Dear Ms. Strunk,
On behalf of the applicants, Tysons Park, Inc. and Tysons Park Place II LLC (collectively, the "Applicant"), please accept this letter as a statement of justification in support of the enclosed applications for a rezoning to the PTC Planned Tysons Corner Urban District and associated Conceptual and Final Development Plans, as well as the enclosed Special Exception application for an increase in the required office parking ratio. With these applications, the Applicant will bring forward the Comprehensive Plan's vision for the Tysons Park Place I site and introduce new, trophy-class office space in Tysons.
I. Introduction
The applicants are the title owners, respectively, of the Tysons Park Place I and Tysons Park Place II properties, located at 7926 (Park Place I) and 7930 Jones Branch Drive (Park Place II) (the "Property"). The Property contains 7.64 acres and is located on the east side of Jones Branch Drive to the south of the newly constructed Jones Branch Connector. The Property is also abutted by the Outer Loop of the 1-495 Capital Beltway on the east, the Hilton hotel on the south, and the Jones Branch Connector on the north. Finally, the Property is within a one-half mile radius of the McLean Metro Station.
The Property is currently zoned to the C-4, High Intensity Office District. In line with its existing zoning, it is developed with two 11-story office buildings and an existing above-grade parking garage. Park Place I currently contains 262,193 square feet of office space and is 139 feet tall. Park Place I was built in 1975 and is functionally obsolete today. Park Place II contains 311,600 square feet of office space and is 147 feet tall. It is currently home to the Hilton Worldwide headquarters.

With a development philosophy that emphasizes creating long-term value through its assets, the Applicant believes the time is ripe to redevelop the Property. To that end, the Applicant is currently proposing to redevelop Park Place I with trophy-class office space featuring world-class architecture and sustainable design features as envisioned by the Comprehensive Plan. A future final development plan amendment will layout the Applicant's vision for Park Place II, as ongoing leases and remaining useful building life prohibit redevelopment at this time.
II. Summary of Application Requests
(A) Rezoning, CDP, & FDP Requests
In order to achieve the vision for the Property, and as required by the Zoning Ordinance and Comprehensive Plan, the Applicant is requesting a rezoning to the PTC Planned Tysons Corner Urban District ("PTC District"). The Applicant is also requesting approval of a Conceptual Development Plan ("CDP") and Final Development Plan ("FDP", and collectively with the CDP, the "CDP/FDP") for the Property.
The Applicant does not have immediate plans to redevelop the Park Place II office building. The office building was constructed in 2008 and is fully leased. A future Final Development Plan amendment will be filed for this portion of the Property when it has reached the end of its useful life. However, the Applicant recognizes the importance of including Park Place II in the CDP/FDP in order to achieve the Comprehensive Plan's parcel consolidation goals and to bring this portion of the site within the PTC District.
As to Park Place I, the Applicant will redevelop the existing, obsolete office space with approximately 450,000 square feet of new, trophy-class office and office/retail space. This new building is proposed to be 18-stories tall and designed to prominently face the Outer Loop. Compared to the existing condition, the proposed office space will be rotated 90 degrees, thereby opening up views, light, and air through the site and creating symmetry with the adjacent Hilton Worldwide headquarters.
The proposed Park Place I office space will dramatically change the look and feel of the Property. In addition to rotating the building, the Applicant's design will introduce a cohesive set of building materials that especially feature glass and precast concrete elements. The high volume of glass will particularly lighten the feel of the building. As envisioned by the Comprehensive Plan, the building will step back in several areas above its base, adding interest to the form and shape of the building while lessening its visual impact on the public realm. The combination of high-quality building materials and interesting architectural design will result in a world-class office building that furthers the County's vision for an attractive, synergistic Tysons.
As depicted in the enclosed plans, the Applicant will also provide a better visual connection with an improved public realm. In addition to improvements within the right of way consistent with the Comprehensive Plan's guidance for "collector" streets, the Applicant is proposed a series of usable green spaces and café spaces within the perimeter of the Property. By rotating the building to face the Outer Loop, the Applicant is able to achieve onsite open

space in line with the Comprehensive Plan's call for 1 acre of open space for every 10,000 employees. Further, the proposed café spaces will provide an activating outdoor use that will ultimately compliment the build-out of Tysons as an interconnected, urban space.
A major element of the proposal includes the creation of a 3,800 square foot bicycle pocket park ("Bike Park") on the southwest corner of the Property. The Bike Park will include filtered water fountains, benches to provide a temporary rest area for bicyclists passing the Property, and a minimum of two permanent bicycle stations that provide access to various bicycle tools and equipment to perform basic repair and maintenance tasks. This will allow cyclists to inflate their tires and adjust their brakes, gears and chains. The Applicant will maintain the Bike Park elements and will grant an easement for public access and will support both recreational and commuting bicyclists.
(B) Special Exception for Increased Parking Ratio
The Applicant is further requesting a special exception to permit parking on the Property above 2.2 spaces per 1,000 square feet. The increased ratio results from the fact Park Place I and Park Place II were originally developed with a single onsite garage serving both buildings and constructed to accommodate the C-4 district parking standards. The total parking onsite given existing conditions equates to 3.25 parking spaces per 1,000 square feet. As Park Place II is subject to existing lease obligations, such as the Hilton Worldwide headquarters, and is not slated to be redeveloped with this application, the proposed CDP will equate to 2.44 spaces per 1,000 square feet, once the proposed redevelopment occurs. The Special Exception is, therefore, necessary to capture this higher parking ratio.
Initially, it should be noted that this Special Exception will only be a temporary necessity brought on by the garage's existing condition. On redeveloping Park Place II, the Property will come into compliance with the PTC District parking standards. In this way, the request is comparable to other projects within Tysons, such as Greensboro Park Place (RZ/FDP 2012-PR-002) and The Mile (RZ 2017-PR-015), that will meet the ratio as ultimate site development is phased into with subsequent Final Development Plans.
However, the Applicant recognizes that this short-term effect may detract from the goals set out for Tysons in the Comprehensive Plan. To mitigate this outcome, the Applicant intends to proffer and will work with staff on a transportation demand management plan that will encompass the following elements: (a) the provision of Metro vouchers to office tenant employees upon initial lease-up of Park Place I; (b) provision of Metro vouchers to Park Place II tenants during lease renewal negotiations in exchange for giving up parking spaces in the garage; and (c) establishing a "transportation education reserve fund" that the building operator will use to promote and educate tenants on public transportation and modal alternatives.

III. Conformance with the Comprehensive Plan
(A) Comprehensive Plan Guidance for the Property
The Comprehensive Plan places the Property within the Tysons Urban Center's North Central District. The North Central District is considered a Non-Transit Oriented Development district, providing a transition between Tysons Central 123 and the communities neighboring the urban center. Yet, the Comprehensive Plan clearly describes the vision for the North Central District as mixed-use and focuses on the intensity of development relative to the urban core.
The Property specifically falls within Subarea 2, Capital Beltway Office Area. As shown on conceptual land use map for Subarea 2 (Map 19), the Property is planned for office space with supporting retail and service uses. Recognizing the existing conditions in the area, the base plan for Subarea 2 describes densities up to 1.65 FAR with building heights up to 175 feet. The redevelopment option planning guidance for Subarea 2, however, emphasizes that planned intensities should be realized based on proximity to Metro and in conjunction with the access and circulation improvements recommended in the Areawide Urban Design and Transportation recommendations.
The proposed project meets the Comprehensive Plan guidance for Subarea 2. In line with the conceptual land use map, the Applicant is proposing new, trophy-class office space. While the proposed height exceeds the Comprehensive Plan guidance, the Applicant believes this increase is justified. Since adoption of the Comprehensive Plan, the Fairfax County Department of Transportation and Virginia Department of Transportation have acquired the right of way necessary for, and have begun construction of, the Jones Branch Connector, ultimately to be delivered in the Fall of 2019. While the Property has always been within one-half mile of the McLean Metro Station, the Jones Branch Connector provides an "avenue" connecting the western side of the Outer Loop with its eastern counterpart. This argues for treating the Property, in the first instance, like others similarly situated within one-half mile of a metro station in Tysons. The Property should, therefore, be analyzed in light of the Tier II height guidance of the Conceptual Building Heights Map (Map 11).
Moreover, as proposed with this application, the Applicant will provide access and circulation improvements called for in the Comprehensive Plan. First, as depicted on the CDP/FDP, the Applicant will provide an on-street parking lane within the Jones Branch Drive right of way adjacent to the site, as well as a dedicated bike lane. Notably, the Comprehensive Plan does not depict the Property or Jones Branch Drive, generally, for improvements facilitating the Grid of Streets concept. Second, as described above, the Applicant will reduce the onsite parking ratio with this redevelopment from 3.25 spaces to 2.44 spaces per 1,000 square feet, thereby lessening travel impacts to the adjacent road network. This parking reduction will be complimented by a Transportation Demand Management program that will incentivize current and future tenants to use alternative transportation modes until such time as Park Place II is redeveloped.
Further, as noted above, the Applicant is proposing a substantial community facility in the form of the Bike Park. The Bike Park will serve the community and the Applicant's office

tenants. This unique feature enhances the community realm and furthers the vision for Tysons as a live-work-play environment.
Lastly, consideration should be given to the fact the proposed project will present new commercial space in Tysons. With some exceptions, while other projects in Tysons contain a phased office element or are planned for future office uses, this Application has the potential to bring new, world-class office space online in the immediate future. This substantially furthers the Comprehensive Plan's call for creating a mix of attractive uses in Tysons. The influx of additional employees will contribute to the need for greater retail uses in the area, as employees seek a place to dine or relax after work. Moreover, as residential uses come online in Tysons, new office employees become potential tenants and homeowners contributing to the greater vision for a mixed-use Tysons Urban Center. The Applicant firmly believes, though, that the proposed intensities are required to make this a reality.
(B) Major Elements of the Tysons Corner Urban Center Guidance
As set out in the Comprehensive Plan, accomplishing the vision for Tysons is measured by conformance with the "Major Elements" of the Tysons Urban Center guidance. As described below, the proposed plans achieve the goals of these Major Elements.
(i) Mix and arrangement of uses
The proposal contributes to the mix of uses in the Tysons Urban Center. In line with the Subarea 2 guidance, the Applicant is proposing to redevelop the Property with world-class office space. Potential ground floor retail and service uses that serve the office users and that may ultimately serve an interconnected Tysons further add to this mix.
The building orientation also accomplishes the goals for arrangement of onsite uses. By rotating the proposed building 90 degrees (compared to the current condition), the Applicant is able to substantially open up the views through the site and increase light and air in the pedestrian realm. This arrangement further allows the Applicant to add outdoor café spaces and additional usable green space for the office employees.
(ii) Affordable and workforce housing
While office uses are proposed, the Applicant anticipates supporting the implementation of the Comprehensive Plan's policies for affordable dwelling units in Tysons.
(iii) Green Buildings
The new office space will contribute towards the Comprehensive Plan's environmental sustainability goals. The Applicant anticipates committing to a minimum LEED silver certification for the building.

(iv) Stormwater Management
The Applicant's Stormwater Management Plan ("SWM Plan") is included as Sheets P-0502 through P-0505 of the CDP/FDP. The SWM Plan as outlined in the CDP/FDP provides a thorough examination of onsite stormwater mitigation requirements and measures to meet these needs.
(v) Consolidation performance objectives
The Applicant's proposal will not adversely affect redevelopment of unconsolidated properties within Subarea 2. Notably, all of the parcels within the Subarea are either developed with existing office or hotel assets or are approved for such uses under existing zoning approvals, yet remain undeveloped. However, the Applicant's proposal is in line with the Comprehensive Plan's guidance for onsite and offsite improvements, which will ultimately contribute to the overall vision for Tysons as these adjoining parcels come online for redevelopment.
(vi) Transportation
While the Property is not anticipated to directly contribute to the grid of streets or Tysons circulator, the proposed development will contribute to overall trip reduction and mode split goals in Tysons. While the Property and the Hilton Worldwide headquarters utilize a shared garage space, redevelopment of Park Place I will lower the overall site parking ratio, and the Applicant intends to proffer an interim transportation demand management program that will incentivize alternative transportation modes while Park Place II remains. The Applicant is very familiar with developing and implementing TDM programs in Northern Virginia and is confident that such a program can successfully be developed for the Property.
Third, in line with the Comprehensive Plan's call for on-street parking along "collector" streets, the CDP/FDP proposes such parking within the right of way adjacent to the Property. Finally, the Applicant is proposing onsite and offsite improvements to sidewalks and the pedestrian realm as shown on the CDP/FDP that will permit greater and easier pedestrian access through the site.
(vii) Urban Design
The "Urban Design" section of the Comprehensive Plan emphasizes six overall principles. The project will contribute to each of these principles, as follows:
Enhance Regional Identity — The Applicant is proposing new office space featuring world-class architecture. The combination of new office space with high quality building design will promote Tysons within the region.
Establish a Sense of Place — The combination of world-class architecture, outdoor café space, onsite open spaces, and public realm improvements will enhance the Property's sense of place in relation to the Tysons Urban Center.

Improve Connectivity — While the Property is not slated to contribute directly to the Tysons grid of streets or circulator improvements, the Applicant anticipates providing on-street parking adjacent to the site within the Jones Branch Drive right of way. The Applicant will further provide a dedicated bike lane on Jones Branch Drive, as shown in the CDP/FDP.
Design Sustainable Environments — The Applicant is proposing LEED certification for the new office building, as called for in the Comprehensive Plan. Further, the Applicant's SWM Plan outlines measures to control stormwater runoff from the redeveloped site in line with current state and local standards.
Respect Surrounding Neighborhoods — The Property is located within Subarea 2 of the North Central District, which is entirely planned for commercial uses. Office uses are further contemplated north of the site within the DAAR Office Area (Subarea 1). To the west, the West Park Urban Neighborhood is planned for residential mixed-use along Jones Branch Drive. Currently, RZ 2017-PR-015 (The Mile) is proposing residential uses in this area, and thus the two developments will complement one another and contribute to the mix of uses in Tysons.
Create a New Destination for the Arts and Design — The Property is not designated as an area for arts or other civic features.
(viii) Urban park standards
Per the Comprehensive Plan, new office buildings should provide 1 acre of urban park space for every 10,000 employees. In similar office applications, the County has used a standard of 300 square feet of office space per employee. Applying those criteria, the proposed application should produce a minimum of 2,6141 square feet of urban park space onsite. The Applicant will meet this requirement onsite through a thoughtful redesign of the existing pedestrian islands and new green space achieved through rotating the building. The ultimate design and layout of these spaces will evolve as the applications proceed.
Further, as noted above, the Applicant is proposing a unique feature onsite in the form of the Bike Park. This community facility will be open for use by the public, in addition to the office tenants.
(ix) Active recreation facilities
The Conceptual Parks and Open Space Networks Map (Map 9) does not contemplate active recreation facilities on the Property. To that end, the Applicant will review mechanisms with staff to contribute towards such facilities based upon the additional density generated by the proposed site redevelopment.

(x) Public facilities
The Public Facilities Map (Map 10) does not contemplate public facilities on the Property. To that end, the Applicant will review mechanisms with staff to contribute towards such facilities based upon the additional density generated by the proposed site redevelopment.
IV. Compliance with the Zoning Ordinance
(A) PTC District Compliance
The PTC District requires an applicant to demonstrate that the proposed development furthers the Comprehensive Plan's vision for the Tysons Urban Center. Section 6-501 of the Zoning Ordinance applies the following criterion to this analysis:
(1) Contribute to a tiered intensity of development having the highest intensities located closest to the transit stations and provide the mix of residential, office and commercial uses necessary to achieve a vibrant, urban environment.
The Property falls within the half-mile ring for the McLean Metro Station and is connected to the eastern side of the Outer Loop by the Jones Branch Connector. Therefore, the higher intensities envisioned by the Comprehensive Plan and implemented by the Zoning Ordinance are applicable to the Property. As such, the Property will contribute to the tiered density envisioned within the one-half mile ring. Further, by providing the office use contemplated in Subarea 2, the proposal will contribute to the mix of uses in Tysons.
(2) Contribute to the network of open space and urban parks, to include stream valley parks, pocket parks, common greens, civic plazas and athletic fields for the workers and residents of Tysons.
The project will contribute onsite open space at the levels contemplated by the Comprehensive Plan and under the formulas traditionally applied by the County for office uses. In addition, the Applicant intends to develop the site with the Bike Park, as described above.
(3) Promote environmental stewardship by implementing green building design; efficient, renewable and sustainable energy practices; incorporating low impact development strategies, such as innovative stormwater management and green roofs; and achieving the tree canopy goals for Tysons.
The Applicant will commit to LEED certification for the building. As described above, the SWM Plan provides effective mechanisms to control stormwater runoff from the site. Finally, tree canopy is addressed in the CDP/FDP, and the project contributes to the overall tree canopy goals for Tysons.

, (4) Further the implementation of the urban grid of streets and the described
street hierarchy for Tysons.
The proposed project will accomplish the street goals for Jones Branch Drive as a "collector" street. The redevelopment of the site will also provide an opportunity to add a bike lane adjacent to the Property.
(5) Reduce the amount of single occupant vehicle trips by limiting the amount of provided parking, encouraging shared parking arrangements among uses, permitting the inclusion of managed tandem parking spaces, and implementing various Transportation Demand Management strategies, such as transit subsidies, carpool and vanpool services, employee shuttles, car-sharing programs and bicycle accommodations.
Through this application, the Applicant will reduce onsite parking spaces within the existing parking structure on the Property. Currently, the site is parked at 3.25 spaces/1,000 square feet or greater as permitted under the C-4 district standards. This application will reduce that ratio to 2.44 spaces/1,000 square feet. In addition, the Applicant is very familiar with developing and implementing TDM programs in Northern Virginia and is confident that such a program can successfully be developed for the Property to mitigate this interim parking condition.
(6) Contribute to the necessary public facilities to support the projected job and population growth, including schools, fire and police services, a library, public utilities, and an arts center.
Through this Application, the Applicant will provide public utilities necessary for the proposed development. While the Public Facilities Map (Map 10) does not contemplate public facilities on the Property, the Applicant will review mechanisms with staff to contribute towards such facilities based upon the additional density generated by the proposed site redevelopment.
(7) Contribute to the specified streetscape and apply the urban design guidelines specified for build-to lines, building articulation, fenestration, ground floor transparency and parking design to create an integrated urban, pedestrian-friendly environment.
The Applicant will provide the necessary streetscape improvements required for a "collector" street as described in the Comprehensive Plan. The Applicant's office building will be treated with a world-class design meeting the Comprehensive Plan's urban design guidelines, including a mix of materials with an emphasis on glass and masonry materials, transparent ground floor lobby and café space, and step backs above the ground floor to provide interesting form and shape to the building.

(8) Contribute to implementing the workforce and affordable housing policies for Tysons to provide housing to various income levels.
While only proposing office uses, the Applicant anticipates supporting the implementation of the Comprehensive Plan's policies for affordable dwelling units in Tysons.
(B) Special Exception
The following information is provided in accordance with Zoning Ordinance § 9-006:
(1) The proposed use at the specified location shall he in harmony with the adopted comprehensive plan.
As described above, the proposed use is in harmony with the Comprehensive Plan's vision for Tysons.
(2) The proposed use shall he in harmony with the general purpose and intent of the applicable zoning district regulations.
As described above, the proposed use is in harmony with the purpose and intent of the PTC District. While the Property will exceed the parking standard set out for Tysons within the Tier II band, this is a temporary condition that will be ameliorated with a Final Development Plan for Park Place II. In the interim, the Applicant will develop a robust transportation demand management plan for the proposed and existing office buildings and their tenants.
(3) The proposed use shall be such that it will be harmonious with and will not adversely affect the use or development of neighboring properties in accordance with the applicable zoning district regulations and the adopted comprehensive plan. The location, size and height of buildings, structures, walls and fences, and the nature and extent of screening, buffering and landscaping shall be such that the use will not hinder or discourage the appropriate development and use of adjacent or nearby land and/or buildings or impair the value thereof.
The proposed use will not deter or adversely affect development on any neighboring properties. Indeed, the proposed use complies with the Comprehensive Plan's vision for the property as office uses. Further, the interim parking condition that is the subject of this special exception request will be mitigated as described herein.
(4) The proposed use shall be such that pedestrian and vehicular traffic associated with such use will not be hazardous or conflict with the existing and anticipated traffic in the neighborhood.
As the Applicant anticipates a robust mitigation strategy for the interim parking condition, the proposed special exception use will not be hazardous to or conflict with current or projected traffic in the vicinity of the Property.

(5) In addition to the standards which may be set forth in this Article for a particular category or use, the Board shall require landscaping and screening in accordance with the provisions of Article 13.
The parking uses are currently screened within the existing garage from Jones Branch Drive and the Outer Loop. They will remain screened in this manner, as the existing parking garage is proposed to remain. Onsite landscaping shall be as provided in the CDP/FDP.
(6) Open space shall be provided in an amount equivalent to that specified for the zoning district in which the proposed use is located.
As this special exception request deals with an exception to the Tysons parking standards, open space is inapplicable to the request. However, the Applicant is providing open spaces for the overall use of the tenants and community as shown in the CDP/FDP.
(7) Adequate utility, drainage, parking, loading and other necessary facilities to serve the proposed use shall be provided. Parking and loading requirements shall be in accordance with the provisions of Article 11.
The proposed development will provide adequate utilities, drainage, loading and other necessary facilities, subject to the modification requests herein. The proposed parking ratio is the subject of this special exception request and will be mitigated as described herein.
(8) Signs shall be regulated by the provisions of Article 12; however, the Board may impose more strict requirements for a given use than those set forth in this Ordinance.
This criterion is inapplicable to the proposed special exception request.
The following information is provided in accordance with Section §9-011(7) of the Zoning Ordinance:
(1) Type of operation(s).
The special exception pertains to parking for a proposed office use.
(2) Hours of operation.
Parking will be available 24 hours per day, 7 days a week.
(3) Estimated number of patrons/clients/patients/pupils/etc.
None.

tat3 (4) Proposed number of employees/attendants/teachers/etc.
This criterion is inapplicable to the proposed special exception use, which is for parking.
(5) Estimate of traffic impact of the proposed use, including the maximum expected trip generation and the distribution of such trips by mode and time of day.
Overall traffic impacts for the office use are as summarized in the enclosed traffic statement. Pertaining to the request to increase maximum onsite parking, the impacts will minimal in light of the fact the current parking provides a ratio of 3.25 spaces per 1,000 square feet of office space, and the Applicant will reduce this ratio to 2.44 space per 1,000 square feet. In addition, the Applicant intends to proffer a robust transportation demand management plan for the project to mitigate in the interim impacts of this increased parking.
(6) Vicinity or general area to be served by the use.
Tysons, in particular the Property.
(7) Description of' building facade and architecture of proposed new building or additions.
This criterion is inapplicable to the proposed special exception request.
(8) A listing, if known, of all hazardous or toxic substances as set forth in Title 40, Code of Federal Regulations Parts 116.4, 302.4 and 355; all hazardous waste as set forth in Virginia Department of Environmental Quality Hazardous Waste Management Regulations; and/or petroleum products as defined in Title 40, Code of Federal Regulations Part 280; to be generated, utilized, stored, treated, and/or disposed of on site and the size and contents of any existing or proposed storage tanks or containers.
None.
(9) A statement that the proposed use conforms to the provisions of all applicable ordinances, regulations, adopted standards and any applicable conditions, or, if any waiver, exception or variance is sought by the applicant from such ordinances, regulations, standards and conditions, such shall be specifically noted with the justification for any such modification.
Except as otherwise noted or requested herein, the proposed use conforms to the provisions of all applicable ordinances, regulations, standards, and other adopted conditions.

V. Requests for Waivers and Modifications
In order to achieve the vision for the site as new office space contributing to the greater development of Tysons as a live-work-play destination, the Applicant requests the following waivers and modifications from the Zoning Ordinance and Public Facilities Manual ("PFM"):
(A) Maximum building heights pursuant to Section 16-401(8) of the Zoning Ordinance.
The Applicant is requesting that Board of Supervisors ("Board') modify permissible building heights at the Property to allow the Park Place I office building to develop up to 290 feet in height, inclusive of the mechanical penthouse elements. The Zoning Ordinance permits the Board to authorize a modification of specific district regulations based on two criterion: (a) the strict application of the regulation would inhibit or frustrate the purpose and intent for establishing the given zoning district; and (b) the modification would promote and comply with the standards set out in Section 16-100 of the Zoning Ordinance.
In this case, a strict application of the heights proposed under the Conceptual Building Heights Map would prevent an effective redevelopment of the Property under the PTC District, thereby frustrating the goals of the Comprehensive Plan. Among other things, "[t]he PTC District is established for the Tysons Corner Urban Center...to implement the mix of uses, density and intensities under the redevelopment option set forth in the adopted comprehensive plan. The PTC District regulations are designed to provide the necessary flexibility to transform the designated Tysons Corner Urban Center area..." While the existing office asset is in many ways obsolete, there remains little appetite in the marketplace for new Class B or Class C office space. The Applicant believes this will remain the case for the foreseeable future. Thus, new Class A office space is necessary in the current market climate to effectively redevelop the Property. As the Comprehensive Plan designates the site to redevelop with office uses under the PTC District, additional height is necessary to fulfill this vision and provide a contributing office asset to the greater Tysons area. Otherwise, the Property runs the risk of operating under the status quo for the foreseeable future, which will inhibit the goals of the Comprehensive Plan and, by association, the PTC District.
Furthermore, the Applicant believes the Property can actively contribute to the overall vision for Tysons as a live-work-play environment. As such, the Applicant is proposing the Bike Park to provide a unique onsite community space that is open to the public. In doing so, the Applicant had to consider the site layout and building form relative to the location and connectivity of the Bike Park to the street network. Consideration for the inclusion of this community facility should be given in the review of necessary height for the Property.
Moreover, the modification would not run afoul of Part I of Article 16:

(i) Conformance with the Comprehensive Plan
The project will substantially conform with the Subarea 2 guidance for the Property as an office site. The project will achieve substantial conformance with the intensity recommendations through the effective development of contributions towards affordable housing and public facilities. As noted above, the additional height requested is necessary to achieve the goals of the Comprehensive Plan for the site and, by extension, the effective implementation of the PTC District at the Property.
(ii) Design under PTC District versus Conventional District
Per the Comprehensive Plan and Section 6-501 of the Zoning Ordinance, the PTC District must be utilized for redevelopment projects implementing the vision for Tysons in the Comprehensive Plan.
(iii) Efficient Use of Land
The proposed site layout provides the most efficient redevelopment pattern for the Property. The proposed building orientation substantially opens up the views through the site and increases light and air. Moreover, rotating the building from the current conditions provides additional opportunities to introduce green spaces and activating outdoor uses, such as café space.
(iv) Protect Surrounding Properties
The proposed site development responds to the Comprehensive Plan's guidance for the site relative to adjacent uses and contributes towards the mix of uses for Tysons. Redevelopment of the Property will not impact surrounding sites or their ability to redevelop in line with the Comprehensive Plan.
(v) Availability of Public Utilities and Facilities
The Tysons Urban Center contains many existing transportation, public facility, and public utility assets that will support the proposed development. The project, which is within one-half mile of the McLean Metro Station, will contribute towards the development of Jones Branch Drive as a "collector" street. Also, as noted above, the Applicant will review mechanisms with staff to contribute towards such facilities.
(vi) Coordinated Linkages
Internal site access is provided through private driveways connecting the Property, the Hilton Worldwide headquarters building, the shared parking structure, and Jones Branch Drive. The site is well situated for employee access to and from the Outer Loop via Jones Branch Drive and the Jones Branch Drive Connector.

(vii) Conventional District Design Standards
Per Section 16-102(1), conformance with the bulk, landscaping, and screening regulations of the C-4 district would not be applicable to the Property, as it is not located at the periphery of the Tysons Urban Center.
(viii) Open Space, Parking, Loading, and Signage Standards
To the extent they are not provided for in the PTC district standards, or as otherwise requested herein in the form of a special exception or modification/waiver request, the application will meet the open space, parking, loading, and signage standards of the Zoning Ordinance.
(ix) Streets and Trails
As noted above, the Applicant will provide right of way improvements to Jones Branch Drive in line with the Comprehensive Plan guidance for "collector" streets.
(B) Section 2-506(1)(A) of the Zoning Ordinance.
The Applicant requests that the penthouse and mechanical structures be permitted to occupy 49% of the Park Place I roof. This waiver is necessary for the effective operation of the proposed building.
(C) Section 2-506(2) of the Zoning Ordinance.
The Applicant requests that the parapet wall be permitted to exceed the height limit above the roof line by 21.5 feet. This is necessary to provide effective screening for the penthouse and mechanical equipment.
(D) Section 6-501(7) of the Zoning Ordinance.
The Applicant is requesting a modification of the Urban Design Guidelines in favor of the building and parking design shown for the Property on the CDP/FDP. The request takes into account the proposal to redevelop Park Place I, while the existing garage and Park Place II remain in place until a Final Development Plan is submitted for Park Place II in the future.
(E) Section 6-505(7) of the Zoning Ordinance.
The Applicant is requesting a modification of this section to permit outdoor seating associated with the FDP.
(F) Section 6-506(1) of the Zoning Ordinance.
The Applicant is requesting a waiver of this section to permit a PTC District for the Property, which is under 10 acres. The combined acreage in the proposed district is over 7 acres;

however, it provides substantial consolidation of this block along Jones Branch Drive for future development under the PTC District standards.
(G) Section 6-509(1)(A) of the Zoning Ordinance.
As described above, the Applicant is seeking a waiver of this section to temporarily exceed the maximum parking requirements of the PTC District. A special exception request, as described herein, has been requested.
(H) Sections 11-201 and 11-203 of the Zoning Ordinance.
The Applicant is requesting a modification of the loading requirements as shown on the CDP/FDP.
(I) Section 16-102(1) of the Zoning Ordinance.
The Applicant is requesting a modification of the yard, setback, bulk, and building heights in favor of those shown on the CDP/FDP.
(J) Section 1 7-201(3)(B) of the Zoning Ordinance.
The Applicant is requesting a waiver of the interparcel access requirement for sites adjacent to collector streets. The Applicant's application will conform to the road vision for Tysons as shown on the CDP/FDP.
(K) Section 17-201(4) of the Zoning Ordinance.
The Applicant requests a waiver of this section requiring any further dedication and construction of widening for existing roads beyond that shown on the CDP/FDP.
(L) Section 17-201(7) of the Zoning Ordinance.
The Applicant requests a waiver of this section to permit installation of "No Parking" signs along travel ways at intervals greater than 50 feet with parking control signage to be determined at final site plan.
(M) Section 6-1307.2C of the PFM.
The Applicant requests a modification of this section to permit bioretention facilities to be located within the VDOT right of way with specific approval by VDOT.
(N) Section 6-1307.2F of the PFM.
The Applicant requests a waiver of the setback requirements for bioretention facilities in favor of that shown on the CDP/FDP.

The Applicant requests a waiver of this section to permit ladder truck access to the buildings as shown on the CDP/FDP. The existing and proposed road alignments will necessitate alternative compliance with this section of the PFM.
(T) Section 12-0510.4E(5) of the PFM.
The Applicant requests a modification of this section to permit planting area widths as shown on the CDP/FDP.
(U) Section 12-0515.6B of the PFM.
The Applicant requests a modification of this section to permit tree plantings within utility easements and/or storm drainage easements as shown on the CDP/FDP.
VI. Conclusion
For the reasons noted above, the Applicant respectfully requests that the Board approve a rezoning of the Property to the PTC District, as well as approve the enclosed CDP/FDP for the proposed site development. The Applicant further requests that the Board approve a special exception to permit an increase in the maximum onsite parking for the development.
