APPLICATION FOR A PERMIT TO CONSTRUCT A NEW 230/138 KV AUTOTRANSFORMER AND ASSOCIATED FACILITIES AT MCDONALD

SUBSTATION UNDER THE UTILITY ENVIRONMENTAL PROTECTION ACT

Nevada Power Company d/b/a NV Energy ("Nevada Power" or the "Company"), in

accordance with Subsection 2 of Nevada Revised Statutes ("NRS") § 704.870 and Nevada

Administrative Code ("NAC") § 703.423, hereby files with the Public Utilities Commission

of Nevada (the "Commission") this Application for a Permit to Construct the facilities

described below, namely a single 230 kV transmission structure in Clark County, Nevada (the

"Project"), pursuant to the Utility Environmental Protection Act ("UEPA") set forth in NRS

§§ 704.820 to 704.900 (the "Application").

This Application is filed with the Commission pursuant to Subsection 1 of NRS

704.870 for a permit to construct a utility facility, where federal authorization is not required.

In this Application, Nevada Power is requesting the Commission issue a UEPA Permit

authorizing Nevada Power to construct one new steel, double circuit 230 kV transmission

structure, together with approximately 500 feet of overhead double circuit 230 kV

transmission conductor, along with telecommunications and related appurtenances to ensure

safe and reliable operation. The Project is one jurisdictional piece of a transmission project

required to meet the transmission demand and requirements of a new customer. The overall

project consists of folding the existing Faulkner - Equestrian 230 kV line into a new 230 kV

switchyard to be located on the customer site. Two 230 kV lead lines will be required from

this new switchyard to the customer's substation to meet the customer's reliability

requirements. The new switchyard and lead lines are located entirely in the City of

Henderson's city limits, and thereby exempted from the UEPA requirements pursuant to NRS

§ 704.860(2).

As discussed in detail below, the Project and the associated facilities, including the

new substation, are required to be constructed on an expedited schedule in order for NV

Energy to make reasonable efforts to meet the specific customer's requested in service date

of May 2019. In order to meet this deadline, the Company must perform its construction

activities in an outage window between October 2, 2018 to April 30, 2019. As a result, the

Company is also requesting expedited review and relief by the Commission and a deviation

from NAC § 704.9503(1)(a) for good cause.

A. GENERAL ALLEGATIONS

1. Nevada Power is a wholly-owned subsidiary of NV Energy, Inc., a holding

company incorporated under the laws of the State of Nevada.

2. Nevada Power provides retail electric service to the public in portions of Clark

and Nye Counties and is a "public utility" as that term is defined and used in NRS § 704.020.

3. Nevada Power's principal place of business, mailing address and telephone

number are: 6226 West Sahara Avenue; P.O. Box 98910, Las Vegas, Nevada, 89151; (702)

4. All correspondence related to this Application ( copy of all pleadings, notices,

B. LEGAL AUTHORITY

5. This Application is filed in accordance with the Commission's regulations

governing pleadings (NAC § 703.530 et seq.); statutes governing the UEPA (NRS §§ 704.820

to .900), specifically: NRS § 704.870(1) (requirements for filing); NRS § 704.873

(Commission has exclusive jurisdiction to determine need for utility facilities); NRS §

704.890 (Grant or denial of the permit: Required findings; conditions and modifications); and

the Commission's regulations governing construction of utility facilities (NAC §§ 703.415 to

.427, specifically, NAC § 703.423, requirements for filing after when no federal agency is

required to conduct an environmental analysis).

6. Nevada Power respectfully requests that the Commission accept this

Application as complying with the statutory and regulatory requirements set forth above,

grant this Application, grant expedited review and the request for deviation from regulation

described below, and issue Nevada Power a Permit to Construct the Project pursuant to NRS

§ 704.8905.

C. THE NATURE OF AND NEED FOR THE PROJECT

7. The Project will consist of one new steel, double circuit 230 kV structure that

is approximately 126 feet in height, as well as approximately 500 feet of overhead double

circuit 230 kV, 954 ACSR bundled transmission conductors along with telecommunications

and related appurtenances to ensure safe and reliable operation. The Project is needed to

provide new high voltage electric service to a new customer in southern Nevada.

8. The Project is more fully described in Part 2 of this Application and its

exhibits, which: (a) describe the location and nature of the Project; (b) summarize studies

made of the environmental impact of the construction of the Project; (c) describe the analysis

performed of alternative locations for the Project and the benefits provided by locating the

Project as proposed; ( d) describe the environmental effects of the construction and operation

of the Project, (e) describe the measures that will be implemented to mitigate those impacts,

as required by NRS § 704.870(2)(b) and NAC § 703.423(9) and (f) explains the extent to

which the Project is needed to ensure reliable utility service to customers.

9. Nevada Power has a need to provide safe, reliable and cost-effective electric

service to its retail service customers, and to maintain its transmission system in compliance

with state and federally mandated safety and reliability standards. The construction of the

facilities described in this Application will enable Nevada Power to meet these requirements.

10. The construction of the Project will not have additional environmental impacts,

for the reasons described in Section 7 of Part 2 of the Application.

D. FEDERAL, STATE AND LOCAL PERMITS FOR THE PROJECT

11. The Project will be constructed entirely on private property and thereby not

subject to federal permitting requirements or federal environmental studies. As is explained

in Section 11 of Part 2 of the Application, Nevada Power will need to obtain a special use

permit for construction and operations from Clark County and a dust control permit from

Clark County Department of Air Quality prior to commencing construction.

E. REQUEST FOR DEVIATION FROM REGULATION

NAC § 704.0097 provides that the Commission may allow deviation from any

provision of NAC Section 704 if:

(1) Good cause for the deviation appears;

(2) The person requesting the deviation provides a specific reference to each provision

of the chapter from which the deviation is requested; and

(3) The Commission finds that the deviation is in the public interest and is not contrary

to statute.

Nevada Power requests a deviation from NAC § 704.9503(1)(a) (Monitoring and

Amendment of action plan). Specifically, NAC § 704.9503(1)(a) requires a utility DEPA

applicant to file an amendment to its integrated resource plan's ("IRP") action plan if it

anticipates filing an application for a permit to construct a utility facility pursuant to the

UEP A statutes and that facility was not previously approved as part of the action plan.

The Project in this Application has not been previously approved by the Commission

in an IRP. As is set forth in the attached affidavit, the customer approached the Company

about the Project after the Company filed its pending Joint IRP in Docket No. 18-06003. See

Exhibit F, Affidavit of Sachin Verma in Support of the Request for Deviation. The Project

and the associated facilities, including the new switchyard, are on an expedited construction

schedule pursuant to the request of the customer's requested in service date of May 2019. Id.

The construction of the Project and new facilities requires the Company take a line outage,

which can only be taken between October 2, 2018 and April 30, 2019. Id. As a result, the

Company must obtain a UEP A permit to commence and complete construction of the new

transmission line and switchyard in the Company's outage window. Id.

If the Company could file an IRP amendment within the next month, the Commission

has 165 days to review an IRP amendment, pursuant to NRS § 704.751(2). Under the most

optimistic scenario, this would put the approval date in March or April 2019, which is at the

end of the outage window and time period for the Company to complete construction. There

is insufficient time to file an amendment to its IRP and obtain Commission approval of the

Project and complete construction to meet the customer's in-service date request. For good

cause showing, the Company respectfully requests that the Commission allow deviation from

NAC § 704.9503(1)(a) and consider this UEPA application without the need for an

amendment to Nevada Power's integrated resource plan. Nevada Power recognizes that,

without integrated resource plan approval, the determination of prudence related to the Project

will be made in a subsequent general rate review proceeding.

F. CONCLUSION

12. Together with the description of the Project contained in Part 2 of this

Application), Exhibit A (Vicinity Map), Exhibit B (Location Map); Exhibit C (Site Plan

the Request for Deviation) this Application contains all of the information required for the

Commission to evaluate and grant the Application.

13. Regarding public notice, proof of publication of a summary of this Application

has appeared in newspapers published and distributed in the area where the Project is planned

pursuant to NRS § 704.870(4)(b) and NAC § 703.423(5) (see Exhibit D).

14. Regarding proof of service, a copy of this Application has been filed on the

clerk of each local government affected by the location pursuant to NRS § 704.870( 4)(a) (see

Exhibit E).

15. Finally, the State Environmental Commission is designated as a party to this

proceeding, pursuant to NRS § 704.885(l)(b), and has been served a copy of this Application

pursuant to NRS § 704.870(3), simultaneously with this filing (see Exhibit E).

G. PRAYER FOR RELIEF

Nevada Power respectfully requests that the Commission proceed in the manner

required by law and, in accordance with NAC § 703.535(d), issue an order that:

1. Grants this Application;

2. Authorizes the issuance by the Commission Secretary of a Permit to Construct

for the facilities described in Section 2 of Part 2 of this Application pursuant

to NRS § 704.890;

3. Grants deviation from the Commission's regulations, in particular NAC §

704.9503(l)(a) as may be in the public interest;

4. Grants the request for expedited review and relief; and

5. Grants such additional other relief as the Commission may deem appropriate

and necessary.

NEVADA POWER COMPANY

APPLICATION FOR PERMIT TO CONSTRUCT A UTILITY FACILITY Pursuant to the Utility Environmental Protection Act (UEPA)

NRS 704.820 to .900 and NAC 703.415 to .427

This application is filed with the Commission pursuant to NRS § 704.870(1) for a permit to construct a utility facility where no federal agency is required to conduct an environmental analysis of the proposed utility facility:

1. A description of the location of the proposed utility facility as required by NRS § 704.870(1), and NAC § 703.423, including:

(a) A general description of the location of the proposed utility facility, including regional map that identifies the location of the proposed utility facility;

The Breeze Project 230kV interconnection subject to UEPA requirements will be located in the southeast Las Vegas valley, south of West Warm Springs Road entirely on private property within the jurisdictional boundary of unincorporated Clark County ( see Exhibit 8, Project Location Map and Exhibit .!2_, Vicinity Map).

(b) A legal description of the site of the proposed utility facility, with the exception of electric lines, gas transmission lines, and water and waste lines, for which only a detailed description of the site is required:

The proposed utility facility will be constructed within the South Half (S ½) of the Northeast Quarter (NE ¼) of Section 12, Township 22 South, Range 62 East Mount Diablo Base & Meridian, Clark County, Nevada.

(c) Appropriately scaled site plan drawings of the proposed utility facility, vicinity maps and routing maps:

See Exhibit 8, Project Location Map; Exhibit .!2_, Vicinity Map; and Exhibit C, Site Plan Drawing.

2. A description of the proposed utility facility, including:

(a) The size and nature of the proposed utility facility:

The proposed utility facility includes one new steel, double circuit 230 kV transmission structure 126 feet in height, and approximately 500 feet of overhead double circuit 230 kV transmission line using 954 ACSR bundled conductors along with telecommunications and related appurtenances to ensure safe and reliable operation. This new line will interconnect to a new substation on Nevada Power's existing Equestrian to Faulkner 230 kV transmission line. The new substation, which is located entirely in the City of Henderson's city limits, and thereby exempted from the UEPA requirements, will serve a new transmission load.

(b) The natural resources that will be used during the construction and operation of the proposed utility facility:

The utility facility will be located on privately owned land that is already disturbed and currently under the purview of the Nevada Division of Environmental Protection ("NDEP"). The Company is working with the NDEP to adhere with its existing restrictions and stipulations during construction, which may include special handling requirements for soils above and below 9-feet from ground surface, as well as any saturated soils and groundwater encountered based on its analytical results. There will be no natural resources used for construction and operation other than water that will be utilized for dust control purposes during construction only.

(c) Layout diagrams of the proposed utility facility and its associated equipment:

See Exhibit C, Site Plan Drawing.

(d) Scaled diagrams of the structures at the proposed utility facility:

(e) A statement concerning whether the proposed utility facility is an electric generating plant or the associated facilities of an electric generating plant that uses renewable energy as its primary source of energy to generate electricity:

The proposed utility facility is not an electric generating plant or associated facilities of an electric generating plant that uses renewable energy as its primary source of energy to generate electricity.

3. A copy and summary of any studies which have been made of the environmental impacts of the proposed utility facility as required by NRS § 704.870(1):

The Company did an internal analysis of the environmental impact of the proposed utility facility and consulted with the NDEP agency regarding its oversite of the property. As such, the Company will comply with existing environmental plans to mitigate any environmental impact resulting from the proposed utility facility. No third-party environmental impact studies were performed because the project is located entirely on privately owned land that has been previously disturbed.

4. A description of any reasonable alternate locations for the proposed utility facility, description of the comparative merits or detriments of each location submitted, and a statement of the reasons why the location is the best suited for the proposed utility facility, as required by subsection 1 of NRS 704.870:

The location of the proposed utility facility was selected due to its proximity to existing 230 kV transmission and the location of new high voltage electric service request.

An alternative route that would head directly north from the tap point of the existing 230 kV transmission line was investigated, however, the private property owner informed Nevada Power the property was currently in a double escrow. The timing to acquire an easement on the property due to the double escrow would not meet the project schedule.

Another alternative route was investigated, however construction was not feasible since it would cross several energized high voltage transmission lines.

5. A copy of the public notice of the application or amended application and proof of the publication of the public notice, as required by NRS § 704.870(4):

See Exhibit D for a copy of the public notice of the application and affidavit of the publication of the public notice as required by NRS § 704.870(4).

6. Proof that a copy of the application or amended application has been submitted to the Nevada State Clearinghouse within the Department of Administration to enable agency review and comment

A copy of this Application is being served on the Nevada State Clearinghouse. See Exhibit g for the Certificate of Service, which lists the Clearinghouse.

7. An explanation of the nature of the probable effect on the environment, including:

(a) A reference to any studies described in section 3, if applicable:

Based upon the Company's internal analysis and consultation with the NDEP, all construction will occur on already disturbed private land under the purview of the NDEP, as such, this project would not have any new environmental effects. The Company will adhere to NDEP's restrictions to ensure there are no new environmental effects. The Company does anticipate some short-term impacts due to construction activities, including fugitive dust, but mitigation will be in accordance with the dust control permit.

(b) An environmental statement that includes:

(1) The name, qualifications, professions and contact information of each person with primary responsibility for the preparation of the environmental statement:

(I) The environmental characteristics of the project area existing at the time the application or amended application is filed with the Commission:

The existing project area is located along the north perimeter of the site previously known as the Kerr-McGee site and subsequently the Tronox site, situated within the Black Mountain Industrial ("BMI") Complex. Remediation activities for the site are managed by the Nevada Environmental Response Trust ("NERT") with oversight from the NDEP. The Company is working with the NDEP to adhere with its existing restrictions and stipulations during construction.

(II) The environmental impacts that the construction and operation of the proposed utility facility will have on the project area before mitigation:

During construction, there will be temporary fugitive dust prior to mitigation. There will be no environmental impacts from the operation of the proposed project. The Company is working with NDEP to adhere with its existing restrictions and stipulations during construction.

(Ill) The environmental impacts that the construction and operation of the proposed utility facility will have on the project area after mitigation:

There would be minimal environmental impacts resulting from fugitive dust and construction-related noise after mitigation measures are applied to construction activities. There will be no environmental impacts from the operation of the proposed project. The Company is working with the NDEP to adhere with its existing restrictions and stipulations during construction.

The proposed utility facility is needed to provide, at the customer's request, new high voltage electric service.

The proposed utility facility has not been approved in a resource plan. Please see Exhibit F, Affidavit of Sachin Verma.

9. An explanation of how the need for the proposed utility facility as described in subsection 8 balances any adverse effects on the environment as described in subsection 7:

All construction associated with the project will occur on privately owned land that has already been disturbed with no unmitigated effects on the environment. This balances the need for the proposed project to provide new high voltage electric service to the Company's customer, at their request.

10. An explanation of how the need for the proposed utility facility represents the minimum adverse effect on the environment:

The proposed Breeze Project is needed to provide new high voltage electric service to the Company's customer, at their request. Installing the proposed utility facility on land that has already been disturbed represents the minimum adverse impact on the environment.

(a) The state of available technology:

The primary method of supplying electricity to end use customers has been virtually· unchanged since alternating current electricity became the standard nearly 100 years ago. High voltage electricity must be transmitted by transmission lines to areas where service is requested.

(b) The nature of various alternatives:

Due to the proximity of existing high voltage transmission and the request for new electric service in the immediate area, there are no alternative solutions to deliver electric service other than by transmission lines.

(c) The economics of various alternatives:

There are no alternative solutions to delivering new electric service to areas other than by transmission lines.

Sachin Verma, being sworn, states:

1. I am employed by Nevada Power Company d/b/a NV Energy (hereinafter

referred to as ''NV Energy" or the "Company") as the Director of NV Energy's Transmission

System Planning. Except where stated on information and belief, I have personal knowledge

of the facts set forth in this affidavit and would be competent to testify to them if asked. As to

the facts I state on the basis of information and belief, I have investigated these facts and

believe them to be true.

2. A new customer requested transmission service in the City of Henderson along

West Warm Springs Road. The Company and the customer executed a high voltage

distribution agreement on July 16, 2018, which provides for the necessary upgrades and

installation of new facilities to meet the customer's needs.

3. In order to meet the customer's reliability requirements, service will be

provided via the 230 kV system by folding the existing Faulkner- Equestrian 230 kV line into

a new 230 kV switchyard to be located near the customer site. Two 230 kV lead lines would

be required from this new switchyard to the customer's substation to meet the customer's

reliability requirements.

4. The customer's site and all the upgrades and new facilities discussed above are

located within Henderson's city limits, with the exception of one new steel, double circuit 230

kV transmission structure, and approximately 500 feet of overhead double circuit 230 kV

transmission line along with telecommunications and related appurtenances to ensure safe and

reliable operation. This portion of the project is located in unincorporated Clark County, and

therefore, requires a permit to construct pursuant to the Utility Environmental Protection Act.

5. The customer has requested an in-service date of May 2019, which the

Company has stated it will take reasonable efforts to meet this date. Thus, the project and the

associated facilities including the new substation are on an expedited construction schedule.

6. The construction of the project and new facilities requires the Company take a

line outage, however, the Company can only take an outage between October 2, 2018 and April

30, 2019. If the Company misses this outage period, then it cannot provide the customer an

in-service date until November 2019.
