Staff reportIn early November 2010, media reports claimed that the staff of the ITC (or more precisely, of its Office of Unfair Import Investigations)had stated in a memorandum dated 27 October 2010 that "the evidence will not establish a violation ... as to any of the assertedpatents." However, the investigating staff is merely a party to the proceeding, and the Administrative Law Judge (ALJ) assigned to thecase is free to decide against the staff recommendation. That has, in fact, happened in a number of cases.
