I. INTRODUCTION

The subproject: “Tay Ha Noi 220kV Substation” is one of the subprojects that will be

implemented in Phase I of the Transmission Efficiency Project (TEP) funded by the World

Bank. The subproject will be implemented in Dong Quang commune of Quoc Oai district, Ha

Noi city. The implementation of the subproject is in line with the national Power

Development Master Plan 7 (PDMP7) to meet the growing electricity demand load and power

system in the West area of Hanoi city.

The activities of subproject include: construction of a new 220kV substation. These activities

may cause negative impacts on the local environment and communities during pre-

construction, construction, and operation phases.

During this phase of study, the substation will be installed for one 220/110/22kV- 250MVA.

The 220kV side will be designed as a diagram with 2 busduct systems using ring busbar and

including 9 switchgear equipment bays. The 110kV side will be designed as a diagram with 2

busduct systems using ring busbar and including 9 switchgear equipment bays. The part of

secondary and telecommunication equipment will comprise protection-control system, related

information system, SCADA…. The part of civil works will comprise main elements as

following: scrape, external and internal road, outdoor construction structure, specialized

building…

To ensure the potential negative impacts are identified and mitigated during the subproject

implementation and in compliance with the policy on environmental assessment of the World

Bank (OP/BP 4.01), an Environmental Management Plan (EMP) of the subproject has been

prepared in accordance with the guidelines provided in the Environmental and Social

Management Framework (ESMF) of the TEP project. The EMP includes the following

contents: an introduction, the main legal framework, the subproject description, the

environmental background, potential positive and negative impacts, proposed mitigation

measures, and implementation arrangements. It also includes an Environmental Codes of

Practice (ECOP) prepared for the subproject. The EMP will be incorporated into the bidding

documents and construction contracts, as well as a scope for environment quality monitoring.

A Resettlement Plan (RP) has also been prepared for the subproject and presented separately.

The Government of Vietnam stipulates the preparation of Environmental Impact Assessment

for this subproject. The EIA of the subproject has been prepared and submitted to Hanoi

DONRE for approval.

II. POLICY, LEGAL AND ADMINISTRATIVE FRAMEWORKS

2.1. Government Regulations

The following laws and regulations are applied for subproject:

- Law on Protection of the Environment No. 52/2005/QH11 passed by the National

Assembly on November, 29th

, 2005 regulates the obligations of individuals,

organizations in protecting environment.

- Law on Water Resource No. 17/2012/QH13 enacted June 21, 2012.

- Land Law No. 13/2003/QH11 dated November 26, 2003, and the new Land Law No.

45\2013\QH13 dated November 29, 2013 which will take effect on July 1, 2014.

- Construction Law No. 16/2003/QH11 dated November 26, 2003.

- Labor law No. 35-L/CTN dated 23rd Jun 1994, with some amendment under Document

No. 84/2007/QH11 by the National Assembly.

- The Law of Cultural Heritage No. 28/2001/QH10 promulgated on June 29 2001, with

some amendment in 2009 by the National Assembly (No. 32/2009/QH12).

- Other relevant sector technical regulation and standards.

2.2. World Bank Safeguard Policy

An environmental and social screening of the subproject was undertaken in line with the OP

4.01 and it showed that the World Bank’s policies on Environmental Assessment (OP/BP

4.01), and Involuntary Resettlement (OP/BP 4.12) will be triggered for the subproject. The

screening has also resulted in categorizing the subproject as a Category B project. In addition,

the Bank’s requirements on public consultation and information disclosure will need to be

followed.

Environmental Assessment (OP/BP 4.01):

Environmental Assessment (EA) is an umbrella policy for the Bank’s safeguard policies. The

overarching objective is to ensure that Bank-financed projects are environmentally sound and

sustainable, and that decision-making is improved through appropriate analysis of actions and

of their likely environmental impacts. The EA process is intended to identify, avoid and

mitigate potential impacts of Bank operations. EA takes into account the natural environment

(air, water, and land); human health and safety; social aspects (involuntary resettlement,

indigenous peoples, and physical cultural resources); and transboundary and global

environmental aspects. EA considers natural and social aspects in an integrated way.

This subproject triggers OP 4.01 because it involves the construction and operation of a high-

voltage substation and connecting overhead transmission lines, requiring the identification,

mitigation and monitoring of potential adverse environmental and social impacts. As required

by OP 4.01 and the government EA regulation, the subproject has prepared an EIA and an

EMP that meet the Government’s and the World Bank’s safeguards requirements. By the TEP

appraisal, the subproject draft EIA and EMP were disclosed locally at the subproject sites and

the Bank’s InfoShop in Washington DC on January 24, 2014 as required by OP 4.01 and the

Bank’s policy on access to information. The final EIA and EMP were disclosed locally at the

subproject sites, at the Bank’s InfoShop, and that the Vietnam Development Information

Center on January 24, 2014.

Involuntary Resettlement (OP/BP 4.12)

The Involuntary Resettlement policy seeks to prevent severe long-term hardship,

impoverishment, and environmental damage to the affected peoples during involuntary

resettlement. OP 4.12 applies whether or not affected persons must move to another location.

The Bank describes all these processes and outcomes as “involuntary resettlement,” or simply

resettlement, even when people are not forced to move. Resettlement is involuntary when the

government has the right to expropriate land or other assets and when affected people do not

have the option to retain the livelihood situation that they have.

This policy is triggered because the subproject it would have impacts involving the temporary

and permanent involuntary taking of land and the loss of structures and assets associated with

the land for the construction of the substation and the associated connecting line. By

appraisal, the subproject has prepared and disclosed a draft RP locally at the subproject sites

and the Bank’s InfoShop in Washington DC on January 24, 2014. The RP includes the

measures to ensure that displaced people are: (i) informed about the options regarding

resettlement; (ii) consulted and offered alternative resettlement choices; and (iii) provided

with effective compensation and livelihood restoration. The final EIA and EMP were

disclosed locally at the subproject sites, at the Bank’s InfoShop, and that the Vietnam

Development Information Center on January 24, 2014.

World Bank-financed projects should also take into account the World Bank Group

Environmental, Health, and Safety Guidelines1 (known as the "EHS Guidelines"). The EHS

Guidelines are technical reference documents with general and industry-specific examples of

Good International Industry Practice.

The EHS Guidelines contain the performance levels and measures that are normally

acceptable to the World Bank Group and are generally considered to be achievable in new

facilities at reasonable costs by existing technology. The environmental assessment process

may recommend alternative (higher or lower) levels or measures, which, if acceptable to the

World Bank, become project- or site-specific requirements.

This subproject should conform the Environmental, Health, and Safety Guidelines for Electric

Power Transmission and Distribution and the General EHS Guidelines.

III. Subproject description

3.1. Objectives of the Subproject

The objectives of the proposed subproject are to: i) meet the load growing electricity demand

of Hanoi city power system especially load of the West of Hanoi city; ii) create power links

between West of Hanoi city and neighboring provinces, distributing power capacity, avoiding

overloading of the transformers at the station in the area, thereby ensuring safety and reliable

operation of power network in Hanoi city; iii) reduce power loss in entire power network,

enhancing effectiveness of electricity generation of EVN.

3.2. Scope of the subproject

The subproject involves: construction of a new 220kV substation with two 220kV-250MVA

transformers.

During the project implementation, the first transformer with a capacity of 250MVA will be

installed and put in operation in 2015. The second transformer will be put place during the

period of 2018 - 2020 depending on the load growth rate of Ha Noi and surrounding areas.

The construction activities include: i) construction and installation of the function house

service for management and operation (bay housing and control housing 220kV); ii)

construction of a 261 m of access road to the substation from Province Road no 80.

3.3. Subproject location

The total area of Tay Ha Noi 220kV substation is 63,281.m2 at rice field on territory of Yen

Noi hamlet, Dong Quang Commune, Quoc Oai District, Ha noi City. Its geographical position

of land is as below:

- East side: Dike of Day river, section connected from Lang - Hoa Lac to National road

No.6.

- North side: Rice field, about 1km far from Centre of Quoc Oai town.

- South side: vicinity with residential area of Dong Quang commune.

- West side: bordering irrigation canal of district, further is rice field of Dong Quang

commune.

- Substation site is about 1km far from Centre of Quoc Oai town toward North.

3.4. Scope of work

The 220kV Tay Ha Noi substation:

- Area inside the fence : 54967,0m2.

- Land occupied area of the substation : 60093,0m2.

- Architectural area : 4982,0m2.

- Area of concrete road inside the substation : 6114,7m2.

- Area spreading rock at foundation of substation : 47152,0m2.

- Amount of soil embankment : 119355,0m3.

Road access into the substation:

- Land occupied area : 3188,0m2.

- surface area of concrete road : 1561m2.

- Amount of soil embankment : 9082,0m3.

Gate and fence

- Fence has structure of brick constructed wall, each interval of 2,5m shall be 1 brick

abutment.

- Gate of the substation has dimension of 6m for main gate and 1m for auxiliary gate.

Gate’s abutment shall be built by brick, gate’s wing shall be steel, controlled by electric

motor.

Internal routes

- Internal road of the substation is designed by asphalt concrete, width of road surface is

4m and 6m, road surface is about 100mm deeper than foundation surface of the

substation, 2 pavements of the road shall be provided with M200 concrete sidewalk,

curvature radius of 5m.

- Structure of road surface comprise of top layer which is asphalt concrete with coarse

aggregate, thickness of 70mm-80mm, then layer of graded aggregate layer with the

thickness of 250mm.Next is coarse sand layer with cement consolidation with ratio of

8%, thickness of 200mm and finally is well compacted foundation soil layer affirming

K 0,95.

- Structure of pavement on 2 sides of the road comprise: on the top is block brick layer,

thickness of 60, next is coarse sand layer, thickness of 100mm for making flat, and

finally is foundation sand layer which is well compacted affirming K 0,95.

Access road

- Road access into the substation shall be turned in branch from dyke road of Day river.

The length is about 261,0m.

- Road surface shall be embanked by sand being well compacted K 0,95.

- Road has the width on surface of 6m, each side of road pavement shall be 1.5m wide.

Road surface is steep into 2 sides, the horizontal slope: I = 2%; longitudinal slope: i

0,1.

- Structure of road surface: road surface is by asphalt concrete, graded layer of Ashlars,

soil foundation is well compacted K = 0,95.

- On 2 sides of the road shall be embanked by Ashlar wall, particularly the section which

has high slope, nearby the dyke road shall be embanked by soil roof with appropriate

slope (presented in detail in the Volume of drawings).

- Foundation of the transformer by reinforced concrete, structure of raft foundation with

beam system to bear the transformer.

- Oil pit has dimension suitable with present regulation and being made sloped toward the

place where locating oil drainage pipe.Emergency oil (if any) shall be collected into oil

pit and flow at the oil drainage pipeline to the emergency oil basin that located in the

substation.

Tower and cross arm of the wire

- The whole set of tower and cross arm shall be fabricated by shaped, galvanized steel,

connected by bolt, with structure of hollow tower shape.

- The 220kV region has kinds of tower with height of H=23,5m, H=18,5m and arm has

the length of L=15,4m positioning at the height of 18,5m; Busbar tower is 8m high.

- The 110kV region has kinds of towers with height of: H =16m, H=12m, arm has length

of L=9m positioning at the height of 12m.Busbar tower is 6m high.

- Besides, at the substation area, there’s also lighting towers with the height of H=20m

Equipment supported pillar

- Equipment supported pillar shall be fabricated by galvanized shaped steel, linking by

welded joint and bolt.Its structure is hollow, shaped type, square dimension.

- Height of pillars is suitable with equipment of substation and affirming safety distance

in accordance with regulation on management and operation.

Tower foundation

- Tower foundation shall be reinforced concrete, structure of foundation type is adjacent

to the beam system and 4 supported pillars for the tower foot.

- At the top of foundation pillars, anchored bolts have been embedded available.

Pillar foundation to support equipment

- Abutment foundation to support equipment shall be reinforced concrete, foundation

structure is type of pillar intact slab foundation.

- At the top of foundation pillars, anchored bolts have been embedded available.

Cable channel system

- Cable channel is designed with type of sub-underground with cable bracket.

- Cable channels have following types:

+ Type 1: Inner width of the channel: 400mm using for the trench section running into

the equipment.

+ Type 2: Inner width of the channel: 700mm using for the channel section running

along the equipment section.

+ Type 3: Inner width of the types: 1000mm using for channel section running along the

equipment section and toward the Control house.

Control house

- Control house is arranged favor for operation and meet requirements of the 500kV

substation that proposed to be built adjacently in future.The building has structure of 2

stories, its layout dimension is (20,7x16,3)m.Height of each story is 4,2m.

- Foundation surface of the building is 0,45m higher than foundation surface of the

substation.

- 1st floor comprises of following chambers:

- Doors, windows shall be aluminum framed, glass type.

- External face and ceiling shall be covered by 2 layers of watertight glue, after that

covered by 2 layers of white, anti- mould paint.

- Internal face at control room, relay room, communication room and working rooms

shall be covered by 2 layers of watertight glue, after that covered by 2 layers of cream-

color, anti-mould paint.

- Walls and ceiling of the battery room shall be covered by acid-resistance paint.

Control house for bay

- Is provided at the switchyard area with dimension of (3 x 7,2)m.

- The building has framed structured and its foundation is reinforce concrete, brick built

wall, and in-place reinforced concrete placement on top of the building.

- Doors, windows are aluminium frame, glass typed.

- Internal and external wall is covered by paint.

- Foundation of rooms is granite split in square by glass joint.

- The whole power line supply source for lighting, fan equipment shall be run submerged

inside the wall.

Guard building

- Guard building shall be arranged right on the road access from substation’s gate with

dimension of 5,1x3,6m.

- The building has reinforced concrete foundation structured, brick masonry wall, the top

of the building is in-placed by reinforced concrete.

- Doors, windows are aluminium frame, glass typed .

- Internal and external wall is covered by paint .

- Foundation of rooms is paved by tile.

- The whole power line supply source for lighting, fan equipment shall be run submerged

inside the wall.

Substation management & operation Building

- This is the roof concrete placed building with 9 rooms, each room has dimension of :

(3,6x8,4)m.

- In front is a 1,2m wide corridor running along the whole building.

- Each room has 2 parts: the main part and auxiliary part.

- Wall is built by force bearing brick, roof is reinforced concrete, then covered on top by

corrugated iron.

Water supply, drainage and fire prevention and firefighting system

Water supply

- Water source for living and fire fighting in the substation is taken from drilled well

exploiting underground water at depth of 80-100m.

- Water source from drilled well shall be treated via water disposed part and directed into

water tank, then being bumped directly into reserve tanks in auxiliary area of Control

house and O& M-shift -resting building.

Water drainage

- Rainfall on the substation’s layout surface shall be partially drained directly following

the surface foundation of substation via holes in fence’s bottom to get out. The remains

shall follow road’s surface to collect at the wastewater tank provided adjacent to road

sides and from there release out of the substation through concrete drainage piping

system.

- Water in Cable channel flows along bottom of the trench into PVC drainage pipe to

wastewater tank and through the general drainage piping out of the substation.

- Wastewater from living after being treated that in compliance with environmental

sanitation will be released out by PVC pipe.

Some main items of the water supply and drainage system and firefighting & prevention

system

Pump substation:

Pump substation is designed to meet both requirements of the 220kV substation and the

future built 500kV substation. The structure and technical data are as below:

- The house is one floor structure, dimension of layout: (7,2 x 4,5)m, house’s height: H =

3,9m. Foundation surface of the pump substation is 0.45m higher than foundation

surface of the substation.

- Foundation shall be reinforced concrete, house’s wall shall be built by brick M75,

thickness of 22cm, pasted by cement mortar : M50.

- Machinery floor shall be reinforced concrete M200.

- Doors shall be panel aluminum type. Windows shall be aluminum framed, color glasses.

- Inside the pump substation, it shall provide 2 pumps with Q = 54,0156,0 m3/h; H =

89,554,0m. In addition, there will be 1 pressure compensated pump at the substation to

maintain pressure inside the fire-fighting pipelines for the transformer and for resisting.

Water basin:

- At the substation, there will be 2 water basins to supply water for firefighting system for

both the 220kV substation and the 500kV substation in future, capacity of each tank is

V = 100m3.

- The basin shall be reinforced concrete M200, structure of overflow basin, located above

the ground. Inner diameter of the basin: D = 6,0m, height from ground surface of the

substation foundation to the upper surface of the basin’s wall is: Ht=3,0m, depth from

ground surface of substation foundation to the bottom of the basin: Hđ = 0,4m.

Breakdown oil tank:

- As not considering to the case of repeated emergency cases so that oil basin has bearing

capacity of V = 60m3 counting for emergency case of one 220kV transformer.

- The basin is built underground, the whole basin shall be reinforced concrete, pestering

by cement mortar.

Drilled well exploit underground water and water treatment area:

- Drilled well exploits underground water at the depth of 80m, diameter of the well where

having filter pipe section is: 110.

- Water discharge exploited frequency: Q = 1,52,0 l/s except for water volume sufficient

to be exploited during the time of > 20 years.

- Clean water treatment area used to supply household water for the Control house and

O&M and resting area:

+ The treating area: locates above the ground on foundation surface of the substation,

layout dimension: (2 x 5)m.

+ The treating area comprise of water spraying frame-work, filtered basin and clean

water bearing basin.Water after being sterilized iron and filtered free from impurities

shall be put into bearing basin with capacity of 10m3, from that being pumped into the

basin at the WC area of the Control house and operation & management building.

Communication System

The communication system will be quippe with purpose follows:

- Creat the communication channel for protective relay.

- Serving for the communication channel for the Control- Dispatch flow as:

+ Telephone communication between operation on duty of the 220kV Tay Ha Noi

substation and Dispatch operator at National Dispatch Center A1:

+ Supply data transmitted channel serving for the SCADA/EMS:

+ Creating connected link to 220kV substations, 110kV substation at the adjacent region

towards the Dispatch Center for Power System.

+ Connecting the LAN/WAN.

Control system and SCADA system

Controlling system of the 220kV Tay Ha Noi substation is an integral controlling

system.The system shall ensure main requirement such as below:

- Operating system shall be Windows XP, Window Vista or the latest version or Linux.

- All of equipment and device shall be connected with each other for operation by double

fiber optic cable Ethernet 10/100Mbps, with one net is main and the other is stand-by

net to ensure uninterrupted operation of the system even in case of any failure or

breakdown from any single elements on the system. The LAN system shall support

protocols TCP/IP, FTP and Telnet.

- Design of controlling system shall ensure that any damages of any individual element

shall cause no effects to normal operation of the system.

- The IEC61850 protocol is selected to be communication protocol of LAN net between

host computer and Intelligent Electronic Devices (IEDs).

- The IEC60870-5-101 protocol is used as interface for connection of the controlling

system of 220kV Tay Ha Noi substation to S.P.I.D.E.R system in the North Region

Load Dispatch Center (NRLDC) in order to supervise, acquire data and control.

3.6. Major activities before and during construction

- The preparation work shall be carried out suitable for the construction progress, weather

characteristics and infrastructure of the construction area.

- Utilization of vacancy areas within the limit of the substation to arrange equipment and

material storages.

- Camps shall be close to the construction site for facilitating the construction, life

activities and personnel mobilization.

- Based on quantity of the construction and erection work, quantity of materials and

equipment, construction progress and etc., it is expected that the scale of temporary

works and storage/yard will be as follows:

Temporary storage/yard

- Arrangement: Stock, warehouse serving for construction are proposed to be taken usage

blank regions, areas within the construction layout.

- Structure:

+ Tight warehouse shall be by bamboo, covered roof by phibro-cement. Foundation of

the cement warehouse shall be propped by timber beams that 0.2m far from natural

surface.

+ Opened warehouse shall be by bamboo, covered roof by phibro-cement.

+ Platform for casting concrete items shall be by concrete M100, 100 thick, paving by

cement mortar, 20 thick.

- Structure: wall 110 with pillars, roof covered by phibro cement, with fiberboard ceiling,

house’s foundation is concrete M100, 100 thick, paving by mortar cement M50 with the

thickness of 20.

- Scale and arrangement: area: 50m2. Arranged at the provision region of the substation.

a. Manner of Execution

Earthwork

- Scrape: take off the layer of vegetable earth on the subsatation surface by combined

bulldozer, excavating machine and 5 tons auto.

- Sandy filling for scrape: Sandy shall be levelled by the bulldozer and compacted by 9

tons mechanical compactor.

- Soil excavation of the tower foundation, foundation of the transformer shall be by

excavator 0.4 m3 and bulldozer. Adjustment of the foundation shall be made manually.

- Soil excavation for foundation of pillar, foundation of houses, earthing, cable channel,

pipeline shall be manual. Earthfill shall be manual.

- Spoil earth is transported by 5 tons auto with average distance is 5 km

Concrete work

- Pre-casted concrete shall be placed concentratedly at the area providing at the site.

- Concrete mortar shall be mixed by 250l mobilized mixer. Concrete compaction shall be

done by roller combining with manual.

Reinforcing steel work

- Reinforcing steel of pre-casted concrete and cast-in-place concrete shall be processed at

the site.

- Steel structure: galvanized steel pillar tower, arm shall be manufactured domestically. In

addition to the pillar of electric equipment that be imported.

Formwork

- Formwork of concrete shall mainly use timber formwork, fabricated at workshop

arranged at the site.

Masonry

- Mortar for building and plastering shall be mixed by 250 liter mobilised mixer.

- Materials delivered to higher position shall be done by lift.

Erecting steel structure

- Constructional element: Pre-casted concrete elements shall be erected manual.

- Steel structute: Tower, steel arm shall be combined and erected by machine combining

with manual. Equipment supported pillar shall be erected manually.

Delivery

- Main electric materials, equipment shall be imported to Hai Phong port and from Hai

Phong port to the site is transported by auto. In addition to the transfomer is

transported from Hai Phong port to Ha Noi port by the waterway and from Ha Noi

port to the site by specialized means

- Construction materials shall be transported to the site by main land road.

Demand serving for construction & installation

- Demand for machines, trucks: Demand for machines, trucks has been defined

following present stipulated norms for construction.

- The transformer, when transporting to the construction site, shall be brought in the base.

The correction and arrangement of declination by hydralic jack, winch, pulley puli.

- Install accessories of the transformer: high, medium, low-voltage input bushing, cooling

flanges, explosion vent, connection box and etc. by crane and manual way.

- Filter oil by special purpose machine

- Complete grounding work and manually paint.

Installation of outdoor equipment

- Before installing the equipment, it will be required to check, clean up and transport to

the right location. The installation of equipment supplies shall be carried out in a

manual way.

- Install socket, accessories, stretch the earth wire, fillet weld manually.

Installation of indoor equipment

- Transport the equipment to the house by using manual method combined with pulley

puli, jack.

Transportation

Material and equipment supply

Material and equipment supply will be determined in detail in later phase, depending on the

state budget disbursement and the subproject bidding method. Two sources are expected:

+ Material and equipment supply by the subproject owner.

+ Material and equipment supply by the contractor.

Long distance transportation

For material and equipment supplied by the project owner:

+ Long distance transportation of such material and equipment will be undertaken using

specialized trucks. Such trucks will be selected in accordance with the requirements

provided in the contract.

+ Long distance transportation from the subproject owner warehouse to the site will be

undertaken using 5-7.5 ton trucks and loading and unloading will be done using 5-ton

cranes.

For materials and equipment supplied by the contractor:

+ Electric poles will be transported using Kawaz trucks, using 5-ton cranes for loading

and unloading.

+ Supporting frames and accessories will be transported using 5-ton trucks with manual

loading and unloading.

+ Cement and steel will be transported using 5-ton trucks with manual loading and

unloading.

+ Stone and sand will be transported using 5-ton dump trucks.

Intermediate transportation

Materials and equipment stored at the site such as cables, insulators, accessories, breakers,

capacitors, power meters, meter boxes and cement will be transported to the construction sites

using non-motorized vehicles and manual handling.

Manual handling

All materials and equipment will be transported to the construction site manually. The

distance will be determined case by case.

IV. BASELINE DATA

4.1. Geographical location and population

As mentioned above the subproject will be located on the paddy rice land area belonging to

the communes of Dong Quang, Quoc Oai district, Ha Noi city. Quoc Oai district have a total

natural land area of 147km2, divided into 20 commues and with a population of about

168,935 people.

Quoc Oai district has favorable natural conditions for economic and social development, and

significant transportation advantages facilitating good and trade exchange between Hanoi and

the west provinces. The district administratively borders Phuc Tho district to the north;

Chuong My district to the south, Hoai Duc district and Ha Dong urban district to the east; and

Luong Son, Ky Son district on the west.

4.2. Topography

Topographical condition in area where substation will be constructed comprises mainly paddy

fields, pond, channel, demarcation between population centers, limits between subsidiary

crops, and limits of graveyard.

This area is distributed mainly with trees, subsidiary crops owned by local resident.

Vegetation, subsidiary and tree are distributed as below:

Subsidiary crop land : 15%

Paddy land : 85%

Generally the area is classified as topographical grade III

4.3. Hydro- meteorological characteristics

Geology

On paddy field area and subsidiary crop field, topography of the deposited delta has rather flat

surface with unremarkable different in height. Rock and soil structure creates this topography

are mainly: hard plastic clay, soft plastic clay, semi soft plastic clay, semi plastic sand which

are originated from blend river, ocean deposits (amQ)

Meteorology

On the project site, from May to October, the climate is hot and humid, the average

temperature is 27.7 oC. From November to April the next year, the cold climate with an

average temperature of 19.9 oC. Absolute highest temperature measured at the meteorological

station in Ha Dong was 40oC, appeared on 5/7/2010. Absolute lowest temperature measured

was 5.9 ° C on 26/01/2005.

The average humidity of the project area from 2002 to 2011 was 84%.

Total average sunlight hours measured in 10 years (2002-2011) was 1325.9 hours/year.

Sunlight mode is closely related to the mode of radiation and cloud status. From December to

April the sky is cloudy so that the sunlight hours is at least of a year, only 63.6 hours/month.

In May, the weather is warmer so that the number increases to 144 hours /month.

On the project site, winter wind is prevailing at the northwest and north directions, summer

wind is prevailing at the South East and North Northwestern directions.

The average evaporation (mm) over years at the project area is 999mm. The greatest

evaporation is in July reached 106.4 mm. Evaporation is low as 61.7 mm in February.

The rainy season usually occurs during the period from May to October. The highest

rainfall are usually in July or August related to the rainstorm season in the Northern Plain.

The lowest rainfall are in February or December. Annual average rainfall is 1551.7 mm.

Maximum daily rainfall is 214mm in the period 2002-2011 (appeared on 13/7/2009)

Rainstorm: During the hot season (from August to October), there are a certain number of

tropical depressions and typhoons forming offshore Philippines going through the East China

Sea then landing on the Northern Plain towards the West cause of heavy rains and strong

winds.

Hydrology

The 2 rivers flowing through the district are Day river and Tich river. The hydrological

mode of the district depends on Red River, Day river and Tich river and many other ponds

and lakes.

- Underground water: Underground water level stabilized at a depth of 0.0-1.2 m. Water

penetration is weak (Ia) according to TCVN 3994-85

- Surface water: the planned site building the substation is located on alluvial plains right

bank of Day river, there are many ponds and lakes. During the time of landform surveying,

the major substation area were flooded. Water supply to Day river and ponds, lakes, rice

fields is mainly the upstream water, rain water and irrigation water inland.. The level river

water usually high on rainy season. The water penetration is weak at the substation area

according to TCVN 3994-85.

- Surveying work about water supply for the substation: the planned site building the

substation is about 400m away from the residental area of Yen Noi village, Dong Quang

commune, Quoc Oai district, Hanoi city. Currently, local people use water taking from public

deep wells. Water purchase contract could serve the needs of water at the substation in Dong

Quang commune.

On the basis of the statistics data for 10 years (2002-2011) of the substation the water level

of Day river in the flood season (VI-X) is quite high. Monthly avarage water level for many

years in the flood months are greater than 110cm. The highest average water level is reached

211cm in August. Annual average water level at the project area is 105cm.

4.4. Land use

Xã Đồng Quang có diện tích tự nhiên 1.080,89ha, trong đó có 601,39ha đất nông nghiệp và

nuôi trồng thủy sản. Bên cạnh đó, đất phi nông nghiệp của xã chiếm 26,9% bao gồm 92,1ha

đất ở; 108,88ha đất giành cho giao thông; 85,09ha đất thủy lợi và 2070m2 phục vụ vệ sinh

môi trường.

4.5. Environmental baseline data

4.5.1. Air

Dust density

Suspended dust is one of the important criteria in the inspection evaluating impact of the

production areas on the environment. According QCVN 05:2009/ BTNMT, dust density of 300

μg/m3 in ambient air is allowed. Under this regulation, at all supervisory positions in the

construction area of 500 kV and 220 kV Tay Ha Noi substation (expected) the dust density are

very low and within the permitted value. Dust content in the same place in the afternoon is more

than that of the morning due to cool weather, high air humidity and light winds cause lower dust

content

The density of toxic gases

SO2 emission: According to QCVN 05:2009/ BTNMT, the density of SO2 in the ambient air of

300 μg/m3 is allowed in the project area, the gas density at all monitoring points are very low and

within permissible standards, from 51 to 68 μg/m3, the highest is at K5 position - on the dam of

Day River in the afternoon, influenced by traffic activities because there are many vehicles

involved.

NO2 emission: According to QCVN 05:2009/BTNMT, the NO2 density in the atmosphere is

allowed around 200 μg/m3. The analysis results showed that the density of NO2 in the surveying

area is much smaller than the allowable value. NOx density ranges from 42 to 54 μg/m3. The

small density of exhausted gases is small due to mainly agricultural activities in the surveying

area.

CO emission: According to QCVN 05:2009/BTNMT, the CO density in the air allowed is around

30,000 μg/m3, generally carbon oxide emissions in the project area and in the surrounding area

are permitted. The density of carbon oxide in the areas ranges from 1.745 to 1.905 mg/m3

Noise

Monitoring results showed that noise level Leq in most of the measuring positions is lower than

the allowed value in QCVN 26:2010/BTNMT. Noise levels in the measuring points on roads are

higher than that in the substation area, measured noise levels in the afternoon is higher than in the

morning, noon and night due to many life activities of local people at this time.

Vibration

Vibration unit is vibration acceleration (m/s2). Measuring results showed that the vibration

levels at most of points of the project area have the same value of zero (not detected).

4.5.2. Water condition

Quality of surface water environment

The analysis results indicated that the quality of irrigation water used for irrigation purposes for

farming (NM1) has most of the parameters following QCVN 08:2008/BTNMT applied to the

column B1 (used for irrigation purposes) but at a higher threshold. Some of nutrition figures as

NH4, NO3-, PO43- or nutrition figures such as TSS, BOD5 began exceeding permissible

standards, demonstrated the quality of this irrigation water has been contaminated at the low level

except for the heavy metal figures.

The water quality of Day River has most of parameters met the standard QCVN 08:2008/BTNMT

applied to the column B1 (used for irrigation purposes).

Quality of underground water environment

Generally underground water quality in the project area is permitted according to QCVN

09:2008/BTNMT. Some figures such as COD, ammonia, heavy metals (Asen, lead, iron)

approximate allowable values, especially the figure Coliform of underground water samples NN1

has the concentration of 3 MPN/100 ml, reaching a the highest threshold as QCVN

09:2008/BTNMT. Therefore, in case exploiting groundwater project for domestic purposes

should consider to that two parameters.

4.5.3. Soil condition

Content of metal Asen, Cd, Zn, Cu, Pb, Hg in soil, indicates the accumulation of heavy metals in

agricultural land. The analytical results of the heavy metal content for all examined samples are

much smaller as the standard QCVN 03:2008/BTNMT. This showed the soil samples of the

surveyed area are not contaminated heavy metals and relatively safe for the development of

production, the cultivation of food crops, vegetable.

Electro-magnetic condition

Survey results at measurement points are within the range of 1 kV/m, in the permitted value (eight

hours continuously), that less than value 5kV/m as specified.

For the strength of the magnetic field, the measured values are very smaller in comparison with

the standard and the magnetic sources in the area are almost undetectable.

4.6. Socio-economic status of the project area

Dong Quang commune has 3,330 households with the population of 13,759, including 7,880

persons at the working age, accounting for 57.59% of the population. The natural growth rate

of population is 13.6 ‰.

The main livelihood of people in the commune is agriculture – employing 75.78% of the

population at the working age, there are also some other manual works such as construction,

carpentry, handicrafts from rattan, mechanic, transport services and trade. Per capita income

was 13 million VND/person/year in 2010

Dong Quang commune has large land area for production, characterized an agricultural land

in the alluvial soil fertile river flat. Besides, by the geographical conditions and convenient

transportation, the commune has many advantages for the development of industry and

services in the future. Taking advantaged and potential conditions available, in recent years,

the economic structure of Dong Quang has had a positive shift towards increasing the value of

handicraft production, construction, trade and services. Many infrastructures of economy,

culture, society, medical health, education and other welfare facilities are also interested to

construct and improve.

In 2011, the District's economic has a fair growth, investment and technical infrastructure;

social infrastructure is concerned, contributing to the general economic growth of the district.

Regarding to industry, handicraft industry: The industry and handicraft industry value in 2011

is estimated at 1,294.9 billion, reach a portion of 90.3% of the year plan, and 112.9% as the

same period of the last year. Traditional handicraft industry value is estimated at 96.3 billion,

or 107% as the same period of the last year, non-state industry is estimated at 1198.6 billion,

or 113.4% as the same period of the last year. The traditional handicraft industry has

developed steadily. Handicraft production value is estimated at 157.8 billion, or as 108.5% as

the same period of the last year. The district currently has 83 industrial enterprises running

business. The City's people's committee approved Nghia Huong trade village with the land

scale of 11 hectares, the district is implementing the next steps

Regarding to capital construction: In 2011 there are 154 construction projects, total planned

source of capital is 338.9 billion

Planning work: continue to implement planning works, establish a Steering Committee for

approving the overall planning scheme of economic-social development of the district period

2011 - 2020, with a vision to 2030, the planning layout of school system; basically complete

the build of planning works and construction of 07 new rural communes in the stage 1, submit

to the authorities for approval, and detailed planning of the project expanding the

administrative center and the complex culture - sports of the district are implemented.

The value of the service - trade sectors in 2011 (at compared prices) is estimated at 478

billion, 102% higher than the planned, 119.4% as the same period of the last year.

The total production value of agriculture, forestry and fisheries is estimated at 368.56 billion,

reaching 105% over the planned, 108% as the same period of the last year.

Implement a good health care system for people. Arrange, examine and propose the Hanoi

people's committee to agree three communes reach the national standard of medical health,

bringing the total number of communes meet national standards of medical health to 21/21

communes and towns. Implement the next steps of the extending and upgrading the district

general hospital with a capital of 205 billion VND. Direct and arrange propaganda,

dissemination works efficiently about population statutes, limiting people have a third child or

more. The crude birth rate of 17.6%, decreased by 1.2% compared to the planned, in 2011

there are 412 persons have a third child or more reaching 13.6%, decreased by 0.2%

compared to that of 2010.

Efficiently implement the policy for deserved well people and socially sponsored people,

ensuring proper policies. Visit and give17,920 gifts for people of social policy, retired people,

loss of working capacity. Complete review of the poverty households, started the construction

For culture – sports aspect, by the end of 2011, there are 75 villages, residential areas, 35

offices and agencies recognized and maintained the title of culture, sport movement continues

to develop across the district-wide.

4.7. Protected areas, natural reserves, sensitive areas, cultural property, historical

monument, temple and pagoda in the project area.

The project is located in an area of agricultural land. There are no any natural reserve area,

sensitive area, cultural property, historical monument, temple and pagoda in the project area.

V. ENVIRONMENTAL IMPACT ASSESSMENT

The subproject would contribute to meeting the demand load and power safety in Hanoi city

and thereby bring about significant socioeconomic benefit. Apart from such benefits, the

subproject may also result in environmental and socioeconomic impacts which are adverse to

the local conditions.

The environmental screening of the subproject indincates that it is eligible for financing

considering that the subproject would not involve possible high risk and would not create

potential adverse impacts on (a) critical natural habitats and/or protected area including

proposed protected areas; (b) loss or damage to cultural property, including sites having

archeological (prehistoric), paleontological, historical, religious, cultural and unique natural

values, graves and graveyards; (c) water regime, particularly water flow and water quality;

and (d) local traffic.

The implementation of the subproject would mainly cause land acquisition, increased dust

generation, air pollution, domestic waste, and health and safety issues due to construction

activites and electrical magnetic field. However, these impacts are not significant, temporary,

localized impacts with available mitigation measures. Only OP 4.01 and OP 4.12 are triggered

for this subproject.

The potential negative impacts of the subproject are identified in table below and could be

minimized by applying the proposed mitigation measures developed for the subproject which

is described in the next section.

monolithically with transformer’s foundation and anti-fire wall’s foundation and higher than

0.3m in comparison with the substation’s surface, the pit bottom is created slope I = 0.5 % in

the direction of the oil conllection tube . The breakdown oil tank is buit in the ground by

reinforced concrete, cement plaster, the tank’s cover is higher than 0.15 m in comparison

with the substation’s surface. The breakdown oil tank is arranged in convenient location for

the collection of transformer oil . The tank’s capacity is V = 100m3 to ensure collecting 100

% of oil go out of the transformes when there is a problem . The breakdown oil (if any) will

be collected in oil collecting pit and flow under the oil drain pipe to the breakdown oil tank

located in the substation.

- No burning, on-site burying or dumping of solid waste shall occur.

- Recyclable materials such as wooden plates for trench works, steel,

scaffolding material, site holding, packaging material, etc shall be

collected and separated on-site from other waste sources for reuse, for

use as fill, or for sale to reprocessing to companies with legitimate

operating permits.

- If not removed off site, solid waste or construction debris shall be

disposed of only at sites identified and approved by the Construction

Supervision Consultant and included in the site specific measures. Under

no circumstances shall the contractor dispose of any material in

environmentally sensitive areas, such as in or close to watercourses.

8. Hazardous

wastes - Hazardous waste of any kind shall be disposed of at an approved

appropriate landfill site and in accordance with the national legislative

requirements. The Contractor shall obtain needed disposal certificates.

- The removal of asbestos-containing materials or other toxic substances

shall be performed and disposed of by specially trained and certified

workers.

- Used oil and grease shall be removed from site and sold to an

approved used oil recycling company.

- Used oil, lubricants, cleaning materials, etc. from the maintenance of

vehicles and machinery shall be collected in holding tanks and removed

from site by a specialized oil recycling company for disposal at an

approved hazardous waste site.

- Used oil or oil-contaminated materials that could potentially contain

PCBs shall follow procedures provided in the ESMF to avoid any

leakage or affecting workers. The local DONRE must be contacted for

further guidance.

15. Chance find

procedures - If the Contractor discovers archeological sites, historical sites, remains

and objects, including graveyards and/or individual graves during

excavation or construction, the Contractor shall:

- Stop the construction activities in the area of the chance finds.

- Delineate the discovered site or area.

- Secure the site to prevent any damage or loss of removable objects. In

cases of removable antiquities or sensitive remains, a night guard shall

be arranged until the responsible local authorities or the Department of

Culture and Information takes over.

- Immediately notify the Construction Supervision Consultant and the

subproject owner who in turn will notify responsible local or national

authorities in charge of the Cultural Property of Viet Nam.

- Contact the relevant local or national authorities who would be in

charge of protecting and preserving the site before deciding on

VII. EMP IMPLEMENTATION ARRANGEMENTS

Proper environmental management during construction requires the involvement of several

stakeholders and agencies, each with different roles and responsibilities including: NPT,

NPPMB, DONREs (Provincial Department of Natural Resources and Environment) of Hanoi

city, the Contractors, the Construction Supervision Consultant, and local communities.

To ensure effective implementation of the EMP, the following actions will be carried out

during the implementation of the subproject:

a) During the process of detailed designing and bidding document preparation

- During the detailed design of technical specifications and preparation of bidding

contract documents for each contract, the technical design consultant will incorporate

into these bidding and contractual documents the parts of the EMP specific to that

contract, as well as the specific measures identified in the EMP.

- In preparing the bidding and contract documents, make an effort to ensure that the

contractors are aware of the safeguard obligation and commit to comply. The

environmental specifications in Annex 1 needs to be included in the bidding and

contractual documents.

b) During the preconstruction and construction phases

The NPPMB shall hand over the work of supervising on a daily basis the implementation of

safety measures of contractors to the Construction Supervision Consultant and/or the site

engineer. According to the terms of reference for the Construction Supervision Consultant

included in corresponding Appendix 2, Construction Supervision Consultant and/or Site

Engineering shall be responsible for the following tasks:

- Confirming that the idemification to related parties who are influenced by the Project

and bomb and mine disposal have been completed before the commencement of the

construction phase.

- Review and approve Site Environmental Management Plan (SEMP) to be prepared by

contractor before the commencement of the construction.

- Closely monitoring the implementation of preventive measures during the construction

phase.

- Confirming the compliance of the contractor with the EMS, inspecting for any damage

caused by the contractor, and if necessary, making record and requesting the contractor

to indemnify/restore the original status of the construction site as stipulated in the

contract. Implementation of the contractor towards environmental safety shall be

included in the progress report of the mini-project.

- In order to be effective in the implementation process, PMBs will establish

inputs to the consultant selection process; v) reviewing reports submitted by

the CSC; vi) conducting periodic site checks; vii) advising PMB on

solutions to environmental issues of the project; and viii) preparing

environmental performance section on the progress and review reports to be

submitted to NPT, the Bank, and the local authorities if requested.

- The CSC will be responsible for routine supervising and monitoring all

construction activities and for ensuring that Contractors comply with the

requirements of the contracts and the EMP. The CSC shall engage sufficient

management to perform the required duties and to supervise the

Contractor’s performance.

- The CSC also assists NPMB in reporting and maintaining close

coordination with the local community.

- Based on the approved EMP and environmental specifications/requirements

in the bidding and contractual documents, the Contractor is responsible for

establishing a site-specific EMP for each construction site area, submit the

plan to the NPMB and CSC for review and approval before commencement

of construction. In addition, it is required that the Contractor get all

permissions for construction (traffic control and diversion, excavation, labor

safety, etc. before civil works) following current regulations.

- The contractor is required to appoint a competent individual as the

contractor‘s on-site Safety and Environment Officer (SEO) who will be

NPMB reports on environmental performance/compliance of the subproject should be

included in the progress report submitted to the NPT before each project implementation

support mission and must include sufficient information on: i) preparation and disclosures of

environmental safeguards instruments for subprojects; ii) incorporation of new subproject

EMPs in the bidding and contractual documents; iii) monitoring and supervision of EMP

implementation by the contractor, the construction supervision engineer, and the NPMB; iv)

any challenges in safeguard implementation, solutions, and lessons learned.

VIII. MONITORING PROGRAM

8.1. Objectives

It is essential to design the monitoring program and monitoring frequency appropriately to be

able to demonstrate both the overall performance of the subproject works as well as the short-

term impact due to peak construction activities. More specifically, as the integral and critical

part of the EMP, the environment monitoring program should have the following objectives:

- Determine the actual extent of the impacts.

- Control impacts which are generated from construction process and mentioned in the

EMP.

- Check and supervise implementation of environmental protection solutions during

construction based on EMP.

- Suggest mitigation measures in case of unexpected impacts.

- Suggest to the related parties to coordinate with central and local environmental

organizations to solve any pending issues that might arise relating to environmental

protection under the scope of the subproject.

- Assess the effect of mitigation measures in pre-construction, construction and

operation stages and recommend for improvement.

The environmental monitoring plan is described in the table below.

IX. CAPACITY BUILDING

9.1. Upcoming training plan includes

Training programme of EVN: Internal training courses on environment monitoring at the

site and methods of reporting on environmental issues of the Project as a part of the biannual

and annual Report. The programme also includes trainings on how to surmount unwanted

influence on the environment, which turns out different from the forecast of the EMS Report.

Training programme of National Power Transmision Corporation: Training programme

of EVNNPT for employees and local residents involves:

Training on labour safety: Periodical training on the safety and maintenance of electrical

grid;

Training on methods of monitoring and reporting on EMS implementation for related

parties in provinces and districts involved in the Project. These trainings will also provide

guidance on collaboration with the community in terms of environment monitoring.

X. PUBLIC CONSULTATION AND DISCLOSURE OF INFORMATION

Community consultation activities are carried out in two forms: flyers and meeting.

Meeting for community consultation was held at the office Yen Noi village, Dong Quang

commune, Quoc Oai district, Hanoi. Employer and Consultant held a community consultation

on environmental impacts of the subproject "220kV Tay Ha Noi substation ". Representatives

of the Employer and Consultant presented to the public on key issues as follows:

- Description of the project: construction site and the necessary for related construction

items, capital investment for the project, project objectives, project items

- Compensation Policy of the Project;

- Measures to mitigate the impact and limit damage to people …

- Representatives of households are invited to attend consultation meeting include

representatives of affected households, administration representatives, the relevant

agencies and organizations: Women's Union, Farmers' Association and Veteran's

Organization.

XI. DISCLOSURE OF THE EMP

The draft EMP copies in Vietnamese were disclosed the at the Dong Quang Commune, Quoc

Oai District, Ha noi City before the appraisal of the TEP project on January 24, 2014.

The draft EMP copies in Vietnamese and English were also disclosed at the Vietnam

Development Information Center at 63 Ly Thai To street, Hanoi City on January 24, 2014.

The draft EMP copies in English were disclosed at the InfoShop of the World Bank in

Washington DC on January 24, 2014. The final EIA and EMP were disclosed locally at the

subproject sites, at the Bank’s InfoShop, and that the Vietnam Development Information

Center on January 24, 2014.

ANNEX 1: Environmental Specifications for the Contractor

The environmental management requirements in construction of the subproject have been

established and presented clearly in the EMP (indicate the specific section of the EMP here).

The Contractor need to carefully read and fully understand all requirements included in the

contractor’s bid: (Insert the name of the Civil Works Package here) of the subproject.

I. Overview

In order to avoid negative effects into the environment and local community, as well as

minimizing damaging impacts to the environment during the construction and operation

stages of the resettlement sites, Contractor and workers are required to observe the mitigation

measures as mentioned below:

- “Environmental Management Plan for the Project…”.

- The technical specifications, procedures and the most popular practices are presented

in this annex.

II. Overall requirements of Contractor for environmental management

Contractor need, in in line with the requirements of the EMP, to include, but not limited the

following responsibilities:

- Be in compliance with the current national legal regulations on environmental

management.

- Work in scope of requirements in the contract and the conditions in the bidding

documents.

- Assign the representative of the construction team to participate in the site inspection

operations by the PMB, CSC or the DONRE as well as implement all corrective actions

to overcome the environmental issues as guidance provided by the Construction

Supervision Consultant (CSC).

- Provide and update information for PMB about any activities, assignments that can

contribute or continue to cause the significant harmful impacts into the environment.

- In case of instruction by the CSC and PMB, the Contractor must stop the construction

activities that causes adverse impacts, also propose and conduct the environmental

remedial actions and implementation other construction methods (if required) to

minimize the negative environmental impacts.

- Establish and maintain an Environmental and Safety Unit, which consists of

Construction team leader or Vice- team leader and Safety and Environmental Officer

(SEO) with the purpose of receiving and dealing with the complaints, objections,

argument and displeased of the local community caused by the construction operation.

SEO is responsible to record all of complaints, resolve methods and results into the

complained register. The register need to keep at the construction office and available

for review by the supervision engineer and PMB.

III. Responsibilities of Contractor in EMP implementation:

The construction Contractor has responsibility in compliance with the technical specifications

of the EMP, (name of the subproject to be inserted here) and national environmental

management regulations, including but not limited the following items:

i) The mitigation measures presented in relevant section of the EMP(indicate the specific

section of the EMP here) and prepare budget for implementing the mitigation

measures.

ii) Based on EMP, Contractor developed a detail Site Environmental Management Plan

for addressing the construction related impacts. The SEMP includes the following

components:

- Management Plan for worker camps.

- Management Plan of the overall construction operation.

- Plan for management and storage of construction materials (including the

dangerously chemicals)

- Solid waste and waste water management plan (including construction and

household waste)

- Plan for management and mitigation of noise and dust.

- Plan for management and mitigation of impacts to vegetation and wild animals.

- Plan for environmental landscape restoration

- Healthy and safety ensuring plan at the construction.

- Erosion and soil aggrandizement controlling plan.

- Safety plan during the construction stage and training for workers about

environmental management and community relations.

- Rules and regulations about living activities of staffs and workers at the

construction sites.

- Emergency Problem Treatment Plan.

- Management and Monitoring Plan for Report Process.

The detail measure of plan need to satisfy the following requirements: to implement the

particular mitigation measures: who implement (people, team, etc), how to implement

(labours, machines, equipment, etc.) and the cost. This plan shall be completed and submitted

to the CSC for review and approval before start of the construction. The Contractor will:

a) ensure that at least one supervisor is available in compliance with EMP before and

during the construction time.

b) ensure that all of the construction activities will be approved in document of the

relevant authorities.

c) ensure that all of staff and workers understand through their process and duties.

d) be in compliance with requirements about the environmental management monitoring

and reporting in EMP and inform to PMB about the difficulties and solutions.

e) Inform to the local authority and PMB in case of environmental problems and co-

ordinate with the relevant institutions and stakeholders for resolving.

IV. Safety and Environmental Officer of Contractor:

Each contractor will nominate a Safety and Environmental Officer (SEO) to work full-time at

the construction site. Requirements for a SEO include an undergraduate degree in

Environmental Major, at least 3 years of working experience in environmental management,

training and monitoring at the infrastructure construction project. Additionally, SEO should

have a good knowledge about Vietnamese Environmental Legal Regulations and has

participated to the labor safety and sanitation training class that organized by Department of

Labour- Invalids and Social Affairs and have the labor safety and sanitation certificate.

SEO have the responsibilities for implementing and managing EMP of Contractor. Tasks of

SEO will include, but not limit the following activities:

i) Training and developing environmental awareness for workers of Contractor within 2

weeks after the contractor is mobilized. The training is repeating every six months.

The additional trainings will be implemented under the guidance of Environmental

Supervision Engineer.

ii) Conduct the internal environmental monitoring at the site to check the construction

activity implementation of contractors, equipment and implementation methods to

manage the environmental pollution and evaluate the efficiency of the mitigation

measures into the environmental impacts.

iii) Internal monitoring the implementation of environmental mitigation measures and in

compliance of contractors with the environmental protection measures to prevent

and control pollution; the committed requirements in the contract; guidelines of the

contractor(s) on environmental improvement, environmental awareness and also

proactive measures to prevent pollution.

iv) Conduct an investigation and propose the mitigation measures for the contractor(s) in

case of incompliance/ infringe the EMP; monitoring and implementing the

environmental mitigation measures.

v) Evaluate the success of the EMP implementation to estimate effectively the cost and

adequacy of the implemented mitigation measures.

vi) Survey after receiving the complaint, thence evaluate and select the corrective actions.

vii) Conduct the additional monitoring activities, based on the concrete guidelines of the

monitoring engineer and/ or PMB; and

viii) Contact and implement all activities under the co-ordination or guidance of the

Contractor Leader, Environmental Supervision Engineer, Supervision Engineer,

PMB, representatives of the provincial environmental management offices, local

authority about all of environmental problems if necessary.

ix) Establish the regularly reports for the environmental implementation of the civil works

package.

x) All of the internal monitoring as well as other activities of SEO should be documented

and updated frequently in the environmental implementation monitoring diary of

Contractor. This diary is used for normally checking by the CSC to evaluate the

effectiveness of mitigation and the work of SEO.

V. Monitoring the environmental implementation of Contractor:

The PMB will sign a contract with the Consultant to carry out the task of CSC. The CSC will

apply the environmental and monitoring activities of the package as indicated in Appendix 2.

The environmental monitoring engineer of construction/execution monitoring Consultant is

responsible to monitor daily the implementation of measures, in order to minimize

environmental impact and safety of the Contractor. The construction monitoring Consultant

will carry out the following main tasks:

Before the construction stage, make sure that all of the compensation process for

land, works on land and relocation and/ or recovery/ donation of land as well as

the clearance of landmines and UXO have been completed.

Review and approve the SEMP for implementing the EMP by Contractor before

the construction operation.

During the construction process, monitoring closely the compliance with

implementing of the environmental and safety mitigation measures.

Confirm the compliance with the EMP of Contractor and check any negative

effect or damage caused by the contractor. If necessary, establish a request

statement for contractor to compensate/ restore the construction site, as provided

in the contract. The implementation of environmental management issues of the

Contractor shall be mentioned in the progress report of the sub-projects.

VI. Compliance Framework:

a) The contractors are not allowed to implement the construction activities, including

preparation of construction within the project scope in advance the detail SEMP for

implementation of the EMP are reviewed and approved by the construction

supervision consultant and environmental official of the Client.

b) The PMB is mandatory to ensure that the Contractor in compliance with the contract

provision including compliance with EMP and the detail implementation plan of EMP.

In case of incompliance with EMP, Client will require the Contractor to bring out the

suitable measures.

c) In order to ensure in compliance with the environmental standards of the sub- project,

PMB is allowed to hire the third party to solve the problems in case the Contractor

could not implement the remedies on time, leading to the negative effects into the

environment, as follow:

- For small infringements (such as minor impact/ damage, temporary and

repairable), PMB or the representative of PMB (the CSC) will notify the

Contractor to correct the problems as required in the EMP within 48 hours after

receiving the official report. If the mistakes are satisfactorily repaired during that

time, no more action should be undertaken. Supervision consultants have the right

to extend more 24 hours in the limited time for recovery, under the conditions that

the Contractor has implemented activities but not completed the prescribed time,

due to irresistible conditions that mentioned in the contract.

- For major violations, it is required about 72 hours for repairing, the PMB through

the CSC will announce the violation and require the Contractor to rectify the

problems within the prescribed time by their budget. If the Contractor fails to

complete corrective work according to the specified time, they will be punished

by financial punishment (cost punishment is calculated by the cost of remedying

damage)

- According to the evaluation of the CSC, if the Contractor fails to resolve the

problems in environmental management or the contractor conduct reparing

unsatisfactorily within the specified period of time (48 hours or 72 hours), the

investors have the capacity to arrange for another contractor (third-party) to

implement the suitable measures and deduct money for this task from the contract

with the contractor in the next payment.

ANNEX 2: TOR for Construction Supervision Consultant

Overview

The Construction Supervision Consultant will be the provider of engineering services

(“Services”) to ensure the effective implementation of the Sub-project EMP.

Scope of Services:

General services as provided by the Construction Supervision Consultant are checking and

inspecting construction activities to ensure that the mitigation measures set forth in the Sub-

project EMP shall be accurately taken and adverse impacts on the environment shall be

mitigated.

On behalf of NPMB, the Construction Supervision Consultant shall fulfill the following tasks:

- Execute site inspection on a regular basis;

- Consider the implementation situation of environmental protection measures stated in the

EMP and Contract Documents;

- Consider efficiency of environmental mitigation measures and environmental

implementation of the Project;

- If necessary, take account of acceptability in terms of environmental aspect of

construction method (for temporary and permanent works), relevant design plannings and

submittals. When necessary, the Construction Supervision Consultant shall look for and

recommend the least impact plan on the environment in consultation with the designer, the

Contractor and NPMB;

- Appraise the survey results about any nonconformity to the environmental quality and

efficiency of remedial measures; and

- Provide regular feedback audit results to the contractor’s Chief Engineer according to the

ECOP and site-specific mitigation measures;

- Instruct the Contractor to execute the remedial actions within the prescribed schedule and

carry out additional supervision if necessary, in accordance with requirements and

sequence of the Contract in case there are any nonconformities and complaints;

- Instruct the Contractor to implement actions to mitigate impacts and comply with the

EMP procedures as requested in case the nonconformity/inconsistency is identified;

- Instruct the Contractor to stop the actions which cause adverse impacts and/or the

Contractor’s failure to implement requirements of the EMP / carry out remedial actions.

- For the contracts, it will be required to set forth EMP on site (SEMP), the

Construction Supervision Consultant shall consider the last time and make a

recommendation via all the environmental plans at site which are likely to affect the

dumping site areas, camping area of workers. The Construction Supervision Consultant

shall consider and approve SEMP as submitted by the Contractor. If finding that these

plans do not comply with the EMP, EIA or RAP, the Construction Supervision Consultant

shall co-ordinate with NPMB and the Contractor to propose a reasonable measures or

remediation.

- Settlement of complaints: The complaints about environmental violation such as noise,

dust, traffic safety and etc. from the local people will be received by the Contractor’s site

staff. The site superintendent or his deputy of the Contractor and the Construction

Supervision Consultant shall have to settle and achieve the solution for such complaints.

The Construction Supervision Consultant shall be provided with a copy of such

complaints and certify that these complaints are settled by the Contractor in a proper

manner, which is similar to the related matter as identified in the site inspection.

- Certification of monthly payment: The Construction Supervision Consultant shall

certify monthly payments for the related activities on the environment performed by the

Contractor.

- Report: The Construction Supervision Consultant shall prepare the following

written reports:

o Report on nonconformities every two weeks

o Report on monthly summaries including issues and main findings from review

and construction activities

o To the end of the Project, the Construction Supervision Consultant shall

prepare a final report which summarizes main findings in its work, a number of

violations, solution and etc. as well as provide consultations and guidance’s on

the implementation form of such tasks in future.
