Permit Descriptions CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related facilities in the coastal area as defined by the Act. Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require certification by the DEP prior to the issuance of the permit by the federal agency. Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated transition areas. A Stream Encroachment Permit, a U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may also be required. General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously contaminated with petroleum products. NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwaters, a discharge from an indirect user or the land application of municipal and/or industrial residuals. (A more comprehensive definition of activities which require a permit may be found at N.J.A.C. 7:14A-2.4) Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq. Stream Encroachment: Under the Flood Control Act DEP is empowered to require a permit to control construction within and proximate to flood hazard areas to reduce flood damage to and from new development and to protect the flood storage capacity and ecology of flood plains. Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands. Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal systems. Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable waterway in the State.

General Information
The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Stream Encroachment (SE) permits, Tidal Wetlands permits, Waterfront Development permits and Treatment Works Approvals (TWA). In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however, constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover. Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public. Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal. Interest in these hearings is generally limited to those directly involved. DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

Take Notice that in accordance with N.J.S.A. 13:1D-51 through –58, the State of New Jersey, Department of Environmental Protection, Green Acres Program, will hold two public hearings to seek comments on a proposed land exchange between the State of New Jersey and the Township of Bass River in the County of Burlington. The Department of Environmental Protection proposes to convey to the Township of Bass River 24.45+/- acres of property, designated for tax purposes as Block 56, Lot 50A and having partial frontage on U.S. Route 9. The State property is undeveloped open space in the vicinity of, but not contiguous to, Bass River State Forest, and is outside the Pinelands preservation boundary. The property to be conveyed to the Township of Bass River will be deed restricted for recreation and conservation purposes. In exchange for this property, the Township of Bass River proposes to convey to the State 80.4+/- acres designated for tax purposes as Block 103F/ Lot 6, Block 115/Lot 16; Block 77/Lots 43 and 55; Block 78/Lots 21, 28, 29 and 30. Take Notice that in accordance with N.J.S.A. 13:1D-51 through –58, the State of New Jersey, Department of Environmental Protection, Green Acres Program, will hold two public hearings to seek comments on a proposed land exchange between the State of New Jersey and the Borough of Hamburg in the County of Sussex. In May 2001, the Green Acres Program acquired on behalf of the State property located at 60 Gingerbread Castle Road and designated for tax purposes as Block 7, Lot 29 in the Borough of Hamburg, Sussex County. This parcel comprises 38.195 acres and was acquired for rails to trails purposes as part of the Industrial Heritage Trail being developed by the Department of Environmental Protection’s Division of Parks and Forestry in the Hamburg, Franklin and Ogdensburg area. The DEP wishes to retain a 14.902-acre trail corridor along the Walkill River within Block 7, Lot 29 and to transfer the remaining 23.293 acres to the Borough of Hamburg for active recreational uses, including playing fields. In exchange for this acreage, the Borough of Hamburg has offered to convey to the State Block 11, Lot 10, a 2.13-acre parcel located at 41 Lime Kiln Road and containing four freestanding lime kilns of outstanding historical significance. The property to be conveyed by the State to the Borough will be deed restricted for recreation and conservation purposes. The lime kilns on Block 11, Lot 10 are eligible for listing on the National Register of Historic Places, but have been the subject of past demolition proposals. If acquired by the State, the lime kiln property will be a key component of the proposed Walkill Valley Mineral Heritage Area. The State of New Jersey purchased Block 11, Lot 10.01, a 1.3-acre parcel adjacent to the lime kiln property, in February 2000 as another component of this area. The buildings are located on Block 401, Lots 2 and 2.01 in the Township of Fredon, Sussex County, within a 101.67-acre tract acquired by the Green Acres Program in 2000 as part of the Paulinskill Wildlife Management Area. The proposed Administrative Consent Order requires that Ramapo College treat all stormwater from existing parking lots on its campus in excess of Department requirements prior to discharge to Darlington Brook or its tributaries, provide and deed restrict wetland buffers of 150 feet to the wetlands nearest the tributaries of Darlington Brook upstream of the current development project and permanently preserve the northern most wetland / upland complex as open space to serve as habitat for wood turtles. In certain other areas the proposed Administrative Consent Order provides for reduced wetland buffers, but in no case less than 20 feet. Ramapo College is constructing dormitory buildings outside of certain of these reduced buffer areas. In addition the proposed Administrative Consent Order requires that Ramapo College fund and participate in a Wood Turtle Study Plan and upon Department approval of the completed Study, participate in the development and implementation of a Wood Turtle Management Plan. Ramapo College will also be required to pay a penalty settlement of $37,350. Based on compliance with this Administrative Consent Order, Ramapo College may engage in certain specified construction activities enumerated in paragraph 32 of the Order. Subject to this Administrative Consent Order becoming effective, the Department also anticipates issuing to Ramapo College a freshwater wetlands general permit 10 for the construction of three road crossings and a freshwater wetlands general permit 11 for the construction of five stormwater outfall structures. This application is for a new NJPDES permit to regulate an existing discharge. The applicant operates potable water treatment plants, SIC Code 4941. Potable water is treated to remove iron and manganese, which are filtered out. The discharge to Greenwich Township Sewage Treatment Plant consists of filter backwash, i.e. water used to clear solids from the filters along with the solids themselves. About 57,000 to 72,000 gallons daily of filter backwash is discharged from each of two filter houses, for a total discharge of about 129,000 gallons daily if operating continuously. The operation is in fact intermittent, and depends largely on the demand for potable water. Because groundwater in the area contains low levels of naturally occurring radionuclides which can become more concentrated in the filter backwash, the Department is also proposing monitoring and limitations for radionuclides present in the discharge. The Department has determined that the limit found in Table III-A-1 (Residuals DMR Limits and Monitoring Requirements – page 1 of 3) of NJPDES Permit NJ0109525 for Parameter: Operating Capacity, Sample Point: In, Limit: 5.9 Dry Metric Tons/Day, Statistical Base: Reporting Period Maximum is unwarranted. Instead, the Department believes that an Operating Capacity Limit with a Statistical Base of Reporting Period Average, not Reporting Period Maximum, better reflects the nature of SCMUA’s residuals composting facility. As a result, the Department issued a Stay of Permit Limitation for Parameter: Operating Capacity, Sample Point: In, Limit: 5.9 Dry Metric Tons/Day, Statistical Base: Reporting Period Maximum dated February 6, 2002. As indicated in the February 6, 2002 Stay letter, all other conditions of the existing NJPDES permit remain in full force and effect. Limitation letter dated February 6, 2002, to establish an Operating Capacity Limit with a Statistical Base of Reporting Period Average, not Reporting Period Maximum;
2) amend typographical errors made to Part IV – Land Application of Class A Biosolids, specifically condition A.1.c (page 4 of 10) and condition D.1.b (page 7 of 10) where reference to Table III-B-1 should be Table III-A-1; and
3) revise Form RMS-10 “Sludge Derived Product Generator’s Inventory of Distribution Outlets” as suggested by the permittee to require all “Distribution Sites” be reported, not just “Distribution Sites Receiving in Excess of 100 Cubic Yards”.
