Congratulations to the Remodelers Council of Lincoln for receiving an Integrity Award from the Better Business Bureau at the Cornhusker on September 9, 2010. We have one of the best Councils in the entire country. And, as you know, things like that don’t just happen. It takes hard work by a lot of people who are willing to volunteer time and talents for the betterment of all. Personally, I’d like to thank Chairperson Lori Pippitt and the other past leaders for making us shine. I felt honored to be included in the luncheon.
The headline of an article in the September 24 Omaha World Herald about their local housing market stated “All that’s missing is confidence.” That just about sums it up. House prices are reasonable, interest rates are unbelievably low, and yet many people are still waiting for the confidence to build or buy that next home. Now that the “experts” have declared the recession to be over, maybe our industry can start moving in the right direction again. It is painful to hear of recent layoffs, knowing that good quality construction workers are now looking for work or even changing career paths.
As we move into fall, I hope those of you who like to hunt will sign up for the HBAL Clay Shoot on October 14 at Oak Creek Sporting Club. It’s a lot of fun and good practice for hunting season.

Green building is the practice of creating structures and using processes that are environmentally responsible and resource-efficient throughout a building’s life-cycle: from developing the site to design, construction, operation, maintenance, renovation and deconstruction. This practice expands and complements the classical building design concerns of economy, utility, durability and comfort.
Although new technologies are constantly being developed to complement current practices in creating greener structures, the common objective is that green buildings are designed to reduce the overall impact of the built environment on human health and the natural environment.

BBB Integrity Awards Honor Ethical Business Practices
The RemodelersCouncilofLincolnalong with two members of HBAL received Better Business Bureau (BBB) Integrity Awards at an award ceremony at the Cornhusker Marriott on September 9th. These awards focus on demonstrated ethical business practices with key stakeholders including customers, employees and the community at large, rather than a company’s growth, profitability or popularity. The Integrity Award winners were chosen by an independent panel of business leaders and members of the academic community.“The BBB Integrity Award Winners have shown that ethics and integrity are core values of their organization,” said Jim Hegarty, president and chief executive officer, of the Better Business Bureau serving Nebraska, South Dakota and southwest Iowa. “The 2010 BBB Integrity Award Winners join an elite group of organizations that realize dealing fairly and honestly with employees, customers and partners are central to profitability and growth.”Schaefer’s,Inc. and NebraskaSeamless,Inc., both longtime members of HBAL, were also awarded Integrity Awards at the event.

Reaching Retirement--Now What?By John Oestreich, Waddell & Reed
You’ve worked hard your whole life anticipat-ing the day you could finally
retire. Well, that day has arrived! But with it comes the realization that you’ll need to carefully manage your assets so that your retirement savings will last.
Review your portfolio regularly
Traditional wisdom holds that retirees should value the safety of their prin-cipal above all else. For this reason, some people shift their investment portfolio to fixed-income investments, such as bonds and money market ac-counts, as they approach retirement. The problem with this approach is that you’ll effectively lose purchasing power if the return on your invest-ments doesn’t keep up with inflation.While generally it makes sense for your portfolio to become progres-sively more conservative as you grow older, it may be wise to con-sider maintaining at least a portion of your portfolio in growth investments.
Spend wiselyDon’t assume that you’ll be able to live on the earnings generated by your investment portfolio and retire-ment accounts for the rest of your life. At some point, you’ll probably have to start drawing on the princi-pal. But you’ll want to be careful not to spend too much too soon. This can be a great temptation, particularly early in retirement.A good guideline is to make sure your annual withdrawal rate isn’t greater than 4% to 6% of your port-folio. (The appropriate percentage for you will depend on a number of factors, including the length of your payout period and your portfolio’s asset allocation.) Remember that if you whittle away your principal too quickly, you may not be able to earn enough on the remaining principal to carry you through the later years.Understand your retirement
plan distribution optionsMost pension plans pay benefits in the form of an annuity. If you’re married you generally must choose between a higher retirement benefit paid over your lifetime, or a smaller benefit that continues to your spouse after your death. A financial profes-sional can help you with this difficult, but important, decision.Other employer retirement plans like 401(k)s typically don’t pay benefits as annuities; the distribution (and investment) options available to you may be limited. This may be important because if you’re trying to stretch your savings, you’ll want to withdraw money from your retirement accounts as slowly as possible. Doing so will conserve the
principal balance, and will also give those funds the chance to continue growing tax deferred during your retirement years.Consider whether it makes sense to roll your employer retirement account into a traditional IRA. IRAs usually offer greater withdrawal flexibility than employer plans. A rollover to an IRA also allows you to consolidate your retirement assets.
Plan for required distributions
Keep in mind that you must gener-ally begin taking minimum distribu-tions from employer retirement plans and traditional IRAs when you reach age 70½, whether you need them or not. Plan to spend these dollars first in retirement.If you own a Roth IRA, you aren’t required to take any distributions during your lifetime. Your funds can continue to grow tax deferred, and qualified distributions will be tax free. Because of these unique tax benefits, it generally makes sense to withdraw funds from a Roth IRA last.
Know your Social Security options
You’ll need to decide when to start receiving your Social Security retire-ment benefits. At normal retirement age (which varies from 65 to 67, de-pending on the year you were born), you can receive your full Social Security retirement benefit. You can elect to receive your Social Security retirement benefit as early as age 62, but if you begin receiving your ben-efit before your normal retirement age, your benefit will be reduced. Conversely, if you delay retirement, you can increase your Social Security retirement benefit.
Consider phasingFor many workers, the sudden change from employee to retiree can be a difficult one. Some employ-ers, especially those in the public sector, have begun offering “phased retirement” plans to address this problem. Phased retirement generally allows you to continue working on a part-time basis--you benefit by having a smoother transition from full-time employment to retirement, and your employer benefits by retaining the services of a talented employee. Some phased retirement plans even allow you to access all or part of your pen-sion benefit while you work part time.Of course, to the extent you are able to support yourself with a salary, the less you’ll need to dip into your retire-ment savings. Another advantage of delaying full retirement is that you can continue to build tax-deferred funds in your IRA or employer-sponsored retirement plan. Keep in mind, though, that you may be required to start tak-ing minimum distributions from your qualified retirement plan or traditional IRA once you reach age 70½, if you want to avoid harsh penalties.If you do continue to work, make sure you understand the consequences.
Some pension plans base your retire-ment benefit on your final average pay. If you work part time, your pen-sion benefit may be reduced because your pay has gone down. Remember, too, that income from a job may affect the amount of Social Security retirement benefit you receive if you are under normal retirement age. But once you reach normal retirement age, you can earn as much as you want without affecting your Social Security retirement benefit.
Facing a shortfallWhat if you’re nearing retirement and you determine that your retire-ment income may not be adequate to meet your retirement expenses? If retirement is just around the corner, you may need to drastically change your spending and saving habits. Saving even a little money can really add up if you do it consistently and earn a reasonable rate of return. And by making permanent changes to your spending habits, you’ll find that your savings will last even longer. Start by preparing a budget to see where your money is going. Here are some suggested ways to stretch your retirement dollars:• Refinance your home mortgage if
interest rates have dropped since you obtained your loan, or reduce your housing expenses by moving to a less expensive home or apartment.
• Access the equity in your home. Use the proceeds from a second mort-
gage or home equity line of credit to pay off higher-interest-rate debts, or consider a reverse mortgage.
• Sell one of your cars if you have two. When your remaining car needs to be replaced, consider buying a used one.
• Transfer credit card balances from higher-interest cards to a low- or no-interest card, and then cancel the old accounts.
• Ask about insurance discounts and review your insurance needs (e.g., your need for life insurance may have lessened).
• Reduce discretionary expenses such as lunches and dinners out.

Associate of the Year AwardSend in your nomination by November 1
PurposeThe purpose of the “Associate of the Year” program is to recognize an outstanding Associate member of the association who has conducted themselves in an exemplary manner so as to bring credit to the building industry, community, and HBAL.
EligibilityEach nominee shall be an active Associate member of HBAL and must have been a member for a minimum of three years on January 1, 2010.
DeadlineSubmit your nomination by filling out the form on the back before November 1. Mail or fax this form HBAL. If you need additional space, please attach a separate sheet of paper to the nominating form. From the nominations received, the winner of the award will be chosen by the selection committee.
Selection CommitteeThe committee will have a minimum of five members. The committee shall consist of the President, President Elect, First Vice President, Immediate Past President and the 2009 “Associate of the Year,” Eric Hoke.
Basis of SelectionThe basis for selection shall include the following criteria:
1. Business conduct and experience (25 percent)2. HBAL activities/involvement (50 percent)3. Civic and volunteer activity (25 percent)
PresentationThe 2010 “Associate of the Year” will receive a personal award at the installation meeting in January 2011. The presentation will be made by the outgoing President, Mike Rezac, or the previous “Associate of the Year” winner. The recipient’s name will be added to a permanent trophy on display at the HBAL office.

The seasons have begun to change, our days are shorter, our nights are
getting cooler and leaves are starting to fall from the trees. Much like the leaves, interest rates for
homes keep falling and are at record lows. Now is a great time to refinance, lower your payments and put that money back into a home renovation! Many current owners are taking advantage of the tax credits and are replacing windows, doors and upgrading insulation. Others are reinvesting their equity into a master bathroom, kitchen or basement finishing project. Unfinished or needed home improvements are at the forefront of people’s minds and we can only hope their pocketbooks as well! Mark your calendars for our next meeting on October 6. We will be having a quick lunch at Valentino’s on 35th and Holdrege followed by a tour of Keim Hall on East Campus. Keim Hall recently underwent two years of renovations, which earned them a Leadership in Energy & Environmental Design certification from the US Green Building Council. Thermostat RecyclingIn partnership with the Nebraska Department of Health and Human Services (NDHHS) & the Thermostat Recycling Corporation (TRC), WasteCap Nebraska has begun to collect mercury-switch thermostats for safe disposal at their location on 285 South 68th Street Place, Suite 540, in Lincoln. Intact, mercury-containing thermostats are accepted at no charge (FREE). No digital units are accepted.
NAHB Concerned Over EPA’s Continued Use of Faulty Lead Rule Test Kits, Enforcement Plans
The U.S. Environmental Protection Agency has no plans to discontinue the use of the faulty lead paint test kits available, even though they indi-cate “false positives” of lead being present by 42-78% of the time, NAHB learned during an Aug. 25 meeting it called to discuss concerns about the implementation and enforcement of the lead paint rule.The EPA has also released interim enforcement guidelines detailing how the agency plans to levy fines against remodelers and other con-tractors who run afoul of the Lead: Renovation, Repair, and Painting rule. The fines will range from $150 to $37,500 per violation per day, depending upon the severity of the infraction, the EPA said.NAHB called the meeting — the latest in a series the association has held with the agency and other industry groups throughout the year — so that the EPA could provide updates on the lead paint rule and give industry representatives an opportunity to air concerns about its implementation and enforcement. Under the rule, which went into effect on April 22, remodelers and other contractors who work in housing and child-occupied facilities built before 1978 are required to undergo training and certification in order to work in the homes and must employ lead-safe work prac-tices unless the homes are tested and found to be free of any lead paint. About 78 million homes are subject to the new EPA regulation.During the meeting, EPA officials confirmed that second-genera-tion and more reliable test kits would not be available on Sept. 1, as originally planned. The agency said that none of the new test kits reviewed was able to pass the “false positive” requirement indicat-ing the presence of lead and did not know when more accurate kits would become available. NAHB indicated its concern that the use of the three currently recognized and inaccurate test kits will continue to raise the cost of renovation and repair for home owners as remodelers employ lead-safe work practices even though lead may not be present. As posted on the EPA website, the inaccurate kits will remain in use until new kits that meet both the EPA’s negative and positive response criteria are introduced. EPATrainingContinuestoFallShortThe EPA reported that 449,000 remodelers and contractors had been trained under the lead rule as of mid-August and that 53,000 firms have been certified. However, EPA officials indicated that they were concerned about the low number of firms that had been certified to date and about contractors’ confusion about the individual training and firm certification requirements needed to work in pre-1978 homes.The EPA has continued to receive applications for new lead rule training providers, with more than 200 in the pipeline for review. Currently, about 315 training providers have been approved by the EPA, including 15 online providers.However, EPA officials also told meeting participants that they are investigating the accuracy of some of the training being provided. For example, one trainer was continuing to teach remodelers about the viability of the opt-out rule — where home owners could sign a waiver under certain circumstances. The opt-out rule expired on July 6.The EPA has requested that remodelers contact the National Lead Information Center at 800-424-5323 with any complaints or concerns about lead rule training so that the agency can correct any problems.In response to NAHB concerns that Occupational Safety and Health Administration (OSHA) general work site safety regulations may conflict with lead-safe work practices — for example, slipping hazards while using plastic sheeting — EPA representatives said OSHA has reviewed the rule and, while not noting conflicts in the regulations, has suggested changes to the training material. These changes will be incorporated when EPA updates its training material, the officials said. Until then, remodelers are urged to contact their regional EPA or
OSHA offices with questions about safety under the lead rule and OSHA inspections.EPAEnforcementProceduresNotFinalizedEPA officials have released a interim enforcement plan detailing the fines it will levy against contractors for violating the lead rule. The nature of the offense; the contractor’s record, including previ-ous offenses; and the contractor’s willingness to correct issues would all be factored into the severity of the fine, officials said.EPA officials also said that some regional offices are investigating enforcement actions against remodelers after receiving tips on potential violations. In addition, building officials in some jurisdictions have begun to deny permits to firms that have been unable to provide proof that they earned the proper certification under the rule. The EPA is “encouraging people to ask questions, but not necessar-ily deny permits.” said the EPA’s Michelle Price.Ten states have adopted the lead rule and have assumed implementa-tion and enforcement responsibilities, with Georgia, Rhode Island and Massachusetts the most recent ones to implement the regulation.Most of the states have instituted identical requirements of the fed-eral rule, but some — such as Rhode Island, which plans to require clearance testing for completed remodeling projects in homes that test positive for lead — may enforce stricter rules and levy larger certification fees.
