The Postgraduate Committee considered the Council Inspector (October, 2009) and decided to recommend to the Central Govt. to issue Letter of Permission for increase of seats in MS(Ophthalmology) course at Sardar Patel Medical College, Bikaner under Rajasthan University of Health Sciences, Jaipur u/s 10A of the I.M.C. Act, 1956 prospectively i.e. from the academic session 2010-2011 from 2(Two) to 4(Four) students per year till the first batch admitted against the increased number appears in the final examination of the said course. The institution be advised to apply for recognition of the qualification for the additional increased intake at the time of first available examination as per the provision of Section 11(2) of the IMC Act, 1956.

facilities available at the E.S.I-PGIMSR, Rajajinagar, Bangalore for starting of MS(Orthopaedics) course under Rajiv Gandhi University of Health Sciences, Bangalore u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Council Inspector (September, 2009) and decided to recommend to the Central Govt. not to issue Letter of Intent for starting of MS(Orthopaedics) course at E.S.I-PGIMSR, Rajajinagar, Bangalore under Rajiv Gandhi University of Health Sciences, Bangalore because of the followings:-

(i) There is no Dean. (ii) There is no Professor & Associate Professor in the department. (iii) Resultantly, teaching faculty component is inadequate. (iv) Average daily OPD is 89, which is inadequate. (v) Average daily bed occupancy is 76%, which is inadequate. (vi) Average daily 1 major operation only, which is inadequate. (vii) Resultantly, clinical material is inadequate. (viii) There is no departmental library. (ix) There is no departmental museum. (x) There is no space for departmental office or teaching faculty. (xi) There is no departmental research laboratory. (xii) Hostel for PG students not available. (xiii) Arthroscope, ‘C’ arm image intensifier and orthopaedic operation table

are not available. (xiv) There is no wardside lab. (xv) There is no fracture clinic. (xvi) Facilities for occupational therapy are not available. (xvii) Investigative facility for nerve conduction is not available. (xviii) Other deficiencies/observations as pointed out in the inspection report.

07: Increase of seats in MS(Ophthalmology) course at Rural Medical College, Loni

u/s 10 A of the Indian Medical Council Act, 1956.

Read: the Council Inspector Report (September, 2009) on the physical and other teaching facilities available at the Rural Medical College, Loni for Increase of seats in MS(Ophthalmology) course under Pravara Institute of Medical Sciences, Loni (Deemed University) u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Council Inspector Report

(September, 2009) and decided to recommend to the Central Govt. not to issue Letter of Intent for increase of seats in MS(Ophthalmology) course at Rural Medical College, Loni under Pravara Institute of Medical Sciences, Loni (Deemed University) because of the followings: -

(i) Promotion of Dr. S.V. Bongal, Professor & HOD, is not as per Regulations as he has been promoted as Asso. Prof. with experience of only 4 y 3 m as Asst. Prof. against the requirement of 5 y as per Regulations.

(ii) Dr. Shubhangi Nigwekar, Assistant Professor, Unit-II, does not have recognized postgraduate qualification.

(iii) Other deficiencies/observations as pointed out in the inspection report. In view of above, the Committee further decided to direct the institution

authorities to henceforth stop admission in MS(Ophthalmology) course from the academic session 2010-2011

08: Starting of MD(Community Medicine) course at Kamineni Institute of

Medical Sciences, Andhra Pradesh u/s 10 A of the Indian Medical Council Act, 1956.

Read: the Compliance verification report (October, 2009) alongwith council

inspector’s report (March, 2005) on the physical and other teaching facilities available at the Kamineni Institute of Medical Sciences, Andhra Pradesh for starting of MD(Community Medicine) course under Dr. NTR University of Health Sciences, Vijayawada u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Compliance verification report (October, 2009) and decided to recommend to the Central Govt. to issue Letter of Permission for starting of MD(Community Medicine) course at Kamineni Institute of Medical Sciences, Andhra Pradesh under Dr. NTR University of Health Sciences, Vijayawada u/s 10A of the IMC Act, 1956 prospectively i.e. from the academic session 2010-2011 restricting the number of admission to 3(Three) students per year, till the first batch admitted appears in the final examination of the said course. The institution be advised to apply for recognition of the qualification at the time of first available examination as per the provision of Section 11(2) of the IMC Act, 1956. 09: Increase of seats in MD(Psychiatry) at NKP Salve Institute of Medical

Sciences, Nagpur u/s 10 A of the Indian Medical Council Act, 1956.

Read: the Council Inspector (October, 2009) on the physical and other teaching facilities available at the NKP Salve Institute of Medical Sciences, Nagpur for Increase of seats in MD(Psychiatry) course under Maharashtra University of Health Sciences, Nashik u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the compliance verification report (October, 2009) and decided to recommend to the Central Govt. not to issue Letter of Intent for increase of seats in MD(Psychiatry) course at NKP Salve Institute of Medical Sciences, Nagpur under Maharashtra University of Health Sciences, Nashik, as the clinical material is just adequate for present annual intake of 1 student. 10: Starting of MD(Forensic Medicine) course at Mahatma Gandhi Medical College & Hospital Jaipur under University of Rajasthan u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Compliance verification report(October, 2009) alongwith council inspector’s report (Dec,2008) and decided to recommend to the Central Govt. not issue Letter of Intent for starting of MD(Forensic Medicine) course at Mahatma Gandhi Medical College & Hospital Jaipur under University of Rajasthan because of the followings:-

1. The staff of the institute are not allowed to perform medico-legal work and the

State Govt. has deputed one Medical Officer for Medico-Legal work of the institution.

2. Other deficiencies/observations as pointed out in the inspection report.

The Postgraduate Committee considered the compliance verification report(October, 2009) alongwith Council inspector’s report (Jan, 2009) and decided to reiterate its earlier decision taken as its meeting held on 31.01.2009 not to issue Letter of Intent for starting of MD(Forensic Medicine) course at Kamineni Institute of Medical Sciences, Narketapally, Andhra Pradesh under Dr. NTR University of Health Sciences, Vijayawada, as the following deficiency is still persisting:-

(i) The Institute is not permitted to carry out medico-legal post-mortems. Permission is available to attend post-mortem at Govt. hospitals for U.G. students.

14: Starting of MS(Orthopaedics) course at Mediciti Instt. of Medical Sciences,

Ghanpur under NTR University of Health Sciences, Vijayawada u/s 10A of the IMC Act, 1956.

inspector’s report (May, 2009) on the physical and other teaching facilities available at the Mediciti Instt. of Medical Sciences, Ghanpur for starting of MS(Orthopaedics) course under Dr. NTR University of Health Sciences, Vijayawada u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Compliance verification report (September, 2009) alongwith council inspector’s report (May, 2009) and decided to reiterate its earlier decision taken at its meeting held on 11.05.2009 not to issue Letter of Intent for starting of MS(Orthopaedics) course at Mediciti Instt. of Medical Sciences, Ghanpur under Dr. NTR University of Health Sciences, Vijayawada because of the followings:-

(i) Promotion of Dr. Raman, Associate Professor, is not as per MCI norms. (ii) The average daily OPD is 40. (iii) Bed occupancy is 50%. (iv) Major operations are 2 to 4/week and minor operation are 3-4/week. (v) Resultantly, clinical material is inadequate. (vi) Physiotherapy wing does not have facilities for Orthotics & Prosthetics

and Occupational Therapy. (vii) Other deficiencies/observations as pointed out in the inspection report.

15: Starting of MD(General Medicine) course at Mediciti Instt. of Medical

Sciences, Ghanpur under NTR University of Health Sciences, Vijayawada u/s 10A of the IMC Act, 1956.

16: Starting of M.Ch(Urology) course at N.R.S. Medical College, Kolkata u/s 10 A

of the Indian Medical Council Act, 1956.

Medical College, Kolkata under West Bengal University of Health Sciences because of the followings:-

(i) Urodynamic equipment & lithotripsy machine are not available. (ii) Resultantly, instrumentation is inadequate. (iii) Library lacks urological journal. (iv) Other deficiencies/observations as pointed out in the inspection report.

17: Increase of seats in MD(Dermatology & Venereology & Leprosy) at J. L. N.

Medical College, Ajmer Rajasthan u/s 10 A of the Indian Medical Council Act, 1956.

facilities available at the J. L. N. Medical College, Ajmer, Rajasthan for Increase of seats in MD(Dermatology & Venereology & Leprosy) course under Rajasthan University of Health Sciences, Rajasthan u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Council Inspector (September, 2009) and decided to recommend to the Central Govt. to issue Letter of Permission for increase of seats in MD(Dermatology & Venereology & Leprosy) course at J. L. N. Medical College, Ajmer, Rajasthan under Rajasthan University of Health Sciences, Rajasthan u/s 10A of the I.M.C. The Postgraduate Committee considered the Council Inspector (October, 2009) and decided to recommend to the Central Govt. not to issue Letter of Intent for increase of seats in MS(Orthopaedics) course at NKP Salve Institute of Medical Sciences, Nagpur under Maharashtra University of Health Sciences, as the clinical material is just adequate for present annual intake of 1 Degree & 1 Diploma student. 20: Starting of MD(Radio-Therapy) course at Assam Medical College, Dibrugarh

u/s 10 A of the Indian Medical Council Act, 1956.

The Postgraduate Committee considered the Council Inspector (October, 2009) and decided to recommend to the Central Govt. not to issue Letter of Intent for starting of MD(Radio-Therapy) course at Assam Medical College, Dibrugarh under Dibrugarh University because of the followings:-

1. Average daily OPD is 8-10. 2. Bed occupancy is 10%. 3. Resultantly, clinical material is inadequate. 4. Other deficiencies/observations as pointed out in the inspection report.

21: Increase of seats in MD(Radio-Diagnosis) at J.J.M. Medical College,

Davangere u/s 10 A of the Indian Medical Council Act, 1956, under Rajiv Gandhi University of Health Sciences, Bangalore

facilities available at the J.J.M. Medical College, Davangere for Increase of seats in MD(Radio-Diagnosis) course under Rajiv Gandhi University of Health Sciences, Bangalore u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Council Inspector (October, 2009) and decided to recommend to the Central Govt. not to issue Letter of Intent for increase of seats in MD(Radio-Diagnosis) course at J.J.M. Medical College, Davangere under Rajiv Gandhi University of Health Sciences, Bangalore because of the followings:-

(1) Instrumentation facilities are inadequate as there is no MRI, Mammography,

Angiography (conventional/DSA) and CT Scan is non-functional. (2) Radiation protection service – non-functional. (3) Promotion of Dr. Navin Patil, Professor, is not as per MCI norms.

(4) Other deficiencies/observations as pointed out in the inspection report.

In view of above, the Committee further decided to direct the institution authorities to henceforth stop admission in MD(Radio-Diagnosis) course from the academic session 2010-2011. 22: Starting of MD(Psychiatry) course at Mahatma Gandhi Mission’s Medical

College, Navi Mumbai u/s 10 A of the Indian Medical Council Act, 1956.

Read: the Council Inspector (November, 2009) on the physical and other teaching facilities available at Mahatma Gandhi Mission’s Medical College, Navi Mumbai for starting of MD(Psychiatry) course under MGM University of Health Sciences u/s 10A of the IMC Act, 1956.

The Postgraduate Committee considered the Council Inspector (November, 2009) and decided to recommend to the Central Govt. not to issue Letter of Intent for starting of MD(Psychiatry) course at Mahatma Gandhi Mission’s Medical College, Navi Mumbai under MGM University of Health Sciences because of the followings:-

(1) Number of patients inadequate. (2) No child guidance clinic, no de-addiction centre. (3) Clinical psychologist not available. (4) Psychological testing not available. (5) Occupational Therapist and Rehabilitation facilities are not available. (6) No on-going outreach community services. (7) Other deficiencies/observations as pointed out in the inspection report.

23: Starting of D.O. course at Amrita School of Medicine, Kochi, Kerala under the

Amrita Vishwavidyapeetam u/s 10 A of the Indian Medical Council Act, 1956.

The members of the Postgraduate Committee observed that vide letter No.MCI-

23(1)/2009-Med./4525, dated 23rd October, 2009 sent to all the medical colleges in the country, it was communicated by the Council as under:-

“It has been brought to the notice of the Council that certain institutions are facilitating procurement of air-tickets on behalf of the inspectors and/or are providing air-tickets for the purposes of journey required to be undertaken for the inspection. This practice is undesirable and requires to be discouraged.

Accordingly, you are requested not to pursue this practice of providing air-tickets or facilitating of procurement of air-tickets to the inspectors. It may please be noted that if it is brought to the notice of the Council that the institution has indulged in such a practice in spite of clear and unambiguous directions of the Council, such an inspection will be considered null & void ab initio and the inspection report will not be processed further by the Council. It was informed by the office that on scrutiny of the documents supplied by the

Inspector alongwith the inspection report that although the place of Residence of the Inspector, Dr. Ravi Kumar, is from Chennai, the Ticket has been purchased from Mangalore, where the institute i.e. Father Muller Medical College, Mangalore is located.

After due deliberations, the members of the Postgraduate Committee decided that the inspection report may be treated as null and void and a fresh inspection also be conducted immediately. 39. Increase of seats in MD(Paediatrics) at Govt. Medical College, Kota, Rajasthan

authorities to henceforth stop admission in MD(Paediatrics) course from the academic session 2010-2011. 40. Increase of seats in MD(OBG) at Mahatma Gandhi Medical College &

Research Institute, Pondicherry u/s 10 A of the Indian Medical Council Act, 1956.

(i) There is no Associate Professor in Unit-I. (ii) There are 2 teaching faculty only in Unit D. (iii) Resultantly, teaching faculty component is inadequate. Admission made in PGDSM course after the last date for the academic session

2009-10 at Netaji Subhash National Institute of Sports, Patiala. Read: the letter dated 22/10/2009 & 05/11/2009 received from the Executive Director, Netaji Subhash National Institute of Sports, Patiala regarding Admission made in PGDSM course after the last date for the academic session 2009-10.

The Postgraduate Committee considered the letter dated 22/10/2009 & 05/11/2009 received from the Executive Director, Netaji Subhash National Institute of Sports, Patiala regarding Admission made in PGDSM course after the last date for the academic session 2009-10 and decided to reiterate it earlier decision taken at its meeting held on 18.09.2009, which reads as under:-

“The Postgraduate Committee considered the list of admission made in the Govt. Medical Colleges for the academic session 2009-10 and noted that the following medical colleges have admitted students after the last date i.e. 20th June, 2009 fixed by the Hon’ble Supreme Court vide order dated 26/05/2009 for admission for the said session:- SPORTS AUTHORITY OF INDIA, PATIALA

(ii) There shall be no admission of students in respect of any academic session beyond 31st May for postgraduate courses and 30th September for super speciality courses under any circumstances. They Universities shall not register any student admitted beyond the said date.

(iii) The Medical Council of India may direct, that any student identified as having obtained admission after the last date for closure of admission be discharged from the course of study, or any medical qualification granted to such a student shall not be a recognized qualification for the purpose of the Indian Medical Council Act, 1956.

Since, the above medical college have admitted students after the last date i.e. 20th June, 2009 prescribed by the Hon’ble Supreme Court for admission of students in Govt. Medical Colleges for the academic session 2009-10, the Postgraduate Committee decided to initiate action by issuing discharge notice in respect of the above mentioned students.”

47. i) Starting of M.S. (Orthopaedics) course at Mata Gujri Medical College,

Kishanganj u/s 10 A of the Indian Medical Council Act, 1956.

ii) B.N. Mandal University - Recognition of D.Ortho qualification in respect of Mata Gujri Medical College, Kishanganj.

The Postgraduate Committee considered the compliance together with Council inspector report (May 2009) and noted that Dr. P.P. Sanghvi, Associate Professor, Unit-III, does not possess prescribed academic qualification.

However, the teaching faculty complement other than the teacher mentioned

above is adequate and complete; and hence decided to recommend that M.D.(Paediatrics) qualification granted by Datta Meghe Institute of Medical Sciences University, Nagpur in respect of students being trained at J.N. Medical College, Swangi Wardha be recognized and included in the 1st Schedule to the I.M.C. Act, 1956 restricting the number of admissions to 2(Two) students per year.

The Postgraduate Committee further decided that the attention of the institute be

drawn to Clauses 6.4 and 6.6 of the Postgraduate Medical Education (Amendment) Regulations, 2000, Part-II, dated 21st July, 2009 and act accordingly at appropriate time, which reads as under:-

“….. 6.4 The recognition so granted to a Post Graduate Course shall be for a maximum

period of 5 years, upon which it shall have to be renewed. 6.6 Failure to seek timely renewal of recognition as required in sub-cluase-4 shall

invariably result in stoppage of admissions to the concerned Post Graduate Course.

University regarding increase of seats in MD/MS courses in order to implement the 27% OBC reservation in the Central Educational Institution as per Government of India, Ministry of Human Resource Development, Department of Higher Education, Office Memorandum 20th April, 2008. The Postgraduate Committee considered the letter dated 30/10/2009 from Director, Banaras Hindu University regarding increase of seats in MD/MS courses in order to implement the 27% OBC reservation in the Central Educational Institution as per Government of India, Ministry of Human Resource Development, Department of Higher Education, Office Memorandum 20th April, 2008 and increase the number of seats in MD/MS courses in the Instt. of Medical Sciences from 87 to 134 to accommodate the students belonging to OBC category upto 27% as per Govt. of India reservation policy.

The Postgraduate Committee noted that as per the provisions of Section 10A of

the I.M.C. Act, 1956, no medical college shall increase its admission capacity in any course of study or training (including a postgraduate course of study or training) except with the previous permission of the Central Govt., obtained in accordance with the provisions of this Section.

The members of the Postgraduate Committee also observed that Regulation 9 of

Medical Council of India (criteria for identification of students admitted in excess of admission capacity of medical colleges) Regulations 1997, pertaining to the excess admission reads as under:- “9 Identification of excess admission & non-recognition of medical qualifications:-

The Council shall find out the excess admissions in a medical college and no medical qualification granted to any identified student of the medical college which comes under the excess admission shall be recognized medical qualification for the purpose of Indian Medical Council Act, 1956 (102 of 1956). The names and other particulars of students so identified shall be intimated by the Council to all concerned for taking action under the provisions of the Act. Any dispute in the matter of identification of excess admission of students(s) in a medical institution shall be referred to the Central Govt., for decision.”

In view of above, the members of the postgraduate Committee decided to initiate action by issuing the discharge notice in respect of the students who have been admitted in excess of the permissible intake and the college authorities may be advised to apply as per provisions of Section 10A of the I.M.C. Act, 1956 for increase of seats in MD/MS courses.

68. Admission made in various postgraduate medical courses after the last date for the academic session 2009-2010 as prescribed in the Postgraduate Medical Education Regulation, 2000 by B.J. Medical College, Pune. Read: the letter dated 03/11/2009 received from the Dean, B. J. Medical College,

Pune regarding admission made in PG Courses after the last date prescribed for the academic session 2009-10.

The Postgraduate Committee considered the letter dated 03/11/2009 received from the Dean, B. J. Medical College, Pune regarding admission made in PG Courses after the last date prescribed for the academic session 2009-10 and observed that the Dean, B.J. Medical College, Pune vide their letter dt.3.11.2009 has submitted as under:-

“1. According to the Hon’ble Supreme Court’s order dated. 26/5/2009, the final admission for

postgraduate courses must be done by Personal Counseling. Therefore, Personal Counseling process was done by the Competent Authority & the Director of Medical Education & Research, Mumbai.

2. The personal counseling of the candidates took place in the Directorate on 18th, 19th and 20th

June, 2009. Accordingly, the last date of admission was 20th June, 2009. Therefore, the admission process was stopped at 5.00 pm. On 20th June, 2009. (for ready reference please see the information given in the table format on page no.2)

3. During the above three days, the admission process was done against receiving admission fees

and original documents of the candidates (Enclosed Xerox copies of the receipt.)

However in the above referred letter dates displayed, by mistake, in the column i.e. ”Date of Admission” were actually the Dates of Reporting to the respective departments and not the dates of Admission. In support of this, they have enclosed the Xerox copies of receipt of admission fees.”

In view of above, the members of the Postgraduate Committee after due

The Postgraduate Committee considered the letter dated 27/10/2009 received from the Dean, Government Medical College, Surat regarding admission made in P.G. courses for the academic session 2009-10 in excess of the admission capacity fixed by the Council and observed that the Dean, Govt. Medical College, Surat vide their letter dt.27.10.2009 has submitted as under:-

1. M.D.(Paediatrics) : This Degree was recognized since March 1984 (before 1992)

Council report as well as recommendation letter of Council PG committee has not mentioned regarding restriction for the number of admission. So teacher student ratio 1:1 implemented & continued.

2. M.D. (Microbiology): No excess admission was given out in our list name of one candidate Dr. Neha Bansal is duplicated in M.D. (Anaesthesia) as well as M.D. (Microbiology). Because first time she got admission in M.D. (Microbiology) in Ist round counseling and then 2nd round counseling she left this college and then in extended 2nd round counseling again she got admission in M.D. (Anaesthesiology) in our in college, So by mistake the name of Dr. Neha Bansal was not omitted in the M.D. (Microbiology) list. Actual 2 (Two) admission given in M.D. (Microbiology).

3. Diploma in Clinical Pathology (D.C.P.): This degree was recognized before 1992. Recommendation letter of Council PG Committee has mentioned that the number of students admitted for these courses should not exceed 4 for M.D. and 8 for D.C.P. per year.

In view of above, the Postgraduate Committee decided to accept the clarification

submitted by the Dean.

70. Admission made in various postgraduate medical courses after the last date for the academic session 2009-2010 at C. U. Shah Medical College, Surendranagar.

Read: the letter dated 11/10/2009 received from the Dean, C. U. Shah Medical

College, Surendranagar regarding admission made in various postgraduate medical courses after the last date for the academic session 2009-2010.

The Postgraduate Committee considered the letter dated 11/10/2009 received

from the Dean, C. U. Shah Medical College, Surinder Nagar intimating that the seats filled in on 19/6/09 were Government quota seats and were filled by P.G. Admission

Committee of Saurashtra University, Rajkot on behalf of Government of Gujarat. The seats were not filled by the institution. Saurashtra University had filled the seats on the basis and in abeyance of the order of Hon’ble Supreme Court of India in the Writ petition No. 216 of 2009, Smita Nath Vs Union of India and others, in the order published on 26th May, 2009. The said order clearly defined that “all States should complete their 2nd round of counseling” before 20/6/09. Accordingly the counseling was completed by Saurashtra University on 19/6/2009.

It was further observed that the admissions were done by the PG Admission

Committee of Saurashtra University, Rajkot in Government quota seats is within the extended period and the admission is not been done in the Private quota of the said college, violating the Postgraduate Medical Education Regulations, 2002.

In view of above, the members of the Postgraduate Committee after due deliberations decided to accept the explanation submitted by the Dean, C. U. Shah Medical College, Surinder Nagar and decided to revoke the decision taken by the Postgraduate Committee to discharge the following students admitted after the last date i.e. 31st May, 2009:-

by the Council for academic session 2009-10. Read: the letter dated 14/10/2009 received from the Dean, Sri Ramachandra

University, Porur, Chennai regarding admissions made in DMRD course in excess of the admission capacity fixed by the Council for academic session 2009-10.

The Postgraduate Committee considered the letter dated 14/10/2009 received from the Dean, Sri Ramachandra University, Porur, Chennai regarding admissions made in DMRD course in excess of the admission capacity fixed by the Council for academic session 2009-10 and observed that the explanation submitted by Dean, Sri Ramachandra University, Porur, Chennai is not tenable in view of the fact that the following decision taken by the General Body of the Council at its meeting held on 16.11.2007 was communicated to the Govt. of India, Ministry of Health & F.W. vide MCI letter dt.21.01.2008, a copy whereof was also endorsed to the Dean, Sri Ramachandra Medical College and the University:-

“The Postgraduate Committee considered the Council Inspector’s report (June, 2007) and noted that MD (Radio-Diagnosis) qualification already stand recognized and now the matter is for consideration of recognition of the qualification in respect of increased intake and decided to recommend that MD (Radio-Diagnosis) qualification granted by Sri Ramachandra University in respect of students being trained at Sri Ramachandra Medical College & Research Instt., Chennai be recognized and included in the 1st Schedule to the I.M.C. Act, 1956 restricting the number of admissions to 5 (five) students per year.

As there are 6 (six) P.G. teachers, the Committee further decided to reduce the number of admission to 1 (one) student per year in DMRD course in conformity with the Regulations on Postgraduate Medical Education, 2000.”

The Postgraduate Committee after due deliberations decided to reiterate the

decision taken in its earlier meeting dt.18.07.2009 to issue discharge notice in respect of students admitted in DMRD course in excess of the admission capacity fixed by the Council.

institutions with regard to number of Professors, No. of Units & bed strength in each Post Graduate Speciality together with the Central Government Gazette notification dated 24/07/2009 regarding amendments in clause 12(1), (2), (3) & (4) of the Postgraduate Medical Education Regulations 2000.

The Postgraduate Committee considered the Central Government Gazette notification dated 24/07/2009 regarding amendments in clause 12(1), (2), (3) & (4) of the Postgraduate Medical Education Regulations 2000 and noted the following:-

1. The ratio of recognized postgraduate teacher to the number of students to be admitted for the degree course where diploma is not prescribed shall be 1:2 for a Professor and 1:1 for other cadres in each unit per year subject to a maximum of 4 PG seats for the degree per unit per academic year provided a complement of 10 teaching beds is added to the prescribed bed strength of 30 for the unit for broad specialities.

2. The ratio of recognized postgraduate teacher to the number of students to be admitted for the degree course in broad specialities where diploma is prescribed shall be 1:2 for a Professor and 1:1 for other cadres in each unit per year subject to a maximum of 4 PG seats including diploma per unit per academic year provided a complement of 10 teaching beds is added to the prescribed bed strength of 30 for the unit.

3. The requirement of units and beds shall not apply in the case of Postgraduate degree or diploma courses in Basic and para-clinical departments.

Provided that against the very same units, teaching personnel and infrastructure, no other postgraduate courses under any other streams like National Board of Examinations, College of Physicians & Surgeons etc. are permitted.

4. The ratio of PG teacher to the number of students to be admitted for super

specialities course shall be 1:2 for Professor/Assoc. Professor and 1:1 for remaining cadre in each unit per year subject to a maximum of 4 PG seats for the course per unit per academic year provided the complement of 10 teaching beds per seat is added to the prescribed bed strength of 20 for the unit.” Provided that against the very same units, teaching personnel and infrastructure, no other postgraduate courses under any other streams like National Board of Examinations, College of Physicians & Surgeons etc. are permitted.

Accordingly a circular was sent by the Council Office to the Health Secretaries of all the states on 15/09/2009 and 24/09/2009 requesting to direct the Deans/Principals to send the information as regards availability of Professors in the subjects of broad specialties and availability of Professors and Assoc Professors in respect of super specialties and also unit wise number of teaching beds and students.

The Postgraduate Committee considered the Council Inspector’s report

(November, 2009) and decided to recommend that DPH qualification granted by Dr. D.Y. Patil University, Pune in respect of students being trained at Dr. D.Y. Patil Medical College, Pimpri, Pune be recognized and included in the 1st Schedule to the I.M.C. Act, 1956 restricting the number of admissions to 2(Two) students per year.

The Postgraduate Committee considered the compliance verification inspection

report (November, 2009 and July 2008) along with Council Inspector’s report (March 2007) on the physical and other teaching facilities available at S.S. Medical College, Rewa in light of Writ Petition No.13939/06 – Dr. Vishal Bansal Vs. State of MP & Ors for permitting intake in M.S. (Ortho.) & D. Ortho. courses and noted the following:-

1. Promotion of Dr. D.N. Sonkar, Professor & HOD, is not as per MCI norms as he

has been promoted as Professor with experience of only 3 years & 7 months as Associate Professor.

2. Unit-II has only 2 teaching faculty members. 3. Resultantly, teaching faculty component is inadequate. 4. Orthopaedics O.T. is running only 4 days a week. 5. Other deficiencies/observations as pointed out in the inspection report.

The Postgraduate Committee also noted that the following deficiencies were observed during the inspection carried out on 27th & 28th November, 2006 for continuance of recognition at MBBS degree:-

V.D. These specialities are sections/divisions of department of medicine. These specialities do not have their separate departmental libraries. The head of department of Medicine is also the head of these specialities which is not as per MCI norms.

4. Hostel accommodation for students is inadequate as it is available for 216 students only against the requirement of 300.

5. Non-teaching staff in the library is inadequate. 6. Number of available journals are only 45 against the requirement of 100. 7. Central Animal house with required facilities are not available. No animal is

regularly maintained in the animal house. 8. No Lecturer cum medical officer having MD(PSM) is available at RHTC.

Infrastructural facilities are inadequate at RHTC. No audio-visual aids are provided.

9. At UHC – No Lecturer-cum-Medical Officer for MD(PSM) qualification is posted. Record for investigations are not maintained properly.

10. Registration counter for OPD is not computerized. 11. The indoor registration counter is not computerized and not cross linked with

the outdoor registration. 12. The Medical Record department is not computerized. ISD classification of record

is not being followed. 13. Only one mobile x-ray unit is available which is inadequate as per MCI norms. 14 Canteen for patients, staff and students is not available. 15. In Pathology department, the up-keeping of the museum is not satisfactory. 16. Service laboratory for Serology, virology, parasitology, mycology and

tuberculosis are not available in the Department of Microbiology. 17. Catalogues are not available in the museum of Deptt. of Forensic Medicine. 18. Number of books in the departmental library in TB & Chest, Psychiatry, ENT,

Paediatrics is inadequate as per MCI norms. 19. Other deficiencies/remarks are in the main report.

In view of above, the Postgraduate Committee decided to reiterate its earlier decision taken at its meeting held on 02.07.2008 for withdrawal of recognition of M.S. (Ortho.) & D. Ortho. qualification at S.S. Medical College, Rewa granted by A.P. University u/s 19 of the IMC Act, 1956. The Committee also reiterated the earlier decision of the Postgraduate Committee taken at its meeting held on 02.07.2008 to direct the institution authorities to henceforth stop admissions in M.S.(Ortho.) & D. Ortho. qualification from the academic session 2009-2010. The Committee further decided to direct the institution authorities to henceforth stop admissions in M.S.(Ortho.) & D. Ortho. qualification from the academic session 2010-2011.

81. Starting of MD(Ophthalmology) course at Katuri Medical College & Hospital, Guntur u/s 10 A of the Indian Medical Council Act, 1956.

Read: the Compliance report along with Council Inspector’s report (October

2009) on the physical and other teaching facilities available at Katuri Medical College & Hospital, Guntur under Dr. NTR University of Health Sciences, Vijaywada for starting of MS(Ophthalmology) course u/s 10 A of the IMC Act, 1956.

The postgraduate committee observed that in the Standard Inspection Form (SIF)

signed by the Dean and submitted by the institute at the inspection of October 2009, the academic qualification of Dr. K.S.N. Rao was mentioned as M.S. (Ophthalmology) from Kurnool Medical College. As it is not a recognized postgraduate degree, it was decided to recommend to the Central Govt. not to issue Letter of Intent. This decision was communicated to the institute vide Council letter dt. 3.11.2009. Vide letter dt. 13.11.2009, the institute has clarified that due to inadvertent typographical error, the academic qualification of Dr. Rao was mentioned as from Kurnool Medical College while in fact he has acquired M.S. (Ophthalmology) from Armed Forces Medical College, Pune which is a recognized postgraduate degree. The certificate from Armed Forces Medical College and from University of Poona were also attached which were duly verified.

In view of above, and as the postgraduate degree acquired by Dr. K.N. Rao is a

recognized qualification, the Postgraduate Committee considered the clarification from the institute along with Council Inspector’s report (October 2009) and decided to recommend to the Central Govt. to issue Letter of Permission for starting of MS(Ophthalmology) course at Katuri Medical College & Hospital, Guntur under Dr. NTR University of Health Sciences, Vijaywada u/s 10A of the IMC Act, 1956 prospectively i.e. from the academic session 2010-2011 restricting the number of admission to 2(Two) students per year, till the first batch admitted appears in the final examination of the said course. The institution be advised to apply for recognition of the qualification at the time of first available examination as per the provision of Section 11(2) of the IMC Act, 1956.

82. Increase of seats in MD (Community Medicine) at Jawaharlal Nehru Medical College, Sawangi, Meghe, Wardha, u/s 10 A of the Indian Medical Council Act, 1956.

In view of above, the Postgraduate Committee decided to process the applications of the

above mentioned courses in respect of the above mentioned 3 colleges.

84. Recognition of DRM course under Homi Bhabha National Institute (deemed Uni.) at the Radiation Medicine Centre BARC located in Tata Memorial Centre Mumbai.

Read: the letter dated 18/11/2009 received from Dean, Homi Bhabha National

Institute (deemed Uni.) with regard to recognition of DRM course at the Radiation Medicine Centre BARC located in Tata Memorial Centre Mumbai.

The Postgraduate Committee considered the letter dated 18/11/2009 received from Dean, Homi Bhabha National Institute (deemed Uni.) with regard to recognition of DRM course conducted at Bhabha Atomic Research Centre located in Tata Memorial Centre, Mumbai and noted that DRM qualification is already recognized under Mumbai University in respect of students being trained at Tata Memorial Centre, Mumbai and now under Homi Bhabha National Institute (deemed Uni.). The Postgraduate Committee observed that the General Body of the Council at its meeting held on 10.03.2007 while considering the matter of recognition of DRM qualification under Homi Bhabha National Institute (Deemed University) had decided as under:- “The Postgraduate Committee considered the letter dt.09.11.2006 and noted that DRM qualification already stands recognized under Mumbai University and included in the 1st Schedule to the I.M.C. Act, 1956 and now the matter is under consideration for recognition of the said qualification under Homi Bhabha National Institute (Deemed University) being the change of name of University, decided to recommend that DRM qualification granted by Homi Bhabha National Institute (Deemed University) in respect of students being trained at Tata Memorial Centre, Mumbai be recognized and included in the 1st Schedule to the I.M.C. Act, 1956.” The Postgraduate Committee further observed that the Executive Committee at its meeting held in June, 1988 while considering a similar matter had decided as under:-

“No inspection is required where there is change of name and change of affiliation of the University or the college whose medical qualifications are already recognized and included in the 1st Schedule to the I.M.C. Act,1956 unless the Executive Committee decides otherwise.”

In view of above, the Postgraduate Committee decided that DRM qualification conducted at Bhabha Atomic Research Centre be recognized under Homi Bhabha National Institute (Deemed University) and included in the 1st Schedule to the I.M.C. Act, 1956 and forward to the Govt. of India for appropriate notification of the same.
