1. The Advisory Committee agrees with the Commission that the addressees of the draft decision haveparticipated in agreements and/or concerted practices within the meaning of Article 81(1) of theEC Treaty and Article 53 of the EEA Agreement.

2. The Advisory Committee agrees with the Commission's assessment of the product and the geographicscope of the agreement and/or concerted practice.

3. The Advisory Committee agrees with the Commission that the addressees of the draft decision haveparticipated in a single and continuous infringement.

4. The Advisory Committee agrees with the Commission that the agreement and/or concerted practicebetween professional videotape suppliers in the EEA were capable of having an appreciable effect upontrade between Member States.

5. The Advisory Committee agrees with the Commission that the object and the effect of the agreementand/or concerted practice was to restrict competition within the meaning of Article 81(1) of theEC Treaty and Article 53 of the EEA Agreement.

6. The Advisory Committee agrees with the Commission's assessment on the addressees of the draft deci-sion, specifically with reference to imputation of liability to parent companies of the groups concerned.

7. The Advisory Committee agrees with the Commission's assessment on aggravating circumstances.

8. The Advisory Committee agrees with the Commission's assessment on mitigating circumstances.

9. The Advisory Committee agrees with the Commission on the application of the 2002 Leniency Notice.

10. The Advisory Committee recommends the publication of its opinion in the Official Journal of theEuropean Union.

11. The Advisory Committee asks the Commission to take into account other points raised during thediscussion.

The draft decision gives rise to the following observations:

Introduction

In May 2002, the Commission carried out inspections at premises belonging to members of the Sony, Fujiand Maxell groups in five Member States. Following these inspections leniency applications were submittedand the Commission carried out further investigation. The Commission came to the preliminary conclusionthat Fuji, Maxell and Sony discussed and entered into agreements and/or concerted practices in violation ofArticle 81 of the EC Treaty and Article 53 of the Agreement on the European Economic Area with a viewto increasing and maintaining or stabilising prices for two formats of professional videotapes, Betacam SPand Digital Betacam, in the EEA, and also exchanged information to facilitate and/or monitor their imple-mentation from at least as early as 23 August 1999 and at least until 16 May 2002.

Statement of Objections and the time to reply

On 8 March 2007 the Commission initiated proceedings and adopted a Statement of Objections (‘SO’). Theaddressees of the SO were Sony France SA and its parent companies Sony Europe Holding BV, SonyCorporation (hereinafter jointly referred to as ‘Sony’), FUJIFILM Recording Media GmbH and its parentcompanies FUJIFILM Corporation and FUJIFILM Holdings Corporation (hereinafter jointly referred to as‘Fuji’) and Maxell Europe Limited and its parent company Hitachi Maxell Limited (hereinafter jointly referredas ‘Maxell’).

The addressees received the SO between 13 and 16 March 2007, with a two-month deadline to reply. Upontheir reasoned requests, I granted extensions to Fuji and Sony until 16 and 21 May 2007, respectively. Allparties replied in due time.

Access to file

The parties had access to the Commission file in the form of CD-ROMs which they received together withthe SO. None of the parties addressed any issues relating to access to file to me.

Maxell's leniency application

On 10 April 2007, Maxell applied for leniency under the terms of the 2002 Leniency Notice (1) which wassent to the other parties.

Oral hearing

An oral hearing was held on 12 June 2007. All addressees of the SO attended the oral hearing andpresented their views.

The draft decision

In the draft decision, the Commission included a favourable assessment of Maxell's leniency application,stating that Maxell's reply corroborated to a very significant extent to the interpretation of the facts, andgranted a reduction of the fine which otherwise would have been imposed on Maxell.

The draft decision is the first Commission decision in which the 2006 Guidelines on fines (1) are applied.

The draft decision submitted to the Commission only contains objections in respect of which the partieshave been afforded the opportunity of making known their views.

I conclude that the rights of the parties to be heard have been respected in the present case.

I. INTRODUCTION

(1) On 20 November 2007, the Commission adopted a deci-sion relating to a proceeding under Article 81 of theEC Treaty and Article 53 of the EEA Agreement. Inaccordance with the provisions of Article 30 of CouncilRegulation (EC) No 1/2003 (1), the Commission herewithpublishes the names of the parties and the main contentof the decision, including any penalties imposed, havingregard to the legitimate interest of undertakings in theprotection of their business secrets. II. CASE DESCRIPTION

1. Procedure

(2) This case started as an ex officio investigation with dawnraids on 28 and 29 May 2002 at a total of elevenpremises belonging to members of the Sony, Fuji andMaxell groups in five Member States. Two incidentsoccurred at Sony's premises, one involving the destructionof documents, the other a refusal to reply to questions.

(3) On 5 December 2006, Fuji formally applied for a reduc-tion of fines under the 2002 Leniency Notice (2). Itsapplication made reference to information previouslysubmitted to the Commission since June 2002. By letterof 23 February 2007, the Commission informed Fuji ofits intention to grant Fuji a reduction of 30 to 50 % ofthe fine under the 2002 Leniency Notice.

(4) The Statement of Objections was adopted on 8 March2007 and notified to all the parties by 16 March 2007.

(5) On 10 April 2007 Maxell formally applied for a reductionof fines under the 2002 Leniency Notice. Its applicationmade reference to information previously submitted to theCommission since October 2004.

(6) An oral hearing was held on 12 June 2007.

2. Summary of the infringement

(7) TV-stations and independent producers of TV-content andadvertising films are the main customers of professionalvideotape. The decision concerns only the two mostpopular professional videotape formats at the time of theinfringement: Betacam SP and Digital Betacam, whichtogether represented 77 % of all professional videotapesales in the EEA in 2001. The estimated EEA market valuefor these two formats was approximately EUR 118 millionin 2001. For that year, the three undertakings involved inthe infringement held an estimated market share of 89 %.

(8) The decision concludes that Sony, Fuji and Maxell oper-ated between 23 August 1999 and 16 May 2002 a cartelwith a view to increasing and maintaining or stabilisingprices for Betacam SP and Digital Betacam videotape inthe EEA market, and also exchanged information to facili-tate and/or monitor their implementation.

(9) The companies organised three (successful) rounds ofprice increases and otherwise endeavoured to stabilise theprices. They also regularly discussed past and forthcomingtenders, typically from public and private TV-stations.

(10) There were 11 meetings between representatives of thethree undertakings during the period of the infringement,in all of which they discussed and agreed prices and/orexchanged sensitive commercial information, as well ascontinuous contacts between meetings to discuss pricesand specific clients and to follow-up the implementationof the cartel agreements.

(11) The decision further concludes that it has been establishedthat the agreements on prices were generally imple-mented.

3. Addressees

(12) The decision is addressed to the following legal entities,which belong to the three participating undertakings(Sony, Fuji and Maxell):

(b) Sony Europe Holding BV;

(g) Hitachi Maxell, Ltd; and

(h) Maxell Europe Limited.

(13) Liability of the ultimate parent companies is establishedboth because of their direct participation in one of thecartel meetings, which was held in Japan, and on the basisof the presumption of the exercise of decisive influenceover their wholly-owned subsidiaries, which is reinforcedby several additional indicia.

4. Remedies

(14) This is the first cartel case in which the 2006 Guidelineson Fines (1) have been applied.

4.1. Basic amount of the fine

(15) The basic amount of the fine is determined as a propor-tion of the value of the sales of the relevant product madeby each undertaking in the relevant geographic areaduring the last full business year of the infringement(‘variable amount’), multiplied by the number of years ofinfringement, plus an additional amount (‘entry fee’), alsocalculated as a proportion of the value of sales, which ismeant to enhance deterrence in respect of horizontalprice fixing agreements.

(16) Having considered different factors, in particular thenature, the combined market share and the geographicscope of the infringement, the decision applies in this casea variable amount of 18 % and an entry fee of 17 %.

(17) Taking into account that the infringement lasted for atleast 2 years and 8 months, the variable amount is multi-plied by 3.

4.2. Adjustments to the basic amount

4.2.1. Aggrava t ing c i r cumstances : r e fusa l tocoopera te or obs t r uc t ion

(18) As mentioned in paragraph 2, two separate incidentsoccurred at Sony's premises during the inspection. Thedecision concludes that both incidents constitutedobstruction and justify an increase of 30 % in the basicamount imposed on Sony.

4.2.2. Mi t iga t ing c i r cumstances

(19) The parties argued for the application of a series of miti-gating circumstances such as early termination of theinfringement, limited involvement in the infringement,effective co-operation outside the Leniency Notice, isolatedand unauthorized conduct without senior management'sknowledge and introduction of a compliance programafter the infringement. These claims are all rejected.

4.2.3. Spec i f i c inc rease for de te r r ence

(20) Taking into account the need to ensure that fines have asufficiently deterrent effect, and in consideration of thelarge size of Sony's turnover beyond the sales of goods orservices to which the infringement relates, the decisionincreases the fine to be imposed to this undertakingby 10 %.

4.3. Application of the 10 % turnover limit

(21) The 10 % worldwide turnover limit provided for inArticle 23(2) of Regulation (EC) No 1/2003 is not attainedin respect of the fine to be imposed on any of the under-takings.

4.4. Application of the 2002 Leniency Notice: reduction offines

(22) As mentioned under paragraphs 5 and 6 above, both Fujiand Maxell filed applications for a reduction of finesunder the 2002 Leniency Notice.

(23) The decision grants a reduction of the fine of 40 % forFuji and 20 % for Maxell. These percentages of reductiontake into account the extent to which the evidencesubmitted by each company represented added value, aswell as the time at which this evidence was submitted.

(24) Sony's contribution to this case was limited to notcontesting most of the facts after having received theStatement of Objections. The decision concludes that thisdoes not constitute significant added value under theLeniency Notice.

III. DECISION

(25) The following undertakings infringed Article 81 of theTreaty and Article 53 of the EEA Agreement by partici-pating, from 23 August 1999 until 16 May 2002, in acomplex of agreements and concerted practices with aview to increasing and to maintaining or stabilising pricesfor Betacam SP and Digital Betacam videotape in the EEAmarket:

(a) Sony Corporation;

(b) Sony Europe Holding BV;

(c) Sony France SA;

Annotated presentation of regulated markets and national provisions implementing relevantrequirements of ISD (Council Directive 93/22/EEC)

Article 47 of the Markets in Financial Instruments Directive (Directive 2004/39/EC of the European Parlia-ment and of the Council, OJ L 145, 30.4.2004, p. 1) authorises each Member State to confer the status of‘regulated market’ on those markets constituted on its territory and which comply with its regulations.

Article 4, paragraph 1, point 14 of Directive 2004/39/EC defines a ‘regulated market’ as a multilateralsystem operated and/or managed by a market operator, which brings together or facilitates the bringingtogether of multiple third-party buying and selling interests in financial instruments — in the system and inaccordance with its non-discretionary rules — in a way that results in a contract, in respect of the financialinstruments admitted to trading under its rules and/or systems, and which is authorized and functions regu-larly and in accordance with the provisions of Title III of Directive 2004/39/EC.

Article 47 of Directive 2004/39/EC requires that each Member State maintains an updated list of regulatedmarkets authorised by it. This information should be communicated to other Member States and the Euro-pean Commission. Under the same article (Article 47 of Directive 2004/39/EC), the Commission is requiredto publish a list of regulated markets, notified to it, on a yearly basis in the Official Journal of the EuropeanUnion. The present list has been compiled pursuant to this requirement.

The attached list indicates the title of the individual markets which are recognised by national competentauthorities as complying with the definition of ‘regulated market’. In addition, it indicates the entity respon-sible for managing these markets and the competent authority responsible for issuing or approving the rulesof the market.

As a result of reduced entry barriers and specialisation in trading segments, the list of ‘regulated markets’ issubject to greater turnover than under the Council Directive 93/22/EEC on investment services. Article 47of the Markets in Financial Instruments Directive also requires the European Commission to publish the listof regulated markets on its website and to update it regularly.

Consequently, the European Commission will, in addition to yearly publication of a list in the OfficialJournal, maintain an updated version of this list on its official website (http://ec.europa.eu/internal_market/securities/isd/mifid_en.htm). This list will be updated regularly on the basis of information communicated bynational authorities. The latter are called upon to continue to advise the Commission of any additions to ordeletions from the list of regulated markets for which it is the home Member State.

OPEN CALL FOR PROPOSALS — GP/RPA/ReferNet-FPA/002/08

ReferNet — European Network of Reference and Expertise in Vocational Education and Training(VET)

1. Objectives and description

The European Network of Reference and Expertise in VET (ReferNet) comprises a national consortium ineach Member State, Iceland and Norway, made up of organisations representative of VET. Each consortiumis led by a national consortium leader.

To facilitate these activities this call invites proposals from national consortia or key organisations involvedin VET. For each eligible country one beneficiary shall be selected. The national consortium will cooperatewith the national ReferNet representative and Cedefop in implementing and validating the activities.

The overall objective of this call is to select and conclude a three years framework partnership agreementwith one successful applicant (one organisation or one consortium) in each of the eligible countries toset-up and lead a representative national consortium of key organisations in the field of VET in order tosupport Cedefop and carry out, with the consortium partners, activities agreed each year in an annual actionplan.

Activities in each consortium's action plan will be selected from those listed in the ‘scope of activities’.Although the consortium leader must demonstrate that the consortium has the capacity to carry out all ofthe activities listed, it should be noted that not all of the activities listed need to be carried out by theconsortium every year.

The consortium's annual action will be financed by a specific grant agreement concluded each year. Thegrant will vary according to the country size and the action (set of activities) carried out.

2. Budget and project duration

The estimated budget available for the duration of the framework partnership agreements amounts toEUR 4 000 000 for all participating countries (EU-27, NO and IS), depending on the decisions of theBudget Authority.

The yearly total available budget (approx. EUR 1 million) will be distributed amongst all participating coun-tries on the basis of three country groups based on population:

Country group 1: Cyprus, Estonia, Latvia, Lithuania, Luxembourg, Malta, Slovenia and Iceland.

Country group 2: Austria, Belgium, Bulgaria, Czech Republic, Denmark, Finland, Greece, Hungary, Ireland,the Netherlands, Portugal, Romania, Slovak Republic, Sweden and Norway.

Country group 3: France, Germany, Italy, Poland, Spain, United Kingdom.

The Community grant is a financial contribution to the beneficiary's (and/or co-beneficiaries) costs whichmust be supplemented by own financial contribution and/or local, regional, national and/or private contri-butions. The total Community contribution shall not exceed 70 % of the eligible costs.

Cedefop reserves the right not to award the total budget available.

3. Eligibility criteria

Applications which comply with the eligibility criteria will be the subject of an evaluation.

3.1. Eligible organisations

To be eligible, the applicant (national Consortium Leader) must satisfy the following requirements:

— be a public or a private organisation, with a legal status and legal personality (consequently, naturalpersons — i.e. individuals — may not submit applications),

— lead a national consortium whose composition represents the stakeholders' diversity within the country,

— be able to carry out all activities within the scope of those detailed in section 3 of the call for proposalfull text (collection and analysis of information, research, documentation and databases, disseminationand promotion).

3.2. Eligible countries

Applications from the following countries are eligible:

— Luxembourg, Malta, Romania and Norway.

Organisations established in countries other than the countries listed above are not eligible.

3.3. Eligible proposals

Submission deadline and all other formal eligibility criteria specified in the call for proposal full text must becomplied with.

Cedefop reserves the right to disregard proposals that are still incomplete by the deadline. It also reservesthe right to request additional information necessary to take a final decision on the award of financialsupport.

4. Deadline

Applications for the framework partnership agreement must be sent at the latest on 21 April 2008.

1. On 20 February 2008, the Commission received a notification of a proposed concentration pursuantto Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1) bywhich the undertaking Itema Holding SpA (‘Itema’, Italy), jointly controlled by Radici group and MircoRadici group, acquires, within the meaning of Article 3(1)(b) of the Council Regulation, control of thewhole of the undertaking Gebrueder Loepfe AG (‘BarcoVision’, Switzerland) by way of purchase of shares.

2. The business activities of the undertakings concerned are:

— for undertaking Itema: Manufacturing and supply of textile machinery,

— for undertaking BarcoVision: Manufacturing and supply of sensors, inspection systems, and computer-ized production management for the textiles market.

3. On preliminary examination, the Commission finds that the notified transaction could fall within thescope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

The publication of reference amounts for the crossing of the external borders, as referred to in Article 5(3)of Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 estab-lishing a Community Code on the rules governing the movement of persons across borders (SchengenBorders Code), is based on the information communicated by the Member States to the Commission inconformity with Article 34 of the Schengen Borders Code.

SPAIN

The Order of the Ministry of the Presidency (PRE/1282/2007) of 10 May 2007 on the financial meansaliens are required to have in order to enter Spain specifies the amount that aliens have to prove is availableto them in order to be able to enter Spain:

(a) for the costs of their stay in Spain, the amount they have available to them must represent, in euros,10 % of the gross national minimum wage (EUR 60,00 for 2008) or its legal equivalent in foreigncurrency multiplied by the number of days they intend to stay in Spain and by the number of dependentpersons travelling with them. The minimum amount at their disposal must represent 90 % of the grossnational minimum wage (EUR 540,00 for 2008) or its legal equivalent in foreign currency per person,regardless of the intended duration of the stay;

(b) for their return to the state of provenance or for transit via third states, aliens must be able to produce apersonal, untransferable and fixed-date ticket or tickets for the planned means of transport.

Aliens must prove that they have the above means of subsistence either by producing them if they are incash, or by producing certified cheques, traveller's cheques, receipts or credit cards, which must be accompa-nied by a recent bank statement (bank letters or Internet bank statements are not acceptable) or by otherevidence clearly showing the amount of credit available on the card or bank account.

ROMANIA

Article 6 of Aliens Act No 194/2002 provides that aliens are allowed to enter Romania providing they canprove they have the necessary means for personal expenses and for returning to the origin country or fortransit towards another state which will allow them to enter.

As far as the reference amounts required for the crossing of external borders are concerned, obtaining anentry visa to Romania is possible by showing proof of the necessary means for personal expenses in theamount of EUR 50 per day, or the equivalent in convertible foreign currency, for the entire period.

The citizens of EU member states and EEA countries are allowed to enter Romania without meeting theseconditions.

Composi t ion

Edam Holland is produced from one or more of the following raw materials:

— milk, cream and skimmed or semi-skimmed cows' milk (exclusively cows' milk) from Dutch dairyfarms.

The cheese is shaped like a ball with a flattened top and bottom, or it may be shaped like a loaf or ablock. The specifications are given in the table.

The moisture content applies 12 days from the first day of preparation, with the exception of BabyEdam Holland, where it applies 5 days after the first day of preparation.

The other characteristic properties are as follows:

— Flavour: mild to piquant depending on age and type.

— Cross-section: must be uniform in colour with a few small round holes. Bros Edam has a largenumber of small holes. The colour of the cheese varies from ivory to yellow.

— Rind: the rind is firm, smooth, dry, clean and has no fungal flora. It is produced by drying duringthe maturing stage.

— Texture: young Edam Holland must be sufficiently firm and cuttable. Once the cheese has maturedfurther, it becomes firmer and tighter in structure. Bros Edam must be sufficiently firm and hard.

— Maturing period: a minimum of 28 days (a minimum of 21 days for Baby Edam Holland). EdamHolland is a naturally matured cheese. Foil maturing is not permitted for Edam Holland.

— Maturing temperature: at least 12 °C.

— Age: the shelf-life varies from a minimum of 28 days after manufacture (Baby Edam Holland) tomore than a year.

— When they reach and are stored by the cheesemaker, the milk, cream or semi-skimmed milk haveundergone either no heat treatment at all or a non-pasteurising heat treatment.

— The cream and the skimmed or semi-skimmed milk should undergo pasteurisation immediatelybefore being made into Edam Holland so as to meet the following criteria:

— phosphatase activity is undetectable, unless peroxidase activity is undetectable,

— measured on the basis of the fat-free product, acidity levels for cream are no higher than20 mmol NaOH per litre, unless the lactate content is 200 mg per 100 g of fat-free matter orless,

— no coliform micro-organisms are detectable in 0,1 ml.

— Immediately before being made into Edam Holland, all raw materials must be pasteurised in such away that the undenatured whey protein content does not deviate or deviates only slightly from thatof unpasteurised raw material of a similar type and quality.

— Only non-genetically modified cultures of lactic-acid-forming and aroma-forming micro-organismsmay be added when manufacturing Edam Holland. These cultures consist of appropriate mesophilicstarter cultures for Edam Holland: Lactococcus and Leuconostoc L or LD, possibly in combinationwith thermophilic Lactobacillus and/or Lactococcus cultures. The available starter cultures play a veryimportant role in the ripening process and formation of the typical taste and aroma.

— Rennet: only calf rennet is used to manufacture Edam Holland. Other types of rennet may be usedonly in exceptional circumstances, such as if an animal disease makes it necessary. The rennet usedwill then have to comply with the Warenwetbesluit Zuivel (Dairy Products (Commodities Act)Decree).

— The nitrite content of Edam Holland, in terms of nitrite ions, is no higher than 2 mg per kgcheese.

4.3. Geographical area: The geographical area covered by the application is Holland, i.e. the European partof the Kingdom of the Netherlands.

4.4. Proof of origin: A mark made from casein is placed on each Edam Holland cheese before the curds arepressed (see diagram). The mark contains the designation ‘Edam Holland’, together with a combinationof figures and letters that is unique for each cheese (in ascending alphabetical and numerical order).

The COKZ (the Dutch dairy inspection institute) keeps a register of these unique numbers, which alsocontains a record of all test data (including time and place). The indication is easily recognisable toconsumers, and can be verified by an approval authority on the basis of the casein mark and theCOKZ register.

4.5. Method of production: Edam Holland cheese is made from milk obtained from dairy farms in theNetherlands. The milk is cooled on the farm to a maximum of 6 °C and stored in a cooling tank onthe farm. It is transported to the cheese factory within 72 hours. When it arrives at the cheese factory,it is either processed immediately or thermised (a non-pasteurising, light heat treatment) and put intocold storage for a short period of time before being turned into cheese milk.

The fat content of the milk is standardised so that the fat/protein ratio is such that the cheese even-tually produced has a fat content of between 40 % and 44 % fat in dry matter. The cheese milk ispasteurised at a temperature of at least 72 °C for 15 seconds. It is curdled at a temperature of approxi-mately 30 °C. The separation and coagulation of the milk proteins that occurs during this process istypical of Edam Holland.

The curds obtained by coagulation are separated from the whey and processed and washed to ensurethat the moisture content and pH reach the desired levels. The curds are pressed into the correct shapeand desired weight in vats. The resulting ‘cheese’ is then immersed in the brine bath. Edam Holland isonly ever matured naturally, i.e. it is left open to the air to mature, and is regularly turned andchecked. As the cheese matures, a dry rind forms. Time and temperature play an important role inensuring that the enzymatic and ageing processes are given sufficient opportunity to allow the cheeseto develop the physical and organoleptic quality that is so characteristic of Edam Holland. It can takemore than a year for Edam Holland to mature, depending on the type of flavour desired.

Edam Holland may be cut and pre-packaged either in or outside the Netherlands, provided that thepre-packager has a comprehensive administrative monitoring system to ensure that the cut EdamHolland can be traced by means of the unique combination of figures and letters on the mark and thatthe consumer can be sure of its origin.

4.6. Link: The geographical component of this product name is ‘Holland’. As is common knowledge,‘Holland’ is a synonym of the more official name, ‘the Netherlands’. During the time of the Republic ofthe United Netherlands (from the 17th to the 19th century), Holland was the most influential of theseven provinces. Since then, the name has gradually come to refer to the whole territory of the Nether-lands. In many countries the Netherlands is better known or even exclusively known as ‘Holland’(Ollanda, etc.).

His tor i ca l background

Edam Holland is an exponent of the Dutch tradition of cheese making, which stretches back to theMiddle Ages and reached maturity as early as the 17th century (the Golden Age).

It is largely the geographical position of the Netherlands (mostly below sea level), its climate (a mari-time climate) and the composition of the grass that grows there (predominantly on sandy and claysoils) that make the milk so suitable for producing a high-quality cheese that is packed with flavour.

The quality assurance systems in place on dairy farms and the intensive quality assessment system(each delivery of milk is tested and assessed according to various quality parameters) together guaranteethe quality of the milk. Furthermore, there is an unbroken cold chain until the moment the milk isprocessed, with the milk being put into cold storage on the farm (maximum 6 °C) and transported tothe factory in refrigerated tankers. The relatively short distances involved also help maintain the qualityof the milk.

From its beginnings in farm-based production, Edam Holland has developed, by way of production inlocal factories, to become a nationally produced product of worldwide renown, and is an important,stable factor in optimising the quality of farm milk. At the beginning of the 20th century, nationallaws were introduced on Edam cheese, and the name of Edam Holland was established in theLandbouwkwaliteitsbeschikking kaasproducten (Agricultural Quality Decision on Cheese Products).

Edam Hol land 's image among European consumers

A large-scale survey carried out in six European countries showed that European consumers see theNetherlands as the most important producer of Edam (and Gouda). Furthermore, the reputation andstanding of Edam (and Gouda) are associated with the Netherlands.

Edam (and Gouda) are symbols of Dutch cultural heritage. European consumers regard them as brands.They are synonymous with Dutch quality. Market research (carried out on a representative sample of1 250 respondents per Member State, with 97,5 % reliability) in the six Member States where Edam(and Gouda) consumption is highest shows that:

— there is a strong association between Edam and the Netherlands,

— Edam Holland is more popular than Edam produced outside the Netherlands,

— almost half of consumers in the Member States surveyed believe that all Edam is produced in theNetherlands (which is potentially misleading for European consumers, because this is not the case),

— Edam Holland scores significantly higher on the variables ‘excellent quality’, ‘traditionally manufac-tured’ and ‘the original product’.

Over a number of centuries, various measures and laws have been introduced, both by the DutchGovernment and by the industry, to ensure that the very high quality of Edam (and Gouda) is main-tained. Moreover, the Dutch dairy industry has invested a substantial amount of money in meetingthese high quality standards and opening up, cultivating and maintaining markets. Since 1950, morethan NLG 1,4 billion (EUR 635 million) has been invested in advertising, awareness-raising andpromotion in Europe (excluding investment in the Netherlands).

4.8. Labelling: ‘Edam Holland’ is a European Union Protected Geographical Indication (PGI).

This indication must be displayed in a prominent position on all whole cheeses on the label applied tothe flat side of the cheese and/or on the band around the cheese. This is not compulsory if the cheeseis sold in pre-cut and pre-packaged form as described in section 4.5. In that case, ‘Edam Holland’ mustbe displayed on the packaging.

A clear distinguishing mark must be displayed on the packaging to enable consumers to identify EdamHolland on the shelves. By giving the product a name, creating an own identity (a logo is being devel-oped) and displaying the EU's PGI symbol, it must be made clear to consumers that Edam Holland is adifferent product from all other ‘Edam’ cheeses. The aim of the application is to prevent Europeanconsumers from potentially being misled.
