Disability Situation in NepalNational Census held in 2011 claimed population of disability in nepal as 4% to

4.30% out of total population.NGOs and Activist are urging to bring with accurate information consolidating

with 10% of WHO and 15% and of World Bank’s study report.Nepal government has identified disability into 4 categories.Nepal is now state party of UNCRPD after rectifying it in 2009Nepali society used to views disability as penance and object to pettiness. Therefore what ever formulated before UNCRPD,2006 was not worthy for the

disability rights….Responsibilities to ensure independent living and respect for their dignity in

community was lackingBut now some changes can be seen in thoughts of general people about

disability due to awareness raising effort of DPOs.

Independent living Center, Kathmandu

•Independent living center is non profit, non government and self help

organization established with an objective to fulfill core objective of

independent living.

•First time, it was introduced by Mr. Krishna Gautam in Nepal . He trained

from Japan through Duskin Leadership training.

•Now we have 10 more IL centers in Nepal and national independent living

council is its network.

•I’m also one of the duskin trainee and now working in IL center Kathmandu

as project coordinator.

• IL center kathmandu is unique in nature because one hand it is continuing

advocacy to formulate policy for and another hand it is supporting peers from

IL programs.

Discrimination Discrimination refers disadvantageous treatment from family,

society and legislation system.

Legislation system of every country needs to treat its citizen in equal basis to ensure peace and harmony in community.

But in case of Nepal, daily People with disabilities continuously battle exclusion and restriction from achieving their fundamental rights such as education, health, employment etc.

Well! discussing about discrimination that Nepalese PWDs are facing;

Direct Discrimination

Direct discrimination is to treat a person less favorably, , because of his or her disability, than a person without disability in same circumstances

For an example: when a child having disability wishes to join same school where his/her other siblings are studying but if parents do not allow and force to send rehabilitation center for the correction of disability though disability is not curable.

This is direct discrimination against his/her choice.

This kind of discrimination often persons with disability face in their child hood and adulthood whenever they try to get job

Discrimination where the same treatment applies to people with and without disability but the impact is to disadvantage or exclude people with a disability in a way which is not reasonable. This is known as indirect discrimination.

For example: stairs are the same for everyone but some people especially wheelchair users cannot use them; print on paper is the same for everyone but some visually impaired people cannot read it.

In Nepal, PWDs daily encounters to this discriminations in face every aspect of life due to not having reasonable adjustment in thoughts, accommodations, legal actions etc.

Reasonable Accommodation UNCRPD, 2006 Defines it as necessary and appropriate

modification and adjustments not imposing undue burden, where needed in a particular case, to ensure to persons with disabilities the enjoyment on an equal basis with others of all human rights and fundamental freedoms.

it applies every aspect of life such as how people think and treat; men made accommodations, judiciary system etc.

But, in case of Nepal we are totally ignored to realize accessibility in government official’s buildings, public transportation, public buildings etc. Besides it, people having communication also face problem to get right information from right places.

Recommendation Raise awareness about disability and its issues via

comprehensive human rights educationUse media positively to stimulate society to minimize

discrimination and to upgrade thoughts reasonably.Expand Independent living Centers to access the services

to pwds.Have strong network among international and nationals

DPOs are essential for communication exchangeCreate pressure to government to implement UNCRPD,

2006 and to modify public accommodations reasonably.Empower and develop role models to lead disability

movement and to minimize all forms of discrimination.Develop untie or Anti-Discrimination law
