Jim Mc Curley, CPA and Stephen Cole, CPA, from the Sacramento office of RGL Forensic Accounts, were the delightful guest Speakers for the Mid Valley Claims As-sociation February Luncheon.Their presentation on business loss claims was very interesting for the many business owners in attendance as well as the adjusters.“The definition of Business Income is ‘net income’ (net profit or loss before income taxes) that would have been earned or incurred, and continuing nor-
mal operating expenses incurred, including payroll,” Mc-Curley said. “We will pay for the actual loss of business Income you sustain due to the necessary suspension of your operations during the period of restoration.” The suspension must be caused by direct physical loss of or damage to property at premises which are described in the declarations and for which a Business income Limit of Insurance is shown in the Declarations.

Hello All, We had a terrific meeting last month. I would like thank Jim McCur-ley for his very informational presenta-tion on Demystifying Business Income Claims. With his vast knowledge of the industry it made for a great topic and interesting discussion leaving us with a better understanding of what to expect during the adjustment of a Business Income claim. Please be sure not to miss this month’s presentation as we welcome back attorney Mark Berry of Mayall Hurley Knutsen Smith and Green for our annual “Fair Claims Settlement Practices Act” Certification. It will be full of important and current information. We have finally confirmed a date…. please mark your calendar’s for July 10, 2015 as we celebrate “Rockin Around 18 Holes” at this years Mid-Valley Claims Associations 50th Annual Golf Tournament. You will not want to miss this tournament as we bring back those fabulous 50’s. We have an exciting event planned for all you golfers out there. Claims Settlement Practices Act” Regulations.
Mr. Berry has been gracious enough to offer up this presentation annually for the Mid-Valley Claims Association membership for more years now than anyone’s really sure of - at least eight or nine now, conservatively.Mark E. Berry is a shareholder in the Stockton-based firm of Mayall, Hurley, Knutsen, Smith & Green. Born in Sacramento, California, June 25,1962, Mr. Berry graduated from California State University at Sacramento with his Bachelor of Arts degree in 1985, following graduation from the Northern California Police Academy in 1984. He earned his Juris Doctorate from McGeorge School of Law, Uni-versity of the Pacific in 1991, and was admitted to was admitted to the California State Bar that same year.Mark was employed at the City of Berkeley Police Department from 1984 until 2001. He is a member of the San Joaquin County Bar As-sociation, having served as President in 2001. He is also a current member of The State Bar of California. Understanding your insured's business is crucial to coming up with an equitable assessment. He advised to be aware that dif-ferent types of businesses can have different type of impacts. There are Service, retail and manufacturing businesses.Retail business suffer differently according to the time of the year. Jim said " The Constant Dilemma is What should I ask for"? How much info do I need?How long is the restoration Period? Rule of thumb is if loss is days long, get weeks of data.
