V. RECONVENE REGULAR MEETING: Dr. Smith reconvened the open meeting at 6:20 p.m.

VI. INTRODUCTIONS, SPECIAL GUESTS AND RECOGNITIONS: Dr. Head introduced Suzanne Weatherly, LSC-UP Faculty Senate VP sitting in for Dave Gaer and Jenny Chiotti, LSC Kingwood Faculty Senate VP sitting in for Roger Chambers. Dr. Head thanked Rebecca Royer for serving as Faculty Senate president for LSC-CyFair. This will be her last meeting. Dr. Head introduced Andrew Christman with Community Impact and Dr. Jim Cain, former superintendent of Klein ISD. Dr. Head asked Dr. Katie Caruso to introduce the 2019-20 Sabbatical Recipients. The recipients are: LSC-CyFair: Kasey Bass, Professor of English, will research methods of incorporating student leadership into English 1301 and 1302 with the goal of enhancing student engagement in their education, especially low-income students, who are at risk for non-completion; Carolyn Ho, Professor of ESOL, will conduct a study of common mistakes in ESOL student writing. The project will help Professor Ho identify most frequent writing mistakes and produce digital learning modules for ESOL teachers and students. The deliverables will assist faculty in shaping their teaching strategies to support ESOL students' language needs and facilitate student success in ESOL and co-requisite courses, Roscoe Johnson, Professor of English, will produce an academic textbook (English 1302/2327/2328/2342/2343) using the CLT model of instruction, creating a D2L sandbox module, with CLT assessment checklist and implementation. Courses taught with his new research data will be incorporated in to his course teaching both for face-to-face classes and online instruction; Abraham Korah, Professor/Reference Librarian, will investigate the impact of undergraduate research in the social sciences and humanities on students and the institution; will develop a survey instrument that assesses the effectiveness of research opportunities in the social sciences and humanities; and will create a report of best practices for successful student research that can be implemented at Lone Star College; Shawn Miller, Professor of Accounting, will pursue his doctoral studies. Professor Miller’s area of concentration will be accounting students, and what supports or hinders their success in the business program, and how those factors impact their educational experience at Lone Star College and beyond; Matt Turner, Professor of English, will research multimodal writing in order to implement it into his campus and online composition courses. These courses will be taught for the first time in the spring of 2020. With the resulting example multimedia essays and resources, Professor Turner can share what he discovers with colleagues across LSC.

LSC-Kingwood: John Dethloff, Professor of English, will create an OER-based Composition and Rhetoric II "master course," available to all LSC-Kingwood faculty, full-time or adjunct, for their own use, revision, alteration or update. In addition to helping to alleviate the financial burden our students face and potentially raising their achievement in class, this project could serve as an example to our faculty on how to adopt OER; Todd Miller, Professor of Music, will examine the use of music to elicit a greater understanding of diverse populations and experiences as humans, through study abroad, musical performance, and healing in tragedy. Professor Miller will also gain a greater understanding of his own inherent biases and preferences and hopes to begin a dialogue through music (on his campus and around the world) in his own small spheres of influence.; David Putz, Professor of Political Science, will add to our professional development programming by researching, developing, and offering a four-part professional development workshop series specifically targeting faculty in their middle years. Workshop curriculum will address ways to wake up "tired teaching" and identify opportunities for faculty to remain engaged during their middle years at the college. LSC-Montgomery: Robert Broadhurst, Professor of Biology will volunteer at Kampachi Farms, an aquaculture facility along the Hawaiian coast, where he will conduct research regarding best practices associated with the production of algae, Basnagoda Rahula, Professor of English, will research what hampers student success in developmental and freshman English classes, to discover innovative steps to prevent the students from quitting classes. Instead of viewing the shrinking developmental and freshmen English classes as an inevitable problem, Professor Rahula feels that a few innovative approaches may prove to be effective-at least to decrease the dropout rate by a few percentages without lowering the quality of our education, Michelle Richey, Professor of Sociology, will develop a podcast series on civic engagement, including supplemental materials for faculty to use. Professor Richey is hoping to have a strong Fall 2021 Engaging the Election programming calendar, and thinks these podcasts, as well as the responses gathered from them, will help her to develop a strong set of resources for students to learn more about the importance of participating in democracy, specifically when it comes to discussing and understanding issues, Mark Whitten, Professor of Philosophy, will compile, edit, research and write a textbook/handbook for Philosophy 1301 (Introduction to Philosophy) LSC-North Harris: Kay Nguyen, Professor of Art, will create a new body of work and document the technical processes and new works of art to use as teaching material for classes at LSC-North Harris. The end result will be a continuing growth as an artist and educator. With advancement of Professor Nguyen’s own work, she can enhance the reputation of the Art Department and LSC-North Harris. LSC-Tomball: Douglas Boyd, Professor of English, will research and develop assignments and strategies for assessing Teamwork and Personal Responsibility Core Objectives. His objectives are for students to have more opportunity to practice and receive feedback about their teamwork and personal responsibility, for faculty to have tools for creating assignments that include teamwork and personal responsibility and assessing them, and for Lone Star College in general to be able to collect and report better results to the THECB, Maria Del Carmen Marin, Professor of English, will collect poems and seek

a publisher for a chapbook on depression. Professor Marin will also enroll in a creative writing workshop on poetry, either through lnPrint or Stanford Continuing Studies. She will bring her daily practice, increased understanding of craft, awareness of mental health issues, and exposure to poets to the classroom, Inkling Creative Writing Club, English department, and college community, Steven Prewitt, Professor of History, will research the impact of military bases on the local public schools in Westminster, California; Norfolk, Virginia; and Great Lakes, Illinois in order to fill a gap in the historical literature concerning racial integration in public schools near military bases. Professor Prewitt’s preliminary research in this area suggested that military bases had a profound, but unstudied, impact on local public schools and racial segregation within them; Kyle Solak, Professor of English, will visit the virtual teaching centers of surrounding universities and colleges, observe their methods for AR/VR best teaching practices, familiarize himself with extant technologies being utilized (Google Cardboards, Google Expeditions, etc.), and investigate emerging AR and VR technologies and their potential employment in the classroom, online or traditional. After returning from his visits, Professor Solak will write a paper about his impressions and suggestions of how to adapt their best practices to Lone Star College's particular needs; Rebecca Tate, Professor of English, will conduct research to develop a focused collection of African-American literature, historical, and cultural sources that she can incorporate into her ENGL composition and co-requisite classes. This research will address any gaps in her own academic training, and it will allow Professor Tate to create a more inclusive and engaging classroom for African-American students, and, in fact, students of all ethnicities. LSC-University Park: Brian Reeves, Professor of Developmental English, will research and develop a theory-based online ENGL 1301 Co-requisite course to implement in spring 2020.

VIII. APPROVAL OF THE MINUTES OF THE MARCH 7, 2019 WORKSHOP AND REGULAR MEETING: upon a motion by Ms. Pierce and a second by Mr. Murillo, the board approved the minutes of the March 7, 2019 Workshop and Regular Meeting.

IX. SPECIAL REPORTS AND ANNOUNCEMENTS:

1. Chancellor: Dr. Head congratulated Mario Castillo on receiving the Hispanic National Bar Association’s “Top Lawyers under 40” Award. Dr. Head announced Lone Star College received the official letter from SACS indicating that LSC-Houston North received its accreditation.

Dr. Head gave a brief update on the legislative meetings. The primary focus was on the request to receive $15 million in Hurricane Harvey relief. So far, the House and the Senate finance work group have approved $13.1 million. The House has approved their budget for the biennium. Lone Star College is waiting to see what the final appropriation will be since enrollments are off due to the hurricane. Dr. Head said contact hours are up over the biennium. The LifePath associate’s degree, for students

with cognitive learning disabilities, is close to receiving approval. Representative Bell has asked Lone Star College to work on an Emergency Management Program for the Texas Reserve. Senator Creighton is pushing annexation for ISDs under other community colleges that are not providing services to them, so they would be able to join with Lone Star College. The aviation program is moving along and information sessions have been held with great attendance. A recent newscast highlighted the shortage of pilots and Sam Houston State University would like to collaborate with Lone Star College to provide a bachelor’s degree. Lone Star College should be receiving information on the BSN and BAT degrees soon.

2. College Presidents: Shah Ardalan, president of LSC-University Park, gave a presentation on Innovation in Teaching and Learning, highlighting innovation led by LSC faculty at each campus. Technology trends used at the campuses to teach classes include 3D printing, robots, drones, artificial intelligence and virtual reality goggle and dissection tables. New course redesign ideas have been implemented such as an automated manufacturing line and learning about current events and culture through podcasts. Student projects include the Freedman Town excavation, Biomedical Research, Microalgae Biosynthesis in Microgravity with NASA and analysis for refineries and chemical plants. Student activities include Muscle Kings and Queens - faces are painting showing the muscle and bone structure, Second Life of Books – books are turned into art, and Hunger Banquets.

3. Vice Chancellors: None.

4. Faculty Senate Presidents: Rebecca Royer, faculty senate president at LSC-CyFair, gave a presentation on Faculty Led Initiatives such as Model UN at LSC-Tomball that encourages women participation and The Empowerment Center at LSC-CyFair that provides resources, training and programs to address gaps in students’ needs.

5. Board Members: Mr. Ken Lloyd attended the Innovation Conference. Trustee Lloyd

said it was a great event and there were many startup companies that attended.

Dr. Smith attended the opening of Workforce Solutions office at Acres Home. This will help provide skills to find new employment. Dr. Smith attend the ribbon cutting for Complete Communities office. This program will help adopted areas add grocery stores, banking and other amenities to their community. Dr. Smith also attended the scholarship appreciation event at LSC-UP and will be attending the scholarship appreciation event LSC-CyFair.

X. CITIZEN PARTICIPATION: Mr. John Burghduff representing AFT, highlighted the AFT visit to Austin during spring break to lobby at the capital about funding for community colleges, preserving the role of community colleges in providing developmental education, overreliance on adjunct faculty and the impact on students and health cuts in funding for employee’s health benefits through ERS.

XI. CONSIDERATION OF THE CONSENT AGENDA: Chair Smith proceeded with the Consent Agenda. Items # 11 and #12 were pulled from the agenda to be voted on separately. Mr. Murillo made a motion to approve Action Items 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 13, and 14. Mr. Vogt seconded the motion and the Board unanimously passed the Consent Agenda. A copy is attached as Exhibit “B”.

XII. POLICY REPORTS AND CONSIDERATIONS:

1. Consideration and Approval of the Recommended Revision of the Lone Star College

(the “College”) Board Policy Manual Section VI.A. Admissions Policy to include subsection VI.A.2.1. Health Occupation Programs Admission Policy (ACTION ITEM 1): the Board of Trustees considered and approved the recommended revision of the College’s Board Policy Manual Section VI.A. Admissions Policy to include subsection VI.A.2.1. Health Occupation Programs Admission Policy. This item was passed in the Consent Agenda. A copy is attached as Exhibit “C”.

XIII. FINANCIAL REPORTS AND CONSIDERATIONS:

1. Consideration of Approval to Authorize the Chancellor or Designee to Purchase Toner Cartridges and Printer Maintenance or Repair Services (ACTION ITEM 2): the Board of Trustees authorized the Chancellor or designee to purchase toner cartridges and printer maintenance or repair services from Double M Laser Products, Inc., dba Enhanced Laser Products (“Enhanced Laser”), 10516 Katy Fwy, Suite H, Houston, Texas 77043 for a sum not exceeding $2,500,000. This item was passed in the Consent Agenda. A copy is attached as Exhibit “D”.

2. Consideration of Approval to Authorize the Chancellor or Designee to Amend the Contract on Behalf of Lone Star College (the “College”) with Partners in Leadership (ACTION ITEM 3): the Board of Trustees authorized the Chancellor or designee to amend the contract on behalf of the College for the purchase of additional services with Partners in Leadership, Inc., 27555 Ynez Road, Suite 300, Temecula, California 92591, in a sum not exceeding $260,000 for a total revised contract sum not exceeding $1,051,000 and that this authorization expressly delegate authority to the Chancellor to execute this contract with a value of more than $1 million. This item was passed in the Consent Agenda. A copy is attached as Exhibit “E”.

3. Consideration of Approval to Authorize the Chancellor or Designee to Negotiate and

Execute a Contract on Behalf of Lone Star College (the “College”) to Purchase Two 3-D Printers for the Mechatronics Degree Program at Lone Star College-University Park (“LSC-University Park”) and Lone Star College-North Harris (“LSC-North Harris”)Programs (ACTION ITEM 4): the Board of Trustees authorized the Chancellor or designee to negotiate and execute a contract on behalf of the College with T.S. Enterprise Associates, Inc., dba Advanced Technologies Consultants, 110 W. Main Street, Northville, MI 48167, to purchase two 3-D Printers in a sum not exceeding $249,600. This item was passed in the Consent Agenda. A copy is attached as Exhibit “F”.

4. Consideration of Approval to Authorize the Chancellor or Designee to Negotiate and

Execute a Contract on Behalf of Lone Star College (the “College”) for the Purchase and Installation of Movable Furnishings for Lone Star College-East Aldine Center (“LSC-East Aldine”) (ACTION ITEM 5): the Board of Trustees authorized the Chancellor or designee to negotiate and execute a contract on behalf of the College with J. Tyler Services, Inc., 5920 Milwee, Houston, TX 77092 for the purchase and installation of movable furnishings in a sum not exceeding $920,000. If negotiations cease for any reason with J. Tyler Services, Inc., the College may proceed to negotiate with the next firm in the order of selection ranking with a score of not less than 70 until a contract is executed. This item was passed in the Consent Agenda. A copy is attached as Exhibit “G”.

5. Consideration of Approval to Authorize the Chancellor or Designee to Negotiate and Execute a Contract on Behalf of Lone Star College (the “College”) for the Purchase and Installation of Movable Furnishings for Lone Star College-University Park (“LSC-University Park”) (ACTION ITEM 6): the Board of Trustees authorized the Chancellor or designee to negotiate and execute a contract on behalf of the College with Debner & Company, 8020 Katy Freeway, Houston, TX 77024 for the purchase and installation of movable furnishings in a sum not exceeding $200,000. This item was passed in the Consent Agenda. A copy is attached as Exhibit “H”.

6. Consideration of Approval to Authorize the Chancellor or Designee to Negotiate and

Execute a First Amendment on Behalf of Lone Star College (the “College”) to the Interlocal Agreement Between Cypress-Fairbanks ISD and the College, Formerly Known as North Harris Montgomery Community College District, dated October 12, 2004 Related to College Property Located on the South Side of West Road, West of Barker Cypress Road (ACTION ITEM 7): the Board of Trustees authorized the Chancellor or designee to negotiate and execute a first amendment on behalf of the College to the Inter-local Agreement between Cypress-Fairbanks ISD and North Harris Montgomery Community College District dated October 12, 2004, granting access easements related to 0.8549 acres of College property located on the south side of West Road, west of Barker Cypress Road, Cypress, Harris County, Texas 77433. This item was passed in the Consent Agenda. A copy is attached as Exhibit “I”.

7. Consideration of Approval to Authorize the Chancellor or Designee to Negotiate and Execute an Easement and Agreement on Behalf of Lone Star College (the “College”) with Creekside Arts Center, LLC and Blue Creek Builders, LLC for Construction of One Monument Sign (ACTION ITEM 8): the Board of Trustees authorized the Chancellor or designee to negotiate and execute an easement and agreement on behalf of the College with Creekside Arts Center, LLC, and Blue Creek Builders, LLC, for construction of one monument sign. Such agreement include final approval by the Chancellor of signage. This item was passed in the Consent Agenda. A copy is attached as Exhibit “J”.

Consideration of Approval to Authorize the Chancellor or Designee to Amend the Contract on Behalf of Lone Star College (the “College”) for Additional Design Services with PBK Architecture (“PBK”) for Lone Star College-North Harris (“LSC-North Harris”) (ACTION ITEM 9): the Board of Trustees authorized the Chancellor or designee to amend the contract on behalf of the College for additional design services with PBK Architecture, 11 Greenway Plaza, Houston, Texas 77046 in a sum not exceeding $125,000 for LSC-North Harris for a total revised contract sum not exceeding $2,175,629. This item was passed in the Consent Agenda. A copy is attached as Exhibit “K”.

9. Consideration of Approval to Authorize the Chancellor or Designee to Amend the

Contract on Behalf of Lone Star College (the “College”) for Additional Design Services with John Kirksey Associates Architects, Inc. at Lone Star College-System Office The Woodlands (“LSC-SO”) (ACTION ITEM 10): the Board of Trustees authorized the Chancellor or designee to amend the contract on behalf of the College for additional design services with John Kirksey Associates Architects (“Kirksey Architects”), Inc., 6909 Portwest Drive, Houston, Texas 77024 for the monument sign project at LSC-SO for a sum not exceeding $50,000 with a total contract sum not exceeding $1,581,538. This item was passed in the Consent Agenda. A copy is attached as Exhibit “L”.

10. Consideration of Ratification for the Expenditure of Funds Related to Charges for

Learning Materials and Books for Lone Star College (“the College”) Student Body (ACTION ITEM 11): upon a motion by Mr. Vogt and a second by Mr. Murillo the Board of Trustees ratified the expenditure of funds related to charges for learning materials and books for the College student body made to Barnes & Noble College Booksellers, LLC (“Barnes & Noble College”), 120 Mountain View Blvd., Basking Ridge, NJ 07920 in a sum not exceeding $1,586,174. A copy is attached as Exhibit “M”.

11. Consideration of Approval to Authorize the Chancellor or Designee to Amend the

Contract on Behalf of Lone Star College (the “College”) for Bookstore Operation Services (ACTION ITEM 12): upon a motion by Mr. Stoma and a second by Ms. Pierce the Board of Trustees authorized the Chancellor or designee to amend the contract on behalf of the College for the purchase of course materials on behalf of students with Barnes & Noble College Booksellers, LLC, 120 Mountain View Blvd., Basking Ridge, NJ 07920 for a total revised contract sum not exceeding $50,000,000. A copy is attached as Exhibit “N”.

XIV. PERSONNEL REPORTS AND CONSIDERATIONS:

1. Consideration and Authorization for the Chancellor or Designee to Execute Proposed

VI.A.2.1. Health Occupation Programs Admissions Policy Health Occupation programs do not consider applications from Prospective Students not at least 18 years old at the time of the program application’s deadline—except that LSC-Tomball may honor a current contractual obligation with Klein ISD requiring the admission of students below the age of 18 years old. Any applicant that willfully misrepresents Material Information on the application will not be accepted or conditionally remain in a Health Occupation Program.

VI.A.2.2. Definitions

(a) Health Occupation Programs means programs identified by the College that prepare students to enter the healthcare industry. These programs include credit and non-credit programs.

(b) Prospective Students means a student who is seeking to submit an application and who is not officially accepted into the health occupation programs.

(c) Application Deadlines means the identified date provided and published by the health occupation program. Health Occupation Programs only consider applications fully completed by the Program’s application deadline.

(d) Material information means any information that the College reports to a third party on behalf of the student—including but not limited to: hospitals, accrediting, or state agencies.

VI.A.2.3. Admission Grievance Policy The Health Occupation Programs have competitive admission processes even though the College admits students through open enrollment. Admission denials include, but are not limited to: incomplete applications, misleading information, not meeting admission criteria, or lower admission scores that other cohort members. Students may appeal admission denials to the Program Director and then to the appropriate Dean. The Dean’s admission decision is final.

Chancellor’s Recommendation:

That the Board of Trustees authorize the Chancellor or designee to purchase toner cartridges and printer maintenance or repair services from Double M Laser Products, Inc., dba Enhanced Laser Products (“Enhanced Laser”), 10516 Katy Fwy, Suite H, Houston, Texas 77043 for a sum not exceeding $2,500,000.

Rationale: Toner cartridges are required for printers and fax machines to operate across the College. In addition, printers and fax machines need periodic maintenance and repairs to ensure they are operating at a level of optimum performance.

This purchase complies with Texas Education Code §44.031 (a) (4) which allows the use of interlocal contracts. Purchases from Enhanced Laser are conducted through the Choice Partners Cooperative Purchasing Contract #18-056KD-24. A market analysis was performed to ensure best value.

Request: Consideration of Approval to Authorize the Chancellor or Designee to Amend the Contract on Behalf of Lone Star College (the “College”) with Partners in Leadership

Chancellor’s Recommendation:

That the Board of Trustees authorize the Chancellor or designee to amend the contract on behalf of the College for the purchase of additional services with Partners in Leadership, Inc., 27555 Ynez Road, Suite 300, Temecula, California 92591, in a sum not exceeding $260,000 for a total revised contract sum not exceeding $1,051,000 and that this authorization expressly delegate authority to the Chancellor to execute this contract with a value of more than $1 million.

Rationale: On February 5, 2015, the Board approved contracting with Partners in Leadership, Inc. to conduct an assessment of the current cultural climate within the College and to provide ongoing consulting services through a formal Request for Proposal process in compliance with Texas Education Code §44.031 for a sum not to exceed $472,100 over a three-year period, with a total contract term not to exceed five years.

On November 2, 2017, the Board approved an addendum for additional training services for a sum not exceeding $25,000 for a total revised sum not exceeding $497,000 over a three-year period.

On April 5, 2018, the Board approved a contract amendment for additional services to support the College’s 20|20 culture to provide culture expertise in face-to-face workshops with each college leadership team and to continue the license agreement for a sum not exceeding $293,000 for a total revised sum not exceeding $791,000.

The current services are set to expire on April 30, 2019. In order to continue to integrate the culture transformation, execution of the 5th year renewal agreement is requested to extend the license agreement, introduce updated cultural beliefs to the change process, continue face-to-face meetings with leadership teams, and one-on-one coaching and observations for leaders.

The original contract term was for an initial three-year period with an option to renew for two additional one-year periods based on mutual consent. This would be the final one-year renewal beginning on May 1, 2019.

Fiscal Impact: Funds for this purchase are included in the approved FY 2019 budget and will be included in the proposed FY 2020 budget.

Rationale: The LSC-University Park and LSC-North Harris Mechatronics Degree programs provide specialty workforce education for the mechatronics/automated manufacturing workspace. The equipment will be used to train students in programming Additive Manufacturing Technology (3-D printing) and production of items through the use of Additive Manufacturing. The College trains students using the current standards, best practices, and accepted methodologies in order to create competent, safe, and skilled graduates in addition to providing a training environment that embraces advanced technology based upon real-time training relevant to and related to current technology and standards used in manufacturing facilities.

In compliance with Texas Education Code §44.031 (a), a Request for Proposals (“RFP”) #642 was publicly advertised and one response was received. The College conducted the evaluation based on cost, qualifications, experience, and service needs met; references; quality of services; the extent to which certified historically underutilized business (“HUB”), minority and/or veteran or women-owned business are utilized; past performance; long-term cost; enhanced services and completeness; and thoroughness of response.

Fiscal Impact: $124,800 for these purchases are available from Workforce Council Funds and $124,800 from a Perkins Grant.

Rationale: On October 12, 2004, the College and Cypress-Fairbanks ISD entered into an Agreement to allow joint use of each other’s parking lots. The Agreement also granted easements for two driveways from West Road across College property to provide access to the Berry Center, which is owned by Cypress-Fairbanks ISD, and from East Berry Center driveway across Cypress-Fairbanks ISD property to provide access to the College’s property. The agreement was not notarized by the College; therefore, the access easements were not recorded in the Harris County property records. The agreement will reflect the current College name, and be notarized and recorded in the Harris County property records.

Such agreement include final approval by the Chancellor of signage.

Rationale: On May 1, 2014, the Board approved the negotiation and execution of required easements and agreements with adjacent property owners, Creekside Arts, LLC, and Blue Creek Builders, LLC, necessary for the construction of the Lone Star College-Creekside Center (“LSC-Creekside Center”). The adjacent property owners are requesting an easement for the construction of one monument sign on the southeast corner of LSC-Creekside Center property which is adjacent to the south driveway and Kuykendahl Road.

This agreement grants the College and the Chancellor the ability to approve the design of the monument sign if and when The Woodlands Township Development Review Committee has granted their approval to move forward with the monument.

Fiscal Impact: There is no cost associated with the granting of the easement. The monument construction, maintenance, and repair will be at the expense of Creekside Arts Center, LLC and Blue Creek Builders, LLC, and any expenses incurred by the College will be reimbursed by Creekside Arts Center, LLC and Blue Creek Builders, LLC. A proposed $700 per year use fee will be payable to the College with a 2% annual increase after the initial year.

Rationale: On April 9, 2015, the Board of Trustees approved PBK to provide design services for LSC-North Harris projects through a formal Request for Qualifications process in compliance with Texas Government Code §2254.004.

PBK has been commissioned to design and oversee implementation of the Construction and Skilled Trades Technology Building (“CSTTC”). The sum for additional fees is based on the increase of the project scope, which includes CSTTC Lab donated equipment, HVAC air exchange solution, detention pond changes, family restrooms, and an increase in the construction cost limit for the Transportation Institute. The proposed contract extension complies with Texas Education Code Chapter 44, Subchapter B, §44.031, §44.0311, and §44.312.

Rationale: On April 9, 2015, the Board approved Kirksey Architecture to provide design services for LSC-University Park projects through a formal Request for Qualifications (“RFQ”) process in compliance with Texas Government Code §2254.004.

On May 5, 2016, the Board approved the language modification of a previously approved list of architectural firms for Phase I Bond Projects. This modification allows for the use of any of the top ranked approved architectural firms at any campus location.

This proposed contract extension complies with Texas Education Code Chapter 44, Subchapter B, §44.031, §44.0311, and §44.312. Professional Architectural Services include, but are not limited to, design, mechanical, electrical, plumbing, HVAC, and civil engineering.

Request: Consideration of Ratification for the Expenditure of Funds Related to Charges for Learning Materials and Books for Lone Star College (“the College”) Student Body

Chancellor’s Recommendation:

That the Board of Trustees ratify the expenditure of funds related to charges for learning materials and books for the College student body made to Barnes & Noble College Booksellers, LLC (“Barnes & Noble College”), 120 Mountain View Blvd., Basking Ridge, NJ 07920 in a sum not exceeding $1,586,174.

Rationale: The College provides on-campus bookstores to purchase academic and instructional books and materials, and café services aka “Grab n’ Go” food services for enrolled students.

On June 7, 2018, the Board approved Barnes & Noble College to provide bookstore operation services. The agreement contained a guarantee of $2,250,000 commission for the first year of the agreement. The remaining four years would provide annual commissions based on net sales between 11.5% and 15%.

The College needed to reimburse Barnes & Noble College for charges pertaining to financial aid and campus purchased learning materials on behalf of the students.

Fiscal Impact: Funds for the reimbursement were available from student financial aid award receivables.

Request: Consideration of Approval to Authorize the Chancellor or Designee to Amend the Contract on Behalf of Lone Star College (the “College”) for Bookstore Operation Services

Chancellor’s Recommendation:

That the Board of Trustees authorize the Chancellor or designee to amend the contract on behalf of the College for the purchase of course materials on behalf of students with Barnes & Noble College Booksellers, LLC, 120 Mountain View Blvd., Basking Ridge, NJ 07920 for a total revised contract sum not exceeding $50,000,000.

Rationale: On June 7, 2018 meeting, the Board approved Barnes & Noble College Bookseller (“Barnes & Noble”) to provide bookstore operation services. The agreement contained a guarantee of $2,250,000 commission for the first year of the agreement. The remaining four years would provide annual commissions based on net sales between 11.5% and 15%.

In addition to providing bookstore operation services, Barnes & Noble allows students to purchase course materials utilizing their financial aid awards. The funds from student financial aid awards are disbursed each semester from the Department of Education to Lone Star College, a portion of which then need to be paid to Barnes & Noble as payment for the course materials purchased by students. This contract amendment will authorize the expenditure of Lone Star College funds to Barnes & Noble on behalf of students.

Student purchases of course materials utilizing financial aid awards is estimated to be as much as $5,000,000 a year. If renewals are executed, the contract with Barnes & Noble will be ten years, resulting in a total sum not exceeding $50,000,000. This includes the amount requested for ratification in a separate Board Agenda Item.

CONSTRUCTION PROJECTS UPDATE As of April 4, 2019

1. LSC-Kingwood: Hurricane Harvey Recovery:

A renovation of 200,000 sf of the first floors of five of six buildings has reached substantial completion. The architect is AutoArch and design was completed August 2018. The construction firm is Anslow Bryant and construction began July 2018. Classes resumed in the five completed buildings for Spring 2019 with the Library building scheduled for completion and opening in April 2019.

Substantial Completion: Spring 2019 Budget: $45,000,000

2. LSC-University Park: Student Life Renovation: A renovation of 9,583 sf in the Commons Building Level 2, this project will support student life for the college. The architect is RdlR Architects and design was completed November 2017. The construction firm is Gadberry and they began construction February 2019.

Substantial Completion: Summer 2019 Budget: $840,000

3. LSC-North Harris: East Aldine Satellite Center:

A new 65,000 sf building, this project will support general curriculum studies and workforce instruction in the Aldine School District area; as well as an Early College program partnership with Aldine ISD. The architect is Texas IBI Group and design was completed December 2017. The construction firm is Bartlett Cocke General Contractors and construction began March 2018.

Substantial Completion: Summer 2019 Budget: $28,940,000

4. LSC-Tomball: South Entrance Drive Monument:

A new main entrance monument, sign, and landscaping, this project will support the new Tomball South Drive Entrance completed January 2018. Discussions and a survey are in progress with TxDOT to purchase property as well as appraisals being prepared.

Substantial Completion: Fall 2019 Budget: $2,650,000

5. LSC-Corporate College: Transportation Institute:

A new 16,000 sf building, this project will support the growing truck driving program. The architect is PBK Architects and design was completed September 2018. The construction firm is Tellepsen and construction began February 2019.

Substantial Completion: Late Fall 2019 Budget: $13,000,000

6. LSC-University Park: Visual Performing Arts Center:

A new 40,000 sf building, this project will support an instructional arts program. The architect is Studio Red Architects and programming began May 2018.

Substantial Completion: Summer 2021 Budget: $21,675,000

7. LSC-Montgomery: Student Services Building:

A new 50,000+ sf building, this project will support expanded student services capabilities. The architect is Harrison Kornberg and programming began June 2018. The construction firm is Durotech, Inc. General Contractors.

Substantial Completion: Spring 2021 Budget: $25,650,000
