Final Report Mechanism to Ensure Sustainability of Consumer Societies

1. Revised TOR Inception Report of the Energy Forum submitted to PUCSL on 'Mechanism to Ensure Sustainability of Consumer Societies' made 8 recommendations. The recommendation 8 was to amend the Terms of Reference on Mechanism to Ensure Sustainability of Consumer Societies. The PUCSL's letter to the Energy Forum dated on 26th September, 2013, accepted the recommendations and instructed to implement recommendations no. 2 and no. 6 of the Inception Report in place of the deliverable 5 of the TOR. Original TOR - Deliverable 5 Adopt the recommended mechanism with respect to the organizing of a consumer network, through managing five (5) RCSs established in the Sabaragamuwa Province, as a pilot project, for a period of six (6) months. The consultant is expected, at minimum, to: (a) meet and discuss with the members of RCSs by visiting the respective five (5) villages twice: at

the beginning of pilot project and before/at the end of period (b) monitor closely whether the objectives of the Commission (identified under ‘item B2b’ above)

are being met (c) at the end of each month, visit the office of the Commission and report the progress Revised TOR Recommendation 2 of the Inception Report - Establish a network consisting of consumers who responded to the PUCSL public hearing in 2013 March (NGOs, TUs, Senior Citizens, Professionals, University Academia, Students and Activists), the representatives of ECCs established by the CEB and RCSs established by the PUCSL. It is important to conduct a brainstorming session with them, and to get their proposals for finalizing the CCC restructuring process & formulating the strategy of the NCN. Recommendation 6 of the Inception Report- Formulate a 3-year implementation plan for the CCC & NCN and a detailed action plan for the year 1. Based on the revised TOR, EF carried out the recommendation no. 2 and no. 6 of the Inception Report instead of the “Pilot Project” stated in the original TOR.

2. National Workshop Report

A brainstorming workshop titled 'How to safeguard the consumer rights?' was conducted on 20th November 2013 at the HARTI with the participation of representatives of following sectors: Consumer societies formed by PUCSL; Consumer Societies formed by CEB; Consumer Organizations; Electricity Consumer Networks; Consumer Consultative Committee; NGOs; Social Service organizations; Trade Unions; Community Based Organizations; Individuals; CEB; LECO; Consumer Affairs Authority; and PUCSL. The brainstorming workshop was facilitated to obtain further ideas and suggestions from the participants on sector issues, activities that can be implemented to minimize those and their roles for implementing such activities.

The participants strongly indicated that electricity consumers should be organized by creating consumer groups, societies and by networking among them. Therefore, they identified list of activities to be implemented by their organizations. Some of the activities have been implemented by some organizations using their own resources and are willing to expand their activities with additional external support and by pooling the resources. Most of participants expressed that they are committed to the safeguard consumer rights and protecting those is a main objective in their agenda. In addition, they have indicated that they are willing to implement following activities for safeguarding electricity consumer rights: Awareness Creation among public

3. Proposed Implementation Structure Based on the suggestions made at the National workshop and the findings of the desk review & interviews it is proposed to:

1. Restructure the CCC and appoint members for the CCC from the representatives of already active organizations (Chambers, NGOs, TUs, FECS, RCSs, ECCs , etc.)

2. Establish and facilitate the National Consumer Network (NCN) consisting of active organizations (Chambers, NGOs, TUs, FECS, etc.)

3. PUCSL to establish a secretariat for the Consumer Consultative Process housed outside the PUCSL and assign the tasks of facilitating the CCC and the NCN. Functions of the Secretariat:

­ handle the secretariat work of CCC ­ implement the decisions made by the PUCSL & CCC ­ establish, facilitate and build the capacity of the NCN ­ formulate training modules for building the capacities of the Consumer Societies (CS) ­ establish, build the capacity of the both at Distribution Licensee Level Consumer

Networks (DLCNs) and Area Engineer (AE)/Brach Manager (BM) level Consumer Societies (AE/BM-CS) and link them with respective Licensees/AE offices/ Branch Managers of the Distribution licensees and also with NCN

3.2 Restructuring Consumer Consultative Committee (CCC) The Section 2 of the Consumer (Composition of the Consultative Committee) Regulations No. 1 of 2009 notified under the Gazette by the Minister of Plan Implementation on 07th December, 2009 describes the composition. Sub Section 2 (a) of the regulation says that CCC should consists of "nine persons to represent the nine Provinces appointed by the Commission: such persons shall be selected from amongst persons who have demonstrated a keen interest in consumer affairs within their respective provinces and who have responded to an advertisement published by the Commission, which advertisement has been published in one daily newspaper in the Sinhala, Tamil and English languages. In addition there will be three persons selected by the Commission from amongst the persons who possess knowledge relating to each public utility industry and one person each from Federation of Chambers of Commerce and Industry of Sri Lanka, National Chamber of Commerce of Sri Lanka and Ceylon Chamber of Commerce nominated by the respective chambers. Though representatives from Industrial chambers are organized to represent their organization and chambers, provincial members do not have the backing of such networks to represent their respective provinces or domestic consumers. It is proposed to change the composition of the CCC c as follows: Instead of having 9 representatives from 9 provinces it is proposed to appoint 5 representatives to represent the consumer networks to be established in 5 distribution licensee areas, 3 representatives from the National consumer Network to be established, and 1 representative from Federation of Electricity Consumer Societies (FECS) to represent of-grid communities. Members of CCC will be appointed by the PUCSL by taking into consideration the nominations made by the respective networks. 3.3 Establishment of the National Consumer Network (NCN) Purpose of establishing a consumer network under the section 4.3.4 of the Regulatory Manual of the PUCSL:

1. to function as a forum to share the views and concerns with each other 2. to provide inputs on regulatory and policy matters to CCC 3. to provide means for the CCC to consult with the consumers and to survey them

a. Assess high quality electricity supply service through consumer feedback b. Make them aware on rights and responsibility of consumers in electricity sector c. Obtain consumer feedback in decision making process on introduction of the standards

of services, tariff revision etc. d. Enhance public awareness on role of the PUCSL e. Obtain help in carry out the formal way leave procedures f. Obtain help to carry out activities discharged by PUCSL

The inaugural NCN will be established with the participation of organizations selected for the National Workshop. The NCN will be initially focusing on electricity sector issues however the member organizations will have the freedom to address diverse consumer interests. The role of the PUCSL and CAA will be to support and to provide necessary resources to strength the network activities.

The office bearers of the National Consumer Network will be appointed by the members of the network and it will function as an independent civil society organization. The secretariat will work closely with the NCN and build the capacity of the Network members to form Consumer organizations at Area Engineer (LECO -Branch Manager) level (AECS/BMCS). In order to attend and resolve any consumer issue relating to the utility, respective AE office should recognize the role of the AECS as the representative of the consumer. When such AECS are formed then it is possible to go to the next step and form the Consumer Societies at the Licensee level (LCS). The NCN can be strengthened by getting the participation of the representatives of the LCSs.

Terms of Reference Secretariat for facilitating the Consumer Consultative Process

A. Background Public Utilities Commission of Sri Lanka (Commission) was established by the Public Utilities Commission of Sri Lanka Act, No. 35 of 2002 (PUCSL Act), to regulate certain utilities industries in Sri Lanka pursuant to a coherent national policy. The Commission commenced economic, safety and technical regulation of the electricity industry with the enactment of Sri Lanka Electricity Act, No.20 of 2009 (Electricity Act), in April 2009. As per Section 28 of the PUCSL Act, the Commission, in exercise of its powers under the Electricity Act or any regulation made thereunder, is required to protect the interests of the consumers, amongst others, -

a) to be heard and to be assured that their interests will receive due consideration; and b) to consumer education.

The Commission, as required under Section 29 of the PUCSL Act, has appointed a Consumer Consultative Committee (CCC) to protect the interest of consumers, by way of:

a) advising the Commission on appropriate standards for the services provided to consumers;

b) monitoring the extent to which the needs of consumers are being met; and c) promoting awareness of the standards prescribed and the rights of consumers with

respect to such standards. The CCC consists of fifteen (15) members, who work on voluntary basis, including:

nine (9) members representing the consumers in each province of the country

one (1) member each representing the consumers of electricity, petroleum and water service industries – total three (3) members

three (3) members representing small and medium industrial and commercial consumers (through chambers)

The CCC discharges its functions through various means including organizing a consumer network. The consumer network would provide a forum within which consumers can share their views and concerns with each other and with the CCC, and through which they can participate in regulatory and policy matters. It also provides a means for the CCC to consult with consumers and to survey them. It was envisaged that individual consumers, consumer associations in the electricity industry and any other existing consumer organization would participate in the network.

However, due to the absence of effectively functioning consumer organizations and the lack of consumer activism in the country, a successful consumer network couldn’t be established as yet. Hence, the Commission hired a consultant to conduct a study to come up with recommendations for strengthening the electricity consumers in Sri Lanka. Based on the recommendation of the study the Commission has decided to request for proposal from qualified local parties who have expertise in electricity consumer societies' related activities to function as the Secretariat for facilitating the Consumer Consultative Process in Sri Lanka. Goal of the Consumer Consultative Process Country-wide electricity consumer network is established and sustainably functional, providing support for the electricity consumers to protect their rights and to represent their aspirations both at national consultations and at the Distribution Licensee level. Specific Objectives of the program 1. Established a national consumer network and five Distribution Licensee level consumer

networks and 60 consumer societies at Area Engineer/ Regional Manager level. 2. Design and conduct consumer education program for building the capacity of 120 network

leaders and other related groups 3. Conduct consume awareness programs and educate at least 24,000 electricity consumers on

their rights relating to expected level of service and quality of electricity from the utilities and their obligations.

4. Assist the consumers to actively participate at the public consultations of the PUCSL 5. Establish a suitable mechanism to liaise with the utility to address electricity consumer related

issues Activities 1. Establish a national network consisting of organizations working on consumer rights. 2. Establish consumer help desk to support electricity consumers for resolving the issues they face. 3. Prepare a brochure on electricity consumer networking, a training module on consumer rights,

responsibilities & efficient use of energy, and an educational tool kit for activists 4. Conduct 6 Training of Trainers (TOT) workshops for the leaders of organizations keen on

electricity consumer rights for building their capacities to educate members, establish and run consumer societies at AE/BM and DL levels.

5. Establish Distribution Licensee (DL) level electricity consumer networks and liaise those with Distribution Licensees.

6. Facilitate conducting seminars for the members of the CBOs, school children & University students and establish consumer societies at AE/BM level (AE/BM-CS).

7. Conduct studies on consumer concerns relating to power sector core issues. The outcome of these studies can be the position papers of the national consumer network. The PUCSL will provide data and information to support studies to be conducted.
