223 term normal babies incur severe brain damage during labour. (Each Baby Counts)

400 intra-partum still births at term. (Sands)

Investigations

• All cases of severe brain damage and of still births where the baby was alive at onset of labour should be investigated under the new scheme

• Carried out within regional networks (12 across England) avoidable harm basis

• Severe brain injury approx 20 pa per region• Late still births maybe 35 per region

Rapid Resolution and Redress Scheme

110 term cases per annum currently settled on clinical negligence test

Approx 15 cases in addition may pass avoidable harm test

A publically owned mutual based insurance company (or similar body) receives report from incident investigator.

Insurance assessor working with appropriate professional and legal advice settles claim to provide support for family and compensation as appropriate to a maximum of circa £3m alongside health and social support from NHS and social services.
