These outrageous rules and regulations have a huge impact on us, so I encourage everyone to call our Representative and Senators, daily if necessary. Be the thorn in their sides that won’t go away and let’s get rid of these unwanted regulations. Where does the time go? Here it is, November ,and time is

running out for outside work. Before we know it that ugly but

A pat on the back to everyone for their input and voice to

NAHB and our Congressional Delegates in Washington for

stopping WOTUS for the time being, pushing back the

confined space ruling to January of 2016, and for getting some

of the other rulings dropped or redefined. These outrageous

rules and regulations have a huge impact on us, so I encourage

everyone to call our Representative and Senators, daily if

necessary. Be the thorn in their sides that won’t go away and

let’s get rid of these unwanted regulations.

November 5-6 we will be in Deadwood for the Fall Board

Meeting and Annual Installation and Awards banquet. Thank

you to the Black Hills HBA for getting everything put

together. I was assured it will be the best and I don’t have any

doubts. You haven’t let us down before. I look forward to

seeing everyone there! It’s always a pleasure getting together

with my HBA family.

Our National Chairman Tom Woods will be there, along with

our NAHB Field Rep Michael Bezruki and Ariel Moyer,

Director of the Executive Officer Council.

Membership Services Report Well by the time this hits the Newsletter our membership Drive “We Want You” will be over. At this time right now we have 1,812 members for end of September. Thank you for your participation and congratulations to those who signed up new members. The Two Year Residential Carpentry Program started in Brook-ings in September has eight students. Classes are going well and all students have placement for on the job training. This program was just approved as a prerequisite for getting into the four year program. As the HBA Membership Rebate Program goes there will be another $2,636.00 distributed to the Builder Members using this program. Working in “Unity” is better than working “Divided.” More is accomplished with results benefiting all who is involved. - Lynn Mennis, SDHBA Membership Chair

2015 Fall Board was eventful on a variety of levels – the short trip being the first detail – as there was much

discussion regarding this and the lack of having subcommittee meetings, which weighed very negatively in

most every committee. The 2nd being the utilization of electronic voting. We were given a remote when we

entered the board room and had to return it if you left the room. Your ID would be input and they would be

aware of your attendance and vote. Personally, I think this will be a wonderful addition and will hopefully

assist in attendance and accountability at NAHB meetings. The 3rd would have to be the involvement I will

have at the meetings to come. Some of you may not have heard - but I was offered the opportunity to serve

as the 2nd Vice Chair for the Associates Committee at NAHB. It was something extremely unexpected and

something I never thought imaginable, but needless to say I am very excited and humbled at the opportunity.

Without mentors like Jim Lowe and Kim Hefner-Hines this opportunity never would have been possible.

Mentors and programs that involve mentoring are vital – they are extremely important in organizations like

NAHB. We have seen the importance of this first hand not only in our local, state and national associations,

but in the building industry as well. The push to fill the void we have of employees in our industry is at the

forefront. Its vital to our building industry, our communities and our state.

We have to teach, groom and backfill the “up and coming” so that they are prepared to step in and move for-

ward with the fire and passion that so many of us have – but the question is always – how do we get them in-

volved?! I am so please to announce that during the fall meeting, the board voted to establish a Young Pro-

fessionals Committee for members age 45 and under. The committee will recommend policies, programs and

services to provide a community for young professionals in the industry. Since this is newly established, the

deadline to apply has been extended beyond the Oct. 18 deadline. If this is a committee that you are interest-

ed in being a part of – please visit NAHB.org it would be a great opportunity to get involved in a new upcom-

ing committee. I would like to congratulate my mentor, Kim Hefner-Hines for her committed effort on this

task –which was over two years in the making.

There were some great statistics given by guest speaker, Secretary Julian Castro – US Department of HUD

that I felt were important to share with you.

Did you know that 80% of FHA loans this year went to 1st time home buyers. Home sales so far this year

are up 22% over last year.

Millennials (ages 25-34) make up the largest share of homebuyers.

68% of 1st time homebuyers make up majority of our workforce.

With that David Crowe noted that the driving force of homeownership in this country is having children and

marriage. He also noted that we will see a raise in mortgage interest rates in 2016 and 2017.

Membership as of August 2015 is 140,549 with annual retention of 78.2%. Five out of the fifteen areas have

experienced growth at the end of August and most have not had their fall membership drives. Spring drives

were very successful – nationally locals brought in more than 3,600 new members. Participation has been up

as well with a 6% increase over last year.

Remember November is Spike Appreciation Month – be sure to recognize your spikes – ALL your spikes,

there is no better way to encourage more participation than to thank them for all that they have done already!

NAHB is hard at work building OUR Brand. There is some exciting new marketing coming soon. The mem-

ber campaign that they are working on is “We are NAHB, Welcome Home”. Quite honestly the pieces we

got to see are very inviting and universal and they are working to make them accessible and usable for every

local to use. There is also a newsletter template that is in the works as well, which can be implemented at the

local and state levels – which has important information from NAHB for our members and has the ability to

input/omit what each local would like. This will be a tremendous asset!

IBS 2016!! If you have not signed up – do it today – don’t miss out! This years opening ceremonies will in-

clude Jay Leno!!! Not to mention the Spike Party being rocked by Hall and Oats! And if politics is your hot

button – well you will for sure not want to miss out on this – there will be a Presidential Candidate Forum

held on January 20th. Yes – that’s right a Presidential Candidate Forum. Never has there been such an excit-

ing time to headline the value of the building industry and its importance to our economy than during an Elec-

tion cycle – so bring on the Candidates and let’s “Rock the Vote”!

The 2015 Fall Board Meeting was the last of the format of three National meetings, and it was memorable on

many fronts. We had another round of discussions on many national issues, mostly from the regulation area.

The federal government seems to believe that all construction people need to be closely watched and scruti-

nized. First up was The Waters of the United States (WOTUS), and it’s impact on all aspects of land use and

ownership. NAHB was one of the leaders in the opposition to this unbelievable rule. And on October 9th a

federal court issued a stay on enforcement of this rule; giving NAHB and landowners a huge victory….for

now…stay tuned. OSHA has it’s time at the top of our list for new rules regarding confined spaces as well as

our usual favorites: silica sand regulations and our continuous battle with lead paint; and as has been the case

in recent years; we continue to lead the fight to push back un-necessary government regulation in our indus-

try and increased cost of our buyers. The IRS continues it’s work to classify all sub-contractors as employees

with all of the increased costs associated with employees and the tax implications. The Department of Labor

is still working to implement new overtime rules that would also impact the cost and affordability of housing.

As you can see, NAHB still has a lot of work to do to protect our industry and provide housing to every as-

pect of the market. Now for some lighter news from the meeting.

Health Insurance: The Board passed a motion to bring Health, Life, and other forms of personal insurance to

our membership to offer more options to our members and help them comply with the Affordable Health

Care Act for themselves and their employees. The rollout starts November 2nd, so more information will be

coming soon. There is also a revenue sharing element that will benefit our locals and state association.

NAHB’s 75th anniversary: 2016 starts a full year of celebration and commemoration of a milestone in hous-

ing, culminating in a huge event during IBS 2017. Much more coming on this in the new year.

IBS 2016: It’s bigger; it’s better; it has more new stuff and programs, it has more new fun stuff to do. Booth

sales are up and still strong with 500,000 sq ft of NAHB booths plus nearly 300,000 sq ft of our partners in

Design and Construction Week (KBIS and others). Sponsorship is way up as our exhibitors again see the

value of reaching our members. Registrations are up and a few hotels are sold out already, so don’t

wait….get your plans made soon!

Budget & Membership: The NAHB budget is in better shape than it has been in over seven years, a sign that

we are regaining our place leading the Home Building industry. On the membership front we are showing

slow progress in gaining new members but continuous growth and improvement in retaining the members we

have. The revitalized push to show the value in membership is gaining and keeping our members. There is so

much more information that comes from these meetings than can be printed here, so please contact me if you

Secretary Julian Castro, the US Department of Housing and Urban Development, addressed the board about

the role his agency is taking on housing recovery with the help of NAHB leadership.

There were no resolutions offered at the board meeting, the board however took action to approve the budget

(in the black) and to create a Young Professionals Committee for professionals under 45, which will be

geared towards increasing involvement from the next generation of NAHB leaders.

Chairman Tom Woods announced that NAHB has partnered with the National Journal to host a forum for

Presidential candidates at the 2016 IBS.

A preliminary injunction issued by the District Court of ND has temporarily stopped the EPA from imple-

menting the Waters of the US rule. An update from October 9 the US Court of Appeals ordered a nationwide

say on the agency’s new definitions, which had dramatically expanded federal jurisdiction over our nation’s

wetlands. The court agreed that new definitions finalized earlier this fall dramatically alter the existing bal-

ance of federal-state collaboration in restoring and maintaining the integrity of the nation’s waters as the

states contesting the new rules had changed.

An announcement was also made that there will be two new affinity programs rolling out soon. NAHB Exec-

utive Board approved the first new program on September 27 for a Health Insurance Services Affinity pro-

gram, which will be provided by an independent firm by the name of Marsh & McLennan. EO’s should have

received an email with details. Additional information can be found at nahb.org/marsh. States who currently

offer a health insurance program to their members will be allowed to opt out.

The second program will officially launch at the 2016 International Builders’ show. Members will be able to

receive various discounts on products and services on Houzz.com. HBAs will be able to created profiles that

link their local members. State and local HBA’s will be contacted with additional information soon.

On June 30, the Department of Labor (DOL) proposed increasing the salary threshold to $50,440 per year as

of 2016, which is the 40th percentile of earning for all full-time salaried workers. This is an unprecedented

102% increase in the salary threshold. For the first time ever, DOL has proposed increasing this minimum

salary on an annual bases by pegging it to the 40th percentile or by indexing it to inflation. NAHB estimates

over 116,000 construction supervisors will now be non-exempt from overtime requirements under this pro-

posal. On September 4, NAHB submitted extensive comments about the negative impacts of the proposed

rule and continues to actively engage.

The National Labor Relations Board recently issued its decision in Browning Ferris, where it is unilaterally

expanded the definition of “joint employer” to included an employer who has indirect or potential control.

Contractors are concerned this overly broad definition could make them liable for other company’s workers

under the National Labor Relations Act.

In past reports I have discussed NAHB Contracts Subscriptions Service and I want to remind you that you can

go to nahbcontracts.com and access contracts from any device. Experienced builders, remodeler’s construc-

tion law attorneys and industry experts developed this program. The site offers some of the most useful con-

tract documents; there are 27 different contracts available.

NAHB is launching a newsletter template for local associations. The newsletter can be branded with the local

association logo and customized to accommodate both content generated by the local and also populate it with

content provided by NAHB. The template will soon be available for use. Anyone interested participating in

the program should contact Blake Smith at NAHB.

NAHB staff developed a toolkit for associations who are looking to produce a Parade Of Homes in their com-

munity. You can access the toolkit at nahb.org/parade.

Build-PAC at fall board was exciting, with a lot of controversy on contribution levels. This

year we have established guidelines on contributions based on criteria. Such as grade level-

which is based on voting record on housing issues, committee level participation and many

more criteria levels. This is new and with anything new trustees are not accustomed to it.

We distributed approximately $300,000 and Senator John Thune was approved for a contribu-

tion. With that being said, we are looking for opportunities to award John his contribution. If

your association is having an event and would like to see if your date will work with Senator

Thune’s busy schedule, please contact me and we would put forth all efforts to make it hap-

pen.

South Dakota was ranked 6th in percentage towards our goal, so a huge “Thank You” for all

of your fundraising. Our national goal is $3,000,000 for the 2015-2016 cycles. We are cur-

rently at $900,000 and need to be at $1,500,000 by the IBS show in January. We have some

work ahead of us!

National PAC Chariman, Fred Hoppe is asking “Has your state done their fair share?” Over

96% of NAHB members do not support Build-PAC, leaving just 4% of our members to

shoulder the weight of our most important political tool.

Build-PAC’s success is critical to ensure that the interest of the housing industry is heard on

Election Day in 2016. We need every member to do their part!

Beginning Dec. 21, the Environ-mental Protection Agency (EPA) will require builders to submit their National Pollutant Discharge Elimi-nation System (NPDES) program information online, replacing the current paper-based reporting sys-tem.

This rule does not require online submission of Stormwater Pollution Prevention Plans, or SWPPPs. It does, however, apply to forms such as the Notice of Intent for coverage, Notice of Termination and Low Erosivity Waivers.

NAHB has long supported EPA’s effort to develop an online report-ing rule. “Since permit coverage is usually expedited when done elec-tronically, we are hopeful that bringing clean water reporting out of the Dark Ages will save builders time and money,” said NAHB Envi-ronmental Issues Committee chair Geep Moore. “However, there is still work to be done to ensure that certain types of sensitive data are handled correctly and efficiently.”

In its comments to EPA, NAHB voiced concern that, under this rule, builders might have to “double report:” submit online to EPA while still submitting paper forms to a

state regulator if their state failed to meet strict electronic reporting im-plementation deadlines.

The final rule promises to solve this problem by allowing states to not require any additional forms from builders until its online report-ing process is working. So this “switching” of whom to report to doesn’t cause confusion for per-mitees, EPA will seek to ensure that, regardless of whether EPA or the state is supporting the data-base, builders will still report their information via familiar state Web portals.

NAHB also convinced EPA to give states five years, rather than only two, to get their online permit col-lection systems up and running.

Where Reporting is a Problem

NAHB was also concerned about builders working in rural areas where Internet access is often spotty at best. Under EPA’s origi-nal proposal, temporary waivers for such issues would be available for only one year at a time. In the final rule, EPA now allows each state or authorized NPDES program to ex-tend the maximum waiver time to

five years: another NAHB victory for members.

Stakeholders also voiced concern over requiring builders to use ex-pensive authentication software to submit certified electronic signa-tures on compliance documents. (A signature is required by law.)

Under the final rule, construction site operators can either submit a certified electronic signature or submit all paperwork electronically without a certified electronic signa-ture, as long as they also send a signed hard copy of electronic forms.

Moving to online permits means an increased potential for false or in-complete enforcement data to be published and released via public websites: a security and confidenti-ality issue raised by NAHB on be-half of its members. NAHB will work closely with states to ensure that builders and developers have ample opportunity to address po-tential misrepresentations of data, and that clear systems allow per-mittees to expediently address any reporting errors.

OSHA AGREES TO POSTPONE CONFINED SPACES RULE ENFORCEMENT

In a victory for single-family res-idential home builders, the Oc-cupation Health and Safety Ad-ministration (OSHA) announced Oct. 2 its decision to delay en-forcement of the new Confined Spaces in Construction Stand-ard until Jan. 8, 2016. Though the ruling became ef-fective Aug. 3, OSHA has agreed to refrain from issuing citations to any employer that is making good-faith efforts to comply with the standard. This temporary enforcement policy applies to construction on single-family homes, duplexes and townhouses in federal juris-dictions, but does not include multi-unit apartment building. OSHA-approved state plan en-forcement dates may vary; for more information visit osha.gov/dcsp/osp. Confined spaces, such as manholes, tanks, or sewers, are work areas that are not designed for continuous occu-

pancy and may be difficult to exit in the event of an emergency. On May 4, 2015, OSHA issued a final rule to in-crease protection for construction workers in confined spaces. What is a confined space? As defined by OSHA, a confined space has:

Limited means of entry and/or exit

Is large enough for a worker to enter it

Is not intended for regular/continuous occupancy

What are examples of locations where confined spaces may oc-cur during home construction? Examples of locations in home build-ing where confined spaces may in-clude, but are not limited to: manholes, sewer systems, stormwater drains, water mains, crawl spaces, attics, heating, ventilation, and air-conditioning (HVAC) ducts, and pits. What is a permit required confined space? A permit required confined space is a space that may have a hazardous at-mosphere, engulfment hazard, or oth-er serious hazard, such as exposed wiring, that can interfere with a work-er's ability to leave the space without

assistance. Only workers assigned and trained to work in a permit re-quired confined space may do so. A permit specifying safety measures and names of those permitted in the space must be written before any work can take place. Employers are also re-quired to develop a written confined space program if workers will enter permit required confined spaces. How does the new final rule differ from the rules that previously applied to construction work performed in con-fined spaces? The rule requires employers to deter-mine what kinds of confined spaces their workers are in, what hazards could be there, how those hazards should be made safe, what training workers should receive, and how to rescue those workers if anything goes wrong.

The Clean Power Plan has been published in the fed-eral register more than two months after the President and EPA Administrator Gi-na McCarthy announced the finalization of the rule. It goes into effect Dec. 22. The final rule includes key changes championed by NAHB on behalf of our members. It has triggered a series of state actions as states develop their plans to be in compliance with EPA-established emission reduction requirements. Additionally, EPA published a related proposed rule that is open to public comment. It contains multiple com-panion items to help imple-ment the Clean Power Plan, including two model

rules that states could use — once finalized — for their compliance plans to ease the approval pro-cess. The proposed rule al-so includes two draft feder-al plans. EPA has included several new provisions in the final Clean Power Plan that were not open for comment under the original proposal. One is the Clean Energy Incentive Program, intend-ed to encourage early ac-tion on renewable energy and energy-efficiency pro-jects in low-income com-munities. NAHB is review-ing the program, which is outlined in the proposed model rules, and will submit comments on this and all other relevant provisions.

EPA is also accepting com-ments on related draft guid-ance that will affect how emission reductions from demand-side energy-efficiency programs are ac-counted for if states choose to use them as a compli-ance tool.
