Grant the NERCrequest for clarification of Order No. 748 including: (1) the proper effective date language for Reliability Standard IRO-004-2; (2) the correct version identification for the approval of EOP-001intended by the Commission; and (3) the proper effective date for Reliability Standard EOP-001-2. The Commission also grants NERC’s request for clarification of Order No. 749 with respect to the version EOP-001 the Commission intended to approve and its effective date.

    U5 Order On Smart Grid Interoperability Standards

    RM11-2-000 7/19/11 Section 1305(d) of the Energy Independence and Security Act of 2007 directs the Commission to institute a rulemaking proceeding to adopt such standards and protocols as may be necessary to insure smart-grid functionality and interoperability in interstate transmission of electric power, and regional and wholesale electricity markets once it is satisfied that the work of the National Institute of Standards and Technology has led to “sufficient consensus” on smart grid interoperability standards. The Commission finds that there is insufficient consensus for the five families of standards under consideration.For this reason, the Commission will not institute a rulemaking proceeding at this time with respect to these standards and terminates this docket. In this order, the Commission encourages stakeholders to actively participate in the NIST interoperability framework process to work on the development of interoperability standards and to refer to that process for guidance on smart grid standards.

    TFCP has charged CP11 with a comprehensive review ofDirectory #1 to include the triennial document review, an examination of the NERC TPL standards, the existing NPCC planning criteria, and the implementation of Phase 2 of the Directory Project which will reformat existing Directory criteria into NERC style requirements. CP11 on schedule to post the document for a second time in late August, and anticipate Full Member approval by the end of 2011.

    #5 (A-6) Operating Reserve

    TFCO Directory#5 was approved by the Full Members on December 2, 2010. TFCO working to resolve outstanding reserve issues associated with Directory #5. TFCO expects to post a revised version of Directory #5 to the Open Process incorporating further changes to the document this Fall.

    #6 New Reserve Sharing

    TFCO TFCO considering draft of a new Directory on Regional Reserve Sharing which would replace C38 until a Regional Standard is developed. TFCO expects to post an initial draft of Directory #6 to the Open Process this Fall.

    #7 (A-11)

    Special Protection Systems

    Approved on 12/27/07.

    TFSP nearing completion of NRAP review of Directory #7. TFSP to incorporate these recent NRAP revisions (including Appendix A) of the document into a Phase 2 version and post for member comment this Fall.

    #8 (A-12)

    System Restoration

    Approved on 10/21/08.

    TFCO made revisions to criteria for battery testing in October, 2010. Next review date July 9, 2012.

    Verification of Generator Real Power Capability

    Approved on 12/22/08.

    TFCO has posted the initial Phase 2 drafts of both Directories #9 and #10 to the Open Process. TFCO currently developing responses to comments received during the initial posting and a second Open Process posting for both documents is anticipated in late August, 2011.

    Expect Full member approval of both Directory #9 and #10 by December , 2011.

    Northeast Power Coordinating Council, Inc. (NPCC) Antitrust Compliance Guidelines

    It is NPCC’s policy and practice to obey the antitrust laws and to avoid all conduct that unreasonably restrains competition. The antitrust laws make it important that meeting participants avoid discussion of topics that could result in charges of anti-competitive behavior, including: restraint of trade and conspiracies to monopolize, unfair or deceptive business acts or practices, price discrimination, division of markets, allocation of production, imposition of boycotts, exclusive dealing arrangements, and any other activity that unreasonably restrains competition.

    It is the responsibility of every NPCC participant and employee who may in any way affect NPCC’s compliance with the antitrust laws to carry out this commitment.Participants in NPCC activities (including those participating in its committees, task forces and subgroups) should refrain from discussing the following throughout any meeting or during any breaks (including NPCC meetings, conference calls and informal discussions):

    � Industry-related topics considered sensitive or market intelligence in nature that are outside of their committee’s scope or assignment, or the published agenda for the meeting;

    � Their company’s prices for products or services, or prices charged by their competitors;

    � Costs, discounts, terms of sale, profit margins or anything else that might affect prices;

    � The resale prices their customers should charge for products they sell them;� Allocating markets, customers, territories or products with their competitors;� Limiting production;� Whether or not to deal with any company; and� Any competitively sensitive information concerning their company or a

    competitor.

    Any decisions or actions by NPCC as a result of such meetings will only be taken in the interest of promoting and maintaining the reliability and adequacy of the bulk power system.

We are surprised that NPCC does not recognize that there are conflicts, or at least appearance of,between the proposed definition and the regulatory framework applicable in the Canadian provinces.NPCC has signed MOUs with each of the province in its territory should it knows well what isapplicable. Here is what HQT will likely provide as its response to question 12: There appears to be a conflict between the proposed definition and the regulatoryframework applicable in Québec or at least there are some important differencesbetween both. [b1] NERC's proposed definition of Bulk Electric System (“BES”) is made in response toFERC's Order 743. FERC is looking to eliminate regional discretion, and in somecase to make sure BES includes the most important national load centers. As for the case of HQT's System, the definition of the BES shall meet theexpectations of Quebec's regulator, the Régie de l'Énergie du Québec, (QuebecEnergy Board) which has the responsibility to ensures that electric powertransmission in Québec is carried out according to reliability standards it adopts. In arecent order (D-2011-068), the Régie de l'Énergie du Québec has recognized a fewlevel of application for the Reliability Standards in Québec. It states specifically thatthe majority of reliability standards in Québec shall be applied to the MainTransmission System (MTS). One other level of application recognised by thisdecision is the NPCC Bulk Power System (BPS) to which the standards related to the

  • protection system (PRC-004-1, PRC-005-1 and PRC-018-1) and those related to thedesign of the transmission system (TPL 001-0 to TPL-004-0) will be applicable. Thedefinition of this Main Transmission System is somewhat different than the definitionof the Bulk Electric System. The Main Transmission System can be described asfollow : The transmission system comprised of equipments and lines generally carrying largequantities of energy and of generating facilities of 50 MVA or more controllingreliability parameters:· Generation/load balancing· Frequency control· Level of operating reserves· Voltage control of the system and tie lines· Power flows within operating limits· Coordination and monitoring of interchange transactions· Monitoring of special protection systems· System restoration Therefore, it will be necessary to accommodate any difference or distinction betweenNERC's proposed definition of BES or the exception process and the reality ofQuébec with a few levels of application among which most reliability standards areapplicable to the Main Transmission System. After reading this, NPCC now knows for a fact that there is at least one conflict. NPCC's responseshould be something like: "The proposed definition will have a direct impact on many entities and will be in conflict withregulatory requirements which non FERC jurisdictional must comply."

    Draft Scope of Work for the

    Regional Standards Committee (RSC)

    The NPCC Regional Standards Committee (RSC), a committee of the NPCC Board of Directors (BOD), is charged with:

    (a) managing the NPCC Regional Standards Development Process. (b) managing the NPCC Directory and Criteria Development Process. (c) providing consolidated NPCC Regional review and comment to the existing and

    proposed NERC Standards and participating in the NERC Reliability Standards Development Process.

    (d) reviewing the FERC Orders, Rulings and Notice of Proposed Rulemakings (NOPRs) related to reliability Standards, providing a forum for developing consensus viewpoints, and submitting comments to FERC, as necessary.

    (e) reviewing NERC Compliance Application Notices (CANs) working in coordination with the NPCC Compliance Committee (CC) and submitting comments to NERC, as necessary.

    (f) providing consolidated NPCC Regional review and comment to the existing and proposed NERC Standards Development Process Manual, and to the NERC Rules of Procedure as they relate to Standards Development. (g) determining the need for and development of interpretations. (h) providing a forum for sharing viewpoints and opinions with the goal of achieving

    consensus.

    After receiving input from any or all NPCC groups and The RSC, for all submissions of standards related comments on behalf of NPCC, after receiving input from any, or all NPCC groups the RSC will be the only body submitting those comments to FERC, NERC, or any other industry entities.

    The RSC is an open and balanced stakeholder committee inclusive of all stakeholder interests that provide for or are materially impacted by the reliability of the bulk power system. The RSC meetings will be open to all stakeholders who want to participate and will be publicly posted on the NPCC Website.

    Decisions of the RSC will be adopted under a sector based voting structure as described in the NPCC Amended and Restated Bylaws.

    The RSC will coordinate its work through NPCC Standards Staff which will administer the NPCC Regional Standards Process and coordinate the review and submission of comments.

    The RSC will be chaired by an NPCC member of Staff who will be assisted by the NPCC Regional Standards Process Manager (also a member of NPCC Staff) along with co-vice chairs elected by the RSC from the existing members of the Committee at the time the vote is taken. The co-vice chairs will serve a term of two years. The vice-chair term may be extended through a motion and subsequent vote by the committee in accordance with the NPCC Amended and Restated Bylaws.

    Members of the RSC will be elected by the NPCC Board. Each of the NPCC Sectors as defined in the NPCC Amended and Restated Bylaws will be represented on the RSC.

    Subcommittees and ad hoc Working Groups will be formed upon request of the RSC, by NPCC Standards program area Staff and all associated scopes or charters developed will be approved by the RSC in accordance with the most recent approved NPCC Amended and Restated Bylaws.

    The RSC is responsible for managing the standards process for development of standards, VRFs, VSLs, definitions, variances and interpretations in accordance with the NPCC Regional Reliability Standard Process Manual. The RSC is responsible for ensuring the quality of all Standards related materials.

    A. Management of the NPCC Regional Standards Process

    The RSC will be available to advise the NPCC BOD on any standard related matters.

    All RSC Regional Standard related decision making activities will be approved or rejected by a vote as outlined in the NPCC Amended and Restated Bylaws as they pertain to quorum and voting rules.

    The RSC manages and has oversight of the processes for development of NPCC Directories and Criteria. The RSC is responsible for ensuring the quality of all Directory and Criteria related materials. RSC will provide groups generating documents Quality Review guidance, and guidance on how to generate the documents.

    B. Management of the NPCC Directory and Criteria Process

    The RSC will be available to advise the NPCC BOD on any Directory and Criteria related matters.

    Standard Authorization Requests (SARs), and their respective Reliability Standards, are developed as part ofin accordance with the NERC Standard Processes Manual.

    • Identify upcoming issues associated with new NERC Reliability Standards and their potential impact toon the NPCC Region, (i.e. Regional Difference).

    • Propose solutions or guide the development of the Standards through effective and timely comments and soliciting NPCC participation on the SAR and Reliability Standards drafting teams.

    • Develop and maintain a Web-Based Database for tracking and scheduling Standards development activities from a Regional perspective.

    • Target a broaderwider range of participantstion in the standard commenting process. Develop databases and e-mail list servers to engage market participantsmore members and to elicit different perspectives.

    • Develop an entire process for notification, solicitation, commenting on and for proposing revisions to Standards.

    • Follow up on theproposed and adopted changes to the NERC Standard Processes Manual and Rules of Procedure, as they apply to Reliability Standards, evolution and provide NPCC members with basic information (or pointers to the NERC Website) for a common understanding of the process.

    • Coordinate the activities of NPCC members on standard drafting teams. • The RSC will review draft NERC CANs for Reliability Standard, and compliance

    implications after receiving CC input, and submit comments to NERC.

    The RSC will review FERC Orders, Rulings and Notice of Proposed Rulemakings (NOPRs) relatinged to Reliability Standards. The RSC will discuss, develop comments, and if necessary submit the comments to FERC on behalf of NPCC.

    Guy Zito reminded everyone that the RSC Meeting is open, and anyone can call in, and proper decorum is to be observed. Brian Gooder and David Kiguel suggested that a list of all those on the phone be obtained.

    Guy Zito introduced the topics to be covered on the Agenda. He mentioned that an item was added to Item 5 regarding a notice of a deficiency in planning for N-1 overloads that FERC issued. Guy Zito asked if there were any items to be covered May 18, 2011 because of attendees’ schedules. Brian Gooder asked that the BES items be addressed. Mike /Garton said that because of conflicting obligations he would only be calling in for about 1 hour at tomorrow’s session. Guy Zito stressed that he needs RSC thoughts on

    cost effectiveness, and the proposed triage process. Need to develop recommendations for the TPL and TOP postings. The revisions to the RSC Scope document also need to be gone over so it can be presented to the NPCC Board of Directors. The NPCC Regional Standard Development Process worked on by Brian Gooder and Kurtis Chong needed to be reviewed. There are also informational items on the Agenda. Directives will be looked at to prepare for actions that may be needed. Guy Zito will take advantage of the resources available in the NPCC Staff, and if necessary seek legal assistance from Margaret Mayora.

    The minutes of the March 16-17, 2011 RSC Meeting were reviewed, and Kurtis Chong’s comments were discussed as follows:

    KBC1 (Item 9d, p. 6)--A GO/TO group was formed that produced a white paper that said a SAR should be initiated. The minutes were to be left as is.

    KBC2 (Item 9e, p. 6)--To be left as is. Did not have information to make the change.

    KBC4 (Item 5, p. 15)--To be left as is.

    Item 9a--This is a RFC Standard, and was just mentioned but not discussed.

    Item 9b--RSC discussion of the comments submitted by TFSS:1. The RSC disagrees with the TFSS position on Part 1.1.5 of TPL-001-2. 2. No discussion needed.3a. Was a process issue.3b.     Si-Truc Phan remarked that Hydro-Quebec TransEnergie would be voting “No” for the following reasons:

    The impact is not the same for firm load and firm transfer on 10 minute reserve and any UFLS action.

    From Table 1 footnote 3, the definition of EHV facilities should be changed to Bulk Electric System (BES) level references including extra-high voltage (EHV) Facilities defined as those representing the backbone of the System, generally at voltages greater than 300 kV, and high voltage (HV) Facilities defined as those not representing the backbone of the System, as determined by the Planning Coordinator and approved by the Regional Entity.

    From Table 1b, “Consequential Load Loss as well as generation loss is acceptable as a a consequence of any event excluding P0". Firm Transmission Services Loss should be added as being also acceptable (particularly in the P1 Loss of a single pole of a DC line for which the transfer is reduced accordingly to the remaining pole capability).

    Guy Zito considered the discussion and initially felt that an “Affirmative” vote would be in order, but after hearing the discussion felt that there might not be a recommendation because of the outstanding issues raised.

    Randy MacDonald commented that non-consequential load loss is a concern, and he is leaning towards a “No” vote.

    Guy Zito will send a note to TFSS directing them to submit their own comments.

    Michael Schiavone commented that he didn’t see the need for Part 2.7.1. A statement will be added to the Comment Form reflecting that.

    Gregory Campoli’s comments on 2.1 and 2.2 were added to the Comment Form.

    Michael Schiavone said that National Grid’s comments were given to TFCP.

    Comments submitted by the New Brunswick System Operator were incorporated in the Comment Form with some revisions.

    Guy Zito said that there will be time to review the comments. He will then determine what the RSC wants to recommend--either a “Yes” or “No” vote.

    Item 9c--Comments submitted by Kurtis Chong and Kathleen Goodman were discussed. Kurtis Chong commented that R2 in TOP-001-2, from an operational perspective, should not have times. “Upon recognition” from R2 implies immediately. Kathleen Goodman commented that the industry should recommend to NERC that VRFs and VSLs shouldn’t be in standards. Kurtis Chong reviewed his comment regarding rearranging the wording in R4.

    Regarding TOP-003, the revisions to Part 1.1 are not acceptable. The proposed revisions read as follows: “Operating parameters for equipment BES Facilities and Facilities at voltage levels lower than the Bulk Electric System, at the discretion of the Transmission Operator or Balancing Authority BES.”

    Item 9d--Brian Evans-Mongeon mentioned that FERC wants UFLS and UVLS schemes to be part of the Bulk Electric System definition.

    For consideration when filling out the Comment Form, Chris de Graffenried sent a WECC diagram to the group to use as an example. David Kiguel read his preliminary comments. They were not distributed at that time. Chris de Graffenried discussed Con Edison’s intended response to Question 1 regarding the core definition of BES.

    Comments were to be sent to Lee Pedowicz. A comment that will be added pertaining to the Exclusion Section that has to do with how a fault current level supervised automatic fault interrupting device (such as a Circuit Switcher) affects the definition. Regarding E3d, energy is not to be transferred through the LDN under all operating conditions.

    Directories #9 and #10 have been identified to be reformatted in accordance with Phase 2 of the Directory Project. Additionally, TFCO to incorporate draft language that would revise section 7.0 to ensure that documentation is not sent to TFCO. The next TFCO review is scheduled for July, 2011.

    #10(A14) Verification of Generator Reactive Power Capability

    #12 UFLS Program Requirements

    Approved on 6/26/09.

    Small entity (less than 100MW) revision approved by Full Members on 3/3/2010. The RCC approved one additional year for Quebec to complete UFLS implementation (Quebec implementation term is now three years). Open Process posting concluded on Jan. 21, 2011 that considered revisions to the UFLS Implementation Plan.

    b. Directory Work Plan for Phase 2 Reformatting.

    Gerry Dunbar discussed the spreadsheet he developed that tracks the Directory Phase 2 Development. RSC is to provide direction to TFCO on the order of getting Directories 2, 5, and 8 revised. RSC also to provide direction to TFSP on the order of getting Directories 3, 4, and 7 revised. Directories 1, 9, and 10 are in the process of being reformatted.

    David Kiguel asked about the relationship of the BES definition to NPCC documents. Guy Zito responded that Criteria will be governed by A-10. Regional Standards will be governed by the BES definition.

    Kathleen Goodman commented that a lot of work is being done on the Directories, and eventually they will be eliminated. She suggested that work only be done on those with the highest importance. Guy Zito mentioned that Directories are needed for the CCEP. Directories were developed at the request of the NPCC Board ofDirectors, and that the CC requested the Phase 2 Project.

    Kathleen Goodman asked if the cost benefit of keeping the Criteria after the “bright line” is adopted could be looked at.

    Guy Zito suggested that issues with keeping the Directories be taken up with the appropriate NPCC Board of Directors member.

    Directory 1 is not being discussed from an operations perspective. Kathleen Goodman suggested having both TFCO and TFCP take ownership of it.

    Greg Campoli remarked that the CC needs to know the schedule for the Directory revisions. He is looking for a milestone. A column will be added to the spreadsheet that will show the anticipated date for getting a Directory to the RCC.

    Northeast Power Coordinating Council, Inc. (NPCC) Antitrust Compliance Guidelines

    It is NPCC’s policy and practice to obey the antitrust laws and to avoid all conduct that unreasonably restrains competition. The antitrust laws make it important that meeting participants avoid discussion of topics that could result in charges of anti-competitive behavior, including: restraint of trade and conspiracies to monopolize, unfair or deceptive business acts or practices, price discrimination, division of markets, allocation of production, imposition of boycotts, exclusive dealing arrangements, and any other activity that unreasonably restrains competition.

    It is the responsibility of every NPCC participant and employee who may in any way affect NPCC’s compliance with the antitrust laws to carry out this commitment.Participants in NPCC activities (including those participating in its committees, task forces and subgroups) should refrain from discussing the following throughout any meeting or during any breaks (including NPCC meetings, conference calls and informal discussions):

    � Industry-related topics considered sensitive or market intelligence in nature that are outside of their committee’s scope or assignment, or the published agenda for the meeting;

    � Their company’s prices for products or services, or prices charged by their competitors;

    � Costs, discounts, terms of sale, profit margins or anything else that might affect prices;
