till 2005 – no special, separate legislation, numbers of spv with the share of
private partners created on the base of the civil and corporate law, separate act
concerning development of the motorway and expressway network in Poland
(financing, construction and operate concession contracts)
in 2005 – act about the public - private partnership (to expensive, complicated
and bureaucratic procedures, reluctance of local government authorities to apply
it), without results
in 2009 – 2 new acts:
about the concession contract on construction works or services, and
about the public – private partnership (amendment of act from 2005)

• 126 announcements of local government authorities (partner search)
• 24 partnership agreements signed, but
• 18 projects with the financing, only
• 34% projects – sports and recreation,18% - public transport and
parkings, 15% - technical infrastructure, 5% - education
• the total value of PPP projects – 4.4 mld Euros
• current needs: 28 – 47 mld Euros

• technical design with building permit, financing, construction and operation
of the underground public car parking in the downtown of Warsaw
• MAIN CONDITIONS:
• 8 locations offered by the Mayor of Warsaw for choice
• possible offer for 1 to 6 locations
• choice of the one partner, only
• remuneration for partner – income from parking(s) activity
• partner selection criteria – duration of concession contract, number of
locations and total number of new car parks

1. Choice of the professional advisor and appointment of the project team (2010-2011)
2. Preparation of the feasibility study (2011)
3. Decision about the type of PPP (concession contract) and 8 offered locations for parkings
(2011)
4. Elaboration of formal bid documents (2012)
5. Start with the concession procedure (June 2012) – formal announcement, and next:
6. 1st step – application of the companies concerned (September 2012)
7. 2nd step – negotiations (till the end of 2012)
8. 3rd step - preparation of final conditions of the concession contract (2013)
9. 4th step – submission of detailed offers by bidders (2013)
10. 5th step - choice of partner and signing the agreement (2013)
