Three elements of negligence: 1) Duty of Care 2) Breach of Duty 3) Causation (damage flowing from breach) DUTY OF CARE DUTY GENERALLY LECTURE NOTES – ANNS COOPER TEST (UNIFIED) (NOVEL DUTY) After Cooper, the general test to establish a new duty was as follows (do not need to go through this analysis if the duty has already been recognized by the courts) o Stage One: § Was there reasonably foreseeable harm? If yes, § Was there a proximate relationship between the parties (may include “policy” factors applying to relationship between parties, proximity in fact: a relationship where a reasonable person would foresee the harm caused to the plaintiff); if yes o Stage Two: § Are there any residual policy matters negating or limiting the duty (policy factors outside the relationship between the parties) (Cooper v Hobart)
