BACKGROUND

he real estate sector plays a catalytic role in fulfilling the need and demand for housing and infrastructure in the country. While Tthis sector has grown significantly in recent years, it has been largely unregulated, with the absence of professionalism and

standardisation. The lack of adequate consumer protection mechanism resulted in exploitation and profiteering by unscrupulous

builders.

The introduction of the RERA act is definitely a boon to both the developers as well as the customers in a number of ways. It will not

only bring in transparency and clarity but ensure better security as well.

A well-functioning insolvency regime is an important economical institution, particularly for an emerging economy. Insolvency

issues have become more and more decisive in the globalization of capital and financial markets. An effective insolvency law has a

direct bearing on determination of ease of doing business ranking of a country by the World Bank. An insolvency law is needed to

achieve several objectives. Asset maximization is one of the key objectives of insolvency. There are several other issues of

insolvency law - cultural, financial, legal and social - that must be balanced.

Despite the best of efforts and intentions, a regulator may not always have the ground realities. Therefore, the regulator could play a

more active role in making regulations on the based on the issues and crowd sourcing of ideas raised by the stakeholders.

In order to enlighten the various stakeholders, ASSOCHAM is holding National Conference “Insolvency and Bankruptcy code 2016” &
