CORPORATION OF THE CITY OF NORTH YORK
BY-LAW NUMBER 32475
A By-law to amend By-law No. 7625, as amended.
THE COUNCIL OF THE CORPORATION OF THE CITY OF NORTH YORK, PURSUANT TO SECTION 34 AND 36 OF THE PLANNING ACT R.S.O. 1990, ENACTS AS FOLLOWS:
Schedules "B" and "C" of By-law 7625 are amended in accordance with Schedules 1 to 12.
Section 30.10 of By-law 7625 is repealed, and is replaced with the following:
"30.10 Adult Entertainment Parlours
Adult entertainment parlours are permitted in all areas zoned Industrial (M) except for the Industrial-Office Business Park (MO) zone, subject to the following requirements:
(a) An adult entertainment parlour shall be allowed only in a building where it is the sole use;
(b) The building containing an adult entertainment parlour shall not be permitted on any lot abutting provincial highways or arterial roads;
(c) The lot containing an adult entertainment parlour shall be located at least 150 metres from provincial highways or arterial roads;
(d) The lot containing an adult entertainment parlour shall be located at least 300 metres from any other lot containing an adult entertainment parlour; and
(e) The lot containing an adult entertainment parlour shall be located at least 500 metres from any R or RM zone."
Section 64 of By-law 7625 - EXCEPTIONS is amended by:
(a) adding the following to subsection 64.31:
"64.31(2) M1(2)
PERMITTED USES
(a) Adult entertainment parlours are not permitted."
(b) adding the following to subsection 64.32(16) M2(16):
"PERMITTED USES
(a) Adult entertainment parlours are not permitted."
(c) repealing Section 64.32(22) M2(22) and adding the following:
"64.32(22) M2(22)
PERMITTED USES
(a) Notwithstanding the provisions contained in Section 32 of By-law 7625, nothing shall prevent the use as a rehabilitation centre of the lands provided, however, the lands in all other respects shall be subject to the provisions of Section 6 of By- law 7625.
(b) Adult entertainment parlours are not permitted."
(d) adding to Section 64.32(23) M2(23), PERMITTED USES, the following:
"(b) Adult entertainment parlours are not permitted."
and repealing in Section 64.32(23) M2(23), EXCEPTION REGULATIONS, the following:
subsection references "(b), (c), (d), (e), (f), and (g)", and replacing them with "(c), (d), (e), (f), (g) and (h)" respectively.
(e) adding the following to subsection 64.32:
"64.32(35) M2(35)
PERMITTED USES
(a) Adult entertainment parlours are not permitted."
(f) adding the following:
"64.33 EXCEPTIONS TO M2S ZONE (CONTROLLED STORAGE INDUSTRIAL ZONE)
The following exceptions apply to the M2S zone:
64.33(1) M2S(1)
PERMITTED USES
(a) Adult entertainment parlours are not permitted."
(g) adding the following:
"64.34 EXCEPTIONS TO M3 ZONE (INDUSTRIAL AND STORAGE YARD ZONE)
The following exceptions apply to the M3 zone:
64.34(1) M3(1)
PERMITTED USES
(a) Adult entertainment parlours are not permitted."
(h) adding the following to subsection 64.32-A:
"64.32-A(8) MC(8)
PERMITTED USES
(a) Adult entertainment parlours are not permitted."
