BUILD Metro DC offers a four-year program that targets high school students in low-income communities who are not on-track academically and are at the highest risk of dropping out of school. In MEMORIAM

Joel Kaufman(1960 – 2014)Joel Kaufman, Associate General Counsel and Chief of the Administrative Law Division of the FCC’s Office of General Counsel, passed away on October 29, 2014, after a ten month battle against brain cancer. He was 53 years old.

A member of the FCBA since 1995, Joel will be remembered for his 26 of service at the FCC, where he was instrumental in crafting decisions on such complex issues as universal service, media ownership and spectrum auctions. Joel worked with both Commissioners and staff to ensure that the FCC’s orders were legally sound.

As one of his colleagues noted at his memorial service, Joel was the “go to” person whenever a difficult legal issue confronted the agency. He had a reputation for approaching every task in an organized and intelligent manner designed to build consensus. His encyclopedic knowledge of FCC administrative law allowed him to develop strong arguments that would withstand judicial scrutiny. He was always willing to meet with outside attorneys to discuss their concerns.

As the Chief of the Administrative Law Division, Joel set very high standards for FCC documents and work product. He mentored and inspired each attorney to do his or her best work. Joel’s demeanor made him well-suited to his role. He often

listened to others for some time before offering his carefully-considered view. And, quite apart from his substantive contributions, Joel used his dry, quick wit to insert insightful, tension-breaking comments at just the right moment. His unique laugh was contagious and helped create a congenial working environment.

Joel was born and raised in Rhode Island. He was the valedictorian of both his high school and college classes. He graduated from Providence College then Duke University Law School, where he was a member of the Honor Society. After earning his JD in 1985, Joel was admitted to the District of Columbia Bar and joined the law firm of Cadwalader, Wickersham & Taft. He joined the FCC in 1993.

Outside of his legal career, Joel was committed to Reconstructionist Judaism. He served as a member of Adat Shalom Reconstructionist Congregation and as a member of its Board. He was also the informal librarian of the synagogue. His other interests included a passion for U.S. presidential history, space exploration, stamp collecting and the Boston Red Sox.

Joel is survived by his wife Debra Tropp, who lives in Kensington, Maryland. Donations to Joel’s memory can be made to the Adat Shalom Reconstructionist Congregation in Bethesda, Maryland; the American Brain Tumor Association; the Musella Foundation; or the Southern Poverty Law Center.

CLE Seminars

Thursday, December 11, 6:00 – 8:15 p.m.Internet Governance: Results of Plenipotentiary-14, and Prospects for IANA Transition and UNGA-15The FCBA In t e r na t iona l Telecommunications Committee will hold a CLE on Thursday, December 11 from 6:00 p.m. – 8:15 p.m. entitled “Internet Governance: Results of Plenipotentiary-14, and Prospects for IANA Transition and UNGA-15.” This program will be held at Arnold & Porter LLP, 555 12th Street, NW.

In December 2012, the International Telecommunication Union (ITU) held a treaty conference to revise its Telecommunication Regulations (WCIT). That conference exposed a rift between those Member States who wanted greater control over Internet Governance and those – such as the U.S. and Europe – committed to the Multistakeholder model. Subsequent surveillance-related issues underscored the importance of these issues at subsequent meetings at the ITU, at other U.N. bodies, and at various “multistakeholder” groups and meetings. In spring 2014, the Department of Commerce launched a process to transfer its remaining oversight of the “IANA” function. This kick-started a process being coordinated by the Internet Corporation for Assigned Names and Numbers (ICANN), and initiated Congressional debate about the wisdom of this action. In addition, Internet Governance issues will be central to the quadrennial ITU Plenipotentiary Conference, held October 20 – November 7 in Korea. Finally, the U.N. General Assembly (UNGA) will address these issues in 2015.

This CLE will examine the legal and policy outcomes of the Plenipotentiary, and how any alterations to the treaty or resolutions (particularly regarding Internet Governance) could affect U.S. interests, including business. It also will review the IANA transition process to date and expected future timing. Finally, the CLE will examine how to maximize the private sector’s role in UNGA’s 2015 review of Internet Governance.

selling products. “BUILDers” also receive extensive academic training, including classroom tutoring, free SAT and ACT prep courses, college application guidance, and financial aid support. BUILD’s efforts have had a demonstrable impact on the lives of these students, with 100 percent of BUILD Metro DC seniors having graduated high school and enrolled in a college or university. The FCBA Foundation will use proceeds from the Charity Auction to support its annual scholarship program.

This year’s Charity Auction was held at the Almas Temple, and it drew a large and lively crowd. In addition to bidding at silent auction tables and a raffle, the evening included a live auction featuring award-winning professional auctioneer B.J. Jennings. Facilitating the bidding were celebrity emcees David Gross and Jane Mago. We would like to extend a special thanks to the auctioneer and emcees for their entertaining and effective efforts!

This year’s GRAND PRIZE for the raffle was an LG OLED TV, 55-inch Model 55EC9300, Pencil-Thin, Limitless Contrast, Unparalleled Color, valued at $3,500. Congratulations to Bryan Tramont, the grand prize winner. Thank you to everyone that purchased raffle tickets – we raised over $15,000 for BUILD Metro DC and the FCBA Foundation from raffle sales!

As always, FCBA members were generous in their prize donations and in their bidding at the Auction. The Charity Auction Committee is deeply grateful to all prize donors and the winning bidders for helping to make the Auction a success. Thank you to all of the FCBA members and law students that volunteered time and energy to plan the Auction, solicit prizes, and work the night of the Auction. December 4-5PLI/FCBA 32nd Annual Institute on Telecommunications Policy & RegulationFor the 32nd consecutive year, the FCBA and the Practising Law Institute will co-sponsor an annual conference on “Telecommunications Policy and Regulation.” This year’s Conference will be held on December 4-5, at the Washington Hilton, 1919 Connecticut Avenue, NW, Washington, DC. The Conference will provide attendees with a comprehensive understanding of the hot button issues facing the telecommunications industry today – at the FCC, Congress, and within the Executive and Judicial branches.

The Conference will open with a keynote address by FCC Commissioner Mignon Clyburn. The luncheon will feature a “fireside chat” with FCC Commissioner Michael O’Rielly, conducted by FCBA President David Gross. NTIA Administrator Lawrence Strickling will close the first day of the Conference. The second day of the Conference will open with a Q&A session with FCC Commissioner Ajit Pai.

Other highlights include a Congressional staff panel, three substantive panels featuring industry experts dealing with recent developments in wireline, wireless, and privacy issues, and an exciting new panel, titled New Technologies: Views from Silicon Valley, which will feature companies engaged in the development of new technologies, as well as innovative use of existing technologies.

In addition, Julius P. Knapp, Chief of the Office of Engineering and Technology, Julie Veach, Chief of the Wireline Competition Bureau, and Roger C. Sherman, Chief of the Wireless Telecommunications Bureau, will provide attendees with tutorials on their respective areas.

Volunteer at Martha’s Table on December 28On Sunday, December 28 from 10:00 a.m. – 1:00 p.m., the FCBA will be preparing and distributing food at the FCBA Foundation’s partner charity, Martha’s Table. The FCBA has been meeting monthly to volunteer at Martha’s Table for many years. Martha’s Table feeds hundreds of homeless adults and children on the streets of Washington daily, through its mobile soup kitchen. Martha’s Table is located in a yellow building at 2114 Fourteenth Street, NW, in the District, near the intersection of 14th and U Streets. On-street parking is available. Volunteers are asked to bring food if possible, (e.g., cold cuts, bread, peanut butter, jelly, vegetables and potatoes) because the center often runs

out of donated food. Any food donated by volunteers might not be used the same day you volunteer; any food donations will be used at the discretion of Martha’s Table staff.

Please mark your calendars, bring your friends and children (they must be at least nine years old), and participate in this great volunteer effort. If you have question or need more information, please contact Howard Weiss at 703-812-0471, [email protected].

Southern California Chapter On November 14th, the Southern California Chapter held an event. The talk was called “A Practical Approach to Doing Business in Mexico’s Telecommunications Sector within the New Regulatory Framework.” Discussion topics included: reshaping the telecommunications and broadcasting industry in Mexico, and opportunities for new foreign investment in the telecom industry. The panel included keynote speaker, Mr. Daniel Rios, who is the Director of the Regulatory Affairs for Mexico’s Federal Institute of Telecommunications (IFT). The IFT is the recently created agency as part of the reform for the development, regulation and supervision of the broadcasting and telecommunication sectors in Mexico. The second panelist was Mr. Carlos Diaz, an attorney expert on telecommunications

with the Mexican law firm of Santamarina y Steta, S.C. Mr. Diaz spoke about various legal issues arising from the recent regulatory reform. Mr. Marcos Vergara

del Carril, a co-chair of the Southern California FCBA chapter, moderated this event. The breakfast talk took place at Sheppard Mullin’s Los Angeles, CA office.

Pursuant to the Office of Government Ethics regulation on widely-attended gatherings (5 C.F.R. 2635.204(g)(2)), the Chairman’s Dinner appears to qualify as a widely attended gathering. The value of an individual ticket to the dinner is $275.00. Most employees of the Federal Communications Commission may be directly invited to attend the dinner as guests of individuals and organizations purchasing tables or tickets. In most cases, individuals and organizations may issue invitations to the Chairman’s Dinner without the involvement of the FCBA. Some agencies, departments and branches of the Federal Government, however, apply additional stipulations above the regulations issued by the Office of Government Ethics. Individuals who have signed the Administration’s Ethics pledge cannot accept invitations from most registered lobbying organizations or registered lobbyists. While this event has qualified as a widely-attended-gathering in previous years, each FCC employee is required to obtain individual ethics clearance based on matters they are working on within the Commission. Employees of the Commerce Department are required to obtain individual ethics clearance through the Department’s Office of General Counsel. Invitations to Members of Congress, Congressional Staff, and employees of the Department of State must be issued by the FCBA.
