1. Carry a cell phone and program it so that the police emergency number is on speed dial.

2. The more exposure you have, the greater your risk. Concentrate on your professional proficiency

rather than personal information in newspapers and resumes.

3. Don’t get caught off guard at open houses or listing presentations. Prepare a scenario so that you

can leave or encourage the person making you uncomfortable to leave. Some ideas: Your beeper

went off, and you have to call your office; you left some information in your car you need to get;

mention that you’re expecting another salesperson with buyers in a few minutes.

4. If you’re accosted in a parking lot and forced to drive, don’t leave the area. One suggestion: If

you’re in a crowded area, run your vehicle into another one or into something else, such as a

building or a tree. You’ll attract attention, and that’s the last thing a perpetrator wants. If you’re

confronted at your car, throw your car key in one direction and run screaming in the opposite

direction. For this reason, keep your car key separate from your other keys.

5. Make a copy of the party’s driver’s license and write down a car license if you can. If possible, get

an

employer’s name and call to confirm employment. It’s tempting to start showing homes right away to

walk-ins, but it’s better if you get information and make an appointment for the following day so that

you have time to fact check.

6. Check county property records to confirm the ownership of property before you go to a listing

appointment or approach a FSBO. The more information you have, the easier and quicker it is for

police to catch a

perpetrator if you become a crime victim.

7. Know the sales area. Preview the property. Meet the buyers at your office, where they can be

seen by your co-workers. Then travel separately to the property: Don’t feel obligated to act as a

chauffeur.

8. It’s better to walk away from a listing or not show a house if you have an uneasy feeling.

9. Let your office know where you are at all times. Arrange to call your office at a specific time and

do it. No excuses.

10. Take someone with you to open houses, listing appointments, and showings.

11. If a buyer wants to see houses in an area you perceive as unsafe, don’t go.

12. Carry pepper spray on your key ring and in your car and know how to use it. Take a personal

safety course.

13. Exercise caution when being approached by a vehicle with blue lights at night. Call911 to identify

the vehicle, turn on your flashers to acknowledge that you see the police car, and keep moving until

you’re in a well-lit area.

Government Affairs Update

LOCAL

Boulder County

Longmont

• “Spotlight on Longmont” November 29: This event is being hosted by the Boulder Area REALTOR®

Association and the Longmont Association of REALTORS®. It will feature the most current information on Long-

mont’s economic health and growth, housing development and statistics, and plans for critical infrastructure to sup-

port great neighborhoods and a vibrant economy. This event will begin at 8:30 AM and includes breakfast.

It is complimentary for BARA and LAR members. More information and registration instructions will follow in

November.

• LAR Endorses Denig: Following a recommendation from the Government Affairs Committee, the Longmont

Association of REALTORS® endorsed Maureen Denig (R) for Boulder County Commissioner, District 2. Like LAR,

Ms. Denig feels that the current County Commission is “Boulder-Centric”. She agrees that the emphasis on

acquisition of additional open space and environment/climate programs should not be the top priorities of our

county government.

Ms. Denig believes the County’s current policies and regulations are not friendly to business or conducive to

encouraging growth. If elected she intends to help steer the Board of County Commissioners in a new direction. Read

was appointed to serve as commissioner after resigning her House seat (District 12) in 2012.

• Save the Date - Annual Northern Colorado Real Estate Conference: The Everitt Real Estate Center is

holding its 16th annual conference on October 24, 7:00 AM to 1:30 PM at the Fort Collins Marriott. This year’s

• New Rule Proposed for Higher-Risk Mortgages: The Federal Reserve Board has joined with five other federal regulatory

agencies in proposing a new rule to impose appraisal requirements for loans

secured by a borrower’s home and bearing interest rates higher than the average prime offer rate (APOR) for comparable

properties and mortgages. Higher-risk loans will now require creditors to use a licensed or certified appraiser who prepares a

complete report on physical inspection of the property. Applicants for a loan must be furnished a free copy of any appraisal. In

an effort to prevent fraudulent property flipping the rule would require creditors to obtain a second appraisal at no cost to

applicant if the property has been acquired at a lower price in the previous six months. NAR is looking at the proposed rule for

issues of concern and intends to file a formal comment on the proposed rule.

• Senate to Review Package including Mortgage Relief Provision: The Senate Finance Committee has sent the full Senate

a package that would extend the mortgage relief provision for an additional year, through Dec. 31, 2013. The Senate was unable

to act on the bill before adjourning for its August break and the party conventions. Chairman Baucus (D-MT) had expressed a

wish to finish this package before the election in order to provide certainty about the extension (or not) of more than fifty

provisions. Nonetheless, it is not known if the package would also be considered in the House before the election.

In addition to the mortgage cancellation relief provision, the package also includes a relief provision to limit the impact of the

Alternative Minimum Tax (AMT) in 2012 and 2013. The 15-year cost recovery for leasehold improvements is renewed (it had

expired Dec. 31, 2011) and extended through Dec. 31, 2013. The provision that permits the costs associated with brownfields

environmental cleanup was NOT included in this extender legislation. The legislation is not "paid for."

FHA Announces Condo Law Revisions: On Sept. 14 FHA announced that investors can now buy up to half of a

condominium project’s units, which is ten percent more than were allowed before. However, at least half of the units have to

have already been conveyed to individual owners or be under contract as owner-occupied. Half of the project can be used for

commercial purpose. FHA is ?softening its stand on delinquent homeowner’s association (HOA) dues. It’s now allowing up to

fifteen percent of a project’s units to be 60-days delinquent on HOA dues (up from just 30 days delinquent). This change

acknowledges the tough times condo projects have faced as underwater owners of individual units struggle to pay their HOA

fees. NAR calls these changes “fairly significant.”

NAR is still pushing FHA to eliminate the fifty percent owner occupancy requirement. Currently the rule is waived

for REO units but NAR says the fifty percent rule is the biggest hurdle for buyers today.

FHA says the changes announced are interim measures and that it’s preparing a more formal and comprehen-

sive rulemaking, so some of the changes NAR is seeking could be forthcoming. In any case, NAR, which worked with

other groups to play a lead role in getting FHA to make these changes, continues to talk to FHA officials about this

important but still tough segment of the financing market.
