Contractors intending to bid this work must submit five (5) complete copies of the Contractor’s Qualifications asdescribed above. Complete submittals will be received by the ODOT Office Engineer Division, and then forwardedto a six (6) person evaluation team chaired by Mr. Casey Shell, ODOT Chief Engineer. It is the responsibility of theContractor to ensure that the submittal includes the above mentioned documents, and is complete enough for theevaluation team to clearly determine that the members of the Erection Team (Professional Engineer, On-siteSupervisor, and Erection Foreman) each satisfy the required Contractor Qualifications described above. Uponreceiving the submittal the evaluation team will examine the Contractor's Qualifications and notify each Contractorwithin two (2) weeks with regard to the acceptance or rejection of the submitted qualifications. Acceptance of theseContractor Qualifications is a pre-requisite to the sale of the associated bidding documents to the Contractor.

The structural steel for the railroad truss bridge shall be erected by a qualified, competent Erection Contractor. For the purposes of thisproject, a "qualified, competent Erection Contractor" is a construction company that possesses knowledge, training, and experience inerecting railroad, city, state or federal highway through-truss spans, or other significantly complex bridge structures, and has the technicalproficiency and ability to complete the work specified in the contract documents. The Erection Contractor must be able to resolve commonproblems associated with the complexity of the proposed railroad truss bridge. American Institute of Steel Construction (AISC)certification as an Advanced Certified Steel Erector (ACSE) is a minimum requirement.
The Erection Contractor must submit a project reference list verifying their experience in the successful erection and construction of atleast three (3) bridge structures of significant complexity including, but not limited to through-truss design within the past 15 years. Provide a brief description of each project with the owner's name and current phone number.
The Erection Contractor must submit a resumé of the registered Professional Engineer who is employed by, or under contract with theErection Contractor. The resumé shall verify that the experience of the Professional Engineer includes the construction and erection ofat least three (3) bridge structures of significant complexity including, but not limited to through-truss design within the past 15 years. The presented registered Professional Engineer must be registered with the State of Oklahoma, and must supervise the work.
The Erection Contractor’s On-site Supervisor and Erection Foreman must have experience installing at least three (3) bridge structuresof significant complexity including, but not limited to through-truss design within the past 15 years. The Erection Contractor is notallowed to use consultants or manufacturer's representatives to satisfy the requirements of this section.
The Contractor who is awarded this contract shall be required to complete the work specified in the bidding documents using the personnelsubmitted and approved as part of these Contractor Qualifications. The Erection Contractor’s Professional Engineer, On-Site Supervisor,and Erection Foreman shall comprise the project’s Erection Team. A minimum of two (2) members of the Erection Team must be presentat the project site whenever work is being performed that requires the oversight of the Erection Team. The replacement of members ofthe pre-accepted Erection Team must be evaluated by ODOT prior to incorporation into the Erection Team. Work will be suspended ifthe Contractor uses non-accepted personnel, and will not be allowed to resume until the changes to the Erection Team have been acceptedby ODOT. If work is suspended due to changes to the Erection Team, the contractor shall agree to hold ODOT harmless for any damagesresulting from the work suspension imposed by ODOT, and no compensation shall be considered.

The U.S. Department of Labor, Wage and Hour Division, has revised regulations,pursuant to the Davis-Bacon and Related Acts and the Copeland Anti-Kickback Act tobetter protect the personal privacy of laborers and mechanics employed on coveredconstruction projects.
The final rule, 29 CFR Parts 3 and 5, has an effective date of January 18, 2009. Therevisions shall be applicable to federally assisted construction contracts entered intopursuant to invitations for bids issued or negotiations concluded on or after January 18,2009.
The rule change states, in part, “ The payrolls submitted shall set out accurately andcompletely all of the information required to be maintained under 29 CFR Part 5.5(a)(3)(i), except that full social security numbers and home addresses shall not be includedon weekly transmittals. Instead, the payrolls shall only need to include an individualidentifying number for each employee.”
The rule suggests that the last four digits of the employee’s social security number be usedas the employee’s identification number. There is no prescribed method required by U.S.DOL.
The prime contractor is responsible for the submission of copies of payrolls by allsubcontractors. Contractors and subcontractors shall maintain the full social securitynumber and current address of each covered worker, and shall provide them upon requestof the federal and/or state agency responsible for the contract for purposes of aninvestigation or audit of compliance with prevailing wage requirements. It is not aviolation of the rule for a prime contractor to require a subcontractor provide addressesand social security numbers to the prime contractor for its own records, without weeklysubmission of such information to the sponsor government agency.
If the contractors utilize an electronic payroll system, a change from social securitynumber to a personal identification number may require programming changes. If it ismore convenient for the contractors, FHWA agrees that they may go ahead and make thenecessary changes on all existing contracts, rather than only on those entered into after theeffective date.
The provisions of the contracts will be revised to reflect this rule change as soon aspractical. Should you have questions, you may contact the Regulatory Services Office at(405) 521-6046.
Until further notice all projects which include a pay item for ContractorsQuality Control (Item 643) will require the bidder to bid a minimum
amount for that item.
This minimum will be specified at the end of the Special Provision 648-1QA(a)09,Payment for Contractor's Quality Control. You may increase this amount as necessary
to cover the estimated Quality Control expenses.
Failure to include at least this amount will be considered grounds forrejection of Contractor's bid as nonresponsive.
ReminderThe low bidder must submit to the Office Engineer Division written confirmation fromthe DBE that it is participating in the contract as provided in the Prime Contractor'scommitment. This may be submitted with the bid or not later than the Department's closeof business on the Wednesday following the bid opening. Otherwise the bid shall beconsidered nonresponsive and shall be rejected by the Department. Unless otherwise noted in the proposal, all bids must be submitted over the Internet via Bid Express. Whenwritten bids are allowed, sealed proposals sent by registered mail will be received through the ODOT OfficeEngineer Division until 30 minutes prior to the scheduled bid opening. From 30 minutes prior to the bidopening until the time of the bid opening, bid proposals must be turned in directly to the ODOT CommissionRoom located on the east side of the lobby.
