Introduction

The regulation of Mental Health Professionals is found in Title 12 (“Professions and Occupations”), Article 245 (“Mental Health”) of the Colorado Revised Statutes (“Mental Health Practice Act”). The Colorado Mental Health Jurisprudence Examination assesses knowledge and understanding of laws and regulations set forth in Part 1 (Legislative Declaration) and Part 2 (General Provisions) of the State of Colorado Mental Health Statutes. The examination is developed and maintained by the regulatory authorities established pursuant to C.R.S. § 12-245-101, which include the State Boards of Addiction Counselor Examiners, Licensed Professional Counselor Examiners, Marriage and Family Therapist Examiners, Psychologist Examiners, Registered Psychotherapists, and Social Work Examiners.

The Mental Health Jurisprudence Examination is a non-marketed, not-for-sale, structured compilation of test items from a nondisclosed test bank owned expressly by the State (© 2012–present. State of Colorado. All rights reserved.). The examination is for the sole use by an individual to fulfill the jurisprudence examination requirement for licensure, certification, or registration as outlined in the Mental Health Practice Act, Title 12 Article 245.

• The Mental Health Jurisprudence Examination must be taken and passed each time a new application is filed for a license, certification, or registration in accordance with the Colorado Mental Health Practice Act.

Exam Information

The Colorado Mental Health Jurisprudence Examination consists of 45 multiple-choice, one-best answer test items. In addition, please note the following:

• The examination is an online, web-administered, open-book test.

• You must have a computer with Internet access and an e-mail to take the examination.

• The cost for each attempt to pass the examination is $20.00.

A candidate who does not pass the state of Colorado Mental Health Jurisprudence Examination is required to re-enroll for another testing attempt and pay the $20.00 test fee for each re-test attempt. There is a

ten (10) day wait period between the date of the last testing attempt and enrollment to re-test.

The State performs regular queries of testing attempts and conducts investigations into testing irregularities. If evidence suggests efforts to circumvent the 10-day wait period or conduct that violates the terms and conditions outlined herein, the relevant Colorado Mental Health Board may invalidate your exam results, bar you from retaking the exam, and/or subject you to prosecution to the extent allowed under state and federal laws.

• The examination is not timed; however, there is a sixty-day (60-day) window of eligibility to complete the examination.

The testing system permits you to login, log-out, and return to take your examination whenever you desire (provided you are within your 60-day window).

The 60-day window begins when you pay the $20.00 online examination fee. An e-mail is sent immediately upon payment of the exam fee, providing your UserID and exam-specific PassCODE.

You are solely responsible for completing the examination within your sixty-day (60-day) testing window.

• Only one test is permitted during any 60-day window of eligibility. You must submit each test for scoring before you register and pay for a new test attempt.

Please contact ISO Quality Testing at 866.773.1114 if you cannot access your current test.

• There is a Demo Test Tutorial that allows you to become familiar with the testing software and its features. You will receive an opportunity to take this Tutorial each time you access your online test. The time you use to take this Tutorial is not counted as part of your examination time or your test result.

• Your performance is determined by summing the total of points for items you answered correctly. Test items are weighted from 1 point to 3 points, depending on their importance to safe, entry-level practice. It is to your advantage to answer every test item. Test results are calculated on a scale of 200-800. A minimum scaled score of 500 is needed to pass.

Candidates who pass the exam will receive a Results Report advising them they passed. Follow the instructions on the Results Report to submit your results to the Colorado Mental Health Board for the credential you are seeking.

Candidates who fail the exam will receive a scaled score and diagnostic information. You should use this information to focus your study efforts in preparation for a future testing attempt.

• There is no limit on the number of times a candidate who fails the exam may re-test, provided you adhere to the Required Terms and Conditions, which you must agree to uphold before the testing system allows you to take to the Mental Health Jurisprudence Examination (See Exhibit 1).

Terminology Used in Exam

The following terms are used throughout the Mental Health Jurisprudence Examination to simplify and reduce verbiage in test items:

• mental health professional = licensee, registrant, or certificate holder subject to regulation under the Colorado Mental Health Practice Act

• credential = license, registration, or certification required of mental health practitioners regulated under the Colorado Mental Health Practice Act

Failure to adhere to the instructions in this section may result in the scoring of your examination before you intend to do so. You are solely responsible for any actions you take that result in the scoring of your test. Neither the State nor ISO-Quality Testing can “re-set” your test after it has been scored. If you submit your test for scoring before you intend to do so and you do not pass, you will need to start over (i.e., wait at least 10 days, then register and pay for a new test).

I am aware that my testing activities may be monitored by ISO Quality Testing, which provides loss prevention, security, and investigative services to the test publisher on behalf of its Mental Health Jurisprudence Examination test materials. Actions deemed to be incompatible with the State’s ownership and control of test content per 37 C.F.R. Section 202.20(b)(4) shall be investigated and if such person is

found to violate the exclusive rights of the test publisher’s copyright, the individual may be subject to the consequences and remedies provided by U.S. Copyright Laws, Chapter 5 in Title 17 of the United States Code.

YOU MUST READ AND AGREE TO THE FOLLOWING TERMS BEFORE YOU ARE PERMITTED TO TAKE THIS EXAMINATION!

This Examination Agreement (the “Agreement”) is between you and Iso-Quality Testing, Inc. (IQT) and/or Schroeder Measurement Technologies, Inc. (SMT) and sets forth the terms and conditions of you being permitted to take the following examination. The disclosure to you of this examination (the “Exam”) and any questions, answers, worksheets, diagrams, examples, drawings, the length and/or number of Exam segments and/or questions, or any communication, including verbal communications by any party, regarding or related to the Exam, the identity of other Exam takers (collectively and any derivations referred to as the (“Exam Information”) is subject to the terms and conditions detailed herein. BY SELECTING “I AGREE” OR OTHERWISE TAKING THE EXAMINATION, YOU ARE AFFIRMING BY YOUR ACTIONS THAT YOU UNDERSTAND THE TERMS HEREIN AND YOU ARE INTENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.

By clicking “I agree” or otherwise taking the examination, I am agreeing that I have read this Agreement and fully understand and accept the obligations imposed upon me. No promises, threats, or representations have been made to me to induce me to enter into this agreement. I accept this agreement voluntarily and freely:

1. That IQT/SMT and/or the Sponsoring Agency (third party owner of the Examination Information) has spent, and continues to spend substantial sums in developing, keeping current, and administering its Exam Information and carefully guards its integrity and confidentiality;

2. That the Exam Information is the exclusive and confidential property of IQT/SMT or the Sponsoring Agency and is protected by intellectual property rights;

3. That I may not disclose the Exam questions or answers or discuss any of the content of the Exam Information with any person without prior written approval of IQT/SMT;

4. Not to remove from the examination room any Exam Information of any kind provided to me or any other material or information related to the Exam, including, without limitation, any notes I may have written;

5. Not to copy, or attempt to copy, any Exam Information;

6. Not to sell, license, distribute, exchange, give away, comment or discuss the Exam Information, questions or answers, whether before, during, or after the Examination;

7. Not to talk with the other examinees or behave in a rude or disruptive manner during the Examination;

8. I will not cheat, attempt to cheat, or otherwise attempt in any way to falsely enhance my score; and

9. I have met the requisite standards and qualifications required to take this Examination.

I agree that my obligations under this Agreement shall continue to be in effect after the Examination and, if applicable, after termination of my Licensure, Registration, or Certification, regardless of the reason or reasons for termination, and whether such termination is voluntary or involuntary.

I understand that the violation of any of these provisions will cause irreparable harm to IQT/SMT and/or the Examination Sponsor for which monetary remedies may be inadequate, and that IQT/SMT and/or the Examination Sponsor may take all appropriate actions to remedy or prevent such disclosure or misuse, including, without limitation, obtaining immediate injunctions without being required to post bond. Furthermore, any violation of these provisions may result in the immediate and permanent termination of my Certification at the discretion of the appropriate IQT/SMT and/or Examination sponsor officials. Neither this Agreement nor any right granted hereunder shall be assignable or otherwise transferrable by me. This Agreement shall be construed in accordance with the laws of the State of Colorado, U.S.A., This Agreement is supplemental to, and integrated with, any other agreement I may have entered with the Examination Sponsor or Certification/Licensing body.
