TERVS OF SETTLEMENT

5. This Agmrnent is entered into pursuant to 25 C.F.R. 4 575.61b) and shall bc eE"~Avp: upon the date that it is signed by the last party to s i ~ q this Agreemcn:n: (EZcctivt; Date).

6. The Tribe admits that its g m k g operation, Amgc! of t"he Winds Casino. was opernling during all or part of 2007 and 2008.

7. 'I'hs: Tribe agrees that it ursls required 10 submit timely quartmcrIy spxtcrnents mc! fee payments to the NIGC for cach quaeer of 2008.

8. The Tribe asre..es that the fkilure to timely submit my onc of the qumerl y statemmis a d fees for 2008 %"arts gaming o p m t i ~ n would be a violdion o f NlGC ~ g u lations.

9. Thc 'T&c admits thar it failed to submit a l k c l y quarterly stafemcnt and fees for one qr;a?eer of 2008, i .e., ttne last q W e r ending December 3 1,2008.

10. ?%c. WGC awes that the Tribe hair not been late with the subrnjssion of fczs ~c;:::cept for the last qua*^ of 2008, ending D m k r 3 1,2008. The pzyamt was submitted on January 25,2009,28 days late.
