We trust this completes this part of the task as requested. As we understand, you require an MDS report as part of an application to permit a severance on your property. We have prepared an MDS I review for property at Part Lot 43/44, Concession 3, Camden East, Stone Mills Township, County of Lennox and Addington, also known as 3742 County Road 6, Yarker, and note that your application is considered a Type A development under MDS I. We have used information supplied by you via emails and by phone, a review of available aerial photography, and a site visit on June 29, 2016. The agent for your application has prepared a severance sketch which we are using within the base map of the MDS sketch. This shows that the severed parcel is approximately 7.6 ha, the retained parcel is about 26.6 ha and has a residence and grey metal sided barn. In preparing this letter, CCS has referred to the MDS Training Manual and the MDS Implementation Guidelines as published by OMAFRA. MDS I is applied to new non-farm uses and MDS II is applied to new or expanded livestock facilities. In this case MDS I applies. MDS Guideline 6 requires MDS to be applied when an existing livestock facility may reasonably be expected to be impacted by proposed development. It goes on to say that for Type A applications we must review livestock facilities within a 1,000 metre radius of the application lands. MDS Guidelines 6 and 35 describe an application for a single lot creation as a Type A land use.

Implementation Guideline 42: Measurement of MDS for Lot Creation For MDS I, measurements are taken as the shortest distance between the lot line of the lot being created and the livestock occupied portion of the livestock facility (or storage). Where larger lots may be permitted (generally greater than 1 ha), a suitable location must be identified for a 1 ha building envelope outside the MDS I setback. Barns within 1,000 metres During the site visit we located 7 existing barns not including the barn on your property. Some of these barns may be occupied while some have been vacant for quite some time. Each barn location is shown on the MDS sketch. The following section gives comments on each of these structures. Barn A Barn A is located at 79 Estis Rd. This is directly north of the proposed severance. A photo of the barn is included in the attachments. The barn is an orange/brown sided building with a large door on the south side leading into a fenced area at the front. This barn is suited to small stock such as sheep or goats or could house a small number of horses. There does not appear to be any tillable land on the lot and it appears to be well treed with the cleared area supporting the house and barn. A MDS calculations have been made using three options of housing livestock - a possible housing of 30 goats, 30 sheep or 3 medium horses. The setbacks generated by each of these three scenarios is the same, 81 m. The actual distance is 51 m, which means an MDS setback extends about 30 m into your proposed severance. MDS Guideline 42 says that where larger lots are permitted a suitable 1 ha building envelope outside the MDS setback should be identified. Barn B Barn B is located at 18 McQuay Rd and is a larger wooden green roofed structure. There is no evidence of livestock use in quite some time and there are new large windows fitted into the building. This appears to have been refurbished as a storage/workshop building and may not be capable of housing livestock. The lot the barn is on is approximately 3.5 ha and so is not capable of supporting a wide range of livestock. The barn is 560 m from the closest point of the severed lot and so if the barn was used to house a few horses or a few beef cattle the MDS setback would not be greater, and so the creation of the new lot would not impact the barn now or if populated with animals in the future. Barn C Barn C is located at CR6 and Park Road at 3925 CR 6. This is a well maintained barn which would be suited to raising beef cattle. A feeding shelter can be seen just south of the barn. The lot is about 17 hectares of which 7 or 8 hectares may be tillable. The barn is of a size that would house 30 to 35 beef cattle. An MDS calculation has been made based upon 35 beef cattle and 8 hectares tillable. The MDS setback is 172 m while the actual setback is 812 m.

Barn D Barn D is located on the NW corner of CR 6 and Park Road. This is a smaller wooden horse shed on a lot of just over 1 ha. The building is suited to housing or sheltering 1 or 2 horses. The setback generated from this is 81 m and the actual distance is 811 m. Barn E Barn E is an older wooden small barn structure built close to the road at 1141 Park Road. This may have been a free run chicken barn at one time. No chickens would be permitted in this barn now. The building is located close to the road. There is no sign of livestock and no appearance of any capability to house animals. This is not a livestock facility, and so does not generate an MDS setback. Barn F Barn F is an older structure at 1055 Park Road with no sign of livestock and no obvious signs that it could currently be a livestock facility. Since the actual setback is 892 m there is no benefit to further analysis on this structure. No MDS setback is shown. Structure G The seventh structure noted is a dog kennel facility on Estis road. Dog kennels do not generate an MDS setback, as directed by Guideline 2, and so no MDS setback is shown. Livestock Facility on Subject Land A livestock building is located on the subject property on the north west side of the house. It is about 68 feet by 32 feet and is used for equipment storage, feed storage and shelter for small stock such as sheep. The livestock have full outdoor access. There are also three horse stalls in the rear of the building. The farm has about 30 acres tillable. An additional building is an old, small pig barn. This building is no longer used for livestock and is not suitable to house pigs. This is not included in the calculation. The MDS calculation has been made using 30 sheep, 3 medium horses and 12 ha of tillable land. The MDS setback is 165 m while the actual setback from the severed portion is 283 m. Summary In reviewing the proposed severance and its compliance with Minimum Distance Separation we have studied the MDS Implementation Guidelines published by OMAFRA, information from you, available aerial photography and a site visit on June 29, 2016. We located a number of barn structures around your property and only one could be impacted by your severance application. This barn at 79 Estis Road is directly north of the application lands. The setback arc of 81 m from this barn extends into your property. MDS Implementation Guideline 42 permits that where the MDS arc cuts into the property a suitable envelope of 1 ha should be shown outside of the MDS arc.
