years, we wouldn’t have been able to have a Fall event if it weren’t for the Board and committee members, their families and the offi ce staff doing all of the work. If you want us to continue to hold a Fall event, please call the offi ce and volunteer to help out.

SIDEWALKSAll sidewalks within Common Areas shall be maintained by the Association. All other sidewalks shall be maintained by the Owner of the Lot on which the sidewalk is situated. If any section of your sidewalk is uneven, which may cause someone to trip and hurt themselves, you are responsible for repairing or replacing that section of the sidewalk and liable for any injuries incurred. In some cases, a sunken section of a sidewalk may be caused by a water or sewer line leak. If you’re in doubt, you can call Precinct 3 at 281-463-6300 and request that someone come to your home and check it out.

MPCA BOARD ELECTION This November, we will be having an election to fi ll 2 seats on the Board of Directors. The three-year term of Charles Herring and Barbara Burleson will end on December 31st. Both Charles and Barbara are running again to retain their seats on the Board.

BARBARA BURLESONI am seeking election for another term on the Board of Directors. I have been employed with a construction company as Executive Vice President and Treasurer for a total of 27 years. Also I have served on the National Board of National Association of Women in Construction.

I am currently on the MPCA Board and have been involved for several years, having served as Vice President, Secretary and Treasurer. I have lived in the Katy area for 33 years and Memorial Parkway for 12 years. My goals have not changed, which is to keep our neighborhood safe for our families, and our homes well kept. This is and will continue to be, important to me personally. It is a great feeling to know that we can live in a nice, well-kept neighborhood even though our homes are 30 to 40 years old. And we all can work toward that goal and be proud of Memorial Parkway. I ask you to vote in our election and vote for me. Thanks.

CHARLES HERRINGI have lived in Memorial Parkway for 25 years and have been involved with the homeowners association for 9 years while serving on the Board for the past 6 years. Prior to this, I served with my wife, Susan, on the Security Committee for many years. Keeping property values high and our neighborhood safe are my foremost priority. As an auditor for 32 years, I understand the value of money and the proper/ethical use of it. I enjoy visiting with my neighbors at the Board and committee meetings, listening to their concerns while helping them fi nd an equable solution. My children grew up in this neighborhood and I will strive to do my best to keep it a good and safe neighborhood.

MPCA I.D. INFORMATIONEvery resident must have a MPCA I.D. CARD to use the pools, clubhouse and tennis courts. Complete the I.D. Registration form in this newsletter and return it to the office at least 3 days before coming in to the office for pictures taken. If you are renting your home, please provide us evidence that you live in the subdivision, i.e. a water bill with your name on it, etc. ID’s are for residents only. Homeowners who do not live in Memorial Parkway are not eligible for a MPCA I.D. CARD. Once you have the card, turn it in to the office the following year for validation.

MEMORIAL PARKWAY COMMUNITY ASSOCIATION POOL RULES

Anyone violating the following rules is subject to losing privileges with the Memorial Parkway Community Association.

1. Memorial Parkway Community Association swimming pools and pavilion are restricted for the use of residents and their guests.2. Resident must present their valid MPCA ID card before admittance to pool area.3. Guests must be accompanied by a resident and must sign in. Five guests are allowed per family at one time. Guest may not be a Memorial Parkway resident.4. Lifeguards have the responsibility for maintaining discipline and enforcing rules in the pool area. a. Lifeguard shall call infraction of rules to the attention of the offending individual (s). b. Lifeguards have the authority to deny the use of pool facility to residents and guests up to three (3) days as a disciplinary measure.5. Swimming is allowed only when lifeguards are on duty in the stands. SWIM AT YOUR OWN RISK.6. Swimmers must wear property swimsuits.7. Children not toilet trained must wear protective rubber pants or equivalent, under their swimsuits.8. Children under twelve (12) years of age are not allowed in pool unless accompanied by an adult at least 18 years of age or older. EXCEPTION: Notarized parental permission is submitted to lifeguard allowing designated 16 years old-18 years old to accompany and child under age 12. Form is available from lifeguard.9. Baby pool is reserved for children five (5) years and younger and supervised by responsible parent/adult.10. No running or shoving allowed in the pool area or on diving board.11. No pets are allowed in pool area.12. Anyone with open sores or wounds is prohibited from using the pool.13. Floating devices may be allowed at the discretion of the lifeguard. No floating devices allowed in diving area. No large floating devices (example: rafts, boats, etc.).14. Throwing toys, Frisbees, small hard balls, tennis balls, water guns, etc. are strictly prohibited.15. No standing or sitting on safety ropes.16. All children under eighteen (18) including infants, must vacate pools the last fifteen (15) minutes of every other hour for adult swim. Children must be a least four feet from pool during adult swim.17. Glass containers are not allowed in pool area.18. Drinking, smoking and eating are not allowed within four feet of pool.19. Smoking or drinking of alcoholic beverages is strictly prohibited except by persons of legal age. Proof of age may be required. Drunkenness and obscene language will not be tolerated. 20. Two (2) long blasts of lifeguard whistle requires everyone to immediately vacate pool.21. MPCA and pool contractor are not responsible for lost or stolen items.22. No bicycles, skates, skateboards or tricycles are allowed in the pool area. Bicycles must be parked in bicycle rack.23. Guard phone is for business use only. No personal phone use by guards/gatekeepers while on duty. Phone in box is for emergency use only.

DIVING POOL RULES1. The diving pool area is to be used for diving only. No swimmers allowed unless authorized by lifeguards.2. No more than one person is allowed on the diving board at one time.3. Only two bounces on board are allowed before diving.4. All diving shall be from the end of the diving board and straight forward, never off the side. The water in front of the board must be clear of swimmers before entering the pool. Swim directly to the ladder after diving.5. Anyone using the diving pool must be able to swim across the pool twice to the satisfaction of the guard.

VEHICLE PARKING ON THE STREETIt is not a violation of our deed restrictions to park a vehicle on the street as long as it is not being stored, is fully operational and has current tags. However, the Transportation Code of Texas, Title 6, Chapter 545, Section 302, states that .a vehicle cannot park closer than 15 feet to a fire hydrant. .a vehicle cannot park closer than 20 feet to an intersection. .a vehicle cannot park closer than 30 feet to a stop sign. The Board has asked our Constables to take the appropriate action whenever there is a violation of the Transportation Code. The parking of vehicles on the street has become a big problem in our neighborhood. School buses can’t pull close to the curb to pick up and let off students. In some cases, emergency vehicles may not be able to reach their destination if traffic flow is inhibited, especially when two cars are parked directly across from each other. Plus, vehicles parked on the street are those that are vandalized the most. Some of the worst areas are the cul-de-sacs where it’s hard enough to back out of a driveway or navigate the circle even when there aren’t any vehicles parked on the street. Be considerate of your neighbors and don’t park your vehicle in front of their house or block their mailbox. Also, think of the neighbor across the street and park so that you’re not making it difficult for them to back out of their own driveway. All of our homes have at least a two or three-car garage and room for several cars in the driveway. We respectfully request that you refrain from parking on the street.

TRASH COLLECTIONIf you are having any problems with getting trash picked up or want to register a complaint, please call WCA at 281-368-8397 if you are a customer of Memorial MUD. If you are a customer of MUD 81, you may call Royale Disposal and Recycle at 713-526-1536.

TRASH CANSThe HOA has received complaints about trashcans being stored in front of the home, left at curbside, and not being stored out of sight. In the past, the deed restriction committee has not been writing

letters to homeowners about proper storage of trashcans. Since this has become a problem in the neighborhood, we are now sending letters to homeowners if their trashcans are not properly stored out of sight. Trash cans should be placed at the curb the morning of trash pickup and the cans should be stored away out of sight by the end of the day. If your trashcans are visible from the street on any day other than trash day, you will in violation of the deed restriction.

Thanks to all of you who have started storing your trash receptacles out of public view. It really has made a big difference in the over-all appearance of our neighborhood and we appreciate your cooperation.

2013 MAINTENANCE FEESStatements for the 2013 maintenance fees will be mailed to all homeowners during the fi rst week of October. If you haven’t received your statement by the end of October, please notify the offi ce of a good mailing address as you are responsible for paying the fees by January 1, 2013. When you receive your statement in October, you may start paying ahead immediately. If you cannot pay the fee in full by January 1, 2013, you may get on a payment plan, at no charge, making a down payment and $50 monthly payments. If you don’t sign up for the plan by January 14th, you can still get on a payment plan, but will be charged a fee of $25. More information will be in the October issue.

GARAGE SALESMPCA would like to suggest that garage sales be conducted the fi rst Friday and Saturday of each month. This will eliminate the many signs that are out each week and also makes for a stronger turn out. Most area communities only allow sales twice a year. Memorial Parkway could be known for its “Once a Month” garage sales. Do not attach your garage sale signs to the STOP signs, as it is against the law and the County can issue citations for this. If a sign is on a public right of way, like the esplanades), they may be subject to fi nes of $500-$1000 per occurrence per day. We also ask that you do not post your signs on the property of another resident. When your sale is over, please go back and pick up all of your signs.

ARCHITECTURAL CONTROLAll exterior changes to your property must be submitted to our committee for approval before you start any work. This includes, but is not limited to, painting, re-roofi ng, sheds, patio covers, fences, etc. All requests must be on our request form that can be found in this newsletter, online at our website www.mphoa.org or at the offi ce. Please give as much detail as possible, so there is no delay in getting your request reviewed. Except for painting and re-roofi ng, it would be best to include a plat of your property that shows property lines and easements in relation to the location of your project.

DEED RESTRICTIONSMemorial Parkway Community Association has inspectors that drive through the neighborhood checking for violations of our deed restrictions. They are not permitted to get out of their cars and/or trespass on your property. They only take pictures of violations that can be seen from the street.

If you see one of our inspectors stopped in front of your home, please do not approach their vehicle to confront them. Their vehicles are indentifi ed with a MPCA sign on the car door that says deed restriction inspector. If you still have questions, call the offi ce.

If you get a notice of violation and you feel it was sent to you in error, please call the offi ce. Our staff will look at the picture taken of the violation and confi rm whether the address is correct or not. Our inspectors make every effort to make sure they’ve got the right violation logged to the right address with the right picture to go along with it. But with 2,219 homes to inspect and over 25 miles of streets, they sometimes get it wrong. If that’s the case, we apologize for the mistake and will remove the violation from your record.

As you can see from the following list, we continue to have many unresolved deed violations that are ruining the over-all appearance of our neighborhood. Storing miscellaneous items in view from the street can easily be remedied by just moving those items to another location - no cost involved.

Storing trash receptacles and recycle bins in view can easily remedied by just moving them to another location that can’t be seen from the street - no cost involved. Correcting these two violations alone would greatly improve the appearance of your property. Also remember to move the cans from curbside the same day that the trash is picked up and store them where they can’t be seen from the street.

The next big item is lawn maintenance. Many of our residents mow every two weeks, but at certain times of the year, yards may have to be done every week to maintain a neat appearance.

We understand that it takes time and money to resolve some of the other violations such as rotten wood, fences falling down, repainting the exterior of your home, etc. We will work with you and allow ample time to take care of the violation, but you must contact us when you receive the fi rst letter and no later than when you get a second one. The third notice means that a $50 fi ne has already been added to your account.

While you may know your pet is friendly, an animal running at someone who is walking by is very scary for that person. Many children are afraid of animals and become frightened, which could result in the child getting hurt trying to avoid the animal. Harris County Animal Control advises, “All dogs and cats must be kept under restraint while in the unincorporated areas of Harris County, Texas. The custodian of a dog or cat is not authorized to have, harbor or keep any unlicensed dog or cat nor to allow any dog or cat to become a stray.” Restraint is defined as “the control of a dog or cat under the following circumstances:1. When it is controlled by a line or leash not more than six (6) feet in length, if the line or leash is held by a human being who is capable of controlling or governing the dog or cat in question. 2. When it is within a fully enclosed vehicle.3. When it is on the premise of the custodian and the animal does not have access to sidewalk or street. While it may be nice to have your animal out in the yard while you work or play, it is against the law, unless the animal is properly restrained. Let’s all help keep our community a safe and comfortable place for all our residents by being responsible pet owners. This will not only protect anyone who may be walking or bicycling in the area, but also the pet owner who could be held legally responsible or possibly sued for failing to properly restrain their pet.

NON-PROFIT CLUBHOUSE RENTALThe Memorial Parkway Clubhouse located at 21600 Cimarron is available to non-profi t adult and youth groups for meetings. The meeting times and days for adult and youth groups are from:

2012-2013 CRITERIA FOR FREE & REDUCED PRICE MEALSKaty Independent School District announced its policy for providing free and reduced price meals for children eligible under the federal income guidelines for the National School Lunch and School Breakfast Program. Children living in households whose income are at or below the federally approved levels, based on household size, may be eligible for free or reduced price meals. Transfer students approved for the program from another school district may either complete a Katy ISD application or provide documentation of their eligibility status. The 8th Grade Katy Rebels-D’Addieco Team took 1st place in the June 30-July 1, 2012 Primetime tournament in Humble, TX. The team went 4-0 to win the tournament in convincing fashion. Katy, Texas has a new 3-Time World Champion, Mikayla Francisco, age 8. This past June 2012 at the American Taekwondo Association’s World Championships, held in Little Rock, Arkansas, Mikayla took home 3 Gold World Champion Titles in Traditional Form, Sparring and Creative Form. She competed in a total of 7 Top Ten divisions, placing in each event with 3 Silver medals in Traditional Weapon, Extreme Form, Extreme weapon and a Bronze medal in Creative Weapon. At age 6, Mikayla earned her first Texas State Champion Title in Creative Form in 2010 (Division-Girls 8y/o and under). At age 7, Mikayla eventually earned 5 Texas State Champion Titles in Traditional Form, Traditional Weapon, Sparring, Creative Form and Creative Weapon in 2011 (Division-Girls 8y/o and under). Mikayla was promoted to the rank of 1st Degree Black Belt in June 2011 at age 7. Added to her 2012 World Championship achievements, Mikayla also earned 7 Texas State Champion Titles in Traditional Form, Traditional Weapon, Sparring, Creative Form, Creative Weapon, Extreme Form and Extreme Weapon 2012 - this being her 3rd consecutive year as a Texas State Champion in TaeKwonDo.
