bThepropertyislocatedwithintheAlbanyUrbanGrowthBoundaryasestablishedbytheAlbanyComprehensivePlanFINDINGSOFFACTAIThesubjectpropertiescontainapproximately282acresandazecontiguoustothecurrentcitylimitsalongthewestpropertyboundarySeeStaffReportAttachmentAA2Plate1oftheCitysComprehensivePlanshowstheUrbanGrowthBoundaryUGBThesubjectpazcelsarewithintheUGBCONCLUSIONA1ThiscriterionismetbecausethepropertyproposedforannexationiscontiguouswiththeexistingcitylimitsandiswithintheAlbanyUGBBInfrastructureCriteriaTheCityshalldeterminethatitistimelytoannexpropertybasedonthefollowingcriteriaaAnadequatelevelofurbanservicesandinfrastructureisavailableorwillbemadeavailableinatimelymannerbAsusedinthissectioniAdequatelevelmeansconformstoadoptedplansandordinancesiiUrbanservicesmeanspolicefireandotherCityprovidedservicesiiiInfrastructuremeanssanitarysewerwaterstormdrainageandstreetsBemadeavailableinatimelymannermeansthatimprovementsneededforanadequatelevelofurbanservicesandinfrastructurewillbeprovidedatthetimeandplaceneededtoservetheanticipateddevelopmentImprovementsmaybesecuredbyadevelopmentagreementannexationagreementorotherfundingmechanismthatwillplacetheprimaryeconomicburdenontheterritoryproposedforannexationandnotontheCityofAlbanygenerallyFINDINGSOFFACTB1CityutilitymapsshowthatnopublicwaterfacilitiesexistalongthefrontageofthesubjectpropertyThenearestpublicwatermainliesinKnoxButteRoadapproximately3200feetwestofthesubjectpropertyB2TheCitysWaterFacilityPlan2004callsfortheextensionofa24inchpublicwatermaininKnoxButteRoadtoScravelHillRoadB3Cityutilitymapsshowthatan8inchpublicsanitarysewermaincurrentlyexistsinattheintersectionofKnoxButteRoadandMarilynStreetapproximately400feetwestofthesubjectpropertyB4TheCitysWastewaterFacilityPlan1998indicatesthattherearenosystemdeficienciesdownstreamofthissiteThesewerliftstationonSantaMariaAvenuehasadequatecapacitytoaccommodatetheadditionaldischargeanticipatedfromdevelopmentonthesubjectpropertyWhenafuturepublicsewermainisextendedfromSomersetDrivetoSantaMariaAvenuetheliftstationwillberemovedorabandoned7

B5TheCitysStormDrainageMasterPlan1988indicatesthatthesubjectpropertieslieentirelywithintheTruaxCreekdrainagebasinThePlanshowsnocapacitydeficiencieswithinadjacenttoordownstreamofthesubjectpazcelsFig91The1988planindicatesthatthemainchannelofTruaxCreekissufficienttocarrythe100yearstormflowsTheMasterPlanstatesOneproblemareawasidentifiedintheTruaxCreekdrainagebasinFloodingoccursinDrapervilleanareanorthofKnoxButteRoadandsouthofthemainchannelofTruaxCreelcThisareahasveryflatgradesandisservedbyanopenchannelandculvertdrainagesystemItisrecommendedthatthisexistingdrainagesystembecleanedandimprovedtoincreaseitscapacityApipenetworkcouldbeconsideredinthefutureaspartofoverallroadwayimprovementsFuturedevelopmentonthesubjectpropertywillrequirethatadrainageplanbeprovidedbythedevelopertoshowhowstormwaterrunofffromthesitewillbecollectedandproperlydischazgedtothepublicdrainagesystemB6ThesubjectpazcelscurrentlyhaveaccesstoKnoxButteRoadKnoxButteRoadisclassifiedasaminorarterialstreetandisunderthejurisdictionofLinnCountyThepostedspeedlimitonKnoxButteRoadis45milesperhourNewdevelopmentonproperlywithfrontagealongKnoxButteRoadmayberequiredtoconstructstreetandstormdrainageimprovementsinKnoxButteRoadatthediscretionofLinnCountyB7SanFeliciaAvenueisanunimprovedstreetwithinapublicrightofwaythatextendsfromKnoxButteRoadonthewesttothewestboundaryofthesubjectpropertyontheeastSanFeliciaAvenuehasatravelsurfaceofapproximately20feetwidewithina50footrightofwayThestreetandadjacentparcelsarecurrentlyinunincorporatedLinnCountySanFeliciaAvenueisunderthejurisdictionofLinnCountyB8ADC12060allowstheCitytoimposeconditionsforthededicationandconstructionofpubliccitystreetimprovementswithinandadjacenttonewdevelopmentB9AdequatepublicwaterflowforfireprotectioniscurrentlynotavailableinthisareaTheunincorporatedterritoryinthisareaiscurrentlyservedbytheAlbanyFireDepartmentaspartofaruralfireprotectiondistrictBeforeurbandensitydevelopmentcouldoccuronthepropertyadequatepublicwaterfacilitieswouldneedtobeconstructedtothesiteB10AlbanyPolicecurrentlyservestheDrapervilleazeajusttothenorthwestofthesubjectpropertiesandotherpropertieswithintheCitylimitsneazthesubjectpropertyServicetothesubjectpropertieswouldappeartobealogicalextensionofthecurrentpatrolboundaziesB11TheapplicantsfindingsstateThetimelinessofthedevelopmentwillbesecuredthroughanimprovementagreementorothermechanismtoassurethatthedeveloperisresponsiblefortheextensionoffacilitiesnecessarytoservethesiteB12AnAnnexationAgreementmustbesignedbythepropertyownersapplicantsCONCLUSIONSB1ThiscriterionismetbecausetheassociatedAnnexationAgreementseeStairReportAttachmentEensuresthatanyadditionalpublicimprovementsnecessarytoservefuturedevelopmentonthesubjectpropertieswillbemadebythebenefitingpropertiesandnotbytheCityofAlbanygenerallyB2KnoxButteRoadisclassifiedasaminorarterialstreetinAlbanysTSPandisnotimprovedtoCitystandardsKnoxButteRoadisunderthejurisdictionofLinnCountyKnoxButteRoadisadequatetoservetheexistingsinglefamilyusesonthepropertyAdditionaldevelopmentonthesitemayrequireatrafficanalysisandorstreetimprovementstoassuresafetransportationfacilitiesSanFeliciaAvenueisalocalunimprovedstreetthatisunderthejurisdictionofLinnCountyB3ThiscriterionismetbecausefireserviceisalreadyprovidedtotheseparcelsbytheCitythrougharuralfiredistrictPropertiesadjacenttothissitenorthwestareservedbytheCitysfireandpolicedepartmentssotheadditionofthisazeatothecitylimitswouldbealogicalextensionofthecurrentserviceboundariesAnnexationoftheexistingvacantresidencesonthesubjectpropertywillnotcreateanadverseburdenon8

publicfacilitiesFuturedevelopmentonthepropertywouldrequirethatthedeveloperconstructpublicinfrastructureasneededtoadequatelyservetheproposeddevelopmentCPlanningCriteriaTheCityshalldeterminethatadequateplanninghasoccurredbasedonthefollowingcriterionSufficientplanningandengineeringdatahavebeenprovidedandnecessarystudiesandreviewshavebeencompletedsuchthattherearenosignificantunresolvedissuesregardingappropriateComprehensivePlanandimplementingordinancesExamplesofneededstudiesmayincludepublicinfrastructureplansbuildablelandsinventoriesarearefinementplansoranytaskinanapprovedworkprogramforPeriodicReviewFINDINGSOFFACTC1Thisannexationrequestisfortwoparcelsthattotalapproximately282acresTheComprehensivePlanMapdesignationforthesepropertiesisURRUrbanResidentialReserveseeStaffReportAttachmentBTheapplicanthasnotsubmittedaconcurrentzonechangeapplicationatthistimesothezoningwouldremainLinnCountyUGAUGM20untilafuturezonechangeapplicationisapprovedbytheCityC2PublicinfrastructurefacilityplansthatdealwiththisazeaincludeWaterFacilityPlan2004WastewaterFacilityPlan1998StormDrainageMasterPlan1988TransportationSystemPlan1997C3Thesubjectpropertywasnotinthestudyazeaforthe1995EastI5VisionC4TheLocalWetlandsInventoryfortheEastI5area1997showswetlandsontheseparcelsThewetlandsonthesubjectpropertiesarenotconsideredtobelocallysignificantaccordingtothislocalinventorySeeattachedmaplabeledStaffReportAttachmentDC5InthepasttheCityCouncilhasexpressedconcernregazdingresidentialdevelopmentwithbackyardfencesalongarterialandcollectorstreetsStaffhasaddressedthisconcernwithintheproposedAnnexationAgreementSeeStaffReportAttachmentETheCityCouncilmayconsideramendingtheAlbanyDevelopmentCodetoprohibitbackyardfencesalongarterialandcollectorstreetsinthefutureCONCLUSIONSC1ThiscriterionismetbecausetheComprehensivePlanandinfrastructurefacilityplansprovidesufficientplanningandengineeringdatarelatedtothispropertyC2TheAnnexationAgreementaddressesthefenceissueDReasonablenessTheCityCouncilshalldeterminethattheproposedannexationisreasonableFINDINGSOFFACTD1TheapplicantsfindingsstateItisreasonabletoconsidertheterritoryforannexationatthistimeTheannexationappropriatelyplacesthesitewithinthemunicipalboundarieswhereitismoreefficientlyservedbytheCitythanbytheCountyAnnexationwillresultinashyinpropertytaxestotheCityforprovisionoffacilitiesTheproposaltoannexisareasonableandlogicalextensionofthecitylimitsinthisareaofAlbanyD2TheapplicantsfindingsstateAnnexationisapredevelopmentstageTherearevacantresidentiallotsinthispartoftheCityHomesaleshavechangedfromonetypeofmarkettoanotherHoweversubdivisionofthepropertytocreatesinglefamilylotsisonlyonedevelopmentoptionAfallinghomemarketdoesnotnecessarilyimpactthispropertytotheextentthattheCityshouldnotconsiderannexationatthistimeInfactitisprudentfortheCitytoconsiderannexationatthistimeandconsideringrezoningtoaCityzoneatalaterdatewhentheusesonthepropertycanbeanalyzedinmoredetailforaspecificdevelopment9
