MBAProgramRegulations2015-2016AtthecloseofOrientationWeek,youwillbepresentedwithaformtosigndeclaringthatyouhavereadandunderstandthe regulationsof theMBAProgram, theGraduateSchool,andtheUniversityofNewBrunswick.GraduatestudentsatUNBneedtobeawareofthreesetsofregulations.Thefirstsetrelatesto yourMBAprogram in particular and is contained in this document. Secondly, a broader set ofCalendarRegulationsapplyingtoallUNBgraduatestudentsarefoundontheSchoolofGraduate Studieswebsite. Thirdly,whereneitherof theabovesetsof regulations applies, the general UNB regulations applyand are found in the Undergraduate Calendar.If questions or difficulties arisewhich are related to your program, please refer initially to thesources listedabove. Program Description TheMBA Program consists of five modulesover1-year. Eachmoduleis8weeksin length,witha9thweekforexams.Eachmodule,fulltimestudentscomplete12.5credithoursforatotalof62.5credithours(chrs)intheyear.Eachcourseisworth2.5credithourswiththeexceptionofMBA7015,whichis10.0credithours.Studentswillmaintainafull-timecourseload(12.5chrs)eachmoduleandmustcompletewithintheyear.Thereare three streamsof study: EntrepreneurshipandTechnologyManagement(ETM),InternationalBusiness (IB),andProjectManagement(PM).StudentshavetheoptionofformingaGeneralManagementcourseofstudybytakingavarietyofcoursesfromeachofthethreestreams.AResearchoptionisavailable;studentscomplete25credithoursofcoreandmanagementskillscoursesplus37.5credithoursofresearch.IntheweekpriortothestartofModule1,studentswillattendamandatoryMBABootcamp.ImportantdatesfortheyearcanbefoundinAppendix1ofTheMBAStudentHandbook,whilethefullprogramlayoutcanbefoundinAppendix2,anddetailedcoursedescriptionsareinAppendix3,bothalsointhehandbook.

Inmodulefive,IBstudentstakethestudyabroadtermaccumulating10credithoursofelectivecoursespluscompleteMBA7011.PMstudentswillcompleteMBA7015andMBA7011.ETMandGM*complete4electivesintheirareaplusManagementSkillsDevelopmentII.Streams TheMBAProgramoffers3specializations,orstreams,forMBAStudentsplustheoptiontotakemoregeneralstudies(GM).Studentscanchooseanyspecialization.Eachstreamincludesonecorestreamcourse,4electivestreamcourses,andabusiness-consultingproject(IBstudentscompleteastudyabroadtermratherthanaproject).Thefollowingtableprovidesthestream-specificcourses.AfullcourselayoutcanbefoundinAppendix2oftheStudentHandbook,withcoursedescriptionsinAppendix3.

StudentswillrequirepermissiontoworkinCanadafromCitizenshipandImmigrationCanadapriortobeginningthebusiness-consultingproject,whetherthecompanyisaprivatecorporation,non-profit,ortheUniversity,andwhetherthepositionispaidorunpaid. Applications foraco-opworkpermit shouldbeginin January.StudentsmustconsulttheInternationalStudentAdvisortoobtainadviceonapplyingforaco-opworkpermitnolaterthanJanuary30.YoushouldbeginthisprocessnolaterthanJanuary4,2016andsubmityourconfirmationtotheMBAOfficenolaterthanJanuary13,2016.StudentswillalsorequireaSocialInsuranceNumber.

ThecoursedescriptionforMBA7015maybefoundinAppendix3oftheStudentHandbook.Studentsmustbeingoodacademicstanding(withaCGPAof3.0orhigher)tobeacceptedintotheBusiness Consulting Project (MBA 7015)andparticipateininterviews.Therefore,anETM,PMorGMstudent,withaCGPAlessthan3.0atthe endofModule2,willnotbepermittedtogoontheBusinessConsultingProjectandwillcompletecoursesinModules4and5.ETMandPMstreamsarenotgrantedwithoutsuccessfullycompletingMBA7015thereforethesestudentswillfinishwithintheGMstream,and

willneedtodelaytheirgraduationinordertotaketheGMstreamcourse,MBA7503,inModule2ofthefollowingyear.Study Abroad Term for IB Students UNBSaintJohn’sstudyabroadpartnerisTheBurgundySchoolofBusinessinDijon,France.Thestudyabroadportiontakesplaceduringthefinalfallterm,fromSeptembertoDecember.Asaresult,thisprogramwillbe15monthsinlength,ratherthan12.

FeesforeducationabroadarepaidthroughstudenttuitionatUNBSaintJohn.Studentswillstudytheequivalentof10credithourswhileabroad.Thisisequivalentto24ECTScreditsinFrance.Notethatmarkingstandardsarenotthesameatalluniversities;therefore,studentsmustfamiliarizethemselveswiththeexpectationsateacheducationalinstitution.ThestudyabroadexperienceismandatoryfortheIBstream.Studentsmustbeingoodacademicstandingtoparticipateinthestudyabroadprogram.AnIBstudentwithaCGPAlessthan3.0attheendofModule2willnotbepermittedtogoonstudyabroadandwillcompletecoursesatUNBSJinModule5.ThereforethesestudentswillfinishwithintheGMstream,andwillneedtodelaytheirgraduationinordertotaketheGMstreamcourse,MBA7503,inModule2ofthefollowingyear.Business Plan (MBA 7011) ThebusinessplanisarequiredcomponentoftheMBAProgram.StudentswillcompleteinModule4or5dependingonthestreamofstudy.ThecoursedescriptioncanbefoundinAppendix3oftheStudentHandbook.Research Option - Master’s Degree Report (MBA 7020)TheResearchoptionallowsstudentstoconductresearchexploringthemostrecentchallengesinbusinessthroughliteraturereviewsandprimaryresearch.Aftercompletingtheelevenfoundationandskillsdevelopmentcourses,studentswillconductresearchandpotentiallytakeadditionalrelevantcoursesunderthedirection of their faculty supervisor. Students planning to take this option shouldidentify themselvestotheMBADirectorasearlyaspossible,asittakestimetofindaresearchsupervisorandarrangearesearchprogram.Researchstudentswillworkwiththeirfaculty supervisortochoosecoursesthatsupporttheirareasofresearch.MBAstudentsmusthaveastrongcurrentandpreviousacademicrecordinordertobeselected fortheresearchoption.Additionaldetailsmaybefoundonpage14.

MBA Specific-Policies Groups Studentswillworkongroupassignmentsandprojects inmixedgroupsoffourtoseven.Forcorecourses, groupswillbeassignedbyMBAstaff. Innon-corecourses,studentsmaychoosetheirowngroupssubjecttoinstructordesignforeachcourse.Studentsarerequiredtoformdiversegroupswithnomorethantwopeoplefromeachworldregion(i.e.SoutheastAsia,Canada/US,Europe,China,Africa,andLatinAmerica).MichelleScottandyourinstructorswillhavethefinalsayinthecompositionofgroups.Iftherearelessthan4part-timestudentsintheclass,theywillbeintegratedwiththefull-timestudentgroups.

Groupsaremadetomaximizediversity;thereforefamilymembersandfriendswillnotbeputinthesamegroup.Decisionsaremadetobenefittheclassandprogramasawhole,nottoaccommodateindividualneeds.

Communication TheMBAprogram,theGraduateSchool,andprofessorswillcommunicatewithstudentsviaUNBe-mail.Personale-mailaddresseswillnotbeusedduetostrictconfidentialityregulationsinCanada.ThelanguageofuseintheMBAprogramisEnglishatalltimesintheclassroom,duringgroupwork,andinwrittencommunicationbetweengroupmembers.Dress Code ThedresscodeforMBAclassesandseminarsisataminimumtheattireofaprofessionalstudent(Appendix6intheStudentHandbook). During presentations,guestspeakerstoclass, and duringmeetings withmembersoftheSaintJohnbusinesscommunity,formalbusinessattirewillbemandatory.Textbooks Thephotocopyingoftextbooksis illegal inCanadaandthepenaltiesaresevere, includingheftyfinesandprisonterms.Studentswillnotbepermittedtousecopiedtextbooksintheclassroom.Course Syllabus Thecoursesyllabusisacontractbetweenprofessorandstudent.Bothpartiesareboundbythiscontract.Studentsmustfollowduedatessetonthesyllabusandcoursetimetableasinstructorswillnotremindstudentsofimpendingdeadlines.

Tuition and Fees Tuitionpaymentsmustbemadebytheduedates.Beyondthattime,interestpenaltieswillaccrue.Studentsmaybede-registeredfromcoursesandservicesmaybedeactivated.Whilestudentsinothergraduate programspay tuition on a per term basis, M B A Tuitionisscheduledfor3paymentsthroughouttheprogramyear.TuitionispaidatFinancialServicesinOH119.

Toavoidbeingdroppedfromaclass,andthereforetheMBAprogram,studentsmustattend4hourswithinthefirst8hoursofeachcourse.Nomorethanatotalof8hourspercoursemaybemissedthroughoutthemodule.Thismaybeadjustedtofewerthan8hoursmissedattheinstructor’sdiscretion.

Wherethereisadisagreementbetweenthestudent’sandtheinstructor’srecordsofattendance,theinstructor’srecordswillbeconsideredcorrect.Studentsshouldensuretheirattendancehasbeenrecordedaccurately. Code of Conduct TheMBAProgramdoesexpectacertainstandardofprofessionalbehaviour forstudent interactionwithstaffandfaculty.ThefollowingpointsareadaptedfromtheMcGillMBAProgrampolicies.

• Provide24hoursnoticebyemailforcancellationofanyappointmentswithStafforFaculty.• Arriveon-timeforappointments,class,andMBAsponsoredevents.• Respectthedress-codeestablishedforprofessionalevents.Inappropriateattiremayresult

in Programstaffdenyingentrytoanevent.• Strictlynouseofcellphonesorotherelectronicdevicesduringclassorseminarsfor

texting,searchingtheweb,andotherformsofdistraction.Answeringofaphoneduringclasswill resultinthestudentbeingaskedtoleavetheclassroomandnotreturn.

• Professionalbusiness-likebehaviorisexpectedatalltimesintheMBAclassroomandatprofessionaleventsonandoffcampus.

Advanced Standing Advancedstanding(oracoursewaiver)maybegiventoastudentwhohascompletedsubstantialacademicstudysupportedbyrecentworkexperienceinthesubjectarea.Studentsmayapplyforadvancedstandingsinthefollowingcorecoursesonly:

• MBA7214• MBA7303• MBA7605• MBA7504• MBA7404or7405• MBA7626

MBA7102andMBA7100arenoteligibleforadvancedstanding.AdvancedstandingwillnotbegivenforanyothercoursesintheMBAProgram.Students are requiredtocontinueattendingclassuntiltheyreceivewrittenconfirmationofadvancedstandingfromtheSchoolofGraduateStudies.Toqualify foradvanced standing, the studentmusthaveworked in the course subjectareaaswellasmeetoneofthefollowingconditionswithinthepast5years:

• Asubstantiallysimilarcoursetakeninagraduatebusinessschoolatanapproveduniversity,

• Amajorintheareaattheundergraduatelevelinanapproveduniversity,or• Aprofessionalcertificationintheareafromanationallyrecognizedcertificationbody.

Toapply,studentsshouldwritealettertotheDirectoroftheMBAProgramandincludethefollowinginformation:

• theMBAcoursetobewaived,• thecourse(s)orcertificationtobeconsideredasequivalent,• theinstitution(s)atwhichstudywascompleted,• acopyoftherelevanttranscript,and• acopyofthecoursesyllabiforeachcoursetobeconsideredasequivalent(itwillnotbe

necessarytoprovideasyllabusforacoursetakenatUNB).•

ThewaiverdecisionwillbeofficiallymadebytheAssociateDeanofGraduateStudiesuponrecommendationfromtheMBADirector.Studentswhohavereceivedadvancedstandingarenotobligedtoattendtheclass.Studentscanrequestaprivilege forattending thecoursebut in thatcasemustbeexcluded fromgroupprojectsandanyothergradedcoursework.Permissiontoattendwillnotautomaticallybegranted.Tuitionischargedfortheentireprogramratherthanpercourse.Therefore,tuitionisnotreducedwhenstudentsreceiveadvancedstandinginoneormorecourses.

Thedeadline to apply for advanced standing is theendof the firstweekof classes inmodules1,2and3.Nolateapplicationswillbeaccepted. Unethical Actions Itisconsideredunethicalto:

Policy on Discrimination, Harassment, and Sexual Harassment InCanadianandNewBrunswicklaw,aswellasUNBpolicy,therearelawsandrulestofollowaspermanentortemporaryresidentsofCanadaandasstudents,faculty,andstaffofUNB.TheCanadianCharterofRightsandFreedoms,Section15.1,statesthefollowing:“Everyindividualisequalbeforeandunderthelawandhastherighttotheequalprotectionandequalbenefitofthelawwithoutdiscriminationand,inparticular,withoutdiscriminationbasedonrace,nationalorethnicorigin,colour,religion,sex,age,ormentalorphysicaldisability”.TheCharterwasdevelopedbyJohnPetersHumphrey,aNewBrunswicknativeandthemainauthoroftheUniversalDeclarationofHumanRightsadoptedbytheUnitedNationsin1948.TheMBAProgramhasimplementedaprogramtocreateawarenessamongstallparticipants;totrainallMBAprogramparticipantsbothintermsofhowto recognizeharassmentanddiscrimination,andtoknowwhatstepstotakewhentheharassment anddiscriminationoccurs.Finally,theProgramneedstomakepeopleawareoftherepercussionsofsuchactions.STEP1:AwarenessOurfirststepistomakeallstudentsawareofthefollowing:

• ThatharassmentanddiscriminationhavetakenplaceintheMBAenvironment.• TheMBAProgramdoesnotcondoneharassmentanddiscrimination.• Actionwillbetakenagainststudentswhoharass,bullyordiscriminateagainstother

students.Atthispoint,itisimportanttoprovidedefinitionsfortheterms“harassment”,“sexualharassment”,and“discrimination”undertheNewBrunswickHumanRightsAct.

Discrimination:differentialtreatmentofanindividualorgroupofindividualswhichisbased,inwhole

orinpart,onrace,colour,religion,nationalorigin,ancestry,placeoforigin,age,physicaldisability,mentaldisability,maritalstatus,sexualorientation,gender,socialcondition,politicalbelieforactivity,andwhichthushasanadverseimpactontheindividualorgroupofindividuals.Harassment:behaviourwhichservesnolegitimatepurposeandwhichtheinstigatorknows,or oughtreasonablytoknow,hastheeffectofcreatinganintimidating,humiliating,hostileor offensiveenvironment.ExamplesofbehaviourwhichconstituteHarassmentinclude-butarenot limitedto-bullying,intimidation,coercion,physicalassaults,vexatiousormaliciouscomment,ortheabuseofpower,authorityorinfluence.ThereasonableexerciseofadministrativeoracademicauthoritydoesnotofitselfconstituteHarassment.SexualHarassment:conductofasexualnaturesuchas-butnotlimitedto-verbalabuseorthreatsofasexualnature,unwelcomesexualinvitationsorrequests,demandsforsexualfavours,orrepeatedinnuendosortauntingaboutaperson'sbody,appearanceorsexualorientationwhen:

1. submissiontosuchconductismadeeitherexplicitlyorimplicitlyatermorconditionof anindividual'semployment,academicstatus,oracademicaccreditation,or;

2. submissiontoorrejectionofsuchconductbyanindividualisusedasthebasisforemployment,orforacademicperformance,statusoraccreditationdecisionsaffectingsuchindividual,or;

3. suchconductinterfereswithanindividual'sworkoracademicperformance,or;4. suchconductcreatesanintimidating,hostileoroffensiveworkingoracademic

environment.

Behaviourconductedinwholeorinpartthroughelectronicmeans(suchase-mail,webpostings,textmessagingandotherformsofelectronicbehaviour)shallbeincludedwithinthese definitions.Step2:TrainingAseminarwillbeprovidedduringMBAModule1bytheUNBOfficeofHumanRightsandPositiveEnvironmentwiththegoalto:

• increaseyourawarenessofwhatconstitutesharassmentanddiscrimination• equipyouwiththetoolstohandleharassmentanddiscrimination• educateyouonthestepstotakeifyouexperience,orobserveothersexperiencing,

harassmentand/ordiscriminationStep3:ConsequencesTheconsequencesofengaginginactivityofaharassingordiscriminatorynatureatUNBarerelativetotheseverityoftheincidentandcanrangefromminortosevere.Examplesofconsequencesare:

• Trainingand/orcounseling• Aletterinyouracademicfile• ExpulsionfromUniversity

CertainformsofharassmentarealsopunishableundertheNewBrunswickCriminalCode. ThisisaUniversitywidepolicyandpolicycoversallparticipantsintheMBAProgram–staff,students,andfaculty–aswellasallemployeesandstudentsatUNB.Italsocoversharassmentofemployeesbystudents,aswellasstudent-to-studentandemployee-to-student.Attheendofeachacademicyear,wereassessourprogressinthisareaandstrengthenour trainingprogramandproceduresasnecessary.StudentsshouldreviewUNBPolicy,NewBrunswickHumanRightsAct,thematerialpresentedbyTheOfficeofHumanRightsandPositiveEnvironmentatUNB,andtheUNBStudentDisciplinaryCode.Gift Giving Canadaisnotagift-givingcultureasinmanyotherpartsoftheworld.Canadiansgivegiftsto familymembersandintimatefriendsonspecialoccasionsandtimesofcelebrationonly,suchason re l i g ious ho l idays ,andforbirthdaysandweddings.

Giftsarenotgenerallyexchangedbybusinessassociatesorbetweenfaculty/staffandstudents. Graduate School Policies AllpoliciesoftheUNBGraduateSchool,applytoMBAstudents.ThefollowingareparticularlyrelevanttoMBAstudents.Registration GraduateStudiesistheRegistrarforMBAstudents.StudentsregisterthemselvesonlineinallMBAcourses.Ifaregistrationdateismissed,thestudentwillhavetowaituntilthefollowingyeartotakethecourse.Thereisnoflexibilityforpersonalsituations.TheGraduateStudiesProgramwillfollowtheruleswithoutexception.

ForModule1,studentsregisterduringorientationafterbeingassignedtoasection.SectionsaresplitinMBAtoprovidemaximumdiversityineachclass.Forfurthermodules,studentswillbesentatimetableapproximatelytwoweekspriortothestartofthenextmodule.MBAstaffwillassignstudentstoasectioninanycoursewheretherearemorethantwosections.

Research AcandidatefortheMaster'sdegreebyreportmustprepareareportaspartoftheprogramandthisreportmust be approved by an Examining Board established by the Director of Graduate StudiesoftheGraduateAcademicUnit(GAU)–inthiscasetheMBADirector.TheExaminingBoardwill beconstitutedinthesamemannerastheExaminingBoardforaMastersThesis.Thereportmust conformin all respects to the regulations governing the presentation of theses and reports approvedbytheSchoolofGraduateStudies.OnememberoftheBoardmaybefromoutsidetheFaculty’sGAU. • AllcasesofacademicmisconductofanytypewillberecommendedtothePresidentforexpulsionfromtheUniversity.Ifthestudentisexpelled,apermanentnotationwillappearon thestudent'stranscriptofacademicrecord.

PlagiarismPlagiarismis themostseriousacademicoffenseandcouldresult inexpulsion.Enforcement isnotoptional.Formoreinformation,visittheGraduateStudyRegulationswebsite.Quotingverbatim,oralmostverbatim,fromasource(suchascopyrightedmaterial,notes,letters,businessentries,computermaterials,electronicmediasuchastheInternet,etc.),withoutacknowledging this to be a quotation, is plagiarism. Also, taking over someone else's line ofthought, argument, arrangement and supporting evidence (such as, for example, statistics,bibliographies, etc.), without indicating such dependence, is plagiarism. In general, submittingsomeone else's work, in whateverform (film, workbook, artwork, computermaterials, etc.)withoutacknowledgment,isplagiarism(adaptedfromGlendonCollegeCalendar,p.A37).

Incoursesincludinggroupwork,theinstructorwilldefineandwarnagainstplagiarisminworkinvolvinggroups.Unlessanactofplagiarismisclearlyidentifiedwithanindividualstudent,orstudents,apenaltymaybeimposedonallmembersofthegroup.

d. Therearetwostepstofollowfortheformalreviewprocess:i. Thepieceofworkmustbediscussedwiththeinstructorinvolvedwithintwoweeksofthe

receiptofthegradeforthesinglepieceofwork,asprovidedforin(a)above.ii. Afterthisfirststep,andifrequestedbythestudent(s)inwritingtotheChairofthe

Department,orDeanoftheFacultyifthereisnoDepartmentorChair,areviewwillbeconductedbyacommitteeconsistingof:(a)theChairofthedepartmentorDeanoftheFacultyordesignate;(b)theinstructorand(c)thestudent(s).

iii. StudentshavetherighttomeetwiththeChairorDean,ordesignate,withouttheinstructorpresentpriortothisreview.

iv. Thereviewmustbeconductedwithin7daysafterthereviewwiththeinstructorstipulatedin(i)above.

v. Thedecisionofthisreviewisfinalandthereasonsforthedecisionwillbeprovidedtothestudent(s)inwritingbytheChairorDean.

vi. Studentswhohavenotrequestedagradereviewofasinglepieceofworkthatisreviewable,orwhohaverequestedagradereviewofasinglepieceofworkandarenotsatisfiedwiththeresult,maynotaskforareviewofafinalgradeonthebasisofthatsinglepieceofwork.

ReviewofFinalCourseGrade

a) Priortorequestingaformalreviewofafinalgrade,studentswilldiscussthegradewiththeinstructor.Forateam-taughtcoursethecoordinatorofthecoursewillreplacetheroleoftheinstructor.Wherenocoursecoordinatorexists,theDeanoftheSchoolofGraduateStudieswilldesignateoneofthecourseinstructorsascoursecoordinator.

b) StudentswhoarenotsatisfiedwiththedecisionoftheinstructororcoursecoordinatorhavetherighttorequestareviewoftheofficialfinalgradereceivedinacourseontheproperformavailableintheOfficeoftheUNBRegistrar.SuchrequestsmustbereceivedbytheRegistrar,inwriting,within90daysaftertheendofthecourseorexaminationperiod,whereapplicable.Afeeof$15.00mustaccompanytherequest.Thefeewillberefundedifthegradeissubsequentlyraised.

c) Studentsshouldclearlyoutlinethegroundsfortherequesttoreviewthefinalgrade.Normallythegroundsarerestrictedtoeitheroneormoreofthegroundsbelow:

i. thefinalgradeisdemonstrablyunfair;ii. thecalculationofthefinalgradewasnotconsistentwithintheclass;iii. thefinalgradewasnotcalculatedonalltheworkcompleted;oriv. therewasamiscalculationofthefinalgrade;v. compassionate,health-relatedorextenuatingcircumstancesbeyondthecontrolofthe

studentwhichdemonstrablyhadadirectimpactonacademicperformance(Itisthestudent’sresponsibilitytoprovidedocumentationwhichdemonstratesthatsuchcircumstanceshashadadirectimpactontheacademicperformanceofthestudent).

d) TheRegistrarshallrefertherequestforformalreviewtoaCommitteeconsistingof:i. onememberselectedbythestudent;ii. onememberselectedbytheinstructorwhoisamemberoftheGAU;andiii. theChairoftheDepartmentorDeanoftheFacultyoradesignateselectedbytheChairor

Dean,providedthattheChair,DeanordesignateshallbeamemberoftheGAU.Intheeventthatthestudentorinstructorisunabletoselectamemberforthisreviewcommittee,theDeanofFacultywillselect.

e) Ifitisaclassactioninvolvingtwoormorestudentsenrolledinthe/acourse,thestudentsintheclassrequestingthereviewwillselectonememberoftheCommittee.Ifmorethanoneinstructor,theinstructorsinvolvedintheteachingofthecoursewillselectonememberoftheCommittee.Therequiredcriteriaforagradereviewforaclassactionare:

i. thegradeofallmembersintheclassrequestingthereviewmustbeatissue;ii. thegroundsforthereviewmustbethesameforallmembersintheclassrequestingthe

review;andiii. therequestedoutcomeofthereviewmustproduceaconsistentresultforallmembersin

theclassrequestingthereview.f) TheCommitteeshallinterviewtheinstructor(s)andstudent(s).Theinstructor(s)andstudent(s)

maysubmitanymaterialsrelevanttothereviewoffinalgrade.g) ThedecisionoftheCommitteewillbeforwardedtotheRegistrarwithacopytotheDeanof

GraduateStudies.Thedecisionwithreasonsmustbegiveninwritingandprovidedtothestudent(s).

FinalGradeReviewAppealsa) StudentswhoarenotsatisfiedwiththedecisionoftheCommitteereferredtoabove(Reviewof

FinalCourseGrade)havetherighttoappealtheresultsofareviewofafinalcoursegrade.Suchappealsmustbesubmittedwithin4weeksafterthedateofthedecisionoftheCommitteebynoticeinwritingtotheRegistrar.

b) Student(s)shouldclearlystatethegroundsfortheappeal.Thegroundsforappealoffinalcoursegradearelimitedto:

i. thedecisionoftheFinalGradeReviewCommitteewasmadewithoutdueregardtoproperproceduresuchthatthestudentwasmateriallydisadvantaged;and/or

ii. thedecisionoftheFinalGradeReviewCommitteewasmadeinamannerwhichwasnotfairinallofthecircumstances.

c) TheRegistrarshallrefertheappealofFrederictonCampusstudentstotheSenateStudentStandingsandPromotionsCommittee;ontheSaintJohnCampus,theappealwillbereferredtotheStudentAppealsCommittee.

d) TheRegistrarshallgivenoticetothestudentorthepersonactingonthestudent'sbehalf,ofthetimeandplaceoftheappealhearingandshallgiveaccesstothestudentsorthepersonactingonthestudents'behalftoallmaterialsrelevanttotheappeal.

e) TheRegistrarshallgivenoticetotheinstructor,ChairoftheDepartmentandDeanoftheFacultyconcernedofthetimeandplaceofthehearingandrequestanywrittenmaterialsrelevanttotheappealbefiledwiththecommitteeinamannersuchthattherightofaccessprovidedforinsubparagraph(d)shallbefacilitated.

f) TherelevantAppealsCommitteeshallhearanddeterminethematter.ThedecisionoftheCommitteeshallbefinal,shallbeprovidedtothestudent(s)inwriting,andnorightofappealexiststothesameAppealsCommitteefromthisdecisionexceptasfollows:Wherenewevidencebecomesavailabletothestudent(s)ofwhichthestudent(s)wereunawareatthetimeoftheoriginalCommitteeAppealHearing,throughnofaultofthestudent(s),andpriortoanyproceedingscommencingbeforeaSenateReviewCommittee,therelevantAppealsCommitteemay,uponwrittenrequestofthestudent(s),summarizingsuchevidence,electtoholdafurtherhearingtoconsidersuchnewevidenceand,ifdeemedappropriate,handdownafurtherorotherdecisionontheappeal.Therelevantappealcommitteeshallhavethesoleandonlydiscretiontoholdafurtherhearingpursuanttosuchwrittenrequest.

g) IftheAppealsCommitteefindsinfavouroftheappellant(s),itnormallyshallreferthereviewoffinalgradebacktotheDepartmentalorFacultyreviewcommitteeforreconsiderationwithsuchreasons,directionsandrecommendationsastheAppealsCommitteemaydetermine.IntheexceptionalcasewheretheAppealsCommitteedeterminesthatthestudent(s)wouldbedisadvantagedbyareferralbacktotheDepartmentalorFacultyreviewcommittee,theAppealsCommitteereservestherighttoalterthefinalgrade.

h) Theprocedurestobefollowedbytheappealscommitteeareasfollows:i. Student(s)musthavetheopportunitytoappear,inperson,orviaconferencecallorvideo-

conference(attherequestofthestudent(s)),topresentoraland/orwrittensubmissionsonthemattersatissueonappeal.

ii. Student(s)musthaveanopportunitytorespondtoanysubmissionsmadebyanyotherpartiesintheappealandhaveanopportunitytopresentfinalargumentandsummationattheconclusionofthehearing.

iii. Student(s)musthaveanopportunitytodirectquestionstoanyotherpartiesintheappealhearing.
