2.

EXECUTIVE SUMMARY

This Executive Summary presents the work progress of the project road for the month of November

2015 for Four Laning of Hajipur-Muzaffarpur Section of N.H- 77 from km. 0+000 to km. 46+300 and

Construction of 16.870 kms, New Bypass starting at km. 46+300 and connecting N.H- 28 of East-West

Corridor at km. 515+045 in the State of Bihar under NHDP Phase- III on DBFOT (Annuity) Basis.

The Concessionaire is M/s. Patna Highway Project Limited and M/s. Intercontinental Consultants and

Technocrats Pvt. Ltd. has been appointed as the Independent Consultants.

1.1 Mobilization

The Independent Consultant had mobilized all of its permanent key staffs as well as domestic staffs at

site since start of project. The Concessionaire completed also their mobilization of staff as well as

plant and equipment.

1.2 Physical Progress Summary

The physical progress as evaluated by IC based on work done for the month is reported below;

Note : As per letter of IC to Concessionaire with reference no. ICT/102/NH-77/PHPL/TL/2013/1811

dated 08.04.2013, the IC advise the Concessionaire to submit revise execution program and based on

that submitted program the S-curve will be reflected till the final (EOT) Extension of Time is received

from NHAI.

*Re-evaluation of actual physical progress between the IC, NHAI and Concessionaire on 25th

March 2014 and all parties agreed that executed quantities dated 25th

March, 2014 had physical

accomplishment of 71.07%. * Physical progress for the month of November - 2015 is 0.275 %,

having accomplishment for the month of November - 2015 = 75.477 %

1.4.7 R.E. Wall Design and Drawings Review: -

Design and drawings review is in process for R.E. walls.

1.4.8 Quality Control

IC is monitoring closely to the quality of the work. Quality Control Report is shown at Chapter- 7.

1.4.9 Maintenance of Existing Road

The IC in his letter to Concessionaire with reference no. ICT/102/NH-77/PHPL/TL/2015/2825 dated

04.05.2015 and ICT/102/NH-77/PHPL/TL/2015/2873 dated 29.05.2015 reminding the

concessionaire regarding his contra-actual obligation under12.2 clause of C.A. also reminded the

Concessionaire that maintenance work shall be executed by NHAI at the risk and cost of

Concessionaire.

1.4.10 Safety Measures

The Concessionaire was informed to provide barricading at 0+550 to 0+650, 6+600 to 6+610,

45+850 to 45+880 and 46+250 to 46+300, IC had reminded Concessionaire to comply with

Schedule L- Safety Requirements as per IC letter ICT/102/NH-77/PHPL/TL/2015/2825 dated

04.05.2015.

1.4.11 Issue of Concern

The Concessionaire does not have significant accomplishment on plantation on medians, Island on

junctions, land scaping on Toll plaza. Even the Administrative building in which they included in

the estimate of 50 crores in late March-2015 do not have work as of this reporting period.

Up to this reporting, there were no EOT (Extension of Time) given by NHAI to Concessionaire.

No work had been observed at ROB-I and III. ROB-I final design and drawing of rotary at 0+000

starting point and viaduct was submitted by the Concessionaire partially and reviewed the same by

the IC. ROB-II is on going since 05.04.2015 and construction in very slow pace. ROB-III is delay

because of less effort of Concessionaire to do the work.

The Concessionaire is not working on hindrance free areas in Bypass i.e. the chainage listed

below;

(i) 1+500 to 1+600 - Subgrade up to BC.

(ii) 1+880 to 1+900 – DBM up to BC.

(iii) 1+600 to 1+880 - WMM up to BC.

(iv) 1+990 to 2+020 - WMM up to BC.

(v) 1+020 to 2+380 - DBM up to BC.

(vi) 2+380 to 2+600 - WMM up to BC.

(vii) 2+600 to 3+200 - DBM up to BC.

(viii) 3+200 to 3+320 - WMM up to BC.

(ix) 3+320 to 3+520 - GSB up to BC.

(x) 3+800 to 6+200 - DBM up to BC.

(xi) 7+250 to 7+400 - WMM up to BC.

(xii) 8+900 to 9+700 - WMM up to BC.

(xiii) 10+120 to 10+830 - DBM up to BC.

(xiv) 12+500 to 13+330 - DBM up to BC.

(xv) 13+330 to 13+880 - WMM up to BC.

(xvi) 14+440 to 14+870 - Subgrade up to BC.

Note: Above chainages listed above indicating only that it is hindrance free area and the Concessionaire

should do it in sequential manner of construction.

The team of I.C. composed of Team Leader, Key Professional Staff and Sub-professional Staff inspected

the site and observed the following:-

1. Work done on DBM for the month of November – 2015 at ch. 6+640 to 6+810 (LHS), 6+640 to

6+700 (RHS).

2. No work done on BC for the month of November - 2015.

3. DBM Top layer completed upto November is 88.70 Km (Two Lane)- NH-77 & Bypass.

4. BC completed upto November is 77.37 Km (Two Lane)- NH-77 & Bypass).

5. Work at Toll Plaza Admin building works fixing of tiles, electrical works, plumbing works in

progress, static weigh bridge not yet started.

6. No work at ROB-I structures since 29th August, 2013. There were proposal for the provision of

viaduct in front of GM office railway and got principle approval also. Final design & drawing was

submitted by the Concessionaire partially and reviewed the same by IC. Again there is change in

span arrangement in GAD of viaduct requested by ECR so work not started again.

7. In ROB-II, work started from 05th April 2015 due to fresh funds infusion arranged from the

bankers. There were remaining 6 spans (Both Sides) of composite girders, launching of

composite girder was started on 29th August 2015 on non-railway span launching of steel girder of

spans i.e. P2-P3 LHS and P3-P4 RHS non railway span done. Bracing cross girder in progress.

Staging for slab also going on. CRS was approved by railways on 01st September 2015. Applied

for blockage to ECR for launching of railway span. The TAD approved on 29.05.2015, RE wall

approaches work started in full swing. There is change in girders arrangement of railway span

only. Instead of 4 longitudinal girders, 5 girders will be provided now. So, at Sarai Camp,

fabrication of two new composite girders is in progress and modification of end cross girders is in

progress. Rectification in pedestals for new arrangement in completed, Priming, painting sand

blasting alignment of steel girder is in progress. RE panel erection, granular fill works in

approaches also in progress. New RE panel casting, also going on at Sarai Camp.

8. In Bypass, no work had been done on highway since 11.12.2012.

9. In ROB-III bypass, work was started 16th June, 2011 up to 29

th May, 2012 and stopped the

activities because of public resistance because they are demanding for land high compensation.

The works had been started again on 8th October, 2013 wherein the land acquisition problem had

been resolved, the ROB-III stopped again on 21st February, 2014 because of financial problem of

the Concessionaire. The remaining work of pile cap concreting and piling work started again on

11.11.2014, 12.11.2014, 15.11.2014 & 28.11.2014 onwards upto December 2014.

10. In Toll plaza, Administration building electrical work, tiles placing and plumbing works in

progress. There is no work on installation of Toll equipments.

11. Works of PUP at ROB-II Muzaffarpur end a8 0+820 at Devchand College started.

(iv)

ROLE OF INDEPENDENT CONSULTANT

3.0 Role and functions of the Independent Engineer

3.1 The role and functions of the Independent Engineer shall include the following:

(i) Review of the Drawings and Documents as set forth in Paragraph 4;

(ii) Review, inspection and monitoring of Construction Works as set forth in Paragraph 5;

(iii) Conducting Tests on completion of construction and issuing Completion / Provisional

certificate as set forth in Paragraph 5 ;

(iv) Review, inspection and monitoring of O&M as set forth in Paragraph 6.

(v) Review, inspection and monitoring of Divestment Requirement as set forth in Paragraph 7;

(vi) Determining, as required under the Agreement, the costs of any works or services and/ or

their reasonableness.

(vii) Determining, as required under the Agreement, the period or any extension thereof, for

performing any duty or obligation;

(viii) Assisting the Parties in resolution of disputes as set forth in Paragraph 9; and

(ix) Undertaking all other duties and functions in accordance with the Agreement.

3.2 The Independent Engineer shall discharge its duties in a fair, impartial and efficient manner,

consistent with the highest standards of professional integrity and Good Industry Practice.

4 Development Period

4.1 During the Development Period, the Independent Engineer shall undertake a detailed review of

the Drawing to be furnished by the Concessionaire, along with supporting data, including the

geo-tech and hydrological investigations, characteristics of materials from borrow areas and

quarry sites, topographical surveys and traffic surveys. The Independent Engineer shall complete

such review and send its comments/ observations to the Authority and the Concessionaire within

15 (fifteen) days of receipt of such Drawings. In particular, such comments shall specify the

conformity of otherwise of such Drawings with the Scope of the Project and Specifications and

Standards.

4.2 The Independent Engineer shall review any modified Drawings or supporting Documents sent to

it by the Concessionaire and furnish its comments within 7 (seven) days of receiving such

Drawings or Documents.

4.3 The Independent Engineer shall review the Drawings sent to it by the Safety Consultant in

accordance with Schedule-L and furnish its comments thereon to the Authority and the

Concessionaire within 7 (seven) days of receiving such Drawings. The independent Engineer

shall also review the safety Report and furnish its comments thereon to the Authority within (15)

days of receiving such report.

4.4 The Independent Engineer shall review the detailed design, construction methodology, quality

assurance procedures and the procurement, engineering and construction time schedule sent to it

by the Concessionaire and furnish its comments within 15 (fifteen) days of receipt thereof.

4.5 Upon reference by the Authority, the Independent Engineer shall review and comment on the

EPC Contract or any other contract for construction, operation and maintenance of the Project

Highway, and furnish its comments within 7 (seven) days from receipt of such reference from

the Authority.

5 Construction Period

5.1 In respect of the Drawings, Documents and Safety Report received by the Independent Engineer

for its review and comments during the Construction Period, the provisions of Paragraph 4 shall

apply, mutatis mutandis.

5.2 The Independent Engineer shall review the monthly progress report furnish by the

Concessionaire and sent its comments thereon to the Authority and the Concessionaire within 7

(seven) days of receipt of such report.

5.3 The Independent Engineer shall inspect the Construction Works and the Project Highway once

every month, preferably after receipt of the monthly progress report from the Concessionaire,

but before the 20th (twentieth) day of each month in any case, and make out a report such

inspection (the “Inspection Report”) setting forth an overview of the status, progress, quality and

safety of construction, including the work methodology adopted, the materials used and their

sources, and conformity of Construction works within the Scope of the Project and the

Specifications and Standards. In a separate section of the Inspection Report, the Independent

Engineer shall describe in reasonable detail the lapses, defects or deficiencies observed by it in

the construction of the Project Highway. The Inspection Report shall also contain a review of the

maintenance of the existing lanes in conformity with the provisions of the Agreement. The

Independent Engineer shall send a copy of its Inspection Report to the Authority and the

Concessionaire within 7 (seven) days of the inspection.

5.4 The Independent Engineer may inspect the Project Highway more than once in a month if any

lapses, defects or deficiencies require such inspection.

5.5 For determining that the Construction Works conform to Specification and Standards, the

Independent Engineer shall require the Concessionaire to carry out, or cause to be carried out,

tests on a sample basis, to be specified by the Independent Engineer in accordance with Good

Industry Practice for quality assurance. For purpose of this Paragraph 4.2.5, the tests specified in

the IRC Special Publication- 11 (Handbook of Quality Control for Construction of Roads and

Runways) and the Specifications for Road and Bridge Works issued by MOSRTH (the “ Quality

Control Manuals”) or any modification/substitution thereof shall be deemed to be tests

conforming to Good Industry Practice for quality assurance. The Independent Engineer shall

issue necessary direction to the Concessionaire for ensuring that the tests are conducted in a fair

and efficient manner, and shall monitor and review the results thereof.

5.6 The sample size of the tests, to be specified by the Independent Engineer under Paragraph 4.2.5,

shall comprise 10% (ten per cent) of the quantity or number of tests prescribed for each category

or type of tests in the Quality Control Manuals; provided that the Independent Engineer may, for

reasons to be recorded in writing, increase the aforesaid sample size by up to 10% (ten per cent)

for certain categories of types of tests.

5.7 The timing of tests referred to in Paragraph 4.2.5, and the criteria for acceptance/ rejection of

their results shall be determined by the Independent Engineer in accordance with the Quality

Control Manuals. The tests shall be undertaken on a random sample basis and shall be in

addition to, and independent of, the tests that may be carried out by the Concessionaire for its

own quality assurance in accordance with Good Industry Practice.

5.8 In the event that the Concessionaire carries out any remedial works for removal or rectification

of any defects or deficiencies, the Independent Engineer shall require the Concessionaire to

carry out, or cause to be carried out, tests to determine that such remedial works have brought

the Construction Works into conformity with the Specifications and Standards, and the

provisions of this Paragraph 5 shall apply to such tests.

5.9 In the event that the Concessionaire fails to achieve any of the Project Milestones, the

Independent Engineer shall undertake a review of the progress of construction and identify

potential delays, if any. If the Independent Engineer shall determine that completion of the

Project Highway is not feasible within the time specified in the Agreement, it shall require the

Concessionaire to indicate within 15 (fifteen) days the steps proposed to be taken to expedite

progress, and the period within which the Project Completion Date shall be achieved. Upon

receipt of a report from the Concessionaire, the Independent Engineer shall review the same and

send its comments to the Authority and the Concessionaire forthwith.

5.10 If at any time during the Construction Period, the Independent Engineer determines that the

Concessionaire has not made adequate arrangements for the safety of workers and Users in the

zone of construction or that any works is being carried out in a manner that threatens the safety

of the workers and the Users, it shall make a recommendation to the Authority forthwith,

identifying the whole or part of the Construction Works that should be suspended for ensuring

safety in respect thereof.

5.11 In the event that the Concessionaire carries out any remedial measures to secure the safety of

suspended works and Users, it may, by notice in writing, require the Independent Engineer to

inspect such works, and within 3 (three) days of receiving such notice, the Independent Engineer

shall inspect the suspended works and make a report to the Authority forthwith, recommending

whether or not such suspension may be revoked by the Authority.

5.12 If suspension of Construction Works is for reason not attributable to the Concessionaire, the

Independent Engineer shall determine the extension of dates set forth in the Project Completion

Schedule, to which the Concessionaire is reasonable entitled, and shall notify the Authority and

the Concessionaire of the same.

5.13 The Independent Engineer shall carry out, or cause to be carried out, all the Tests specified in

Schedule- I and issue a Completion Certificate or Provisional Certificate, as the case may be. For

carrying out its functions under this Paragraph 4.2.13 and all matters incidental thereto, the

Independent Engineer shall act under and in accordance with the provisions of Articles 14 and

Schedule-I.

5.14 Upon reference from the Authority, the Independent Engineer shall make a fair and reasonable

assessment of the costs of providing information, works and services as set forth in Article 16

and certify the reasonableness of such costs for payment by the Authority to the Concessionaire.

5.15 The Independent Engineer shall aid and advise the Concessionaire in preparing the Maintenance

Manual.

6 Operation Period

6.1 In respect of the Drawings, Documents and Safety Report received by the Independent Engineer

for its review and comments during the Operation Period, the provisions of Paragraph 4 shall

apply, mutatis mutandis.

6.2 The Independent Engineer shall review the annual Maintenance Program furnished by the

Concessionaire and send its comments thereon to the Authority and the Concessionaire within

15(fifteen) days of receipt of the Maintenance Programme.

6.3 The Independent Engineer shall review the monthly status report furnished by the

Concessionaire and send its comments thereon to the Authority and the Concessionaire within 7

(seven) days of receipt of such report.

6.4 The Independent Engineer shall inspect the Project Highway once every month, preferably after

receipt of the monthly status report from the Concessionaire, but before the 20th (twentieth) day

of each month in any case, and make out an O&M Inspection Report setting forth an overview

of the status, quality and safety of O&M including its conformity with the Maintenance

Requirements and Safety Requirements, In a separate section of the O&M Inspection Report, the

Independent Engineer shall describe in reasonable detail the lapses, defects or deficiencies

observed by it in O&M of the Project Highway. The Independent Engineer shall send a copy of

its O&M Inspection Report to the Authority and the Concessionaire within 7 (seven) days of the

inspection.

6.5 The Independent Engineer may inspect the Project Highway more than once in a month, if any

lapses, defects or deficiencies require such inspections.

6.6 The Independent Engineer shall in its O&M Inspection Report specify the tests, if any, that the

Concessionaire shall carry out, or cause to be carried out, for the purpose of determining that the

Project Highway is in conformity with the Maintenance Requirements. It shall monitor and

review the results of such tests and the remedial measures, if any, taken by the Concessionaire in

this behalf.

6.7 In respect of any defect or deficiency referred to in Paragraph 3 of Schedule- K, the Independent

Engineer shall, in conformity with the Good Industry Practice, specify the permissible limit of

deviation or deterioration with reference to the Specification and Standards and shall also

specify the time limit for repair or rectification of any deviation or deterioration beyond the

permissible limit.

6.8 The Independent Engineer shall determine if any delay has occurred in completion of repair or

remedial works in accordance with the Agreement, and shall also determine the Damages, if any,

payable by the Concessionaire to the Authority for such delay.

6.9 The Independent Engineer shall examine the request of the Concessionaire for closure of any

lane(s) of the carriageway for undertake maintenance / repair thereof, keeping in view the need

to minimize disruption in traffic and the time required for completing such maintenance / repair

in accordance with Good Industry Practice. It shall grant permission with such modifications, as

it may deem necessary, within 5 (five) days of receiving a request from the concessionaire. Upon

expiry of the permitted period of closure, the Independent Engineer shall monitor the re-opening

of such lane(s), and in case of delay, determine the Damages payable by the Concessionaire to

the Authority under Clause 17.7

6.10 The Independent Engineer shall monitor and review the curing of defects and deficiencies by the

Concessionaire as set forth in Clause 19.4

6.11 In the event that the Concessionaire notifies the Independent Engineer of any modifications that

it proposes to make to the Project Highway, the Independent Engineer shall review the same and

send its comments to the Authority and the Concessionaire within 15 (fifteen) days of receiving

the proposal.

6.12 The Independent Engineer shall undertake traffic sampling, as and when required by the

Authority, under and in accordance with Article 22 and Schedule-O.

7 Termination

7.1 At any time, not earlier than 90 (ninety) days prior to Termination but not later than 10 (ten)

days prior to such Termination, the Independent Engineer shall, in the presence of a

representative of the Concessionaire, inspect the Project Highway for determining compliance

by the Concessionaire with the Divestment Requirements set forth in Clause 38.1 and, if

required, cause tests to be carried out at the Concessionaire‟s cost for determining such

compliance. If the Independent Engineer determines that the status of the Project Highway is

such that its repair and rectification would require a larger amount than the sum set forth in

Clause 39.2, it shall recommended retention of the required amount in the Escrow Account and

the period of retention thereof.

7.2 The Independent Engineer shall inspect the Project Highway once in every 15 (fifteen) days

during a period of 90 (ninety) days after Termination for determining the liability of the

Concessionaire under Article 39, in respect of the defects or deficiencies specified therein. If any

such defect or deficiency is found by the Independent Engineer, it shall make a report in

reasonable detail and send it forthwith to the Authority and the Concessionaire.

8 Determination of cost and time

8.1 The Independent Engineer shall determine the costs, and/or their reasonableness, that are

required to be determined by it under the Agreement.

8.2 The Independent Engineer shall determine the period, or any extension thereof, that is required

to be determined by it under the Agreement.

9 Assistance in Dispute resolution

9.1 When called upon by either Party in the event of any Dispute, the Independent Engineer shall

medicate and assist the Parties in arriving at an amicable settlement.

9.2 In the event of any disagreement between the Parties regarding the meaning, scope and nature of

Good Industry Practice, as set forth in any provision of the Agreement, the Independent

Engineer shall specify such meaning, scope and nature by issuing a reasoned written statement

relying on good industry practice and authentic literature.

10 Other duties and functions

The Independent Engineer shall perform all other duties and functions specified in the

Agreement.

11 Miscellaneous

11.1 The Independent Engineer shall notify its programme of inspection to the Authority and to the

Concessionaire, who may, in their discretion, depute their respective representative to be present

during the inspection.

11.2 A copy of all communications, comments, instructions, Drawings or Documents sent by the

Independent Engineer to the Concessionaire pursuant to this TOR, and a copy of all the test

results with comments of the Independent Engineer thereon shall be furnished by the

Independent Engineer to the Authority forthwith.

11.3 The Independent Engineer shall obtain, and the Concessionaire shall furnish in two copies

thereof, all communications and reports required to be to submitted, under this Agreement, by

the Concessionaire to the Independent Engineer, whereupon the Independent Engineer shall send

one of the copies to the Authority along with its comments thereon.

11.4 The Independent Engineer shall retain at least one copy each of all Drawings and Documents

received by it, including „as-built‟ Drawings, and keep them in its safe custody.

11.5 Upon completion of its assignment hereunder, the Independent Engineer shall duly classify and

list all Drawings, Documents, results of tests and other relevant records, and hand them over to

the Authority or such other person as the Authority may specify, and obtain written receipt

thereof. Two copies of the said documents shall also be furnished in micro film form or in such

other medium as may be acceptable to the Authority.

12 PERFORMANCE CLAUSE

Independent Engineers shall be expected to fully comply with all the provisions of the „Terms of

Reference‟ and shall be fully responsible for supervising the Designs, Construction and

maintenance and operation of the facility takes place in accordance with the provisions of the

Concession Agreement and other schedules. Any failure of the Independent Consultant in

notifying to NHAI and the Concessionaire on non-compliance of the provisions of the

Concession Agreement and other schedules by the Concessionaire, non-adherence to the

provision of ToR and non-adherence to the time schedule prescribed under ToR shall amount to

non-performance.

The Independent Engineer shall appoint its authorized representative, who shall issue on behalf of

the IE, the Provisional Completion Certification and Completion Certificate along with the Team Leader

and shall carry out any such task as may be decided by NHAI. The IE shall take prior approval of NHAI

before issuing Provisional completion Certification and Completion Certificate. The proposal submitted

shall also include the name of the authorized representative along with the authorization letter and power

of attorney.

Mobilization of Manpower and Equipment

PHPL with their EPC Contractor was mobilized all the staff. Whereas Plant & Equipment were

separately mobilized by dividing the entire project length into three sections (Section 1st - Km 0 to

Km 21, Section 2nd

- Km 21 to Km 46.300 & Bypass section 3rd

- Km 0 to Km 16.870) by

establishing three camps at Sarai (Km 10), at Kamtaul (Km 35) and at bypass. At present, the

laboratories and offices at Bypass and Sarai camp are now closed. Laboratory works and office

works are done in Kamtaul camp. All plants had been removed at Bypass and Sarai camp.

At this reporting period, the Concessionaire deployed the following machine/equipment at ROB-2

ch. 5+700 to 6+780.

QUALITY OF WORKS

(i) PROGRESS REVIEW AND CONSTRUCTION ACTIVITIESRoad Works

Concreting of Crash Barrier at 6+700 – 6+780. Ongoing earthwork at Sarai service road and demolition/removal of debris and structures

(buildings). Subgrade and GSB placing at 6+535 to 6+780 approaches (Muzaffarpur side). Granular fill and filter media in progress at ch. 5+930 to 6+187.79 (BHS) WMM work done at ch. 6+538 to 6+570 (BHS). DBM work done at ch. 6+640 to 6+810 (LHS), 6+640 to 6+720 (RHS). Kerb work done at ch. 6+650 to 6+810 (RHS) 6+650 to 6+800 (LHS).

Structure Works

Activities for ROB-2 is going on as well as in RE walls works in approaches since 25.04.2015

Launching of composite steel girders in progress at ROB-II. Blockage applied.

PUP at ROB-I Muzaffarpur started at 0+820.

(ii) STATUS OF FIELD LABORATORIESThe Concessionaire had constructed field laboratories at km. 9+400 at Sarai and km. 34+600 at Kamtaul.At present the Bypass laboratory is closed and only Kamtaul laboratory is operational.

(iii) STATUS OF SITE CAMPSAt present, the concessionaire is holding their offices in Kamtaul camp at ch. 34+600. TheConcessionaire is obtaining their Concrete, Asphalt, WMM mix at Kamtaul camp.

(iv) STATUS OF MATERIAL SOURCE APPROVAL.

DEFECTS / DEFICIENCIES IN WORK:

1. GSB thickness has been checked at bypass Ch. 7+000 to 7+800 LHS, 5+220 RHS, 4+000-6+000 BS, 2+970and found out that only one layer of GSB has been provided on against the requirement of two (2) layers upto the toe of scope to serve as drain or minimum of 200 mm thickness. This is in accordance with IRC -37and the Concessionaire was notified in this deficiencies vide IC letter ICT-1817 dated 11.04.2013.

SECTION – E

MAINTENANCE OF EXISTING ROAD:

The Concessionaire, in this Month of November 2015 are poorly maintained the existing roads nor thediversion that switch from asphalted pavement to another asphalted pavement. The present condition of theexisting road and the diversion is bad and need immediate action of the Concessionaire to rectify thesituation accordingly. The Concessionaire should comply to the letter of Consultant Road Safety Expert onhis last site visit at the area.

The need of warning signs and informatory signs is needed to be installed by Concessionaire especially atch. 6+200 existing bridge wherein bridge do not have parapet and pose a great danger to motorist (see ICTletter no. ICT/102/NH-77/PHPL/TL/2015/3040 dated 26.11.2015) .

The condition of existing roads and temporary diversion from 0+000 to 45+830 of NH-77 are as follows:-

Comments of IC on Submitted MPR of Concessionaire

Until this reporting, there were no Monthly Progress Report submissions of the Concessionaire forNovember-2015 hence we are attaching our comments for October-2015 of Concessionaire.The following are the comments of IC on the submitted MPR no. 62 for the month of October - 2015;

1. Chapter 2 (Executive Summary) Page no.-3, point-3;

The project progress is greatly affected due to delay in handing over of site by the Authority to theConcessionaire and major delays are due to non-availability of land, clearing of structures, non-payment to the land and building owners. In Vaishali district out of 3495 (expected) cheques, 4188cheques prepared and 4119 cheques has been issued to the land owners and in Muzaffarpur districtout of 3101 cheques 2527 cheques prepared and 2139 cheques has been issued to the land owners.The valuation of structures and payment of cheques to the buildings is another process which is inprogress. Total number of cheques prepared for structures are 5079, already issued 4668 andbalance 411 still to be issued.

Since the issuing of cheque was handed by DLAO and not NHAI. We are requesting theConcessionaire to furnish us the documents that out of 3495 cheques, 4188 cheques prepared and4119 cheques have been issued to land owners and in Muzaffarpur district out of 3101 cheques2527 cheques prepared and 2139 cheques have been issued to the land owner.

2. Chapter 2 (Executive Summary) Page no.-4, point-12;

As per the S-Curve, present work progress is 91.31% “as per Certified & Submitted Invoice”against the scheduled 100.00%. The lapses are mainly due to non-availability of land and delayhanding over the land.

There were no submitted S-Curve by the Concessionaire and the only reference for actual physicalprogress is the re-evaluation of actual physical accomplishment jointly conducted by IE, NHAI andConcessionaire last 25th March, 2014 in which the physical actual accomplishment for March -2015 is 73.683%. Therefore, the actual physical accomplishment for October - 2015 is 75.202%having 0.346% accomplishment for the month of October 2015.

3. Chapter 2 (Executive Summary) Page no.-4, point-14;

To expedite the progress of the works especially when the land is not made available by theAuthority, the Concessionaire is forced to revise the alignment at some locations to see that at leastone carriageway is built. These revisions are being carried out in discussion with IndependentEngineer.

The revision being carried out in discussion with Independent Engineer with regards to revision ofalignment is for vertical alignment only.

4. Chapter 4 (Pre-construction activities):

Point no. 4 – The Concessionaire was asked to substantiate the record that 624 trees is yet to beremoved which is under hindrance.

5. Chapter 5 (Progress):
