– Regarding restoration of one third portion of
commuted pension after 15 years from the date
of commutation – Instructions were issued
vide Boards letter No.F(E)III/96/PN1/9 dated
18.08.98 and 02.08.2000 for restoration of one
third commuted portion of pension after 15
years from the date of commutation or 1st April
1985 whichever is later in respect of Govt.
servants who has drawn lumpsome payment on
absorption in PSO/Autonomous Bodies,
wherein it has been stated that basic pension
sanctioned at the time of absorption of such
Govt. servants is to be notionally revised in
accordance with the then prevailing instruction
and one third of the revised pension is to be
restored after 15 years from the date of
commutation or 01.04.1985 whichever is later
and Dearness Relief is to be paid on full
notional pension. It has been desired by the
Board that appropriate action for finalizing the
restoration of 1/3 position of pension to PSU
absorbers in terms of the existing rules and
regulations in the matter in view of orders of
the High Court of Andhra Pradesh. Interim
stay has also been granted by the Hon’bel
Supreme Court on the question of order of
calculation of commuted portion of pension of
PSU absorbers as ordered by CAT Hydrabad.

LDCE to the same extent. It has been decided that
vacancies may be filled by LDCE and promotion

LDCE. In case of fraction also the vacancy should
go to LDCE. Once the prescribed percentages are

Employees often submit undertakings signed
by Railway authorities agreeing to recover the
loan repayments from their salary and remit

It has been clarified by Board that extent rules
do not permit such augment of recovery of
private loans taken by Railway Employee from
Banks/non-Railway thrift Societies from their
salary for remittance to such banks/societies.
Railway administration should not act as
guarantor on behalf of the Railway employees
in such cases. Whenever instances of taking
loans, non-repayment etc. by Railway
employees on their own comes to the notice of
the Railway administration it should be
examine whether there has been any violation
of Railway servants (Conduct) Rules 1966 if
so, necessary action may please be taken
against such employees.

leave on the date of retirement to the Central
Govt Employees who are compulsorily retired
as a measure of punishment under the
Disciplinary Rules – Railway Ministry’s

encashment of unutilized leave on average pay
(LAP) will be allowed to those Railway
servants who are compulsorily retired as a
measure of punishment under disciplinary
rules even if a cut in pension (including
gratuity) has been ordered, and the sanction of
cash equivalent to leave salary for LAP at the
credit of the Railway servant on the date of
such retirement may be sanctioned by the
authority competent to grant leave subject to
the maximum number of days permissible
under the rule in the manner specified in
Railway Ministry’s decision 4 of Rule 550A.
