2. The following commodities arc notregulated by this Circular:

Article 2. Subjects of application
This Circular applies to organizations andindividuals that manufacture, trade in or import
electric or electronic products.
Article 3. Interpretation of terms
In this Circular, the terms below areconstrued as follows:

1. Allowable limit contents of a number of
toxic or hazardous chemicals in electric or
elt~ctronic products means maximum percentages
of volumes of these substances allowed to be
contained in homogenous materials constituting
electric or electronic products.
2. Homogenous material means a material
which cannot be mechanically disjointed into
different materials.
Article 4. Electric or electronic products
subject to allowable limit chemical contents
Electric or electronic products circulated on
the Vietnamese market which must ensure
allowable limit contents of a number of toxic or
hazardous chemicals specified in Appendix 2 to
this Circular include the following groups of
product:
1. Large household appliances.
2. Small household appliances.
3. Information technology andcommunications equipment.
4. Consumer equipment.
5. Lighting equipment.
6. Electric or electronic tools (except largescale stationary industrial tools).
7. Toys, leisure or spans equipment.

Article S. Toxic or hazardous chemicals

I. Toxic or hazardous chemicals limited in
electric or clcctronic products inel udc lead (Pb),
Cadmium (Cd), Mercury (Hg), hexavalent
Chromium (Cr6+), Polybrorninated biphenyl
(PBS) and Polybrorninated diphenyl ether
(PUDE).
2. Contents of toxic or hazardous chemicalsin electric or electronic products circulated on
the Vietnamese market must not exceed the
allowable limits specified inAppendix I, except
the cases specified in Appendix 3 to this
Circular.
3. An electric or electronic ~uct is
considered compliant with regulatioeeon limit
contents of toxic or hazardous ch~rtiiCids if:111-homogenous materials constitu~g such
product comply with the limit conteats of toxicor hazardous chemicals.
4. When no relevant Vietnarneseeegulation
is available, to assess contents di'toxic or

Article 8. Responsibilities of state
management agencies
1. The Chemical Department shall:'; 'rJ !
a/ Assume the prime responsibility for, and
coordinate with related agencies in, inspecting
manufacturers or importers electric or electronic
products which contain toxic or hazardous
chemicals in excess of the allowahle limit
contents specified in this Circular;
hi Designate lahoratories accredited as
satisfying the requirements of ISO/IECIl7025:
General requirements for the competence of
testing and calibration laboratories, and pcnnitted
to test the norms in Appendix I to this Circular.
The designation of laboratories permitted to
conduct testing complies with the Ministry of
Science and Technology's Circular No. 09120091
TI-BKHCN of April 8,2009, guiding require
ments, order and procedures for designation of
conformity-assessing organizations.
2. The Market Management Department
shall handle, in accordance with law, Violations
involving electric or electronic products
circu hted on Ih[> market which contn in tox ic or
hazardous chemicals in excess of the allowable
limit contents.
Article 9. Effect
I This Circular takes effect on September
23,20 II, and applies pending the promulgation
of a relevant national regulation.
2. From December 1, 2012, information on
allowable limit contents of a number of toxic
or hazardous chemicals shall be disclosed for
manufactured or imported electric or electronic
products under Clause 2, Article 6 of this
Circular.
3. Any problems arising in the course of
implementations should be promptly reported
to the Ministry of Industry and Trade for making
appropriate amcndmcnts.-
