CONSTITUTIONAL OFFICERSFOLLOW THE LEGISLATURE ONLINE The award-winning Nevada Legislative website, www.leg.state.nv.us, is a compendium of information about not only the Nevada Legislature but the 2015 session including a complete list of bill drafts and pre-fi led bills, state statutes and regulations, court rules and even Nevada city charters. In addition to information on the current legislative session, the website, under “Session Info” on the left side, lets you look back as far as the 1985 session. The list of meeting agendas is updated daily and live video of nearly all committee and other meetings is available on the website. Detailed information about all legislators including contact information, committee assignments and the legislation they have proposed this session also is on the site. The Nevada Electronic Legislative Information System (NELIS) has been greatly improved — made much more user friendly this session. NELIS is designed to make reports, exhibits, testimony and presentations available to not only lawmakers but the press and public electronically. NELIS was rolled out in the 2011 Legislative session but, before that, people had to actually attend the committee meetings to get the reports and other backup information.
Now even documents prepared by non-governmental witnesses and advocates are available there if they provide the materials to the committee secretaries. Budget information can be searched by budget account, department or function. Viewers can also search for reports and other data by committee and check not only the meeting schedule but the status of bills in each Senate and Assembly Committee. NELIS also allows a search for di� erent legislation either by name as well as text within a proposed piece of legislation. Bills also can be searched by sponsor. NELIS can be accessed from the main legislative webpage. The link is on the right hand side of the home page. This year, viewers can also view a meeting live without leaving NELIS and create quick links within pages to simplify navigation through the system. People can create a tab that lets them view all the exhibits related to a bill or budget without going to each individual meeting. LCB also o� ers a Personalized Legislative Tracking (PLT) system to let individuals receive notifi cations on bills, drafts and budgets of interest. Individuals can track up to 10 bills, drafts or budgets for free in the PLT system. There are fees for tracking more than that up to an unlimited subscription for $600. The system provides notifi cation of hearings and a daily status report on the items you choose to track. The system can also be tracked on smart phones, pads and other devices and LCB o« cials say it will be continually be refi ned and enhanced as more functionality is added. On the “Who’s my legislator/what’s my district” link on the legislative home page, people can start by entering their address, and the computer will list your representatives. Finally, those interested in searching for legislation dealing with a specifi c issue can do so and there is also a link that lets viewers share their opinion on pieces of legislation.

LEGISLATIVE COUNSEL BUREAU The Legislative Counsel Bureau was created in 1945 when lawmakers decided they needed help getting the information necessary to understand and act on requests by the governor and state agencies. For most of its history, it had only a few employees but that changed in the 1970s when legislative sta� s around the country expanded dramatically so that lawmakers no longer had to rely on the attorney general, the governor’s o« ce or executive branch agencies for data and analysis. Nevada’s LCB now has about 300 permanent employees.Unlike some states where each house and each party has its own sta� , LCB is non-partisan, providing research, assistance and analysis to all members of the Legislature. LCB is divided into fi ve divisions: Administration, Audit, Legal, Research and Fiscal Analysis. The state printing o« ce is tied to the Legal Division, historically its biggest customer. Only in Fiscal Analysis is any division made between the two houses with Cindy Jones designated as Assembly Fiscal Analyst and Mark Krmpotic as Senate Fiscal Analyst. But below them, the analysts assigned to di� erent agencies and functions of government report to both parties and houses. The director of LCB, the heads of the di� erent divisions and the employees are required to maintain neutrality not only inside the building but outside as well. That means they don’t participate in partisan activities or groups.
LCB Director Rick Combs is appointed by the Legislative Commission, which consists of legislative leadership. He appoints the division heads subject to commission review. After that, however, involvement by lawmakers in operations of the divisions or hiring is almost non-existent. The system is designed to provide the sta� a level of independence that helps assure lawmakers they are getting unbiased advice and information. The largest divisions are administration, headed by Roger Wilkerson and legal, headed by Legislative Counsel Brenda Erdoes. Each has about 100 employees. Legal drafts all bills, resolutions and amendments, does legal research for lawmakers, issues opinions on legal questions and defends the Legislative branch in court when necessary. Administration includes accounting, broadcast services, building maintenance, information technology and the Legislative Police among other functions. Fiscal analysis does just that — analyzes the governor’s proposed budget and other proposals that would cost state money. Audit headed by Paul Townsend conducts audits of state agencies looking for waste, errors and poor accounting. Auditors also do performance audits to help agencies improve business practices. Research headed by Pepper Sturm provides research and reports on a wide variety of topics at the request of legislators and manages interim studies on di� erent topics.

BILLS & RESOLUTIONS Every o« cial action the Nevada Legislature takes is in the form of either a bill or a resolution. Bills are legislation that add to, delete or amend state law.Senate bills are labeled SB, Assembly bills are labeled AB. They are numbered in order of their introduction. To become law, a bill must be approved by both houses of the Legislature and signed by the governor. In Nevada, the governor can allow legislation to become law by not signing it for fi ve days if the Legislature is in session, 10 days if they have adjourned. That is the opposite to the U.S. Constitution which interprets the President’s failure to sign legislation within 10 days is a veto. If the governor actually vetoes a bill, it requires a two-thirds vote of each house to override that veto. Nearly all other business is handled by resolutions that do everything from commemorating an individual’s contributions to society and setting legislative operating rules to proposing constitutional amendments for voters to consider. The three types of resolutions are simple, concurrent and joint.
• Simple resolutions, labeled AR or SR followed by their number, are used by each house to set its own rules, set its own committee membership and leadership or take another action that is completely within the jurisdiction of that house. Simple resolutions only require approval by the house where they originate.
• Concurrent resolutions are designated ACR or SCR followed by their number. They are used for purposes such as urging other governmental entities to take action or make changes in an area where the Legislature may not have specifi c power. They are also often used to memorialize a deceased public fi gure or civic leader in Nevada. And they are used to set and amend joint rules of the Legislature. Concurrent resolutions must be approved by both the Assembly and Senate.
• Joint resolutions are labeled AJR or SJR and are most often used for more weighty matters. They are the vehicle for proposing changes to the state constitution or calling for action by the U.S. Congress. Like concurrent resolutions and bills, joint resolutions must be approved by both the Senate and Assembly. Unlike bills, resolutions don’t require the governor’s approval.

2. SPONSOR After the bill number is the name of the lawmaker, committee or group sponsoring the proposal. Usually, the fi rst legislator listed is the author and prime supporter of the bill, although some are requested on behalf of a group of constituents. In that case, the bill says “By Request” after the sponsor’s name. The rules also permit joint sponsorship of bills by members of both the Assembly and Senate. That might be used, for example, by Carson City’s Senator and Assemblyman to jointly sponsor and share credit for a measure on behalf of the Capital. Committee introductions can be the product of an interim study, a request by the governor or an agency. Limited numbers of bills also come directly from sources such as the Nevada Association of Counties, League of Cities, Attorney General, Board of Regents and other groups. Incumbent senators can request 26 bills. New senators — because the fi rst deadline is before the election — are limited to 14. Incumbent and new Assembly members each get half those numbers. Members of leadership can request and introduce more pieces of legislation, as can committee chairs. Occasionally, a lawmaker will ask a committee to introduce a bill to keep his or her name o� the measure for political reasons. The executive branch, agencies and all outside organizations are also limited in the number of bills they can request.
3. INTRODUCTION AND REFERRAL Below the sponsor is the date the measure was introduced, followed by the committee it was referred to for study. The date allows you to look in the journal for that day and see whether there was any discussion about the measure on the fl oor.
4. SUMMARY The summary gives a synopsis of what the bill is intended to do and, in parentheses, which bill draft request it came from. That allows you to compare with the original proposal and see if it was changed before introduction.
5. FISCAL NOTE Fiscal notes analyze the e� ect of the measure on state and local government budgets. They don’t analyze the impact on business or the public. If the bill contains an appropriation, the note states whether that money is already in the executive budget. And it states whether the bill requires or increases a term of imprisonment — which was added after felony DUI legislation unexpectedly increased prison populations
above projections. Details are contained in the actual fi scal note attached to the bill.
6. BODY OF THE BILL The body of the bill begins with a statement of what the bill would do, beginning with AN ACT relating to...
7. LEGISLATIVE COUNSEL’S DIGEST: The digest fi rst explains existing law directly related to the legislation and then explains how that law is changed by the measure. It is designed to help the average person easily understand legislation. The digest may also include information not readily apparent in the text of the bill — such as how it would a� ect other sections of Nevada Revised Statutes. The digest should explain whether the bill was made necessary or prompted in response to court cases, federal laws and other outside infl uences.
8. TEXT OF THE BILL: The text of the bill itself begins:THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED INTHE SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: In the body of the bill, the words [in brackets] are those the legislation would delete from existing law. The words in italics would be added to the law. To understand the changes, read through a section as it is now — reading the bracketed language but not what is italicized. Then read the section again as it would be if the measure passes — reading the italicized language but not the parts in brackets. If the bill is designed to repeal an entire section of law, the measure normally includes the complete text of the section to be repealed.
9. EFFECTIVE DATE The last section of the bill is normally the date it would take e� ect if passed. Sometimes a specifi c date is given. Sometimes the bill becomes “e� ective upon passage and approval” — meaning when the governor signs it. Common e� ective dates are July 1 and Jan. 1. But, if no date is specifi ed, the bill takes e� ect Oct. 1 following the end of the legislative session in which it passed.
SKELETON BILLS In some cases when a proposal is expected to be controversial or require extensive research and hearings, it will be drafted as a “skeleton bill.” Skeleton bills are used in situations where sweeping changes to a number of statutory sections would be involved, such as a complete rewrite of criminal sentencing laws or the restructuring of an agency. That allows the basic idea to be referred to committee for hearings and development. The committee works out the details with the parties involved before ordering the bill drafted for committee review. The rules prohibit using an amendment to completely replace any bill with legislation on a di� erent subject, but that rule is often ignored or skirted, especially late in the session. Legislative Counsel’s Digest: Existing law limits the civil liability of employees, public officers and certain 1 independent contractors of the State of Nevada and provides certain protections 2 against civil liability for such persons (NRS 41.0305-41.039). The only 3 independent contractors to whom this limitation and protection currently applies are 4 those who contract to provide medical services for the Department of Corrections, 5 which are defined in existing law as “immune contractors” (NRS 41.0307). 6 Existing law provides total immunity from liability for certain acts or omissions of 7 immune contractors, meaning that no damages may be recovered for those acts or 8 omissions of immune contractors (NRS 41.032, 41.0321, 41.03365). In addition, 9 existing law provides a maximum of $50,000 that may be recovered as damages 10 against an immune contractor in a civil action based on other acts or omissions of 11 the immune contractor (NRS 41.035). Existing law further requires the State to 12 provide representation to and, in certain circumstances, indemnification of an 13

immune contractor by the State if a civil action is brought against the immune 14 contractor (NRS 41.0338-41.0349, 41.745). 15 This bill amends the definition of “immune contractor” to include independent 16 contractors who contract to provide medical services for the Division of Mental 17 Health and Developmental Services of the Department of Human Resources. 18 Therefore, this bill provides these independent contractors with the same limitations 19 on civil liability and protections afforded to independent contractors who provide 20 medical services for the Department of Corrections. 21
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 41.0307 is hereby amended to read as follows: 1 41.0307 As used in NRS 41.0305 to 41.039, inclusive: 2 1. “Employee” includes an employee of a: 3 (a) Part-time or full-time board, commission or similar body of 4 the State or a political subdivision of the State which is created by 5 law. 6 (b) Charter school. 7 2. “Employment” includes any services performed by an 8 immune contractor. 9 3. “Immune contractor” means any natural person, professional 10 corporation or professional association [which:] that: 11 (a) Is an independent contractor with the State pursuant to NRS 12 284.173; and 13 (b) Contracts to provide medical services for the Department of 14 Corrections [.] or the Division of Mental Health and 15 Developmental Services of the Department of Human Resources. 16 � As used in this subsection, “professional corporation” and 17 “professional association” have the meanings ascribed to them in 18 NRS 89.020. 19 4. “Public officer” or “officer” includes: 20 (a) A member of a part-time or full-time board, commission or 21 similar body of the State or a political subdivision of the State which 22 is created by law. 23 (b) A public defender and any deputy or assistant attorney of a 24 public defender or an attorney appointed to defend a person for a 25 limited duration with limited jurisdiction. 26 (c) A district attorney and any deputy or assistant district 27 attorney or an attorney appointed to prosecute a person for a limited 28 duration with limited jurisdiction. 29 Sec. 2. HOW TO READ A FISCAL NOTE Fiscal notes are attached to all bills that will have a fi nancial impact on state or local governments. They were created to prevent legislation from becoming law without knowing what it would cost. A good example of that problem was that no one asked the Department of Corrections what it would cost to house inmates sent to prison for a third DUI conviction. Fiscal notes do not attempt to estimate the fi nancial impact a bill will have on businesses or individuals. The fi scal note was intended to give state and local agencies a chance to tell lawmakers what the cost of a bill would be before enacting it. But in many cases, fi scal notes are educated guesses and, occasionally, have been dramatically wrong. Sometimes fi scal notes are o� set by savings the bill will generate. Those savings are sometimes pointed out in the explanations agencies or legislative analysts attach to the fi scal note. The note is divided into sections, each containing a di� erent entity’s estimate. Normally, the fi rst estimate contains the projection of the bill’s direct costs to state agencies. The costs are listed by fi scal year. The column labeled “Continuing” lists the ongoing annual costs that will never go away if the measure is passed. Sometimes explanation sheets are attached by the agency. Other sections of the fi scal note may be authored by the Department of Administration (Budget O« ce) or Legislative Counsel Bureau analysts themselves who often talk to local o« cials — including school districts — to see what cost a bill would have to those entities. Those sections, too, can have explanation sheets attached. Entities such as the Public Employees Retirement System and Public Employee Benefi ts Program are occasionally consulted for potential impacts of legislation as well.

HOW A BILL BECOMES A LAW Most bills begin with a problem, which leads to an idea designed to cure that problem. They may come from an interim study, a state agency, school district or local government. Many come from individual lawmakers in response to requests from special interest groups, businesses or citizens. The Legislative Counsel’s legal sta� turns the idea into a bill draft for review by the lawmaker, committee or other requester. Very often, the proposed bill will undergo its fi rst “amendments” at this stage. The lawmaker or agency talks it over with potential supporters and opponents to make sure it will do what was intended and to spot potential problems. If it’s a committee bill, everyone gets to participate in the debate during a public hearing. In many cases, the resulting amendments eliminate most opposition even before the bill is introduced.
INITIAL STEPS BY THE AUTHORIDEA AND DRAFTING
Sources of ideas for legislation include state and local governments, elected o« cials, businesses, organizations and citizens. Requests for drafting may be made by legislators, legislative committees, the governor, state agencies and local governments. A sta� attorney for the Legislature prepares a formal draft of a bill.

FLOOR DEBATE AND VOTE

If the second legislative house considers and passes a bill without amendment, it is returned to the fi rst legislative house for enrollment and transmittal to the governor. (Resolutions are delivered to the Secretary of State.) If the second legislative house amends a measure, it is returned to the house of origin for consideration of the amendment.
RESOLUTIONS OF DIFFERENCES, IF NECESSARYCONCURRENCE
The house of origin decides whether to accept the second legislative house’s amendment. If it accepts the amendment, the bill is enrolled and delivered to the governor. When the amendment is rejected by the house of origin, the bill is returned to the second legislative house for a decision whether to withdraw (recede) the proposed changes. If the second legislative house does not recede from its amendment, a conference committee is appointed, and the bill is returned to the house of origin with a request that it appoint a like committee to meet with a committee of the second house.

INTRODUCTION AND FIRST READING
A bill is submitted for introduction by an individual legislator or committee chair. It is then numbered, read for the first time, referred to committee, printed and delivered to the committee.
COMMITTEE ACTION AND REPORT
A committee may make a variety of recommendations to the entire legislative body. It may recommend that the legislative house pass a bill as it is written or pass it with certain amendments. If a committee decides that a bill requires further committee consideration, it may recommend that the legislative house amend the bill and rerefer it back to the same committee or that it rerefer the bill to another committee. Finally, a committee may vote to indefinitely postpone consideration of a bill, e�ectively killing it, or may take no action at all. After committee reports are read, bills are placed on second reading for the next legislative day unless the committee, by unanimous vote, recommends the bill be placed on the Consent Calendar. This action is limited to certain noncontroversial bills reported out of a committee without amendment.
ACTION IN THEHOUSE OF ORIGINSECOND READING
Bills given a “Do Pass” recommendation are read a second time and placed on General File for debate and final vote. Bills that are given an “Amend and Do Pass” recommendation are read a second time, and if the amendment is adopted, it is reprinted before being placed on the General File for action.
FLOOR DEBATE AND VOTE
Bills are read a third time and debated. A roll call vote follows. For passage of measures that require a constitutional majority, 11 votes are needed in the Senate and 22 in the Assembly. Bills with tax or fee increases require a two-thirds majority (14 votes in the Senate and 28 in the Assembly). A measure that does not receive at least the required number of votes is defeated. Any member who casts a vote on the prevailing side of a measure may serve notice of reconsideration to request a second vote. All bills that are passed by the first legislative house are then forwarded to the second legislative house where the process begins again.
CONFERENCE
If the two-house conference committee is able to resolve the di�erences between the houses, it sends a conference committee report with the proposed reconciliation to the two houses. The house of origin must adopt the report first. If either house fails to adopt the report, the bill dies. However, if both legislative houses adopt the report, the bill is enrolled and delivered to the governor.

ROLE OF THE GOVERNORSIGN OR VETO
The governor must act on a bill within five days after it is received (Sundays excepted) if the Legislature is still in session. However, if there are fewer than five days remaining in session, or if the bill is delivered after the adjournment sine die, the governor has 10 days after adjournment to act. The governor may sign the bill into law, allow it to become law without a signature, or veto it. A vetoed bill is returned to the house of origin to consider overriding the veto. An override of the veto requires a two-thirds majority vote of each legislative house. If the governor vetoes a bill after the session adjourns sine die, the bill is returned to the next regular legislative session. Measures become e�ective on Oct. 1 following the end of the legislative session, unless otherwise specified in the bill.

HOW TO LOBBY AT THE NEVADA STATE LEGISLATURE Professional lobbyists representing corporations and other businesses wear white badges with a dark blue stripe and the words “PAID LOBBYIST” on them. Those paid to represent nonprofi t groups are white with a teal stripe and the words “PAID LOBBYIST — Non-Profi t.” They are paid to represent a corporation, group or other special interest, tracking issues, interpreting legislation, doing research and testifying. Those who represent a group or organization but aren’t being paid have a badge with a light blue stripe stating “NON PAID LOBBYIST” and lobbyists who are veterans have badges with a light green stripe stating “NON PAID LOBBYIST — Veteran.” Most non-paid lobbyists represent one specifi c organization or cause. Both those types of lobbyists are required to fi le monthly reports detailing what they spent and who they spent it on. Those reports are public, free and list spending both by lobbyist and by organization. Gray badges identify representatives of state agencies assigned to represent their department or division at the Legislature. Unlike the corporate and nonprofi t lobbyists, they aren’t required to wear a badge. Most do. Finally, there are the members of the press who, in what has become the Legislative Counsel Bureau’s little joke, wear yellow badges (Yellow Journalists). Unlike those groups, individual citizens don’t have to register or fi le periodic spending reports to push for their particular cause. They just show up and make their case. But those who represent any organized group should check with the Legislative Counsel Bureau to make sure they’re exempt. Lobbyists are hired because they know the Legislative process and how to get things done. They have established relationships with lawmakers, which gives them access and produces results. That knowledge and access means they can charge for their services — usually a lot more than individuals, small businessmen and nonprofi t groups can a� ord. But that doesn’t mean you can’t get results lobbying on your own. Many lawmakers would really rather hear from individuals — who they often refer to as “real people.” Success depends a great deal on how persuasive you are and how well you learn the process. Former Speaker Joe Dini of Yerington said more than 20 years ago that how the Legislature works isn’t actually written down anywhere. The only way to learn is to pay attention.
A FEW BASIC RULES Almost all legislation has people lobbying both for and against. It’s usually pretty obvious who that would be. Look them up in the list of lobbyists published by the Legislature. The Lobbyist Report is alphabetized in two di� erent ways: By the name of the lobbyist and by the name of the company or political group. Find and call the lobbyist representing those on your side. If you aren’t sure you understand what the proposed legislation would do, they can help. Most often they’re glad to do so because you’ll add another voice to their cause — one of those “real people” voices.
MAKING YOUR POINT Every Nevadan is represented by an Assemblyman and a Senator. Your representative is one of the best places to start making your point of view known. You can search for yours by entering your address on the legislative website. Call your Senator and/or Assembly member. In a state where many races are decided by just a handful of votes, they pay attention to those phone calls.
THE COMMITTEE HEARING Lawmakers welcome citizen testimony in committee hearings. They complain that they don’t hear enough from regular folks.
When testifying, give your name and the city where you live or what group you’re with. Keep to the subject and try to add to the testimony instead of repeating what everyone else said. If your testimony is the same as a previous speaker, say that and let the next witness speak. Lawmakers want real-life examples of why you support or oppose a bill — what will it do for or to you. If you bring written materials, try to have at least one copy for each committee member and one for the committee secretary. If possible, bring a few extras for press and others. These days, the best thing to do is turn those materials in ahead of time so sta� can put it up on NELIS, the legislative Internet-based information system, for all to see. Be polite. Those who are loud, rude or threatening at best hurt their cause and, at worst, wind up talking to the Legislative Police. Complaining about how they never listen and how big money runs the show won’t help your case either. NOTE: Lying during testimony is perjury, a bad idea.
THE HEARING WAS YESTERDAY If you miss the committee hearing, fi nd out what happened from those on your side. If you need detail, all hearings are video and audio taped. The tapes are a matter of public record. You can buy a copy.
YOUR LOBBYING EFFORTS FAILED Remember that even if all e� orts fail at one end of the building, each bill has to go through the same process in the other house. You might fi nd more sympathetic ears there. Also remember the press. Politicians are very sensitive to publicity. When dealing with the press, many of the same rules apply. We’re looking for stories that impact people. Tell us your story and stick to the facts. It may bring more attention and support for your cause.
