Definition of Family

Household will mean a nuclear family comprising mother, father, and their children, and may include any person dependant on the head of the family. Household will also mean a single-member family.

Eligibility Criteria

Local Resident / Resident of the Panchayat Adult – 18 years of age Willing to do physical labour

Registration

Any family residing in rural areas can apply for registration

Registration is open through out the year No cost for registration – form etc. Panchayat office will help beneficiaries that are

illiterate Committee can also be formed at the Panchayat

level to register families

Job-cards

Job-card will be provided free of cost 15 days after registering Job-card will be valid for five years

Demand for Job

Demand for work in their respective GP They can ask for work in the Block office /

Programme Officer Job application could be made alone or in group Provision for advance application If form (B-1) not available they can apply for job in

plain paper

Employment GP / PO shall be responsible for providing wage within 15 days

of the receipt of the application Job will be provided for at least 15 days Job will be provided within 5 km radius 10% of minimum wage towards travel if given outside 5 km

radius Applicants will be intimated by written letter and a public

notice will be displayed at the office of GP and PO Priority shall be given to women 1/3 of the job shall be given to

women In case of advance application, employment will be provided

from the date the employment has been sought, or within 15 days of the date of application whichever is later

Unemployment Allowance

If Employment is not provided within 15 days of receipt of his application he shall be entitled to a daily Unemployment allowance

For First 30 days ¼ of the minimum wage For remaining period of the financial year not less

than ½ of the minimum wage Employment wage + Unemployment allowance =

Equal to the wages for 100 days of work in a financial year

Wage Payment

Wages either on time rate or piece rate basis Equal Wage for both men and women Wage should be paid on a weekly basis

– on a pre-announced date – not later than a fortnight

Should be paid in public place with muster roll being read out aloud and displayed at the time of payment

If through bank/ post office detail should be made public In the event of delay state will bear the compensation cost

as per Payment of Wages Act - 1936

Worksite Facilities

Safe drinking water Shade for children and periods of rest First-aid Box for emergency treatment and minor

injuries Crèche - one woman worker to look after five or

more children below the age of six years at the work site

Deputed woman shall be paid wage rate

Permissible Work

Wage cost to material cost will be 60:40 At least 50% of the work will be executed by GP

Selection of Work

The Gram Panchayat shall be responsible for identification of projects in the GP and prepare a development plan as recommended by Gram Sabha

Gram Panchayat shall Maintain a shelf of possible works to be taken up as and when demand for work arises

Sanction and

Allotment of Work

Programme Officer at the block level GP shall forward its proposals in the order of priority

to PO for approvals PO shall allot at least 50% works in terms of cost to

be implemented through GP

Compensation

Medical treatment free of charge If any person employed or child accompanying gets injured

During the period of hospitalization the injured worker shall get free accommodation, treatment and medicines half of the wage per day to be paid to injured person

If a person employed under a scheme dies or becomes permanent disabled the legal heirs of the deceased or the disabled shall get Rs.25000 By the Central government

Labour displacing machine is banned Contractors are also banned in MGNREGA

Transparency and Accountability

All efforts should be made to ensure transparency and public accountability

RTI Act (Section 4) should be followed in letter and spirit – proactive disclosure

All accounts and records relating to work shall be made for public scrutiny

A copy of Muster Rolls of every work shall be made available in the office of PO and GP for inspection by any person after paying such fee

The DPC, PO and GP shall prepare annually report containing the facts and figures and achievements relating to scheme within its jurisdiction

All the above documents shall be made available to the public on demand and on payment of prescribed fees – 7 days – as per actual cost

Social Audit

Transparency: complete transparency in the process of administration and decision making – people’s access to all relevant information

Participation: all affected persons participate in the process of decision making

Consultation and Consent: Accountability: answerable to action and inaction to

concerned and affected persons Redressal: findings of social audit are investigated and

action taken and response to complaints

Social Audit

The Gram Panchayat shall make available all relevant documents; MRs, bills, vouchers, MBs, Sanction orders and other books of accounts and paper to the Gram Sabha for the purpose of social Audit

The Gram Sabha Shall conduct regular social audit of all the works done by GP (every six months)

PO and DPC are the Grievances redressal officers at block and district level

Grievances Redressal

If any dispute or complaint arises at the GP level the matter shall be referred to PO

The PO shall enter every complaint in a complaint register and shall dispose the disputes and complaints within 7 days of its receipt
