta dólares por acre-pie, pagaderasal fondo de escuelas públicas del estado, y a diez dólares por acre-pie, pagaderas a los distritos escolares dentro de la Divisióndel agua 3, tomando como base el conteo de estudiantes del Departamento de educación del estado para dichos distritos; paraordenar al Auditor del estado que determine los montos de tales cuotas pagaderos cada año y para exigir el pago de esosontos dentro de los treinta días después de dicha determinación, sujetos a un interés del dieciocho por ciento sobreretrasos; para exigir que el Distrito de conservación del agua de Río Grande imponga un gravamen a los regadores conderechos de uso del agua en el Río Grande, que sea proporcional a sus derechos de uso del agua, equivalente a lacantidad de agua usada y atribuible al agua bombeada desde abajo de dichas tierras fiduciarias del estado; y para permitir queel dinero pagado a los distritos escolares en la División del agua 3 se agregue al dinero que se ha dispuesto para los niños queasisten a las escuelas públicas y que no deberá ser considerado por la asamblea general cuando se determinen dichos montos.

Una enmienda a la Constitución del Estado de Colorado con respecto al establecimiento de un crédito tributario para lospadres o tutores legales de menores inscritos en escuelas públicas, no públicas y programas escolares no públicos en el hogary, en relación con la misma, para exigir que la asamblea general establezca un crédito tributario para los ejercicios fiscalescomenzando en 1999; para especificar los métodos para determinar el importe de dicho crédito; para establecer lasprioridades de elegibilidad para dicho crédito; para establecer un fondo de oportunidad docente a usarse para compensar elcosto total de dicho crédito; para prohibir reducciones en los gastos actuales por estudiante de escuelas públicas comoconsecuencia de la medida, o como resultado de la transferencia de estudiantes a escuelas no públicas; para prohibir alestado o a cualquier subdivisión política del mismo que use esta sección para ampliar su función regulatoria sobre laeducación de los menores en escuelas no públicas en exceso de la que ya se ejerce y en existencia al 1º de enero de1998; y para eliminar la elegibilidad para el crédito tributario de los padres o tutores legales que envíen los menores a ciertasescuelas no públicas, entre ellas las que discriminen ilegalmente en base a raza, origen étnico, color u origen nacional o queenseñen la doctrina del odio.

Una enmienda de la Constitución de Colorado con respecto a declaraciones de límites de términos de servicio que podrán sersometidas voluntariamente por los candidatos al congreso de EE.UU., y en relación con la misma, para especificarcuándo deben someterse dichas declaraciones ante el secretario del estado; para estipular que no se negará a un candidato lainclusión en la balota si dicho candidato no somete una declaración; para estipular que los candidatos podrándeclarar voluntariamente que el candidato no fungirá más de tres términos de servicio como representante de EE.UUu., nimás de dos términos de servicio como senador de EE.UU., o que podrán declarar voluntariamente que el candidato haelegido no aceptar los límites de términos de servicio; para permitir que los candidatos que hayan hecho tal declaraciónautoricen voluntariamente la inclusión de una designación de balota pertinente al lado del nombre de dicho candidato en lasbalotas de elecciones congresionales y materiales informativos para votantes patrocinados por el gobierno; para especificarcómo se calculan los términos de servicio; para permitir que los candidatos cambien de declaración; para exigir que lasbalotas y los materiales informativos de los votantes contengan la designación de balota pertinente después del nombre de uncandidato; para especificar que el servicio durante más de una mitad de un término de servicio oficial se considera el serviciopor el término de servicio completo; para prohibir que un candidato tenga más de una declaración y designación de balota envigor al mismo tiempo; para especificar que un candidato sólo podrá autorizar la designación de balota aplicable si dichocandidato hubiere hecho la declaración voluntaria; para autorizar al secretario de estado que proporcione declaraciones eimplemente esta enmienda por regla.
