Michigan’s troubled economy is oneveryone’s mind these days. And attorneysat the state’s top law firms are workinghard to diversify their practice areas in aneffort to combat the negative consequencesof Michigan’s bleak financial situation.

While firms are not necessarily cuttingany practice areas, they are certainlynoticing a shift in which fields are mostactive.

Naturally, Rex E. Schlaybaugh Jr.,chairman and CEO of 4th ranked Dykema,said the economy has caused a hike in certain areas, such as “restructuring,bankruptcy, mergers and acquisitions,and consolidations.”

Conversely, Schlaybaugh has noticed“flatter” movement over the last year in“business start-ups” and “aggressive cap-ital raising activities.”

Still, other firms are focusing on up-and-coming areas to offset the effects ofthe down-turning economy.

For instance, Douglas E. Wagner —managing partner of 6th ranked WarnerNorcross & Judd — said his firm was de-veloping “practice areas in new andemerging fields, such as life sciences andbiotechnology,” as well as in “conciergemedicine and entertainment law.”

Additionally, 44th ranked Strobl &Sharp’s Managing Partner Thomas J.Strobl said that though his firm has al-ways “cover[ed] all bases” as a “full-serv-ice business law firm,” his office does planto “fill in some areas … in the estate plan-ning and creditors’ rights areas.”

Other firms, like 32nd ranked Cum-mings, McClorey, Davis & Acho, are tak-ing a different approach and expandingtheir practices beyond the state line.

Cummings Managing Partner T. JosephSeward said his firm “established new of-fices and brought in new attorneys to estab-lish a presence in Arizona and California.”

However, he pointed out, “it [was] notjust the Michigan economy that forcedthis decision. We saw expansion outsidethe state [as] an important strategic movefor us in developing new business specifi-cally in our insurance defense practiceand for educational institutions.”

Still, other companies, like 5th rankedButzel Long and Dykema, are strength-ening their overseas businesses.

Philip J. Kessler — Butzel’s chairman— noted that his firm is continuing “toemphasize our capabilities in interna-

tional work in Asia … [and] in Mexicoand Europe,” while Schlaybaugh saidDykema was establishing a presence in“western Europe, China and India.”

But the ever-evolving practice areas areno cause for alarm, said Wagner.

“We are not dependent on a single in-dustry or client for work,” he explained.“Slowdown in one practice area is tradi-tionally offset by an increase in another.”

Jump in dollar signs Though the economy has caused firms

to consider broadening their businesshorizons, it hasn’t completely dampenedentry-level compensation or billing ratesat many of the largest firms.

Of the 13 firms that responded to the

salary question on this year’s survey, 11 reported starting salaries of $100,000or more.

And, of these firms, five have shown anincrease of at least $10,000 in the last year.

Moreover, 3rd ranked Honigman MillerSchwartz and Cohn and 48th ranked Rad-er, Fishman & Grauer, PLLC, both postednew hire salaries of $125,000.

However, Honigman’s compensationhas not changed since last year. And,much like last year, 37th ranked PepperHamilton is again the salary runner-upwith entry level salaries starting at$115,000.

Schlaybaugh said that, while theMichigan economy might be sagging,firms simply cannot afford to decreasepaychecks.

“We [are] seeing an upward pressure onstarting salaries for new lawyers,” he said.

Because his firm “competes nationallyat the best law schools for the best stu-dents,” Schlaybaugh explained that Dyke-ma has “to be competitive with [its] start-ing salaries to attract people.” And,“irrespective of the economy in southeast-ern Michigan,” he expects that his firmwill continue to offer high levels of com-pensation to draw the best talent.

But this attitude is not unique to Dykema. Kessler said he’s also noticed the “chal-

lenges of the local economy have not

caused entry-level lawyers’ compensationto decline or even remain flat.”

In fact, he noted that “entry-level com-pensation has increased at the majorfirms in Michigan in the last severalyears.”

Indeed, the state’s largest law firm,Miller Canfield, and 2nd ranked Dickin-son Wright each bumped up compensationthis year by $10,000, making their new-hire salaries now $100,000.

Butzel and 10th ranked Bodman alsomade similar jumps, increasing their com-pensation levels for new hires to $105,000.

As Wagner noted, “our firm needs thebest and the brightest [and] we cannot af-ford to compromise when it comes to at-tracting the best talent.”

By the hourAlso this year, attorneys’ billing rates

remained relatively healthy. Of the 14 firms that provided their

billing rates, Dykema was at the high end,charging $245 – $625 for partner rates.

Close behind was Pepper Hamilton,charging $340 – $615 for an hour of apartner’s time.

Though Butzel came in third in partnerbilling with a range $220 – $550 an hour,the firm’s associates commanded this high-est billing rates of those reported. At thetop end, Butzel associates charge $400 perhour, while at the low end the rate is $165.

Dykema’s associates were next in line,with their associates’ billing rates rangingfrom $185 – $390.

More than a J.D.Though salaries and rates might be on

an upward slope, most of Michigan’slargest law firms are still search for the tried-and-true attributes in their new hires.

As expected, Kessler said, firms arelooking for “excellent academics” and “forpeople who have a lot of drive and a lot ofpassion for being lawyers.”

Beyond these qualities, though, somefirms are looking to add to the diversity oftheir companies, as is the case at WarnerNorcross.

According to Wagner, Warner Norcrosshas made a “commitment to improvingdiversity” and is “working aggressively toattract and retain an increasing numberof women and minority attorneys.”

Additionally, as law firms flock to inter-national markets, Wagner said there is a

“constant lookout for attorneys with in-ternational experience and skills, as wellas proficiency in foreign languages.”

For other firms, like Strobl & Sharp,the hiring process is driven by an empha-sis on experience.

Strobl explained that his firm “focus[es]primarily on seasoned people with a solidbook of business who bring a high level ofexperience to client service.”

In fact, Strobl said that his associates“have five to seven years of experienceand offer something more than just a lawdegree,” like a certified public account’s li-cense or “significant trial experience.”

Growth spurt? Moreover, it would seem that many of

the firms have found what they were look-ing for in the last year.

Out of the 56 firms that responded tothe survey, 27 reported growth in num-bers, while 19 saw a reduction in force.

The largest group of new hires found ahome at 7th ranked Clark Hill, whichadded a total of 19 attorneys to its numbers.Second in the hiring race was HonigmanMiller with 15 additional attorneys overall.

However, some firms experienced sig-nificant drops in employment, with thelargest loss occurring at 41st ranked Law,Weather & Richardson, P.C., where thefirm took a 14-attorney plunge.

Secrest Wardle Lynch Hampton Truex &Morley, P.C. — ranked 21st overall — lost11 attorneys, while 20th ranked SommersSchwartz reduced its work force by ninelawyers.

L. Gene DeAgostino — managing part-ner of 34th ranked Powers, Chapman,DeAgostino, Meyers & Milia — said thesedeclines are directly related to the state’s“difficult times,” and that his firm is“downsizing like many other businesses.”

Striking a balanceAiling economy aside, each law firm has

developed its own set of perks to keeptheir associates happy.

First and foremost on most firms’ agen-das is the creation of a good work envi-ronment.

At Butzel, Kessler said that the entirefirm has worked “very hard to create thekind of place that really feels good tocome to.”

He believes an enjoyable work place isnot only beneficial for attorneys, but forclients as well.

According to Kessler, his firm recruitslawyers who “really enjoy people” andwho want to “work on energized teams toachieve great results for clients.”

In addition to hiring the right people,many firms are emphasizing a balancebetween work and life outside the office.

For Wagner, this is key to a pleasantworking atmosphere, and he said that“Warner Norcross encourages all of [its]attorneys to lead well-rounded lives.”

To make sure that attorneys don’t getcaught up in the rat race, Wagner explainedthat his firm offers “flexible careers paths”and “on-sight wellness programming.”

Further, he said his firm promotes avery family-oriented environment by pro-viding “adoption financial assistance andpaid leave,” as well as a “time-donationpolicy to assist people in crisis.”

But Warner Norcross is not the onlyfirm with these types of policies in place.

In fact, Seward said, though his firm’sattorneys “have an abundance of work todo,” his office is “fully cognizant” thatlawyers “have other lives.”

Therefore, his firm ”encourage[s] … at-torneys to live a balanced life and find ei-ther family or personal activities that canround out their weeks.”

Lawyers in Seward’s office are involvedin everything from “Harley Davidsonbusiness groups to coaching their kids’ball teams to working to restore Belle Islein Detroit,” he added.

And, he has found that when associ-ates “use these opportunities to developinterests outside of their work at the firm,they [are] more focused when they arehere at the office or with our clients.”

Showing a commitmentFinding out what keeps attorneys at-

tentive has also taken an interesting turnat Dykema.

There, the administration gives new as-sociates surveys to determine what theyare looking for from their mentors andfrom their jobs in general.

According to Schlaybaugh, his law firmhas “gear[ed] [its] new-hire hiring effortsto the recognition of what the GenerationX and Generation Y want.”

From these surveys, he said his firmlearned a great deal about what young at-torneys expect from their law firms.

“The surveys tend to show that[younger associates] want a constant stateof commitment to them and interest in

them,” he explained. Because a law office doesn’t have “equip-

ment like a manufacturing company,”Schlaybaugh noted that a firm’s “most im-portant assets are human assets.”

Therefore, Dykema has implemented a“whole series of steps” showing young at-torneys that the firm is committed tohelping them grow and develop aslawyers, he said.

In the end, it all comes down to makingsure that attorneys are properly trainedand encouraged to achieve the best out-comes for their clients, which makes theircompanies stronger.

As Schlaybaugh said, “the more effectiveand the better we can make our lawyers,the better we will be as a company.”

Accentuating the positiveIn an effort to make attorneys more ef-

fective in Michigan’s changing economicclimate, Wagner expects firms to look toother businesses to buoy the state.

Specifically, he said, “Michigan istransitioning to an economy focused onlife sciences and biotechnology, healthcare, and advanced manufacturing, aswell as niche industries that will drivegrowth and opportunity.”

With these new industries will come aneed for a “highly trained workforce withtechnical skills,” he explained, adding that“law firms need to be prepared to servicethese new and emerging businesses.”

In doing this, Wagner noted, these lawfirms will “ensure the success of theirclients” and will “also … support ourstate’s economy” in the process.

What’s more, said Strobl, the “contin-ued turmoil in the automotive supply in-dustry will remain a dominant businessand legal issue.”

This, in turn, will “create additional de-mand for counsel in mergers and acquisi-tions, creditors’ rights, and labor law,” headded.

Kessler echoed this sentiment, sayingthat there will likely be “a host of bothchallenges and opportunities as lawyersin the automotive sector get more in-tensely involved in the restructuring.”

Therefore, Kessler said, the auto indus-try shake-up isn’t necessarily all bad forlaw firms.

“Lawyers benefit from change more of-ten than not,” he observed. “And there isprofound change occurring in the auto-motive industry — the greatest degree ofchange that has occurred since [it] wascreated.”
