Estimates and contractsBefore signing a contract with a mover,get at least 3 written estimates from dif-ferent companies.
Once you select a mover, make sure theestimate is part of your contract. Thisway, the mover cannot charge you morethan 10% above the estimated cost unlessyou:• have agreed to a new service or a new
price
• signed a change to your contract
This is the law under Ontario’s Consumer
Protection Act (CPA). All moving contracts worth more than$50 must be in writing. Under the CPA,your contract must include:• the mover’s name, address and contact
information
• a description of the service(s) and theirprices
• the total cost that you will have to pay,additional charges that may apply andtaxes
• start and end dates for the service
• the terms of payment (For example, ifyou will pay by cash or cheque)
Your contract should also include:• the size and value of the items
• who is responsible for any damage orloss
• an estimate of the number of boxes oritems that will be moved
• who is responsible for packing
• the type of packing containers that willbe used
• the number of staff, the number ofhours and size of the vehicle(s) that willbe needed
• any licences or customs documents thatmay be needed to cross a border

Selecting a moverWhen selecting a mover, remember:
• a reputable mover will inspect youritems and furnishings to prepare an esti-mate. Don’t deal with a moving compa-ny that says they do not need to look atyour things to give you an estimate
• to ask for references and check them. ifyou work with a local company it maybe easier to check references
• to ask if the company has liabilityinsurance. Many companies have insur-ance, but their plans often do not coverthings that you have packed
• to find out who is responsible for dam-age or loss and include it in your con-tract
to visit any facility where your items maybe stored. Don’t deal with a company thatwill not show you its storage spaceif you have household insurance, check ifyou have coverage for things that areaccidentally damaged or lost during amove. You may want to contact yourinsurance company and ask about buying
extra coverage.
On your moving day, we suggest you:• move valuable items (For example,
jewelry) and personal documents your-self
• supervise the pickup and delivery ofyour items
• make a note of any missing or damageditems on your contract or inventory listbefore the movers leave
A mover cannot hold your items or fur-nishings to demand extra payment. That’san unfair practice under the ConsumerProtection Act and it is an offence to doso.
if you pay the extra fee because you feelyou have no choice, write on the invoicethat you “paid under protest.” Keep acopy of the invoice and follow up withthe company, call the police or contact theConsumer Protection Ontario.
Complaining about a moverif you have a dispute with a moving com-pany, make sure to keep copies of all thedocuments that support your complaint.
Write the company a complaint letterexplaining the issue. if you cannotresolve the issue with the company, file acomplaint with Consumer ProtectionOntario.

When is a builder’spromise binding?You rely on a builder's marketing material and a new condo because ofan advertised feature. What happens if it’s not there?

Condominium buyers have launched a class-action lawsuit againstEmerald City Developments for a building at 70 Forest Manor Drivein north Toronto because the building does not having direct access to
the Sheppard/Don Mills subway station.Some buyers bought a unit based on the belief that it would it will be up
to the courts to decide whether this was an actual promise and if so, whetherbuyers are entitled to a reduced price for their units.

One of the items in the 2008 purchase and sale agreement says that thebuilding’s features include a “Lower lobby with direct access to the subwaystation.” This was also apparently promoted in marketing materials at thetime.
When owners started moving into their units this January, the building didnot have direct access to the subway from the lower lobby. Owners mustleave the building to get to the subway which is nearby. One buyer said thathaving direct access was important to him for safety reasons for his daughterto travel to the University of Toronto.
The original contract also contained the usual developer’s clause that saysthe builder can change plans and specifications of the building at its sole dis-cretion, or as required by any government. This is as long as it is not a mate-rial change, including any changes advertised in any sales brochure.
Related:Why a condo’s status certificate is importantin law, a material change is one that would cause someone to change their
mind and not buy a property. if the developer makes a material change, theyare obligated to give buyers 10 days to cancel the contract, even if the changeoccurs years after the original contract was signed. This was one of the argu-ments made by buyers suing the Trump condominium in downtown Toronto.They did not want to close, complaining that the financial promises made atthe time they signed their contracts were not true at closing.
The builder appears to be taking the position that since it will be relative-ly few steps from the building to access the subway, this was not a materialchange and does not merit any reduction in the price paid.
When you buy a pre-construction condominium, you have 10 days tochange your mind. Use the time to go to a lawyer to review your agreementso you understand what all the clauses really mean. You must also be awarethat you may not receive exactly what was promised, as the builder can stillmake changes to your square footage, the layout of your unit and the finish-ings, as long as these are not material, and you cannot complain. This is whyit is important to check the reputation of the builder. Go to other buildingsthey have completed and ask the owners the following questions:• Did they build what was promised?
• Did they finish on time?
• Did they correct any deficiencies in a timely manner?
• Do proper research before you buy, and you should not be disappointedlater.

(May 6, 2014 – Hamilton, Ontario)The REALTORS ® Association ofHamilton-Burlington (RAHB) reported1474 property sales were processedthrough the RAHB Multiple ListingService ® (MLS ® ) system in April.This represents a 2.7 per cent decreasein sales compared to April of last year.
There were 2252 properties listed inApril, an increase of 1.6 per cent over thesame month last year. End-of-month list-ing inventory was 9.3 per cent lower thanlast year at the same time.
“Listing activity picked up through themonth of April,” said RAHB CEO RossGodsoe, “and was actually a little aboveaverage for the month of April for the last
ten years. Sales were about five per centabove the 10-year average, even thoughthey are lower than April a year ago.”
Seasonally adjusted* sales of residen-tial properties were 2.6 per cent higherthan the same month last year, with theaverage sale price up 7.3 per cent for themonth. Seasonally adjusted numbers ofnew listings were 5.7 per cent higher thanthe same month last year.
Actual overall residential sales were1.6 per cent lower than the previous yearat the same time. Residential freeholdsales were 1.8 per cent lower than lastyear while the condominium market sawa decrease of less than one per cent insales. The average price of freehold
properties showed an increase of 9.3 percent over the same month last year; theaverage sale price in the condominiummarket increased 9.5 per cent when com-pared to the same period last year.
The average sale price is based on thetotal dollar volume of all properties soldin the RAHB market area. Average saleprice information can be useful in estab-lishing long term trends, but should notbe used as an indicator that specific prop-erties have increased or decreased invalue.
The average days on market decreasedfrom 40 to 34 days in the freehold marketand from 42 to 35 days in the condomini-um market.
“Properties continue to move well and
aren’t spending as much time on the mar-
ket as last year, or even last month,”
added Godsoe. “We were commenting
on the low inventory last year at the same
time, and this year the listing inventory is
even lower. Buyers will need to take that
into consideration as they look for a home
this spring.”
Year to date, listings are 2.7 per cent
lower than the same January-to-April
period a year ago. Sales are 2.5 per cent
higher and the average sale price is 7.9
per cent higher for the period.

5 Things to Know When Selling a Home by Yourself
Whenever i write about why youshould use a real estate agent tosell your home, the mail pours
in. i’m sure it will this week, too.i am a real estate lawyer and write
courses and teach industry players how todo their jobs more professionally and eth-ically. i also believe that in many casesyou will be better protected and makemore money selling your house if you usean agent. Not always, but in many cases.
Here’s why I think that:You don’t have to pay upfront: Do-
it-Yourself marketing companies are notreal estate agents. You usually pay$1,000-to- $2,000 up front, for pictures,videos and to have your home listed onthe MLS system. However, you get nomoney back if your home doesn’t sell.With a real estate agent, if your homedoesn’t sell, you pay nothing, even thoughthe agent may have spent a lot of timemarketing and using all of their own andtheir company contacts to sell your home.
Abidding war is unlikely: Bidding
wars are the norm in the GTA and otherparts of Ontario. in virtually all cases,the home is sold by a real estate agent.The reason is that it takes experience toprice the home properly. Second, theprocess is fair because no one knowswhat anyone else is bidding. With a pri-vate seller, there is no duty of confiden-tiality, so the seller can tell one buyerwhat another buyer is bidding. Buyersdo not trust the process so there is nobidding war.
You negotiate on your own: Whenyou do it yourself, it is difficult to knowwhat a fair price is for your home. Youmight have to pay an appraiser to findout. When a buyer hears that you aresaving commission, they will want tosplit the savings. So you don’t get all thecommission savings and you also haveto negotiate with a buyer who is likelyrepresented by a real estate agent. Thisagent will use all their experience to fig-ure out how low you will go, while giv-ing nothing away about their own buyer.

Not knowing your obligations:Sellers cannot rely on the term “BuyerBeware.” You have to disclose problemswith your home and you cannot hide orcover up anything. Otherwise, you canstill be sued after closing. Who wants acourt fight long after you move?
Lenders are more cautious whenthey see a private deal: i have seen dealscollapse this way. in one case, the lendersent their own appraiser because theywere concerned the buyer paid too muchmoney. The appraiser agreed and thebuyer’s loan commitment was cancelled.The deal died.
in another case, the seller was worriedthe buyers did not have proper financing.They wanted more proof about thebuyer’s financial situation than the buyerwas willing to give. Lawyers becameinvolved when things could not beworked out amicably. When buyers arerepresented by agents, they are usuallypre-qualified in advance so the seller canhave comfort that they will have themoney available to close the deal on time.
When you’re out for a walk this week-end have a look at the For Sale signs andsee how many are represented by realtors.There’s a reason for that.
By all means, try and sell your houseon your own, just beware that it’s not aseasy as it looks.
