Samiti had concluded vide its circulatory submission that the aspect of granting permission to admit students on the basis of Non CET does not come within the purview of Samiti. The Samiti has already taken the decision in case the students to feel agrieved by that decision. They should approach the court. Samiti ratifies the said decision. Office to inform accordingly.

circulatory submission on 5th Februarv 2014 in respect of a request to enlist with Government CET for admissions to B.Sc. Nursina Course for the Academic Year 2014-15 received from M.K.S.S. Colleqe of Nursinq for Women, Naapur.

Samiti perused letter dated 8th January 2014 received from M.K.S.S. College of Nursing for Women, Nagpur requesting to enlist with Government CET for admissions to B.Sc. Nursing courses for the Academic Year 2014-15, said letter was circulated amongst the members of Samiti for the decision vide its circulatory submission.

Samiti had concluded vide its circulatory submission and grants its permission to aforesaid Colleges/Institutes to join State CET and to follow CET rules as per Government policy, subject to final approval/affiliation/permissions from respective Authorities. Samiti ratifies the said decision. Office to inform accordingly.

Samiti perused aforesaid Hon'ble High Courts order dated 4th February 2014. Office of the Samiti filed the affidavit in this matter and move the same in the Hon'ble Supreme Court. Samiti Noted the same.

a) Letter dated 27th Januarv 2014 recluestins to appoint an observer for the scannina process of PG-CET-2014.

b) Letter dated 2sth Januarv 2014 informina about the scanninq process PG-CET-2014.

c) Letter dated 21sf Januarv 2014 askina for 15 workinq davs time for declaration of Asso-PG-CET-2014 result /Ref. : Aaenda of the meetina dated 20/12/2012 (at Item No. 6ral).

d) Letter dated lsf Februarv 2014 convevina declaration of results of PG-CET-2014 for admissions to Post Graduate Medical and Dental Courses for the Academic Year 2014-15.

e) Letter dated 14'~ Februarv 2014 convevina declaration of final results of PG-CET-2014 for admissions to Post Graduate Medical and Dental Courses for the Academic Year 2014-15.

Samiti perused aforesaid letters received from Association regarding CFTJCAP- 2014 for adrr~ission process of Post Graduate Medical and Dental Courses for the Academic Year 2014-15. Samiti directs the Associations to maintain the transparency in CET and admissions process. All admissions to be done as per the norms, rules, regulations, guidelines and orders laid down by the Hon'ble Courts and respective councils.

I tem No. 7(al: Letter dated sth Februarv 2014 received from Jamia Islamia Ishaatul Uloom, Akkalkuwa, Jalna askins for approval to brochure and conduct o f Minoritv CET for admissions to Minoritv Manaqement Quota for admissions to first year M.B.B.S. course for the Academic Year 2014-15.

Samiti perused the aforesaid letter received from Jamia Islamia Ishaatul Ullom. Akkalkuwa, Jalna asking for approval to brochure and conduct of Minority CET for admissions to Minority Management Quota for admissions to first year M.B.B.S. course for the Academic Year 2014-15.

Samiti observes that per the law laid down by the Supreme Court of India in its judgment in the case of Islarr~ic Academy versus State of Karnataka (2003) 6 supreme Court cases 697 (para 16) there is no provision for separate CET for minority institutes.

I n view of the above, after deliberations, Samiti decides not to accede to the request made by the aforesaid Institute. Office to inform accordingly.

I tem No. 7(b): Letter dated 27th Januarv 2014 received from Maharashtra Universitv of Health Sciences, Nashik askincr for suidance in resDect of admitted students throush NEET-CET to Post Graduate Medical and Dental Courses for the Academic Year 2013-14.

Samiti perused the aforesaid letter received from Maharashtra University of Health Sciences, Nashik asking for guidance in respect of admitted students through NEET-CET to Post Graduate Medical and Dental Courses for the Academic Year 2013-14.

It is observe that Samiti already in its meeting held on 25th October 2013 directs to the "Competent Authority, Association of Management of Unaided Private Medical and Dental Colleges of Maharashtra to submit sufficient evidence as to where the list of qualified students in APGDIAPGM-CET-2013 has been exhausted fully for Academic Year 2013-14 for Post Graduate Medical and Dental courses" but reply of the Association is not yet received.

After deliberation, Samiti decides to call for the explanation in this regard from the Association within one week, after receipt of the same it be placed before Samiti for its consideration.

7th March 2014 I tem No. 7(c): Letter dated llth Februaw 2014 received from Somaiva

Avurvihar K.J. Somaiva Medical Colleae and Research Center, Mumbai requestins to permit t o fill 8 (15% of total intake : 50) seats under NRI quota evew vears t o first vear M.B.B.S. course.

Samiti perused the aforesaid letter received from Somaiya Ayurvihar K.J. Somaiya Medical College and Research Center, Mumbai requesting to permit to fill 8 seats under IVRI quota every years to first year 1Y.B.B.S. course.

It is observed that the said college/Institute is opted Government CET for their admission process. After deliberations, Samiti directs the College/Institute to follow rules, regulations and policy of Government CET.

Item: Letter dated 23* Januaw 2014 received from Annasaheb Chudaman Patil Memorial Dental Colleae, Dhule in respect of refund of fees o f Kum. Garai Anand Birie (Ref. : Minutes o f the Meetinq dated 20/12/2013 a t Item No. 5(b)l

Samiti perused the aforesaid letter received from Annasaheb Chudaman Patil Memorial Dental College, Dhule in respect of refund of fees of Kum. Gargi Anand Bitje.

After deliberations, Samiti decides to forward the said letter to complainant viz. Kum. Gargi Anand Bitje. Student to respond thereupon. After receipt of the same it be placed before Samiti for its consideration. Office to inform accordingly.

I tem No. 7(el: Letter dated 4th Februaw 2013 received from St. Luke's Hospital Colleae o f Nursina, Ah mednaqar requestins t o enlist with Government CET for admissions t o P.B.B.Sc. Nursinq course for the Academic Year 2014-15.

Samiti perused the aforesaid letter received from St. Luke's Hospital College of Nursing, Ahmednagar requesting to enlisting with Government CET for admissions to P.B.B.Sc. IVursing courses for the Academic Year 2014-15.

After deliberations, Samiti grants its permission to aforesaid Colleges/Institutes to join State CET and to follow CET rules as per Government policy, subject to final approval/affiliation/permissions from respective Authorities.

I tem No. 7(Q: Letter dated 23rd Januarv 2014 received from Directorate of AYUSH, Maharashtra State forwardina the ap~l icat ion of one Dr. Sukhdev K. Tonde of Raiarambapu Patil Avurved College, Sanali for Post Graduate Avurved course (Academic Year 2013-14) askinq for refund of fees.

Samiti perused the aforesaid letter received from Directorate of AYUSH, Maharashtra in respect of complaint of Dr. Sukhdev K. Tonde against Rajarambapu Patil Ayurved College, Sangli for refund of fees

It is observed that College/Institute vide its letter dated 22/02/2014 submitted its reply on the same.

After deliberations, Samiti decides to forward the letter dated 22/02/2014 submitted by the College/Institute to complainant viz. Dr. Sukhdev K. Tonde. Student to respond thereupon. After receipt of the same it be placed before Samiti for its consideration. Office to inform accordingly.

Item No.9: To consider and decide on the followina matter with the permission of the Chair.

Item No. 9(a): To consider and decide the followinq letters in respect of a reauest to permit admissions to Nursinq courses who did not appear CET for the Academic Year 2012-13.

i) Letter dated 4th March 2014 received from Medical Education and Druqs Department, Government of Maharashtra.

ii) Letter dated 4th March 2013 received from Association of Manaaement of Unaided Nursins Colleaes, Pune.

Samiti perused the aforesaid letters in respect of a request to permit admission to Nursing courses who did not appear CET for the Academic Year 2012-13. Samiti also perused the Hon'ble High Court order dated 1 3 ~ ~ December 2013 in Writ Petition No. 11495 of 2012; relevant portion of the said order are as under:

'Para : 11 We are of the opinion that the Committee/ Samiti has not

committed any error apparent on the face of record or perversiity in holding that it is created for ensuring that the students are enrolled and admitted strictly in accordance with the merit lljf maintained pursuant to the Entrance Test which have been conducted by the State Government or other competent authorities including the Association of Managements of Private Institutions, The students coming to the Samiti de-hors this examination process/ Entrance Test and seeking admissions to collqes against the vacant seats, is a matter which is beyond the purview of the Samiti. The Samiti has, therefore, refused to oblige the students for this year. We do not see an error in this approach of the Samiti and equally we find no legal basis for the relief's claimed We are unable to entertain these Writ Petition, Leaving other courses open to the Managements and students includig to approach the State Government and other Competent authorities and seek their intervention so as to sort out their dificulties, those Writ Petihns are dismissed Our orders do not prevent the students fiom initiating appropriate proceehgs against the Managemen& and State and to seek appropriate relief's including loss and damages. "

I n view of the above Samiti places on record that the Government of Maharashtra should issue the necessary orders in this respect.

After deliberations, Samiti decides that after receipt of the necessary orders from the Government of Maharashtra it will be placed before Samiti for its consideration. Office to inform accordingly.

Education and Druqs Department, Government of Maharashtra resardinq admission of B.Sc. Nursins courses on the basis of MT-CET-2013 (Ref. : Samiti decision 24/06/2013 Item No. 3relI.

Samiti perused the aforesaid letter received from Medical Education and Drugs Department, Government of Maharashtra regarding admission of B.Sc. Nursing course on the basis of MT-CET-2013 .

It is observed that MT-CET-2013 is conducted by Directorate of Technical Education, Maharashtra State for the admissions of first year B.Engineering and B.Pharmacy courses for the Academic Year 2013-14.

I n view of the above, its seems that course of B.Sc. Nursing comes under Heath Science courses and MT-CET-2013 conducted for the purpose of admissions of technical courses, Hence Samiti decides that not to approve the admissions of B.Sc. Nursing courses done on the basis of MT-CET-2013 for the Academic Year 2013-14, office to inform.

Item No. 9(c): Consider and decide the observation report submitted by the Expert Committee i.e. Maharashtra Universitv of Health Sciences, Nashik vide its letters dated 26/02/2014 and 3/3/2014.

Samiti perused the report under reference.

After deliberation Samiti decides that, where there are no discrepancies such admissions stand approved, where there are discrepancies such admission are approved, subject to the Expert Committee sorting out and disposing off with said discrepancies after appropriate compliances within four weeks from respective Institutions for Academic Year 2013-14, the details which are enclosed as Annexure - A.

Samiti further decides that Expert Committee remarks/observations in respect of approval of admission process of first year M.B.B.S. course of Indian Institute of Medical Sciences Research Centre, Jalna for the Academic Year 2013-14, subject to Hon'ble High Court order dated 4t" September 2013 in Writ Petition (Lodging) No. 1970 of 2013.

Samiti further decide that Item No. 9(e) to 9(n) to be taken in the next meeting due to paucity of time.

Next meeting of Pravesh Niyantran Samiti (Medical Education) will be held on Friday, the llth April, 2014 at 03:30 p.m. in the Conference Hall, Office of the Regional Centre of Maharashtra University of Health Sciences, Mumbai - 400 001.
