InaccordancewiththerequirementsofPublicResourcesCodesection21081.6,andaspartofits certification of the adequacy of Final Environmental Impact Report No. 617 (“Final EIR617”)fortheJohnWayneAirportSettlementAgreementAmendment,theBoardofSupervisors(“Board”)oftheCountyofOrange(“County”)adoptsthefollowing“MitigationMonitoringandReportingPlan”(“MMRP”or“Plan”). TheBoardadoptsthisMMRPin itscapacityasthe leadagency for Final EIR 617 in accordancewith the provisions of the California EnvironmentalQuality Act (“CEQA”) (California Public Resources Code §21000 et seq.) and the State CEQAGuidelines(14CaliforniaCodeofRegulations§15000etseq.).
TheprincipalpurposeoftheMMRPistoensurethattheBoard‐approvedmitigationmeasuresfor the adopted Project are reported and monitored so as to ensure compliance with themeasures’requirements.Ingeneral,JohnWayneAirport(“JWA”)isresponsibleforoverseeingimplementationandcompletionoftheadoptedmitigationmeasures.Thisincludesthereviewof all monitoring reports, enforcement actions, and document disposition, unless otherwisenoted in the attached MMRP Table. However, the Board retains overall responsibility forverifyingimplementationofalladoptedmitigationmeasures.
1.2 MITIGATIONMONITORINGPROCEDURES
TheCountyisthedesignatedleadagencyfortheMMRP.JWAisthedepartmentresponsibleforreview of all monitoring reports, enforcement actions, and document disposition, unlessotherwisenotedintheMMRPTable.
Approving or Verifying Authority. The County Department(s) or other publicagency(ies) responsible for overseeing the implementation and completion of eachmitigationmeasure.
AQ/GHG‐1 Upon Project approval, the County of Orange shall support single/reducedenginetaxiingproceduresauthorizedbytheFederalAviationAdministration(“FAA”)thatachievecorrespondingbenefitsinairqualityand/orgreenhousegas(“GHG”)emissionreductionsanddonotresultinadversenoiseimpacts.

AQ/GHG‐2 UponProjectapproval, theCountyofOrangeshallsupport theeffortsof theairport industry—including those of the FAA, commercial air carriers, andaircraftmanufacturers—todevelopairqualityandGreenhouseGas(“GHG”)emission benchmarking databases that improve the understanding of therelativeefficienciesofaviationoperationsbyactivelyparticipatinginaviationcommunity networks and participating in the biannual Airports CouncilInternational–NorthAmerica(“ACI‐NA”)EnvironmentalBenchmarkSurvey.

AQ/GHG‐3 Upon Project approval, the County of Orange shall continue to evaluate theeffects of future Airport‐related improvement projects cognizant of andinformedbytheresultingairqualityandGHGemissions inaccordancewiththerequirementsoftheCaliforniaEnvironmentalQualityAct(“CEQA”).

AQ/GHG‐4 By January1,2018, theCountyofOrangeshalldevelopandadoptaClimateAction Plan for greenhouse gas emissions sources at the Airport under theCounty’s control. The Climate Action Plan shall be consistent with therequirementsoftheGlobalWarmingSolutionsActof2006(“AB32”)andthegoalsofExecutiveOrderS‐3‐05.
In order to secure greenhouse gas emission reductions from sources undertheCounty’scontrol,theClimateActionPlanshallidentifyoneormoreofthefollowinggreenhousegasreductionstrategies,orcombinationthereof.
i. MaximizingtheenergyefficiencyofexistingAirportstructuresandfacilities through retrofitting and redevelopment at the conclusionand/orexpirationoftheirusefullife;
ii. Tracking energy use at intervals no less than every 12months inordertoallowfortheefficientoptimizationofenergyuse;
iii. Utilizing energy‐efficient (light‐emitting diode [“LED”] orequivalent)lightingontheairfield,withinterminalbuildings,andinconnectionwithsurfaceandparkinglotsecuritylighting;
iv. Installing window awnings, sunshades, or window tinting in
v. Providingaminimumof60electriccarchargingstationsconsistentwithAQ/GHG‐11below;
vi. Increasingthepurchaseanduseofrenewableenergy;
vii. Requiring third parties, concurrent with the execution of new,renewedoramended leaseor contractual agreements, tomeet themorestringentenergyefficiencyrequirementsrequiredinAQ/GHG‐5below;
viii. Continuingtomaximizeuseofhybridoralternativelyfueledon‐siteequipment, including equipment fueled by Clean Natural Gas(“CNG”),LiquefiedNaturalGas(“LNG”),orBiodiesel;
ix. Installing lightcolored“cool”roofsandcoolpavements inanynewdevelopmentsubsequentlyproposedattheAirport;
x. Purchasingcarbonoffsetcreditsthroughanadoptedprogramsuchas the California Air Pollution Control Officer’s Association(“CAPCOA’s”)GreenhouseGasReductionExchange (“Rx”)Registry,of which the South Coast Air Quality Management District(“SCAQMD”)isaparticipatingairdistrict(www.ghgrx.org);
xi. Increasing solidwaste reduction and recycling in accordancewithAQ/GHG‐10below;and/or
xii. Collaboratingwithcommercialaircarriers toreduceground‐basedaircraft engine greenhouse gas emissions through single enginetaxiing (“SET”) for purposes of taxi‐in and taxi‐out between therunwayendsandterminalareastotheextent feasibleandwithoutcompromising passenger safety and aircraft engine operationalconsiderations.
InordertoensureprogressinimplementationoftheClimateActionPlanandits reduction objectives, the County of Orange shall conduct annualgreenhouse gas emission inventories for all stationary sources and othersourcesoverwhichJWAhascontrol.
AQ/GHG‐5 Upon Project approval, the County of Orange shall specify energy efficiencyrequirements and goals for equipment and appliances in contractualagreements,asapplicable.Ataminimum:
i. Concurrent with the execution of lease agreements, amendments,and/orrenewalswithcommercialaircarriers, theCountyofOrangeshallsetaGroundSupportEquipmentelectrificationrequirementofa15 percent increase above baseline by 2016, 35 percent abovebaseline by 2021, and 50 percent increase above baseline by 2026.(Thebaselineelectrification conditionsareestablishedby referencetocalendaryear2013.)
ii. Concurrent with the execution of lease agreements, amendments,and/or renewals with all applicable Airport tenants, the County ofOrange shall require that any new equipment or appliancespurchased by the tenant for the provision of services under itscontractwithJWAshallbeENERGYSTARratedorequivalent,totheextent such equipment and appliances are commercially andtechnologicallyavailable.
iii. Concurrent with the execution of lease agreements, amendments,and/or renewals with all applicable Airport tenants, the County ofOrangeshallrequirethatalltenantsdevelop, implementandsubmitto the Airport—within sixmonths of lease execution—a fleet‐wide,anti‐idlingpolicy. At aminimum, the anti‐idling policy shall includethe requirement that vehicle engines shall be turned off whenvehicles are not occupied, and that occupied vehicles be turned offafternomorethanafive‐minuteidlingperiod.

AQ/GHG‐6 Upon Project approval, the County of Orange shall install energy efficientequipment and controls for equipment being replaced as technologicallyavailable.
AQ/GHG‐7 Upon Project approval, the County of Orange shall install variable speeddrives and optimize the control of air handling unit pumps for equipmentbeingreplacedastechnologicallyavailable.
AQ/GHG‐8 UponProjectapproval,andastechnologicallyavailable,theCountyofOrangeshall install energy efficient elevators and escalators as the existing onesrequirereplacement.
AQ/GHG‐9 By2016,theCountyofOrangeshalloptimizetheenergyefficiencyandcontrolof the conveyor motors in the baggage handling system by adding more“photoeyes” to trackbagsand reduce the time that the systemrunsafter abaghasgonethroughfrom20minutesto10minutes.TheCountyofOrangealsowillreplacetheolderelectricconveyordrivemotorsinTerminalsAandBwithnew,moreefficientonescapableofvariablefrequencyby2016.
AQ/GHG‐10 By 2016, the County of Orange shall develop an Integrated Solid WasteManagement Plan (“ISWMP”) that strives to achieve the policy goal of theState of California—set forth in Section 41780.01 of the California PublicResources Code—that not less than 75 percent of solid waste generated besource reduced, recycled, or composted by the year 2020, and annuallythereafter.InfurtheranceoftheState’spolicygoal,theISWMPshallevaluatefurther improvements to the Airport’s existing solid waste diversion ratethroughenhancedrecyclingandcompostingopportunities.
AQ/GHG‐11 By2016,theCountyofOrangeshallinstallelectricvehiclechargersinpublicparking structures A1, A2, B2 and C, the Main Street parking lot, and theemployeeparkinglots.Chargerswillbelocatedclosetotheterminalstogivepreferenceto theelectricvehicleusers.By2021, theCountyofOrangeshallalsoprovidepreferentialparkingforvehiclespoweredbycompressednaturalgasandotherlowemissionsources.
JWA’sparkingprogram(“PARCS”)willbeusedtotrackthedemand/useofthelow emission vehicle spaces/chargers, and the County of Orange will re‐evaluate the percentage/quantity of spaces required every two years. TheCounty of Orange will optimize the efficiency of the parking program andadjustitaccordingtofuturedemandsforelectricchargersandtheothertypesoflow‐emissionvehiclesdrivenbythepublic.
AQ/GHG‐12 UponProjectapproval, theCountyofOrangeshall support theexpansionofpublic transit opportunities to the Airport by coordinatingwith the OrangeCounty Transportation Authority (“OCTA”), Irvine iShuttle, and MetroLinkupontherequestofthetransitproviders.Additionally,theCountyofOrangewill continue to make available—on the Airport’s website—currentinformation about public transit options that can be utilized to access theAirport.
AQ/GHG‐13 Upon Project approval, the County of Orange shall support bicycle use byAirport employees and the air traveling public by providing convenient,securebicycleracksforuseontheAirport’spremises.

AQ/GHG‐14 UponProjectapproval,theCountyofOrangeshallcontinuetosupporttheuseof alternatively fueled taxis and shuttles through the Request for Proposalprocess and in the contractual agreements (most taxis are currently CNG).JWA also shall support the use of alternatively fueled rental vehicles byprovidingelectricityforchargerswherepracticableby2020.

AQ/GHG‐15 Upon Project approval, the County of Orange shall support the efforts ofcommercialaircarrierstoutilizepaperlesstickettechnologybyupgradingthecurrent kiosks and Common Use Passenger Processing System (“CUPPS”)system with new, more efficient technology as it becomes commerciallyavailable.
LU‐1 Startingwiththe2015AnnualNoiseReport, theannualnoisecontourspresented inthe reportwill be usedby theCounty ofOrange/JWA to identify parcelswithnoisesensitive uses (i.e., residences, schools, or churches) that are newly located eitherpartially or completely within the 65 CNEL contour as compared to their locationrelativetothe65CNELcontourinthe2013AnnualContours,whichwillserveasthebaseline condition. All uses that were established before 1985 and have not beeninsulated under the previous AIP will be eligible for evaluation under the SIPdescribedinMitigationMeasureN‐3.Thoseuseswithanaverageinteriornoiselevelsexceeding45CNELwillbeeligibleforinsulationundertheSIPdescribedinMitigationMeasureN‐3.
indoornoisereductionforeachhabitableroomwillberecorded.IneachsubsequentAnnual Noise Report, the noise level impacting these uses and themeasured noisereductionwill be used to estimate the interior noise level. If the estimated interiornoiselevelexceeds45CNEL,thentheusewillbeeligibleforre‐evaluationintheformofnewinteriornoise levelmeasurements. If the interiornoise level inanyhabitableroomexceeds45CNEL,thentheusewillbeeligiblefortheSIPdescribedinMitigationMeasureN‐3.
LU‐2 PriortoauthorizingtheallowedPhase3increases fortheProposedProject,the2025AnnualNoiseReportshallbeevaluatedbytheCountyofOrange/JWAtodetermineifincreased operations would result in a change in the annual 65 CNEL contour ascompared to their location relative to the 65 CNEL contour in the 2013 annualcontours.Iftheincreasewouldresultinagreaterthana1CNELchangeatNMS1Sor2S,theallowedincreasesinMAPand/orADDshallberestrictedtoensuretheincreasewouldbelessthan1CNELdifferenceattheselocations.ThisshallbedoneannuallytoensuretheincreaseinCNELascomparedtothe2013annualcontours,donotexceedtheCityofNewportBeachthresholdprovidedforinGeneralPlanPolicyN1.8.
N‐1 Startingwiththe2015FourthQuarterNoiseReport,theannualnoiselevelsatNMS1S,2S,and3SwillbecomparedbytheCountyofOrangetothe2013annualnoiselevels.Ifthe noise levels have increased by 1.5 dB or more at any of these NMS, all noisesensitiveusesrepresentedbythatNMS(i.e.,thatistheclosestNMStotheparcel)thathavenotbeenpreviouslyinsulatedunderthe1985AIPwillbeeligibleforevaluationfor participation in the Sound InsulationProgram (“SIP”) as described inMitigationMeasureN‐3.Thoseuseswith interiornoise levelsexceedinganaverageof45CNELwillbeeligibleforinsulationundertheSIPasdescribedinthemitigationmeasure.
Forthoseuseswithinteriornoiselevelslessthan45CNEL,theamountofoutdoor‐to‐indoornoisereductionforeachhabitableroomwillberecorded.IneachsubsequentFourthQuarterNoiseReport, thenoise level impactingtheseusesandthemeasurednoise reduction will be used to estimate the interior noise level. If the estimatedinteriornoiselevelexceedsanaverageof45CNEL,thentheusewillbeeligibleforre‐evaluationintheformofnewinteriornoiselevelmeasurements.Iftheinteriornoiselevel in any habitable room exceeds an average of 45 CNEL, then the use will beeligiblefortheSIPdescribedinMitigationMeasureN‐3.
N‐2 Startingwiththe2015FourthQuarterNoiseReport, the annualnoiselevelsatNMS1S,2S,and3SwillbecomparedbyJWAtothe2013annualnoiselevels.Ifthenoiselevelshave increased by 1.0 dB or more at any of these NMS, all noise sensitive usesrepresentedbythatNMS(i.e.,thatistheclosestNMStotheparcel)exposedtonoiselevelsof65CNELorgreaterthathavenotbeenpreviouslyinsulatedunderthe1985AIPwill be eligible for evaluation forparticipation in the Sound InsulationProgram(“SIP”)asdescribed inMitigationMeasureN‐3.Thoseuseswith interiornoise levelsexceeding 45 CNELwill be eligible for insulation under the SIP as described in themitigationmeasure.

N‐3 Theonlypracticalway tomitigate indoornoise levels is throughaSound InsulationProgram(“SIP”).MitigationMeasureLU‐1,asdescribed in theSection4.5,LandUse,andMitigationMeasuresN‐1andN‐2,describedabove,willdetermine the sensitivelandusesthatwillbeeligibleforparticipationintheSIPdescribedbelowasMitigationMeasureN‐3.FAAregulationsrequirethatresidencesbeexposedtoanoutdoornoiselevelof65CNELorgreaterandinteriornoiselevelsgreaterthan45CNELforFAAorAirportfundstobeusedforsoundinsulation.ThereferringMitigationMeasures,LU‐1,N‐1,andN‐2,willensure theoutdoornoisecriterion ismet.The interiornoise levelcriterion will be determined in the evaluation phase of Mitigation Measure N‐3.Sensitiveuseswithinteriornoiselevelsgreaterthan45CNELwillbeeligibleforsoundinsulation.
TheFAAguidanceforimplementingsoundinsulationprogramsspecificallystatesthattheaveragenoiselevelinallhabitableroomsofaresidenceoralleducationalspacesinschoolmustbegreaterthan45CNELfortheusetobeeligibleforsoundinsulationfunded by the Airport or FAA. However, the County’s noise standards specificallyrequire that thenoise level inanyhabitableroomoreducationalspacemustbe lessthan45CNEL.ThisisimpliedintheCityofNewportBeach’snoisestandards,aswell.UnderCEQA,theleadagency’snoisestandardisusedtodetermineimpacts.Therefore,
a noise sensitive use is considered significantly impact if the noise level in anyhabitableroomoreducationalspaceexceeds45CNEL.
Asdiscussedbelow,theAirportwillrequestthattheFAAwaiveitsrequirementthattheaveragenoiselevelinallhabitableroomsoreducationalspacesexceed45CNELinorderforsoundinsulationtobefundedbytheFAAorAirportinorderthatallnoiserelatedimpactsaremitigatedtoalessthansignificantlevelinatimelymanner.IftheFAAdoesnotagreetowaivethisrequirement,thenuseswithoneormorehabitableroomsoreducationalspacesexceeding45CNELbutwiththeaveragenoiselevelinallhabitableroomsoreducationalspaces less than45CNELwouldbesignificantlyandunavoidably impactedas there isnoother funding source for aSIP.However, theseuseswouldbeeligibleforinsulationwhenandiftheaveragenoiselevelexceeded45CNEL.Asdiscussed inMitigationMeasures,LU‐1,N‐1, andN‐2, if an individual landuse isnot eligible for insulationbecause the interiornoise leveldoesnot exceed45CNEL, there are criteria for re‐evaluation. If the annual report noise levels andpreviousevaluationmeasurementsindicatethattheusemaymeettheinteriornoiserequirementitwillbere‐evaluatedforinsulationeligibility.
Part1,Evaluation:WhenMitigationMeasures LU‐1,N‐1, orN‐2 determines that anoisesensitiveuse is significantly impactedbasedonmeasurednoise levelsandtherelevantsignificancethresholds,thatusewillbeevaluatedbytheCountyofOrangeforeligibility for sound insulation. The evaluationwill be performed bymeasuring theindoornoiselevelsforeachhabitableroomoreducationalspace.Iftheaveragenoiselevelinallhabitableroomsoreducationspacesofauseisgreaterthananaverageof45CNELthentheusewillbeeligibleforsoundinsulation.Additionally,iftheaveragenoiselevelislessthan45CNEL,anyusewithanoiselevelgreaterthananaverageof45 CNEL in any habitable roomor educational space alsowill be eligible for soundinsulation if theFAAwaives its requirement thatnoise levelsbeaveragedacrossallhabitableroomsoreducationspaces.
PerFAAguidance,noise levelswillbemeasuredwithallwindowsanddoorsclosed.Uses with measured interior noise levels less than 45 CNEL that do not have anexisting central ventilation system, but rely on keeping windows open for aircirculation will be eligible for a Continuous Positive Ventilation System.ImplementationofsuchasystemwillbedependentonmeetingtheFAArequirementsforimplementationofsuchasystem.
Part2, Sound InsulationProgram: Schools or residences that have interior noiselevels exceeding 45 CNEL as determined by the evaluation measurements will be
eligibleforsoundinsulation.Theimplementationofsoundinsulationwilldependonsatisfying the FAA criteria described in Chapter 812 of Order 5100.38C AirportImprovementProgramHandbook.
T‐2 The County of Orange/JWA shall coordinate with the City of Newport Beach andconstructathirdsouthboundright‐turnlaneattheintersectionofCampusDriveandBristolStreetNorththatisfullyoperationalpriortoJWAserving10.8MAP.
