CALL TO ORDER

Harold L. Godwin, M.D., President of the Board of Medical Examiners of the State of NorthCarolina, called the meeting to order at 7:30 p.m. , at the North Raleigh Hilton, Raleigh,North Carolina.

The Board members present at this meeting included: Nicholas Emanuel Stratas, M.D. ,Secretary; Eben Alexander, Jr., M.D.; John Thomas Daniel, Jr. , M.D.; John Wesley Nance,M.D.; F.M. Simmons Patterson, Jr. , M.D.; and Mrs. Kathryn Howell Willis.

Staff members present included: Bryant D. Paris, Jr. ; Donald R. Pittman; William H.Breeze, Jr.; Robert J. Broyles; L. D. Beaver; Kathy Burke; and Betty Ann Preston.

MOORE, Bany Allen, M.D. —Gxcenville, NC

On August 17, 1989, the Board of Medical Examiners of the State of North Carolina held ahearing on charges preferred against Barry Allen Moore, M.D. Dr. Moore was representedby counsel, Williatn Holford and Beth McKinney.

At the conclusion of these proceedings, on August 18, 1989, the Board of MedicalExaminers unanimously adopted a motion made by Dr. Patterson and seconded by Dr.Alexander that the Board revoke Dr. Moore's license to practice medicine in the State ofNorth Carolina.

TAPE RECORDINGS OF INFORMAL INTERVIEWS

On August 18, 1989, the Board of Medical Examiners adopted a motion made by Dr.Patterson and seconded by Dr. Daniel that the Board deny, for a period of time not less thanthe next three years, any request by a physician, attorney, etc. to tape record an informalinterview. Drs. Alexander, Nance and Stratas abstained from the voting.

BELL, Ronald Lee, M.D. - Lake View, SC

On August 16, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Stratas and seconded by Dr. Alexander that the Board accept as information thereport that Dr. Bell has surrendered his license.

SURRENDER OF MEDICAL LICENSES

On August 16, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Nance that the Board's staff and counsel examine themethods by which other Boards handle the surrender of a physician's license and reportback to the Board with a reconunendation at the October 1989meeting.

SHAFTNER, Kimberly K., M.D. —Clayton, NC

On August 18, 1989, the Board adopted a motion made by Dr. Patterson and seconded byDr. Godwin that the Board extend Dr. Shaftner's temporary license for a period of sixmonths (expiration February 2, 1990).

RIDDLE, William Mark, M.D. —Greenville, NC

On August 18, 1989, the Board adopted a motion made by Dr. Patterson and seconded byDr. Daniel that the Board extend Dr. Riddle's license until January 1, 1991.

LIPSEY, John Crawford, M.D. —Blacksburg, VA

On August 19, 1989, the Board adopted a motion made by Dr. Alexander and seconded byDr. Godwin that Dr. Lipsey be granted a temporary license until January 1, 1991, saidlicense will be unrestricted as to location.

McLEAN, Harry Herndon, IH, M.D. - Winterville, NC

On August 19, 1989, the Board adopted a motion made by Dr. Godwin and seconded by Dr.Daniel that the Board grant Dr. McLean a three month temporary license (expiration12/8/89) limited to his working no more than forty (40) hours per week.

KILGORE, Larry Charles, M.D. - Fayetteville, NC

On August 19, 1989, the Board adopted a motion made by Dr. Alexander and seconderl byDr. Godwin that the Board grant Dr. Kilgore a temporary license until December 8, 1989and limited to Dr. Kilgore working no more than forty (40) hours per week.

LUPRECHT, Geri Lynn, M.D. - Clemmons, N.C.

On August 18, 1989, the Board adopted a motion that Dr. Luprecht's temporary license beextended for two more years.

COCHRAN, David Lee, M.D. - Salisbury, N.C.

On August 19, 1989, the Board adopted a motion made by Dr. Patterson and seconded by Dr.Stratas that the Board grant Dr. Cochran a temporary license until the October 25, 1989.

On August 18, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Daniel that the Board deny the use of the corporatename "Central Carolina Physicians for Women, P.A."

EXCESS LIABIIXI'Y INSURANCE

On August 18, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Stratas and seconded by Dr. Alexander that the Board cancel its old insurancepolicy and adopt the excess liability insurance policy presented by the Executive Secretary.

HEARING PROCEDURE

On August 18, 1989, the Board of Medical Examiners discussed the possibility of havingthe President of the Board and four other Board members sit in on hearings while the othermembers go about Board business. This discussion has been tabled until the next meeting.

CITIZENSHIP STATUS FOR LICENSURE ELIGIBIIJTY

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Alexander and seconded by Dr. Daniel that the Board proceed with an emergencyfiling of the regulations rescinding the current regulations as it pertains to the citizenshiprequirement as a prerequisite to licensure. It is the Board's intention that this citizenshiprequirement be eliminated from the regulations.

RECORDS RETENTION - FOREIGN APPLICANTS

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Alexander and seconded by Dr. Daniel that office records concerning foreignapplicants need not be kept for 30 years, but should be kept for the same amount of time(five years) as records for American applicants.

SUMMARY SUSPENSION OF LICENSES

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Henry that the Board act and the necessarypaperwork be drawn up and served within 24-36 hours of the Board voting to summarilysuspend a license, and that Mr. Weddington's memo of July 24, 1989 be accepted asinfomiation. It was indicated that if it appears the Board will need to act to summarilysuspend a license in the judgment of the Executive Secretary and attorney, then this shouldbe conununicated to the President of the Board in tune for the necessary paperwork to bedrawn up.

On August 19, 1989, the Board of Medical Examiners unanunously adopted a motion madeby Dr. Daniel and seconded by Dr. Patterson that a subcommittee be formed, chaired by Dr.Stratas and including Dr. Alexander and Mr. Paris, to examine how the Board shouldproceed with foreign medical graduates, particularly those who have graduated fromCanadian medical schools.

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Stratas that Dr. Friedman be issued a one-yeartemporary license.

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Henry that the Board deny Dr. Palaniyandi based onthe fact he only attended medical school for two years. Dr. Daniel voted in opposition tothis motion.

by Dr. Daniel and seconded by Dr. Henry that Dr. Lipscomb be issued a Resident's TrainingLicense.

PEDERSEN, Harold Jon, M.D. —Ballwin, MO

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion macle

by Dr. Alexander and seconded by Dr. Henry that the Board deny Dr. Pedersen'sapplication for licensure based on the Missouri action.

DEAR, Guy deLisle, M.D. - Durham, NC

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Alexander and seconded by Dr. Henry that the Board deny Dr. Dear's application forlicensure on the basis that he does not meet the Board's requirements for post-graduatetrainmg.

ELECTION OF OFFICERS

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Alexander and seconded by Dr. Patterson that Dr. Stratas continue as Secretary to theBoard and that Dr. Daniel be elected President for the upcoming year.

PROPOSED REGULATION CHANGE: FMG CLERKSHIPS FOR RTL APPLICANTS

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Stratas that the Board adopt the proposed regulationchange regarding FMG clerkships for RTL applicants who have completed three years ofapproved PGT.

PROPOSED REGULATION CHANGE: SELF-PRESCRIBING/RUBBER STAMPEDSIGN ATI.JRES

On August 19, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Henry that the Board effect the proposed regulationchange regarding self prescribing and rubber statnped signatures.

EMPLOYEE EDUCATIONAL ASSISTANCE

On August 19, 1989, the Board of Medical Examiners adopted a motion made by Dr. Stratasand seconded by Dr. Daniel that the Board adopt and implement for its staff the educationalassistance policy in force and effect for all state employees.

REPORT ON AUDIT

On August 20, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Henry and seconded by Dr. Daniel that the Board accept the Report on Audit assubmitted.

On August 20, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Stratas and seconded by Dr. Patterson that Board members be encouraged to monitorand submit expenses to the Board for all activities relating to Board business (i.e.,interviews, telephone time, travel time, etc.) and that the staff supply the Board memberswith the appropriate time sheets, etc.

On August 20, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Daniel and seconded by Dr. Stratas that Dr. Citron be invited to present his proposal"Elements of a Modem State Medical Board" to the Board for fifteen minutes on October18, 1989. Drs. Patterson and Henry voted in opposition to this motion.

NURSE PRACI1TIONER REGULATIONS

On August 20, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Patterson and seconded by Dr. Henry that the Board's staff (K. Burke) prepare a listof the various items which the Nursing Board and Joint Subcommittee are likely to raiseobjection to.

On August 20, 1989, the Board of Medical Examiners unanimously adopted a motion madeby Dr. Henry and seconded by Dr. Patterson that Dr. Godwin call his counterpart at theNursing Board to voice the Board's objections to the way discussion on the regulations arebeing handled.

EMS REPORT

On August 20, the Board of Medical Examiners unanimously adopted a motion made byDr. Daniel and seconded by Dr. Godwin that the Board approve the 141 initial applicationsand 144 recertification applications for Advanced Life Support personnel submitted by theOffice of Emergency Medical Services. The Board also adopted a motion made by Dr.Daniel and seconded by Dr. Godwin that the Board approve the 261 Bee StingCertifications submitted by the Office of Emergency Medical Services.

There was discussion of the issuance of patient care orders via an approved cormnunicationsystem. The Office of Emergency Care Services has asked the Board for its position inwriting in this regard. On August 20, 1989, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr. Patterson that Mr. Paris respondto the Office of Emergency Care Services in writing stating that it is the Board's positionthat the relaying of patient care orders to prehospital EMS technicians by registered nursesor other persons was not the intent of the Board and is not permitted under the currentregulations.

There was further discussion on EMS personnel functioning in a hospital setting. OnAugust 20, 1989, the Board of Medical Examiners unanimously adopted a motion made byDr. Daniel and seconded by Dr. Patterson that the Board's approval of EMS personneldoes not extend into a hospital setting.
