ACP’s Legislative UpdatesUpdated 9/26/2016
As noted in an earlier update, Senate Bill 3308 (Improving Transparency and Accuracy in Medicare Part D Spending Act) has been introduced in Congress. Senators Shelly Moore Capito (R-W.Va.), Jon Tester (D-Mont.), John Boozman (R-Ark.), and Tom Cotton (R-Ark.) are the prime sponsors of S.B. 3308. This is bipartisan legislation to boost transparency in Medicare Part D drug spending and to prohibit retroactive “DIR fees.” The companion legislation in the House is House Bill 5951 (H.B. 5951), which was introduced September 8, 2016. The bill would end DIR fees assessed long after prescriptions are filled.
Now is the time to urge your members of Congress to cosponsor S.B. 3308/H.B. 5951. These are identical Senate and House bills that would prohibit PBMs in Medicare Part D from retroactively reducing payments to pharmacies for clean claims under prompt-pay provisions – effectively eliminating retroactive direct and indirect remuneration (DIR) clawbacks by PBMs. Your voice is needed in your member's office to help him/her understand how important it is to be a cosponsor on these bills. Congress will only be in session for a “few” weeks between now and the end of the year. So it is important that you get in touch with your member as soon as possible.
Recently, ACP sent out a questionnaire though an ACP Update asking all pharmacists to list their members of their state Senate and House, and indicating how well they know their particular member as indicated by the questions on the questionnaire. Please take time to fill out this form and return it to Jessica at Mutual Drug. If you do not know your member of the Senate or House, that is fine. ACP needs for you to list your members on the form anyway because we need to be able to match pharmacists with their members in their specific district.
Once again, it is election season and early voting will be here sooner that we can imagine. Take time to talk to your candidate of choice so as he/she is running for office you give them an opportunity to learn about pharmacy and pharmacy issues. As you know, most members and candidates know very little about pharmacy and the issues pharmacies are facing today. You are the expert, it is up to you the practicing pharmacist to step up and make sure members and candidates learn these issues as they campaign for votes.
