guardian and % (entered by representatives of absentee of Article 1381 shall not ta'e place with respect to contractsapproved by the courts.
Art. 138. All contracts by virtue of which the debtor alienatesproperty by gratuitous title are presumed to have beenentered into in fraud of creditors& when the donor did notreserve su6cient property to pay all debts contracted beforethe donation.

(% Those that do not comply with the tatute of ;rauds as setforth in this number. n the following cases an agreementhereafter made shall be unenforceable by action& unless thesame& or some note or memorandum& thereof& be in writing&and subscribed by the party charged& or by his agent$evidence& therefore& of the agreement cannot be receivedwithout the writing& or a secondary evidence of its contents:
(a An agreement that by its terms is not to be performedwithin a year from the ma'ing thereof$
(b A special promise to answer for the debt& default& ormiscarriage of another$
(c An agreement made in consideration of marriage& otherthan a mutual promise to marry$
