But Valenzuela said the new complaint was filed Wednesday by 23 persons against 63 respondents.

The complainants sought the help of the Philippine National Police Criminal

According to Valenzuela, all the three complainants are PNP personnel with the rank of SPO1 to SPO4. Parang mga investors, on top of the 11 that had already been endorsed to the panel for preliminary investigation.

Abandoned NPA rebel dispensary

discoveredTROOPERS from the Philippine Army’s 3rd Special Forces Battalion discovered an abandoned New People’s Army (NPA) dispensary/camp capable of housing 50 rebel fighters during patrol operations in the forested area of Kitcharao, Agusan del Norte early this week.

Recovered from the rebel base were empty bottles of dextrose and other medical items believed to be used by the NPAs in treating their comrades wounded in battle with government forces.

Lt. Col. Potenciano C. Camba, 3rd Special Forces Bat-talion commander, said the discovery of the abandoned rebel base highlights the military’s success in making the area untenable for the communist guerrillas.

The Army has been conducting regular security pa-trols in the Kitcharao area to prevent rebel groups from attacking civilian settlements.

TACURONG City - “I am proud that I have come from Tacurong. This is where I was able to establish my strongest foundations,” said inventor Elma Arboleras.

In 2011, Ms. Arboleras and co-inventor Rodel de Guzman, won the gold medal in the 11th British Invention Show with their invention, called iBus or the Intelligent BUS Utility System, a bus monitoring and manage-ment system that can make the buses load and unload passengers at designated areas only.

“When you see a problem, you should see it as the best opportunity to improve,” Ms. Arbolera said in her inspirational talk during the LGU’s flag raising ceremony on November 19, 2012.

She confessed that she had long been invited by the city officials to come home.

“I regret not being able to come earlier, but I believe that everything has its own time. This is the best time that God has given,” she said.

The crowd of employees

cheered on as Ms. Arbolera pointed out Tacurong’s world class asset:

“We may not have a ma-jestic volcano like Mayon in Albay, or the wings of the Philippine Eagle in Davao, but we have something that we can take anywhere we go. That is, our strong-willed spirit as a people.”

“We have to continue showcasing ourselves and bring glory to our hometown and to God,” she added even

as she stated that Tacurong is made for greatness, just like the Tacurongnons.

Ms. Arbolera congratu-lated the city government for the vast development evident in the city.

The city government then gave her a Plaque of Recog-nition, as a way of thanking her for bringing honors to the city and for encouraging her fellow Tacurongnons to engage in various un-dertakings, like the Project

Pagsulong, a million-peso challenge for young Filipinos to come up with innovative business ideas toward poverty alleviation.

“What is great about her is that she never forgets to look back and inspire the people in her hometown. We are pleased to know that Tacurong has yielded yet another humble and empow-ered individual to the world,” said Mayor Lina O. Montilla. (Tacurong website/asf)

TAGUM CITY, -- Floods af-fected a total of 745 families when an inter-tropical con-vergence zone last Novem-ber 20 (Tuesday) brought heavy rains to the provinces of Davao del Norte, Com-postela Valley and Davao Oriental. Reports from Office of Civil Defense (OCD) XI Regional Director Liza R. Mazo said these families were resi-dents of 32 barangays in nine towns of the three flood-affected Davao Region provinces. Davao Oriental was hardly hit as two persons drowned with one still missing as of this writing. Casualties were identified as Nicholas Rota, 11-year-old resident of Barangay Poblacion in San Isidro and Romeo Luis, 55-year-old resident of Barangay Kaba-gayan, Tarragona. Missing was Dindo Ugapang, 15 years of age and resident of Barangay Bitaogan in San Isidro, also in Davao Oriental. In Compostela Valley, a total of 428 families were affected in nine barangays of the

Uy , at the height of raining yesterday, issued a memorandum sus-pending classes at all levels and stopping mining activi-ties in the entire province of Compostela Valley. Incident Command System (ICS) in affected towns were then activated and the Compostela Valley Emer-gency Rescue Team (CO-VERT) was then deployed to flooded areas to assist MDRRMC operation. In Davao Del Norte, a total of 17 families experienced flooding yesterday in 11 ba-rangays in the municipalities of Kapalong and Asuncion when Saug and Liboganon Rivers overflowed. At the surge of flood waters in both rivers yesterday afternoon, the Provincial Disaster Risk Reduction Management Office (PDRR-MO) advised preemptive evacuation to keep residents along the river banks safe. Pigkawayan launches UBAS Project

NORTH Cotabato – The municipality of Pigcawayan has launched the Adopt Ugnayan Ng Barangay At Simbahan (UBAS) Project, with 243 LGU officials, punong barangays, church leaders, representatives from civil society organi-zations, people’s organi-zations and national line agencies of government in attendance.

The event was held at the Municipal Rooftop, Novem-ber 6, led by the municipal mayor, where the crowd manifested their interest in the project that is primar-ily aimed to promote good governance in the locality.

During the occasion, the UBAS rationale, objectives and organizational structure were explained by personnel of the Department of the Interior and Local Govern-ment (DILG), municipal officials and church rep-resentatives.

Also discussed were the ethics in politics, seal of good governance and ways in bridging the government and the church.

Questions raised by par-ticipants during the open forum were on ‘why can’t the LGU allocate funds for the projects of a particular church’; ‘will UBAS be in conflict with the Moral Re-covery Program of the gov-

ernment’; ‘how will UBAS be started or implemented’; and ‘what are the roles of the church in the collaboration’.

Such concerns were suc-cessfully and satisfactorily responded to by the panel-ists.

The participating sectors have all committed to sup-port the project by signing the Memorandum of the Agreement, while some barangay officials signified interest in implementing the project in their respective areas. (web/asf)

THINK a minute. It’s said that we human

beings are the only crea-tures who refuse to be what we are.

One writer put it: “When people are free to do as they want, they usually copy each other.”

Yet every successful per-son becomes successful because he or she discovered and developed their own special abilities.

As one guy said: “One of the hardest things about climbing the ladder of suc-cess is getting through the crowd of copies at the bot-tom.”

You are a specialist. You’re not made to be all things to all people.

Surveys have shown that usually about 20 percent of all the people who know

Be an original

you don’t really like you that much. You just can’t please all the people all the time!

So don’t try to have peace at all costs—espe-cially at the cost of your own success.

“Don’t stay where you’re tolerated; go where you’re celebrated!” Be yourself. Be an original! You really are one-of-a-kind. You’re the first and last person who will ever be exactly like you.

You know that over 90 percent of all flowers have no odor at all. It’s the ones with a sweet fragrance that we remember.

So don’t be afraid to be different, if it means being yourself. We’re like rivers, “If we follow the easy path of least resistance, it will make us crooked.”

So don’t follow where the path may lead; go where there is no path and leave your own trail. “You’re

born an original;don’t die a copy!”

Remember, nobody can be you as well as you can. Too many people are like the living dead: they’ve buried their real talents and abilities.

Jesus Christ can show you all of your unique tal-ents and strengths, as well as help you to develop and maximize them.

He loves you the way you are, but He loves you too much to leave you that way. But first you have to ask Him to forgive and free you from your past wrongs. Then everyday you must choose to live and do things His way. Only Jesus can give you the inner security and confidence to become the true original you are.

Just Think a Minute.

Double standard in party list accreditation?

DEVELOPMENT, progress, and economic alleviation are the major thrusts of government of any country. The Philippine government shares these visions of future economic stability and steady growth toward the next 50 years.

However, in a country with an annual economic growth of 3 percent and an annual population growth of 2.3 per cent, the Philippines hope of becoming an economic tiger would only be in a drawing board in the next five decades.

Surprising it seems. The Philippines had not moved forward since 1970’s when it was ahead of Thailand. In the 1960s, the Philippines were second to Japan. In the year 2000, the Philippines were Number One – in corruption and at the bottom in terms of socio-political and economic development among Asian neighbors.

What could have been wrong? Many analysts, fore-most the Wallace Group of Consultants blamed, among others, politics and uncontrolled population growth as the principal reason of the country’s stagnation. In ad-

Politics is the heart of the country’s stagnation

dition, Hegel said that religion is an opium. Can anyone remember the Malthusian Theory where

‘population increases geometrically while the economy grows arithmetically? Malthus theory applies to the Phil-ippines. With a current population of over 90 million people and with a sluggish economic growth, hunger and deprivation are not far behind. Any attempt to curtail population growth, like the RH Bill 5043, would meet stiff resistance from the religious sector. For instance, the Roman Catholic Church would mount protests and warn candidates supportive of its passage of religious condemnation. Was Hegel right when he said that ‘re-ligion is an opium?’

Improving the economy is crucial to those who run the affair of the government. However, pushing the economy forward is always dictated with ‘political’ greedi-ness. One does not have to look any further to paint a clear picture of the ugliness of Philippines politics. In Cagayan de Oro City, politicians are up on maligning an incumbent administration. These politicians are even using the courts. They exercise influence peddling at the national level to buy sympathy at the expense of the local populace. Indeed, politics is the heart of the country’s sufferings. React: [email protected]

AKBAYAN’S NOMI-NEES NOT POOR AND MARGINALIZED: Assum-ing the Commission on Elections was correct in saying that the Akbayan Party List has a long “history of struggle” (whatever this means), the fact remains that its incumbent congressmen at the House of Representa-tives really do not belong to the poor and marginalized groups of this country.

If we are to look at the decisions of the poll body which disqualified many other party list groups in recent days, we will see that these groups were barred from participating in the 2013 elections on two grounds---that they did not have a track record

as a party list organization in uplifting the sectors they claim to represent, and that their nominees do not come from the poor and the mar-ginalized.

-ooo-DOUBLE STANDARD

IN PARTY LIST ACCREDI-TATION? In the case of Akbayan, assuming that its “history of struggle” could be considered as a track record (even if this is also highly debatable, as its supposed struggle is mainly along the political front and is therefore not directed at any particular marginalized

sector), the Comelec should have still disqualified it because its nominees no longer come from the poor and the marginalized, as was its decision in the other party list groups.

The Comelec should have applied to Akbayan the standards it applied to the other groups which it disqualified. Indeed, what is sauce for the goose should be sauce for the gander. In allowing Akbayan to run as a party list organization in 2013, even if its nominees are not poor and marginal-ized, the Comelec commit-

ted a clear double standard of justice---one standard for Akbayan, and one for all the rest. This is abuse of discretion, amounting to lack or excess of jurisdiction.

-ooo-PARANAQUE LAND

ROW: ACCEPT OFFER OF COMPROMISE: US-based Filipino lawyer Leo Beligan sent in this question which a friend of his from Paranaque City emailed to him: What are the rights of a person who was made a caretaker of a parcel of land in Paranaque sixty years ago yet, now that the heirs of the owner of the land want to use the land for themselves? The caretaker, now 80 years old, was not paid a single centavo for guarding the land, although he is now being offered P600,000.00 just to move out.

GOVERNMENT health workers have been consis-tently sounding the alarm, especially these past few weeks, regarding the Aquino government’s plans to priva-tize the provision of health services. They have been holding lunch break pickets in various government hos-pitals, specifically in those that would be affected in the near future such as the Na-tional Orthopedic Hospital, which will be transformed into the Center for Bone Diseases and Trauma. But the mainstream media has not been reporting about it and public concern about this life and death issue is still wanting.

The Aquino government, through Health Sec. Enrique Ona, has been denying this. Their packaging is that the government is just mobi-lizing resources from the private sector to invest in health services through public -private partnership schemes (PPP), with the government still retain-ing control through the Board of Directors. Just recently, Bayan Muna Rep. Teddy Casiño revealed that the Aquino government intends to do away with charity wards and replace it with PhilHealth wards. This was again denied by

the government. If we analyze all gov-

ernment pronouncements regarding the health sector, its plans would be clear. It intends to make govern-ment hospitals, especially the specialty ones such as the National Orthopedic Center and the San Lazaro Hospital, attractive to in-vestors by allocating some budget for the improvement of its facilities while asking corporations to also do so.

Corporations, under a deal with the government, would run these hospitals with the government re-taining some seats in the Board. This is no different from what the Episcopal Church did with the St. Luke’s Medical Center, and look at where it is now. It was turned into a world-class hospital with its hotel-like appearance and modern medical facilities. But it is no longer affordable for the poor majority.

Also, government health workers are reminding us of what happened to cor-poratized specialty hospi-tals such as the Philippine Heart Center, the National Kidney Transplant Institute and the Lung Center of the Philippines. The Philippine Heart Center

Speaking in mix dia-lects during an interview, Absali explained that way back in 1972 the fish were in abundance in their tra-ditional fishing grounds. At present, both the fish and the coral reefs are gone. Absali said, he now has better understanding of “things and why”.

Another Badjau lead-er, Mengpi Salbarati, de-scribed how difficult it is to support a family of 6 with the dwindling fish catch coupled with the presence of pirates in the open sea that constricted their fishing activities.

“orientation on coastal resource management and fishery laws” conducted at Claret Formation Center in Zamboanga City, from November 18-20, 2012. Other participants came from Siasi, Sulu; f rom Bongao, Tawi-tawi, and from Zamboanga City.

The activity was a joint endeavor of the Claret

Samal Foundation, Inc. (CSFI), and the Regional Fisheries Training Center (RFTC).

RFTC is the t rain-ing arm of the Bureau of Fisheries and Aquatic Resources (BFAR-9).

RFTC training officer Abubakar A. Abdullah was resource speaker on coastal resource manage-

ment. He also lectured on fishery laws and other pertinent laws related to fishing.

A n o t h e r r e s o u r c e speaker, Jaafar Kimpa, president of Jabu-Jabu, lectured on proper utili-zation and conservation of fishery resources.

In his message to the participants during its

closing ceremonies, RFTC Director Pendatun I. Talib underscored the importance of education and attending seminars and trainings – for the empowerment of every individual and the community as a whole.

As he identified govern-ment fishery programs, he expressed optimism that organized Badjau fisher-folks can avail of some of these livelihood assistance, particularly in seaweeds production.

He said that Agriculture Sec. Proceso Alcala recently announced that the budget allotment for the seaweed industry next year will be around P265 million, or six times bigger than that of the current year.

The conduct of this orientation-seminar is an off-shoot of the annual Sama-Badjau national as-sembly conducted last April this year h in Zamboanga. (JPA/FDM/ PIA9-ZBST)

PNP Chief Direc-tor General Nicanor A Bartolome said the 2012 yearend bonus consists of the remaining half of the policemen’s 13th month pay and other cash benefits mandated by law.

The first tranch of this year’s 13th month was re-leased by the PNP last May.

Police Director Roque Ramirez, PNP Director for Comptrollership (TDC) said continuous form checks drawn from the PNP account with the Land Bank of the Philippines have been released by the PNP Finance Service to the different Police Re-gional Offices and National Support Units thru the Regional Finance Service Offices (RFSO) nationwide for subsequent issuance and distribution to indi-vidual personnel in lower units and offices.

The Department of Budget and Management earlier approved a P1.932-billion allotment to pay for the year-end bonus of PNP personnel. As a disciplinary policy, the release of the 13th month pay to PNP personnel with pending administrative and criminal cases is deferred. -

TAGUM City––As a show of concern, once again the City Government here has included Purok leaders in the list of peacekeep-ers who will receive ad-dit ional year-end cash bonuses this December.

This wil l come true

Purok leaders to get cash bonus this X’masafter the City Counci l passed and approved the resolution increasing the city’s year-end cash sub-sidy in a regular session recently.

C i t y C ou nc i l or D e Carlo “Oyo” Uy said the measure provides an ad-dit ional P1,000 as in-centive for outstanding Purok leaders under the

Tagum City Peacekeepers Organization (Tacipecor).

From the usual P2,000 year-end bonus as stipu-lated in City Ordinance No. 50 of 2002, Uy said the city’s peacekeepers will now receive P3,000 this year

The cash bonus will motivate peacekeepers to actively support and

cooperate in any peace-keeping activity in the city, the councilor added.

Uy said City Hall will release the cash subsidy for barangay peacekeepers not later than December 15.

Other city hall employ-ees are also expecting for an additional year-end bonus.

KIDAPAWAN City––A New Zealand national, nabbed last October in Davao City for trafficking and child abuse but was later given temporary liberty due to technical-ity, was rearrested on Thursday, a police official said.

City police director, Supt. Renante Cabico, said that David William Wakefield, 50, was apprehended after the Regional Trial Court (RTC) in Davao City issued a warrant for his arrest.

“I am pleased that the court has found probable cause to place Wakefield in prison,” said Cabico.

He, however, did not cite details on how the foreigner was arrested.

Wakefield was charged with violations of the Anti-Trafficking in Persons Act of 2003, the Anti-Child Abuse Act, and statutory rape, police records show.

Last October 25, Wakefield was arrested in his hotel room in Davao City.

The police brought the complainants, both girls aged 11 and 13, in Wakefield’s room to check if he was the person they alleged to have committed sexual molesta-tions against them.

A week later, however, the Kiwi was given temporary liberty due to some technicality.

Early November, a meeting between Kiwi’s lawyer and the victims with their family and guardians took place in Kidapawan City facilitated by Mayor Rodolfo Gantuangco. philippine news agency

THE Department of Justice has created a fact-finding panel to investigate the reported new anomaly involv-ing former officials of the Philippine Amusement and Gaming Corporation.

It was earlier reported that Rodolfo Soriano, a former consultant of PAGCOR and known to be close to former PAGCOR Chairman Efraim Genuino, allegedly got US$ 5-million from a Hong Kong affiliate company controlled by an investor of PAGCOR in its project, Entertainment City in May 2010.

In a two-page Dept. Order signed by DOJ Secretary Leila De Lima, designated as members of the panel are Atty. Marlon Tauli of the NBI Anti-Graft Division; Atty. Catherine Camposano, Executive Officer of the Internal Audit Unit of the NBI; and Senior Assistant State Pros-ecutor Rosalina Aquino from the National Prosecution Service. De Lima directed them to particularly focus on the alleged series of questionable payments made by Aruza USA to the former officials, employees and consultant of PAGCOR.

De Lima gave the panel 30 days within which to submit its findings and recommendation, including the appropriate criminal or administrative cases that may be filed against those who may have been involved in the said transaction. pna

THE independent Fact-Finding Committee tasked by DENR Regional Execu-tive Director Ruth M. Tawa-ntawan for Region 10 to look into the robbery at the Environmental Management Bureau (EMB) 10 disclosed the loss of computer acces-sories on November 9.

The Fact-Finding Com-mittee composed of DENR 10 personnel reported to Director Tawantawan that the lost items include three (3) pieces flat computer monitors, three (3) pieces keyboards, three (3) pieces computer mouse, computer camera, and two (2) pieces Automatic Voltage Regula-tor (AVR).

The report of the Fact-Finding Committee further

DENR-10 bares result of fact finding teamdisclosed that the wirings attached to the Central Pro-cessing Unit (CPU) were not taken by the robbers.

The committee is chaired by General Services Sec-tion (GSS) chief Susana Talampas with Budget Sec-tion chief Myrna Kawaling, Legal Division staff Francis Palle and Raul Zapatos, Property Custodian of GSS, as members.

It was reported that the stolen items were acquired in October 2011.The fact-finding committee has not determined the estimated cost of the lost items since these are not indicated in the property/IT Ledger Card.

The report further in-dicated that the thief may have entered the EMB office

through the glass windows at the ladies rest room which is usually left open to allow the smell of room to escape.

Ocular inspection con-ducted by the committee revealed that the Office of Regional Director Sabdullah Abubacar was also entered into as evidenced by two (2) broken plaques on the floor. It was believed that the thief attempted to de-tach the LCD-TV attached to the wall.

The team recommended the augmentation of the number of roving security guards and provision of lightings at the back of the EMB building or at the perimeter fence around the whole DENR 10 compound.

Power...from page 1

Mindanao’s power defi-ciency climbed to 500 MW which caused 6 to 8 hours power interruptions in many urban areas in the island.

And with the forecasted El Niño phenomenon to once again hit the region early next year, renewable energy proponents and ad-vocates are urging the DoE to give equal priority to the construction of renewable power plants initiated even before the enactment of the Renewable Energy Law or RA 9513 to help mitigate the impact of the power crisis in the island.

“The El Niño phenome-non is not new to Mindanao as it happened in mid-70s, early 80s and 90s,” said Greenergy Development, Inc. (GREENERGY) Presi-dent Cerael C. Donggay.

Donggay, former Na-tional Power Corporation (NPC) vice president for Mindanao, claimed that “the 2010 power crisis was not brought about by non-usefulness of hydropower plants but by the rising of power demand that ex-ceeded total aggregate sup-ply capacity. In fact, NPC and TRANSCO as early as 2004 already forecasted that power crisis would erupt in 4 to 6 years if no addi-tional plant capacity would be developed. It happened actually in 2010.”

GREENERGY and the First Bukidnon Electric Cooperative (FIBECO) have initiated the 300 MW Pu-langi 5 Hydro Power Proj-ect. They have acquired 100 percent favourable endorsements from the 22 affected barangays as well as endorsements from four (4) Sangguniang Bayan of Kitaotao, Dangcagan, and Damulog of Bukidnon prov-ince, and

President Roxas town of North Cotabato province.

There is also the 132 MW Bulanog-Batang Hydro Power Project (BBHP) ini-tiated by

Donggay’s GREENERGY in 2005 with the cooperation of NORMECA (Northern Mindanao Electric Coop-erative Association). DoE already issued clearance in 2005 for this project to proceed in preparing for development.

These two initiatives, both in Bukidnon province, are “moves to localize and make independent Mind-anao’s generation of power,” he said.

Both these renewable hydro power projects “re-main hanging” because DoE insists on subjecting them to public bidding, lamented Donggay.

“Today, seven years after the Bulanog-Batang and four years after the Pulangi 5 project initiatives, DoE made the pronouncement that the granting of service contract is based on the guidelines of the RE Law (RA 9513), which took effect merely three years earlier, in 2009. With this comes the unnecessary require-

ment for Bulanog-Batang, Pulangi 5, and even the Agus 3 project, to be subjected to public bidding,” he said.

Donggay questioned DoE’s logic and prudence in “making laws retroactive to apply to even partly-completed renewable energy development initiatives, launched even before the enactment of RA 9513.”

He cited the Electric Power Industry Reform Act (EPIRA) vis-à-vis the DoE’s insistence on subjecting the projects to public bidding. The EPIRA stipulates only the conduct of bidding for the privatization and dis-posal of NPC-owned power plants and facilities that are operational.

“Nowhere in the EPIRA states that potential hydro sites shall be subject to public bidding,” he stressed.

As Mindanao operations vice president of the NPC, Donggay cited the EPIRA, enacted in 2001, in initiat-ing the release in 2005 of the feasibility studies for both the 132 MW Bulanog-Batang Hydro Power Plant and Pulangi 5.

He said that DoE’s in-sistence of subjecting these urgent projects to public bidding only delays ur-gent measures to address Mindanao’s power woes. Worst, DoE’s “politicking is delaying the much-needed construction of clean energy hydro power plants for the island’s energy woes.”

“The urgency to develop large hydro resources to help and maintain the competi-tive advantage of Mindanao has been undermined when projects which have already acquired some, if not all permits from the Nation-al Water Resource Board (NWRB), the Department of Environment and Natural Resources (DENR), and the National Commission on Indigenous Peoples (NCIP) are subjected to more delay,” he said.

“These recent develop-ments do not coincide with the government’s program to promote active participation by the private sector for the development of renewable and indigenous sources of energy,” he added. (Bong D. Fabe)

some 200 hectares of open areas of the watershed , permanently declared as watershed forest reserve by Presidential Proclama-tion 282.

He said the 75th IB sol-diers did not only commit to just plant more trees in other denuded open ar-eas but vowed to serve as forest rangers to protect the planted hardwood Ma-hogany species from illegal timber poachers.

The SFWD has been in the forefront of totally re-greening the remaining open areas of the watershed since they began their reforesta-tion project in 1997 aimed at rehabilitating initially some 928 hectares of denuded and open grasslands.

Board (ERB) to the two cities and 116 municipalities of ARMM relative to the November 26-30, 2012 ERB meeting, attached herewith is the number of EOs to be sourced out from non-ARMM Regions as well as the proposed budgetary re-quirements.”

They lamented the “lack of sufficient bases” made known to the incumbent EOs to replace them as they cited a provision on Repub-lic Act 8189, or the Voters’ Registration Act, that only the Members of the Election Registration Board related to “any incumbent or municipal elective official within the fourth civil degree of con-sanguinity or affinity” may be automatically disqualified from the ERB.

“Not all the election of-ficers of this province are operating under the aforesaid prohibition. Those affected which are very minimal are acted (on) or being acted (on) by the provincial elec-tion supervisor,” they said.

The buffer zone of the watershed, however, is still threatened by unabated small-scale mining activities even there have been con-certed efforts by concerned multi-sectoral groups which heightened last year when they staged an all-out indig-nation rally to put an end to these hazardous small-scale mining activities.

Luzon said small-scale mining numbering to be about 53 operations in Si-tio Sumogbong in Barangay Alegria and the more brazen activities in Barangay Mati continue to thrive despite the campaign.

He blamed local officials for not doing concrete ef-forts by passing a munici-pal ordinance to delineate and declare the proposed 900-meter buffer zone and offer livelihood activities to the small-scale miners and gold panners.

“Small-scale mining which remain unabated is now the main threat to preserve the Magdiwata watershed yet the local government remain adamant to make the right move,” Luzon said.

If the buffer zone should have been put into a local law, mining and sand and gravel quarrying should have been strictly restricted and prevent inevitable encroachment of the watershed.

Reports has it that illegal mining activities continue to thrive because the small miners were beholden and lured by the prospects of having foreign financers said to be Chinese businessmen and a Briton.

The foreigners involve-ment in these illegal activities remain a question as local officials never checked if they really are allowed to engage in business here.

Double...from page 6

Philippines says that a contract between two per-sons need not be in writing. A contract can be verbal.

In this case, it is clear that there is a contract of services between the landowner and the care-taker which subsists, even if the landowner died in the meantime. This kind of a contract assumes that the caretaker will be com-pensated for his efforts---and his staying in the land free of rent is part of that compensation.

My advice is that, the caretaker should already accept the P600,000.00 being offered by the heirs of the landowner. He may of course insist on a higher amount---like the P2 mil-lion he is demanding to be paid---but then, a dis-agreement on this issue could lead to the filing of a case to oust him from the premises, which, in turn, could lead to his ouster without being paid a single centavo.

-ooo-CONGRATS, JUSTICE

MARVIC: I am in full ac-cord with the appointment of Marvic Leonen as the 172nd associate justice of the Supreme Court. He fully deserves this new position, after his stints as law dean of the UP College of Law, and as chief nego-tiator of the government peace panel that brokered the new peace agreement with the Moro Islamic Liberation Front (MILF). I am sure the Filipino na-tion will benefit from his expertise and background as a public official, young as he maybe at 49. Con-gratulations.

-ooo-NTC: GOOD NEWS

THAT IS NOT REALLY GOOD: Just how will the National Telecommunica-tions Commission (NTC) compel the telephone com-panies operating cellular phone services to make refunds for overcharged text messages is a mys-tery. I mean, how will the NTC and the telcos now determine who are to be refunded and how much are they to be refunded? This is a piece of good news that is not really good be-cause of the impossibility of carrying it out.

(PHC) and the National Kidney and Transplant Institute (NKTI) charge as much as P415 ($9.65) to P430 ($10.23) for a chest x-ray while currently, the Jose Reyes Medical Cen-ter and the Rizal Medical Center, both of which are among the 26 hospitals being targeted for corpora-tization, charge only P290 ($6.90) to P310 ($7.38). For an ultrasound pro-cedure, the Heart Cen-ter and Kidney Institute charge P1,650 ($39.28) and P1,800 ($42.85) respec-tively, while it costs only P750 ($17.85) at the Jose

Reyes Medical Center. And these hospitals have not yet been opened up to a lot of private investors, but these have been corporatized, in the sense that their Board of Directors were given more powers such as in deciding to increase rates and were tasked with raising a sub-stantial amount for their operational expenses.

The rates of these corpo-ratized specialty hospitals would certainly increase more with the entry of pri-vate investors. After all, corporations who would be willing to invest in erstwhile government hospitals are there to earn profits and not provide charity.

What about the poor? Will charity wards have a place in corporatized and privatized government hos-pitals? Certainly not. This is the second part of the Aquino government’s design for the health sector.

This is why there is truth in what Bayan Muna Rep. Teddy Casiño said that even-tually charity wards would be removed. It would be replaced by wards catering to PhilHealth card holders.

When the previous Ar-royo administration began distributing PhilHealth cards in 2004, of course, it was part of its electoral campaign. However, it also served a long-term purpose: to replace the free provi-sion of government health services with PhilHealth coverage. Notice that during the 2010 elections, the cam-paign promise of Benigno Aquino III was “health for all”, but immediately after, during his inaugural speech, this was changed to “Phil-Health for all.” The plan is that in a privatized health system, certain segments of the poor, perhaps the same Conditional Cash Transfer beneficiaries, will be pro-vided with subsidized health services through the Phil-Health. All the rest would have to fend for themselves.

The problem with the government’s thrust of re-placing the provision of free government health services with universal PhilHealth coverage is: first. not all medical services and ex-penses are covered by Phil-Health; second, how could those belonging to the poor majority, but would not be chosen as beneficiaries of free PhilHealth coverage afford the monthly premi-ums? Even the premium of PhilHealth would certainly increase because surely, it would also be subjected to corporatization.

It appears that the Aqui-no government is patterning the country’s health system to that of the US. In the US, there are no more govern-ment hospitals. To be able to afford health services, US citizens need to be covered by private health insurance, by Medicaid, which is jointly funded by the federal gov-ernment and the state, or by Medicare, which is being funded solely by the federal government. Medicaid does not cover all poor citizens but certain categories of

eligible groups, including children, pregnant women, parents of eligible children, people with disabilities and elderly needing nursing home care. Medicare, on the other hand, covers people with ages 65 or older, people under age 65 with certain disabilities, and people of all ages with end stage renal disease. Thus, if one does not fall within the coverage of Medicaid or Medicare, is unemployed – and therefore, not covered by company-sponsored health insurance – and could not afford the premiums of private health insurance, he or she would not be able to avail of health services.

There are two things that are fundamentally wrong in the US health care system, which the Aquino govern-ment would like to emulate: it is being controlled by the private sector – corporate hospitals and health in-surance companies – and therefore, geared toward profits; and it is not acces-sible to the poor majority.

Is this what we want to happen to the country? If we let this happen, then more and more Filipinos would die of preventable and cur-able diseases, without ever being able to see a doctor. (http://bulatlat.com)

Other recommendations of the team include the regu-lar monitoring of the per-formance of security guards on duty and installation of barbed wire fencing on top of the concrete fence to dissuade would-be-thieves.

Determining the actual cost of lost items for proper recording in the Inventory Report of Plant, Property and Equipment as basis for dropping in the Book of Accounts was also recom-mended by the team.

It was gathered that the police is still conducting further investigation on the said incident.

“Based on our latest count, there are more than 300 people who were victim-ized by this group in T’boli alone,” Rejano said.

As for the elder Lilio, he said they were still evalu-ating his connection with the Aman Group “but he was possibly aware of its operations.”

“In fact, we found some of the documents in his room,” said Rejano, refer-ring to the pastor.

Rejano reiterated that all charges in connection with the case will be filed at the Department of Justice (DOJ) in Manila and not at the Provincial Prosecutor’s Office.

Several top officials of the Aman Group led by its fugitive founder Manuel Amalilio, who has report-edly fled to Malaysia, are presently facing charges of syndicated estafa based on the initial complaints filed some of their victims in Pagadian. pna

MDN: November 23, 2012

GENERAL Santos City––Around P888 million worth of investments were alleg-edly collected in the last several months by pyramid-ing investment firm Aman Futures Group Philippines Inc. through its agents based in nearby South Cotabato province.

Timmy Rejano, supervis-ing agent of the National Bureau of Investigation (NBI)–Region 12, said Thursday they uncovered the multimillion invest-ments following a search on Wednesday afternoon on a house in Barangay Poblacion in T’boli that supposedly served as the main base of the Aman Group in the area.

He said the house, which is owned by Pastor Rolando Lilio of the United Alliance Church, appeared to have operated as a branch of the Aman Group and with the pastor’s children Roda Lilio-Corpuz and Girlie Lilio-Paner acting as its agents.

“Based on the bank state-ments and other documents we recovered, the invest-

NBI-12 uncovers multimillion investment deals by Aman agents in South Cotabato

ment accounts handled by Roda and Girlie for the Aman Group reached P888 million,” the official told a local radio station.

Rejano said they con-ducted the search based on a warrant issued early Wednesday afternoon by Judge Roberto Ayco of the Regional Trial Court Branch 26 in Surallah town in South Cotabato.

Acting on orders from NBI-12 chief Lawyer An-gelito Magno, he said they applied for the search war-rant based on the complaints filed at their office in Ko-ronadal City last Monday by five victims of Aman Group’s Ponzi-type invest-ment scheme in T’boli town.

The official said the search, which was witnessed by barangay officials and T’boli municipal police station personnel, yielded “stunning” evidences that detailed direct connections and transactions between the Lilio children and fugi-tive Aman Group founder Manuel Amalilio.

He said the specifically found various acknowl-

edgement receipts, payment slips, bank deposit slips and transaction statements bearing the names of Roda Lilio-Corpuz, Girlie Lilio-Paner and the Aman Group.

The official said there were several summary cash transactions and deposits slips amounting to P200,000 that appeared to be collec-tions from local investors, who were lured into the pyr-amiding investment scheme with promised returns of as high as 52 percent.

“There were bank state-ments and deposit slips showing huge amounts of money transfers and depos-its to the personal accounts of Roda and Girlie. It shows that they personally gained from these transactions,” Rejano said.

They also found copies of speeches given by the Aman Group founder and correspondence detailing a supposed complaint filed by Roda Lilio-Corpuz and Girlie Lilio-Paner against Aman executive Fernando Luna for the latter’s alleged failed investments in real estate using the company’s

funds, he said.During the search, Re-

jano said only the elder Lilio was present at the house

and that Roda Lilio-Corpuz and Girlie Lilio-Paner had previously left T’boli along with their families.

“We received informa-tion that Girlie is now in Pagadian City while Roda is still in General Santos City,” he said.

Rejano said they will

immediately process the evidences against the two Aman Group agents for the filing of appropriate charges.

Aside from the initial five complainants, he said they are scheduled to meet with another group in T’boli town on Friday.
