v. EffectiveonMay26,2020at11:59pm,placesofworship,funeralhomes,andothervenuesthatoffergatheringspaceforweddings,funerals,orplannedservicessuchasworship,rituals,prayermeetings,orscripturestudies,mayhostsuchweddings,funerals,orserviceswithover10people,providedthattheyadheretothebelowrequirements:
A. Inallsettings,ensureaminimumof6feetofphysicaldistancingbetweenhouseholds.
B. Inindoorsettings,occupancymustnotexceed25percentofthenormaloccupantcapacityasdeterminedbythefiremarshal,withamaximumof250peopleinasingleself-containedspace.

Executive OrdersOffice of the GovernorEmergency Executive Order 20-63: Continuing to Safely Reopen Minnesota’s Economy and Ensure Safe Non-Work Activities during the COVID-19 Peacetime Emergency
I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:
3. Masks and face coverings strongly encouraged.IstronglyencourageallMinnesotanstowearamanufacturedorhomemadeclothfacecoveringwhentheyleavetheirhomesandtraveltoanypublicsettingwheresocialdistancingmeasuresaredifficulttomaintain(e.g.,grocerystoresandpharmacies)andtofollowfacecoveringguidelinesissuedbyMDHandtheCDCuntilthisExecutiveOrderisrescinded.Assetforthbelow,Minnesotansmayberequiredtowearclothfacecoveringsincertainsettings.Suchfacemasksandcoveringsareforsourcecontrol(tohelplimitthepersonwearingthecoveringfrominfectingothers).Theyarenotyetknowntobeprotectiveofthewearerandthereforearenotpersonalprotectiveequipment.
a. “Home,”“homes,”“residence,”and“residences”arebroadlydefinedtoincludemobilehomes,hotels,motels,sharedrentalunits,shelters,andsimilarfacilities,totheextenttheyareusedforlodging.
b. “Worker”and“workers”arebroadlydefinedtoincludeowners,proprietors,employees,contractors,vendors,volunteers,andinterns.
c. “Business”and“businesses”arebroadlydefinedtoincludeentitiesthatemployorengageworkers,includingprivate-sectorentities,public-sectorentities,non-profitentities,andstate,county,andlocalgovernments.
d. “CriticalBusinesses”areallbusinesses whoseworkersqualifiedforaCriticalSectorexemptionunderparagraph6ofExecutiveOrder20-48.
e. “Non-CriticalBusinesses”areallbusinessesthatarenotCriticalBusinessesandarenotPlacesofPublicAccommodationclosedunderparagraph7.cofthisExecutiveOrder.
f. “PlaceofPublicAccommodation”meansabusiness,oraneducational,refreshment,entertainment,orrecreationfacility,oraninstitutionofanykind,whetherlicensedornot,whosegoods,services,facilities,privileges,advantages,oraccommodationsareextended,offered,sold,orotherwisemadeavailabletothepublic.PlacesofPublicAccommodationinclude,butarenotlimitedto,thebusinessesidentifiedinparagraph7.c.iofthisExecutiveOrder.
6. Activities outside of the home. Mindfulthatwemustcontinuetolimitsocialinteractionstoprotectpublic

a. Guidelines.IndividualsengaginginactivitiesoutsideofthehomemustfollowtherequirementsofthisExecutiveOrderandMDHandCDCGuidelines.IndividualsengaginginoutdoorrecreationalactivitiesmustfollowtheMinnesotaDepartmentofNaturalResources(“DNR”)andMDHguidelinesonoutdoorrecreationandguidelinesforfacilitiesandthepublic(“OutdoorRecreationGuidelines”)availableatDEED’swebsite(https://mn.gov/deed/guidance).
b. Unnecessary travel strongly discouraged. Consistentwithfederalguidanceandtoprotectourneighbors,Minnesotansareencouragedtostayclosetohomeandarestronglydiscouragedfromengaginginunnecessarytravel.
c. Gatherings. Allgatheringsofmorethan10peopleareprohibited,exceptassetforthbelow.Gatheringsaregroupsofindividuals,whoarenotmembersofthesamehousehold,congregatedtogetherforacommonorcoordinatedsocial,civic,community,faith-based,leisure,orrecreationalpurpose—evenifsocialdistancingcanbemaintained.Thisprohibitionincludesplannedandspontaneousgatherings,publicandprivategatherings,andindoorandoutdoorgatherings.Examplesofprohibitedgatheringsinclude,butarenotlimitedto,social,civic,community,faith-based,orleisureevents,sportingorathleticevents,performances,concerts,conventions,fundraisers,parades,fairs,andfestivalsthatbringtogethermorethan10peoplefrommorethanonehousehold.ProhibitedgatheringsdonotincludecommercialactivitybyworkersandcustomersofCriticalandNon-CriticalBusinesses.
i. Legislative and other governmental meetings. ThelimitsongatheringsinthisExecutiveOrderdonotapplytolegislativeandothergovernmentalmeetings. Remotemeetingsarestronglyencouragedwheneverpossibleaspermittedbystateorlocalauthority.
ii. The Judicial Branch.ThelimitsongatheringsinthisExecutiveOrderdonotapplytoproceedingsheldbytheMinnesotaJudicialBranch.ProceedingsheldbytheJudicialBrancharesubjecttothepoliciesestablishedbythechiefjusticeandwilloccurasdirectedbycourtorder.IndividualsmayappearasdirectedbyaMinnesotastatecourt,includingtoserveasajuror,appearasaparty,asawitness,oraslegalcounselonbehalfofaparty,orotherwisetocomplyasdirectedbyacourtorder,subpoena,orsummons.
iii. Federal activities.NothinginthisExecutiveOrderwillbeconstruedtolimit,prohibit,orrestrictinanywaytheoperationsofthefederalgovernmentorthemovementoffederalofficialsinMinnesotawhileactingintheirofficialcapacity,includingfederaljudicial,legislative,andexecutivestaffandpersonnel.
iv. Drive-in gatherings.Toenablesafecongregationofmorethan10people,drive-ingatheringsarepermitted,providedthatallparticipantsremainwithintheirownvehiclesandfollowtheapplicableguidanceavailableatDEED’swebsite (https://mn.gov/deed/guidance).
v. Weddings, Funerals, and Services.Placesofworship,funeralhomes,andothervenuesthatoffergatheringspaceforweddings,funerals,orplannedservicessuchasworship,rituals,prayermeetings,orscripturestudies,mayhostsuchweddings,funerals,orserviceswithover10people,providedthattheyadheretothefollowingrequirements:
A. Inallsettings,ensureaminimumof6feetofphysicaldistancingbetweenhouseholds.

ii. Activitieswithintheboundariesoffederallandheldintrustforoneofthe11MinnesotaTribalNationsareexemptfromtherestrictionsinthisExecutiveOrderbutmaybesubjecttorestrictionsbytribalauthorities.
iii. Activitiesbytribalmemberstoexercisetheirfederaltreatyrightswithintheboundariesoftheirtreatyterritory(alsoknownas“cededterritory”)areexemptfromtherestrictionsinthisExecutiveOrderbutmaybesubjecttorestrictionsbyapplicabletribalauthorities.
iv. Tribalmembersmaytraveltoandfromtheirtribalreservationsinaccordancewithapplicabletriballaw.
7. Workers and businesses. Workersandbusinessesaresubjecttotherequirementssetforthbelow.Theserequirementsmaybeclarified,asdeemednecessarybytheGovernor,toensurethehealth,safety,andsecurityofallMinnesotans.ClarificationswillbeavailableforpublicreviewattheState’sCOVID-19website (https://mn.gov/covid19/).
a. Continue to work from home whenever possible.Anyworkerwhocanworkfromhomemustdoso.
b. Safe work.ExecutiveOrder20-54(ProtectingWorkersfromUnsafeWorkingConditionsandRetaliation)remainsinfullforceandeffect.AllworkmustbeconductedinamannerthatadherestoMinnesotaOSHAStandardsandMDHandCDCGuidelines,includingsocialdistancingandhygienepractices.Underexistinglawandauthority,DLImayissuecitations,civilpenalties,orclosureorderstoplacesofemploymentwithunsafeorunhealthyconditions,andDLImaypenalizebusinessesthatretaliateagainstemployeeswhoraisesafetyandhealthconcerns.
c. Extension of temporary closure of bars, restaurants, and other Places of Public Accommodation.PlacesofPublicAccommodationaresubjecttothefollowingrestrictions:
i. ThefollowingPlacesofPublicAccommodationareclosedtoingress,egress,use,andoccupancybymembersofthepublic,exceptasspecifiedinthisExecutiveOrder:
A. Restaurants,foodcourts,cafes,coffeehouses,andotherPlacesofPublicAccommodationofferingfoodorbeverageforon-premisesconsumption,excludinginstitutionalorin-housefoodcafeteriasthatserveresidents,employees,andclientsofbusinesses,childcarefacilities,hospitals,andlong-termcarefacilities.
B. Bars,taverns,brewpubs,breweries,microbreweries,distilleries,wineries,tastingrooms,clubs,andotherPlacesofPublicAccommodationofferingalcoholicbeveragesforon-premisesconsumption.
C. Hookahbars,cigarbars,andvapingloungesofferingtheirproductsforonpremisesconsumption.
D. Theaters,cinemas,indoorandoutdoorperformancevenues,andmuseums.
F. Amusementparks,arcades,bingohalls,bowlingalleys,indoorclimbingfacilities,skatingrinks,trampolineparks,andothersimilarrecreationalorentertainmentfacilities.
G. Countryclubs,golfclubs,boatingoryachtclubs,sportsorathleticclubs,anddiningclubs.
H. “EstablishmentsProvidingPersonalCareServices,”includingtanningestablishments,bodyartestablishments,tattooparlors,piercingparlors,businessesofferingmassagetherapyorsimilarbodywork,spas,salons,nailsalons,cosmetologysalons,estheticiansalons,advancedpracticeestheticiansalons,eyelashsalons,andbarbershops.Thisincludes,butisnotlimitedto,allsalonsandshopslicensedbytheMinnesotaBoardofCosmetologistExaminersandtheMinnesotaBoardofBarberExaminers.
ii. TherestrictionsimposedbythisExecutiveOrderdonotapplytoanyofthefollowing:
A. PlacesofPublicAccommodationthatofferfoodandbeveragenotforon-premisesconsumption,includinggrocerystores,markets,conveniencestores,pharmacies,drugstores,andfoodpantries,otherthanthoseportionsoftheplaceofpublicaccommodationsubjecttotherequirementsofparagraph7.c.i.
B. Healthcarefacilities,childcarefacilities,residentialcarefacilities,congregatecarefacilities,andjuvenilejusticefacilities.
C. Crisisshelters,soupkitchens,orsimilarinstitutions.
D. Restaurantsandfoodcourtsinsidethesecuredzonesofairports.
iii.
